Hi Laila. Yes, all is well in Cape Canaveral.
As we have discussed for months, in order for the proposed hotel
project to move forward with less than the required 150 rooms, the
property must be rezoned to PD (See Sec. 110-627 c. of the City Code).
Sec. 110-741 of the Code spells out the Concept Plan process, which is
the first step in getting a PD approved. See paragraph (b)(13) under
this section which requires that the proposed method of providing sewer
service be indicated.
Once the Concept Plan is approved, the next step is to submit a PD Land
Use Plan (see Sec. 110-741 of the City Code) for review and approval.
Sec. 110-472 (e) details the criteria that the City’s review of the
application shall be based. See paragraph (4) of said section that
states that the provision of water and sewer must be documented.
Until there is an executed Agreement with the Port that provides for
sewer service, the application is not complete, does not meet minimum
Code requirements and cannot move forward.
It is unfortunate that you feel that I am being resistant to the
proposed hotel. That is not the case. I am taking action to ensure that
your submittal complies with City Code requirements and cannot be
challenged from a procedural standpoint.

Hello David,
Hope this finds you well!
I’m writing in reference to the request I made to be placed on the
zoning agenda.
As you know there’s a small strip on the Cayer property, that needs to
be zoned commercial to conform with the rest of the parcel.
This does not have anything to do with our port agreements. In fact,
it’s not unusual to change the zoning of a parcel with no plans to build
on it.
Certainly, this request would have no effect as to whether our port
agreements materialize or don’t this is an independent matter.
As the rest of the property is in fact zoned for commercial use.
The entire parcel is 2.5 acres the subject piece we’re looking to zone
is approximately ½ acre.
I fail to understand as to why you feel the port agreement and the
zoning of this piece have anything to do with one another.
I’m merely trying to save some time, given that we have spent 18 months
thus far. I’m truly disappointed.
I was expecting some cooperation with your department, rather than a
resistance.
Again, I’m only trying to save some time.
Nevertheless I would appreciate it if you would be so kind to provide
me with the reason you feel the port agreement,
and the zoning of this approximately ½ acre are connected.
