Hello Everyone,
I just talked to Will Hurley who is one of our maintenance personnel.
He is quite familiar with the property infrastructure because he oversaw
construction of the condos for Danny Ringdahl. Will is having copies
made of the final plans, which include the underground irrigation system
and all other infrastructure around the road. I will be delivering two
copies to the city (Anthony) on Monday. Will, approved by Sandie -
President, said that the condo association will maintain the underground
irrigation system, the landscape planter, and the two fiberglass street
lights, so we should do what’s necessary to legally obligate the
association to do so, e.g., easements, title language, etc. Will also
said that anytime anyone with the city needs information about the
infrastructure surrounding the road to not hesitate to call or email

Danny & Will,
We are dealing with a number of issues as we attempt to convey the road
to the city. I don’t believe that any are insurmountable but we need
your help on one particular issue, the condo’s irrigation system. See
the email below from Anthony (city official) regarding underground
system. As I recall, Will said that the final condo drawings that you
have include the irrigation system that runs along the road ROW. Can
you provide the city with those drawings so that the system can be
incorporated into the road survey, the latest one attached? We will
want to obtain an easement for the system since it will be the condo’s
responsibility to maintain it.
Please see the other issues that have been raised by Morgan &
Associates (Chris & Andy’s last email below) and by city officials’
email below. If you can weigh in on them it would be very helpful
because I’m out of my element on all this. In addition to the
irrigation system, the issues include:
1. “encroachments in the ROW area (landscape planter and two
fiberglass street lights)”
2. “in the future, if the Condo association requires a survey,
the original survey would need to be updated (new legal description,
etc.). Many lot splits require the lot and the remainder to be surveyed
to confirm that no gaps/overlaps are created.”
3. “This Right of Way/Road Parcel is approximately 1.3 acres and
changes the permitted and allowable project density. I haven’t seen the
agreement but you will want to confirm that the permitted and allowable
density does not get affected or reduced by the reduction in property
ownership.”

We sent this email to the City’s surveyor to review and comment.
On another note, I tried to contact you this afternoon regarding
another survey issue.
There are several encroachments in the ROW area (landscape
planter and two fiberglass street lights). I’ve been informed that
these are condo amenities. If the condo wants to maintain them, we will
need to address them and may need to include an easement reservation in
the deed or ROW Agreement. Further, the Parks and Recreation Director
seems to think that the Condo has an underground irrigation system
within portions of the ROW. Does your client know whether that is
true? If so, a similar easement or ROW Agreement may be needed to
address the irrigation system.
Please advise.
We may need another closing extension.

Morgan & Associates Surveyor, Chris Bowers, P.S.M., and I have
reviewed the survey and offer the following comments:
- The legal description does not match the sketch
exactly. On the sketch, the 50’ parcel/right of way width at Central
Boulevard is not perpendicular/right angle (check bearing).
- It seems more appropriate for a conveyance of right
of way to provide a complete metes and bounds legal description and
sketch to match. Please note that in the future, if the Condo
association requires a survey, the original survey would need to be
updated (new legal description, etc.). Many lot splits require the lot
and the remainder to be surveyed to confirm that no gaps/overlaps are
created.
- Provide closure information on the Right of Way/Road
Parcel.
- For clarity, please label the east line of the
Angel’s Isle Subdivision (and west line of the east 3,323.00 ft. of
Section 15) as called out in the Legal Description.
- This Right of Way/Road Parcel is approximately 1.3
acres and changes the permitted and allowable project density. I haven’t
seen the agreement but you will want to confirm that the permitted and
allowable density does not get affected or reduced by the reduction in
property ownership.
