not allowed too, please contact the Sherriff’s department they are code
enforcement when we are not here. If they witness the violation they can
report it to us and we can act on it.

Gentlemen,
As you can see, we have a resident here who not only ignores our rules
during the refurbishment of his condominium unit, but flaunts the
ordinances of the city. He has been working Sundays (yesterday),
holidays, and later than 7 PM. What recourse is there?

Sandie--We second everything Carol has said; we don't get the
brunt of the noise that Carol does, being right below 402--although we
do hear it.
We seem to have lost control of this effort, which has been
going on since November. THIS IS NOT A CONSTRUCTION ZONE, but you would
never know it.
Sunday work, and work late at night has become the norm. We
even had to try to shut him down on Christmas, which also happened to be
a Sunday.
We heartily agree that the blue pads being up perpetually is an
eyesore and totally against the spirit and purpose of putting them up in
the first place. We got back yesterday after a week-long cruise, and
the pads were still there from before our departure. Unacceptable.
His sign in the elevators indicating he might make noise from
December (actually November) to March is INSULTING. It insults you the
board and it insults us as residents. We are not stupid. He is taking
advantage of the situation, and all at the expense of the residents. If
he has to make noise, then fine. We accept that. What we don't need to
accept is arbitrary noise at his discretion at any hour of the day or
night, weekday or weeknight. He claims his people have to work late at
night because they don't get up until late. Why does that have to be
our problem????????
I have become tired of telling his crew not to prop the garage
door open. I get a flurry of excuses, which I have become rude about
and shut them off. Mr. Bobinski, when approached about this subject,
told me that the condo rules prohibited him giving his staff a
key--probably a good thing, but it seems it should be his responsibility
for their entry and exit to and from the building.
The construction dirt in the building, described by Carol, is
accurate. Particularly in the elevators and on the carpets outside the
elevators and in the lobby. He has brought construction materials in
through the garage and left a mess.
We would simply like to see some demonstrative action. We
accept that some noise will occur. But arbitrariness of his noise is
unacceptable and should instigate board intervention. The Sunday work
needs to cease. Work after 5 PM needs to cease (his workers are
frequently there overnight). The blue pads need to come down. There
needs to be some target toward closure of his project. What more can we
do????????

Good morning Sandie,
FYI...I got so fed up with the banging around 8 last nite that I
rang the doorbell 5 times with no response. Both he and workers were
inside the unit - the noise stopped when they heard the doorbell.
(Noise began at 10 am Sunday but he didn't arrive till later in the day)
Since I couldn't speak face-to-face with him, I posted a note of my
displeasure on his car window regarding daily work hours, no working on
Sundays, his lack of courtesy and consideration for me and others in
this building! Surely it will be ignored! No one has ever received an
apology from the owner - just a note in the elevator...."sorry for the
inconvenience"!
Not only is the noise a nuisance, but the elevator, hallways,
garage and parking area outside the garage is deplorable (residents have
had to clean the elevators, sweep/vacuum the carpeting, etc.) In
addition, the blue pads are not only an eyesore, they prevent any
posting of information from the Board.
I respectfully request that the Board hold a meeting with the
owner and affected residents of this building to discuss these issues
and to ascertain just how much longer we will have to put up with this
behavior (beginning or end of March or longer). If he ever wants to
become a friendly neighbor in this building, he'll have to change his
ways or be ignored.
