HomeMy WebLinkAboutRE Easement (4) Laila, I understand your concerns, however, I am not aware of any agreement to grant an easement across the Port property. My understanding is that it was determined that the Port was not in a position to give up any of its utility capacity and if the Developer could work with the City to gain access to their system, the Port might look at an easement access across some portion a Port owned parcel that is located along the exit ramp from AIA. It is also my understanding that any easement will be a part of other approvals that would need to be addressed that do impact the Port. Once Staff has review and agreed, Staff would then present to the Commission for review and approval or denial. Subject: RE: Easement Scott, While I understand your internal study’s in process, our easement request does not have an impact on the Ports capacity not now, and not in the future. As I said in our prior conversation, we will be bringing in our own sewer line. There is ample capacity according to the servicing authority’s. The area we are proposing to bring the line through, is a small parcel of land which is basically on the perimeter, and has no effect on any of your future or current use of this strip. I don’t understand where the problem lies? This project has been held up and now that a solution has been identified, the resistance continues, contrary to the discussions with yourself, Port officials and City of Cape Canaveral officials several months ago, at which time there was a consensus to provide Daniel Corporation an easement. In order that the required utilities be brought to the subject property, it’s based on that meeting that we found a solution for the sewer line. Since you were not allowing us to tap into Port connection which is very much near the subject property. This matter has costed us a great deal of money, not to mention a tremendous amount of time and hardship for my company. This matter needs immediate attention and a quick resolution.
