The complainant stated they were working and making noise after 9pm. I would like to remind you of the City Ordinance regarding construction noise. Sec. 34-154. - Construction noise. (a) The construction, erection, including excavation, demolition, alteration or repair of any building shall be permitted only between the hours of 7:00 a.m. and 7:00 p.m. Monday through Saturday. These activities shall be prohibited at all other times and also during all hours on New Year's Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas, except during urgent necessity in the interest of public health and safety, and then only with a permit from the building official, which permit may be granted for a period not to exceed three days or less while the emergency continues and which permit may be renewed for periods of three days or less while the emergency continues. If the building official shall determine that the public health and safety will not be impaired by the erection, demolition, alteration or repair of any building or the excavation of streets and highways between the hours of 7:00 p.m. and 7:00 a.m. and during all hours of the holidays listed in this subsection and if he further determines that loss or inconvenience would result to any party in interest, he may grant permission for such work to be done between the hours of 7:00 p.m. and 7:00 a.m. and during all hours of the holidays listed in this subsection, upon application made at the time the permit for the work is awarded or during the progress of the work. As discussed, there is a clear and present danger to the public, not only from the installation without permit or inspection, but also from the low clearance of the doors of only 75 inches above the floor. The Florida Building Code does now and has required in the past since before the construction of the building, a minimum clearance of 80 inches. This is a minimum requirement for Egress as well as Accessibility and also under the Americans with Disabilities Act, among others. During January and February of 2017 alone, there have been 3 accidents caused by the the low overhead clearance at this location resulting in thousands of dollars of damages. There have also been many other accidents in the past. It is easily foreseeable that some of the damaged and hanging garage door sections will seriously injure, or worse, owners, guests, visitors or City of Cape Canaveral emergency personnel in the future.
