HomeMy WebLinkAboutRE RE Puerto Del Rio Density ConfusionHi Danny. At this point, Anthony (City Attorney) will need to be
involved in the discussion as he has been working with the HOA counsel
on this matter. I will inquire with Anthony if he is planning on being
in Cape Canaveral anytime soon. If not, we may have to set-up a
conference call.
Anthony – going to be around in the near future? If not, what is your
availability for a brief conference call?

David,
Yes, we are aware that the Association is working with Laura from Dean
Mead. However Laura is not
understanding the unit count either. If I can meet with you for 15
minutes, I can
clear up the density confusion as this has been going back and forth
for several months, that is why
the Association President asked for my help.
Please let me know if it would be possible to meet.
Thank you ,
Danny

Hi Danny. We would be happy to meet with you to discuss this item.
We are working with an attorney representing the PDR homeowners group
to gather additional information related to the project and the City’s
efforts to issue vested rights certificates to eligible properties. My
suggestion is that once we have this information, we then meet with you.
I will let you know once we have heard from their attorney. Thanks. Dave

Subject: Puerto Del Rio Density Confusion
Hello David,
I would like to request a time to meet with you and Mr. Garganese to
straighten out the density confusion
at Puerto Del Rio so the certificate issue can be clarified. I have
attached a communication that was sent to
me from the Association President at PDR. With all due respect to the
Association , they do not always understand
how they work with a total number of units that have been recorded into
the Association and what is on the
approved Developer's site plan. This is where the number of units is
getting confused. I would like to come over to your
office at a time that is convenient to you to discuss this discrepancy
and help Mr. Gargannese and the Association get
to a correct number of units that would put the confusion to rest.
Thank you ,
Danny Ringdahl

Hi Brian, thank you for the email. Is the 7' a requirement for
code? I was unaware, but appreciate your help.

Jay,
Could you please check the garage door opener in the
south garage of 8934. Make sure it is installed above 7’ and if it is
under 8’ then the gears need to be covered. If you are changing them out
please look into changing this one sooner than later.
YӞѮC㾘ഠリഢJay,
Have you had an opportunity to measure the garage door opener?
If not and you need my assistance please let me know.
Thanks,
Brian

Jay,
Good morning, is the bottom of the garage door opener at or above 7’?
7’ was a requirement in the FLBC 2004.
Thanks,
Brian

Subject: Re: RE: 8934 Puerto Del Rio
Hi Brian, I apologize for the time to reply to you. The buildings,
including 8934 Puerto Del Rio Dr. were constructed and received CO
before anyone took residence. The buildings were "to code" at the time,
and there has been no change in the south garage of this building. When
was the new code instituted that requires the 7' ?
Nothing changed regarding the garage door openers until Mr. Bobinski
severely damaged the door on the north side of 8934 Puerto Del Rio Dr..
You are familiar with the activity in that regard. In fact, as any
garage door opener in any building of Puerto Del Rio Condominium
Association, Inc. is in need of replacement, we have an opener
identified which meets requirements to use as replacement.
We were told that the garage entry was vehicle entry, not pedestrian,
and as constructed was satisfactory. There is a "people door" for
pedestrian entrance. Since we have a plan to install newly identified
openers when replacement is necessary, we understood that we were in
compliance and that we could follow our plan as described. I did not
realize anything had changed. Please advise.
Respectfully,
Jay Petty
