HI Nancy- I apologize for the delay in getting back to you.
PDR’s surveyor did review the updated survey and has approved it. He
did bring up one issue though that we need to think through and have the
City confirm for us.
This Right of Way/Road Parcel is approximately 1.35 acres and
changes the permitted and allowable project density of the Puerto Del
Rio project. We need written/recorded confirmation (from the City) that
the permitted and allowable density remains and is not affected or
reduced by the reduction in property ownership.
Anthony- PDR will have an easement over this area for its
landscaping and other improvements. Assuming the City is able to
approve/confirm that the current density will remain preserved after the
transfer of the land, what is the best way to document the preservation
of density? We could provide for it in the Resolution that is approved
by the City on April 18th approving the transfer and easement to PDR?
We’ll have a draft of the proposed easement out to you for
review ASAP this week.
