HomeMy WebLinkAboutRE Puerto Del Rio Cape Canaveral Closing (24)Hi Bill- the City’s surveyor has determined that the description we have includes the lift station and other improvements that are not supposed to go the City. Apparently the start point of our legal may be about 25 feet off of where the road is actually on the ground. We won’t know for sure until we have a copy of the City’s survey, but once we get it, we’ll have the surveyor who prepared the original legal review and comment on it. We just need to make sure the legal accurately described the area of the road that is supposed to be conveyed to the City. I am acknowledging the request to sign an extension to the Agreement's closing date to on or before December 31, 2016. I have been in touch with the Developer, Danny Ringdahl, and advised him of the delay. Please contact him directly by phone or email with what we need in order to clear up any questions on the legal description or survey in conjunction to a 25' utility easement. He will contact whomever you need in order to resolve this confusion. The original surveyor is in business and will confirm with the City or City's surveyor as well. You herby have my authorization to send a written extension to me for signature if necessary. You also have my authorization to send any and all documents or requests to resolve this issue to the Developer. He has agreed to be of assistance to you on any requests you might need. Last question, if Kim Koop is okay with all of this would you be able to set up a closing date this week on or before Firiday, 12/9/16? As I said before I will be leaving on the 12th and would very much like to be present. Yes I will check in with her on a date for this week. What needs to be approved at the Board Meeting are the Resolutions set forth in the Certificate attached as the first attachment. The Resolutions need to be actually read aloud at the meeting and adopted by the Board (hopefully unanimously). That will authorize the President or the VP to sign all of the closing documents. The closing documents are still subject to change based on Kim’s review. The do not need to be approved at the meeting, just the Resolutions. Let me know if you have any questions.
