Below I will try to summarize the concept we have been discussing so that we can hopefully take the next steps. BACKGROUND Cape Hotel Group, LLC (dba Springhill Suites) will be purchasing the land on the north side of the Radisson from Robert A Baugher. The site is being planned for two hotels. The Springhill is the first phase of this development. As you know, we have submitted the overall site plan and are seeking approval to move forward with (1) the development of the entire site for site planning purposes and (2) construction of the first hotel: the Springhill. The current Transportation Impact fee charged by Brevard County is just under $2,800 per hotel room. The Springhill is proposed at 151 keys which will incur a transportation impact fee of $422,800+/-. If / when the second hotel is constructed it will also generate the same amount assuming another 151 keys. Furthermore, LBA Properties is proposing to construct 224 keys which will generate another $627,000 +/- in impact fees upon completion. So in this very defined area new projects will generate between $1.05 million and $1.45 million in impact fees over the next several years. PROPOSAL For the sake of this discussion, I am going to assume that the proposed projects will not trigger any requirements to increase transportation capacity based on Concurrency reviews based on proposed increase in trips generated from these new developments, but that remains to be seen. That said, it is our understanding based on discussions with former county staff and an independent consultant, that a city, in agreement with a developer, can make application to the County to “pipeline” the use of Impact Fees paid to specific projects in the area in which the Impact Fees are being generated. The rationale here is that (1) the impact fees should benefit the area impacted and (2) if such application is not made, the County via it’s Impact Fee board can uses such funds anywhere in the District (ours runs from Pineda to Cape Canaveral and encompasses some of Merritt Island - I believe). As we are paying the Impact Fees, we feel that our interests are aligned with the City of Cape Canaveral in that such application should be made to try to utilize as much of these funds to benefit Transportation infrastructure in the City and preferably near these projects. Proposed projects might include: - Improvements to Central Blvd - A traffic light at Thurm Blvd (as we have discussed separately) - Pedestrian improvements along A1A - Specific Improvements to A1A that the DOT does not have in its plan but that the City desires. We are told that making application to designate Impact Fee funds in this manner is not uncommon and is best handled by a Transportation Impact Fee Development Agreement that would be executed between the developer, the City and the County.
