HomeMy WebLinkAboutRe Public Garages (11)Dear Mr. German, Last week I left some messages on your phone answering machine but I have not heard back from you. I was looking for an update on the overhead garage door and the automatic garage door opener at the North garage at 8934 Puerto Del Rio Drive and the associated Building Code issues. I also wanted to let you know that the South garage overhead door at 8934 Puerto Del Rio has similar violations as the North door, that is missing metal straps and re-enforcing brackets at the hurricane struts. The automatic operator which acts as the brain and contains the power for the chains and lifting of the door also is installed below the 8 foot level in violation of the manufacturer's warning labels, just like the other one. As you can see, this parking space and others nearby, are impacted by the limited ceiling height when trying to enter or exit the space. This would be part of the Egress and Handicap requirements of the code. Hopefully you can convince the Association to comply. As discussed, a change-out of the Clopay struts would at least make the spaces handicap accessible at 80" ceiling height which is the same as a minimum door opening height. Please find attached copies from the 2014 Building Code with the text highlighted in yellow. Section 406 of the Code addresses garages and 406.3 delineates Private Garages. You can see that Private Garages are limited to 1,000 square feet, and with exceptions can be increased to a maximum of 3,000 square feet. Private Garages are classified as Group U occupancy, copy attached at the end. Both garages at 8934 Puerto Del Rio Drive are each above the 3,000 square foot maximum for Private Garages. Section 406.4 addresses Public Garages and shows that anything other than a up to 3,000 square foot garage, is a Public Garage. The garages at 8934 Puerto Del Rio Drive are therefore Public Garages and all the rules associated with that designation apply. The fact that these garages are associated with a residential condominium does not matter, just like the pools at the condominium are subject to the rules of Public Pools because it is a requirement imposed by law. These garages would be treated like the Port Canaveral or Orlando Airport or Mall parking garages. That is, Egress requirements, Accessibility and Americans with Disability rules apply as well. Section 406.4.1 requires a clear height of 84" including pedestrian traffic at Public Garages, the same applies to Private Garages as well. Please let me know if you need any additional information.
