This is truly disappointing in that the opener has not been changed or
altered since mounting and was CO'd with the building in 2007. We will
do what we can.

In regards to the garage door opener at 8934 (south garage), if
it cannot be raised to the proper height, the garage door opener needs
to be replaced in accordance with the Florida Building Code.
If this cannot be accomplished in a timely manner then I will
send a Notice of Violation to the association.

Hello Mike and Brian,
I hope all is well with you both. It seems we have a saga that
won't end. Mr. Bobinski is sending emails to residents and mentioning
you both. I thought I would send you the email in which he mentions you
so that you are aware. The "killer garage door openers" to which he
refers are accentuated by his video of the door coming down on the
level. You have that video, so I did not attach it. The thing he
conveniently doesn't mention is that
the level is below the sensor that prevents the door from coming
down.

Dear Condominium Owner,
Did you know we have Killer Garage Door Operators in our
buildings?
Have a look at the video attached and you will see what
I mean. That thick plastic level on the floor was crushed
by the heavy overhead garage door without mercy.
Now imagine a little girl on a tricycle falling down or
one of our pets being caught under that door. Those overhead
doors are on a timer and they don't reverse, as you can
see.
I supplied this and more information to the Board months
ago, but no action was taken.
There is a better automatic operator than what we have,
from the same company, together with the remote controls for less money
and it complies with the Building Code and it reverses
automatically.
Actually, most of the automatic operators in our
buildings are the commercial type and are not to be used in a
residential
building because of the danger.
The manufacturer warns against that in the installation
instructions. The manufacturer also warns against installing the
present operators below 8 feet above the floor. Such an
installation and the use of these operators is in violation of the
Florida Building Code.
Did you know that all our operators are installed below
the 8 foot level?
When the operator was replaced in building 8, I
contacted the City of Cape Canaveral Code Enforcement :

And they made the Association get a permit, remove the
Killer Operator and replace it with the safe kind.
When I asked the Chief about the other Killer Operators
he told me that I was the only person who complained.
The Chief wants other owners in other buildings to put
in complaints to show that they too are concerned about
those Killer Operators, then he will have the
Association replace them.
I will send separately the Photos of the Killer
Operators so that you can identify if you have the Killer type
in your garage.
Actually, the Association Board Members have refused to
let me check out any of the automatic openers in the
other buildings. The Board has refused through their
expensive attorneys to let me enter any of the other buildings
even though the Declaration of Condominium ( similar to
the Constitution of the US as a basic law) specifically
includes such access for all owners.
Oh, did you know that the Board is now employing 3
attorneys on their behalf! Anyone who needs 3 attorneys at the
same time must be pretty worried.
How come the owners have to pay for all these attorney
fees and have their assessments raised just to protect the Board
members?
