I see you included in there a utility easement, and to my knowledge
that was not discussed. I was under the impression that it was simply a
landscaping and entranceway feature.
Further, Cumberland Farms is a sub-tenant. We are leasing the property
from the Crowder Trust and subleasing it to Cumberland Farms.

Please find attached a Staff Recommendation to the P&Z Board
that they place two conditions on the SE approval regarding the
temporary easement. This will be presented by Dave Dickey to the Board
tonight. The conditions allow the project to move forward without delay
as we work out the details along the way.
I think you will find this is consistent with all we’ve
discussed since the beginning.
We truly appreciate and thank you, your partners, the Trust and
Cumberland Farms for engaging with the City toward redeveloping this
site and the opportunity to create a culturally-enriching community
focal point.
