So, is it accurate to say that the site, as designed, is the only way
that it can work?
In other words, are there any other options that could satisfy both
FDOT and CF?
The reason I ask is because, if there are not, it must be rationally
articulated/argued that the FDOT design standards must be mitigated by
technical variance to offset the economic development harm they would be
causing.

My understanding is that Cumberland wants to reduce the current access
on A1A from the existing two 60' full access points down to 1 full
access of 36' on the north and one 18' (I think) right turn only on the
south.
FDOT wants them to completely abandon the south access, leaving
Cumberland with only the north access. Unfortunately, this access would
not allow for fueling trucks to enter the site, and thus no convenience
store with gas.

all if DOT doesn't come along. Which would mean no new development on

Todd,
Good to speak with you this morning. Sorry to
seem pushy, but I am trying to tie up loose ends on this project and the
easement remains as one of the last remaining items on my list. If it
is possible, please have the City's attorney call me directly regarding
the easement language as soon as possible if there are any concerns so
that we may iron out any issues expeditiously. If there are no concerns
with the language as proposed in our revision, I will have the owner's
execute immediately and return to the City for execution and recording.
Both myself and Cumberland are looking forward to proceeding with the
construction of the new facility, and we just need to finalize this
issue ASAP.

Todd,
Has legal finalized the easement? CF received
minimal comments on the building permit, we are rapidly concluding the
demolition and tank removal, and the language and recording of the
easement is looming as the only issue remaining with the site. Anything
that you could do to speed up legal would be helpful.
