This residential and business friendly atmosphere is a liveable, attractive, safe, inclusive and sustainable coastal community that embraces the seaside and riverside as the main amenities, and supports local culture, commerce and education. We envision: A1A as a “complete street” with a native-landscaped and tree-lined median with traffic calming elements and dark-sky street lighting. “Complete street” amenities include bicycle facilities, covered transit stops, and safe pedestrian crossings that invite pedestrians and bicyclists to access the beach, river, local neighborhoods and adjacent communities. Our improved “complete streets” will allow us to travel calmly to intimate waterfront destinations and a walk- able uptown core. Multi-use paths lined with shade trees should be wide enough for bikes and pedestrians and lighted so anyone can walk or bicycle safely anywhere in town, day or night. We envision: Welcoming community entrance features that create a sense of arrival and unique community identity. The “uptown” and other areas will contain an architecturally rich and unique mix of uses, with wide tree shaded sidewalks and umbrella covered café tables at restaurants and bistros where friends gather, interact, and enjoy drinks and dinner. We envision: A community that; removes or transforms blighted and unfinished buildings into attractive structures, offers city-wide green spaces, provides a pet-friendly park with ample shade, and actively recruits and supports businesses that enhance economic viability and serve our residents and visitors. We envision: Open shorelines and rivers accessible to the public including amenities that take advantage of the water, such as limited and quaint water-view establishments and intimate public gathering and entertainment places that may include pavilions, gazebos, or a performance stage. Administrative Services Update for Week Ending February 24, 2017 The City Manager’s Office is responsible for the day to day administration of all City departments in accordance with City Council’s established policies/direction, local ordinances, resolutions and State/Federal laws/rules and regulations. Telephone conferences, meetings with citizens, documents prepared/reviewed/approved and meetings/conferences held are numerous and may not be included in the Weekly Updates. Highlights: Met with Department Directors regarding various projects/issues/initiatives. Met with Strategic Planning Consultant/Department Directors, collectively, to discuss the strategic planning process and Staff’s role in conducting a second SWOT analysis. Met with Mayor Hoog regarding 02-21-17 City Council Agenda Items/various City initiatives. Attended City Council Regular Meeting. Facilitated Team Staff Meeting. Met with Strategic Planning Consultant and Finance Director regarding the City’s updated Purchasing Policy. EA assisted CCO/Department Directors in preparation/completion of City Council 2-21- 17 Agenda Items. EA attended Team Staff Meeting. EA updated Action Tracking EA provided counter coverage in CCO, as needed. EA provided assistance to City Council Members and select Department Directors. City Clerk’s Office Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public/Staff and provided assistance to City Council. Highlights: Records Management – 279 pages of documents scanned; processed large portions of the electronic records database (Laserfiche) with Optical Character Recognition (OCR) for searching and archiving purposes; met with Public Works Services records coordinator to discuss retention/disposition of duplicate records; continued preparing records for disposition/destruction. Public Records – continued preparing response to/fulfillment of four information/public records requests regarding Oak Lane received 01-28-17, 01-30-17 and 02-06-17. Council Meetings – finalized/distributed Agenda/Packet for and attended 02-21-17 Regular Meeting; continued preparing for 03-21-17 Regular Meeting. Proclamations – prepared, processed and distributed Proclamations declaring support for the Merritt Island National Wildlife Refuge Community Conservation and Education Center and March 2017 as Irish-American Heritage Month and Problem Gambling Awareness Month (attached). Mayor’s Fitness Challenge – assisted Community Engagement and Culture & Leisure Services with distribution of event T-shirts. Relay for Life of Central Brevard – will take place from 4pm, April 22nd to 6am, April 23rd at Cocoa Village Riverfront Park, 430 Delannoy Avenue, Cocoa. Discussed commemorative Apollo 1 Anniversary USPS postmark program (attached) with Postmaster of Cape Canaveral. Attended Brevard County City Clerk’s Association (BCCCA) Meeting in Indialantic; the City of Cape Canaveral’s Business Tax Official, Ginger Wright, was the guest speaker to discuss training/certification, implementation/enforcement of business tax receipts and Florida SB 330, which would heavily restrict the amount a municipality can charge for business tax receipts; other discussion included Florida HB 17, which would eliminate county and local municipal government Home Rule power/authority to regulate businesses and professions within their jurisdictions; West Melbourne City Clerk Sue Frank was elected BCCCA President and Cape Canaveral City Clerk Mia Goforth was elected BCCCA Treasurer. Attended Staff meeting. Met with City Manager and select Department Directors regarding various items/issues. Financial Services Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the Public. Attended Strategic Planning Meeting with Consultant/City Manager/Department Directors. Attended Monthly City Council Meeting. Attended Monthly Staff Meeting Met with City Manager and Consultant regarding progress on City’s updated Purchasing Policy. Completed Monthly Financials for January 2017 (attached). Human Resources/Risk Management Staff performed day to day duties/responsibilities and assisted various telephone/walk-in requests from the public. Highlights: Legal Updates New I-9 Form As of January 22, 2017, all employers are required to use the new federal I-9 Employment Eligibility Verification form when a new employee is hired. Go to: https://www.uscis.gov/i-9 to access the form. Form I-9 is used for verifying the identity and employment authorization of individuals hired for employment in the United States, including citizens and noncitizens. What Employers of Foreign Born Workers Need to Know o While ICE (Immigration and Customs Enforcement) once conducted “sweeping” workplace raids, the Obama Administration turned away from such efforts opting rather to focus on I-9 enforcement and removal of criminals and other serious immigration offenders with outstanding Order of Removal, particularly those who had recently arrived in the United States. During the previous administration, 200,000-400,000 undocumented immigrants were removed each year. o The raids of the last several weeks are described by ICE as “targeted enforcement operations” specifically targeting an individual. Under President Trump’s Executive Order of January 25, 2017, “Enhancing Public Safety in the Interior of the United States,” the scope of enforcement has been expanded to include all violators allowing ICE agents to deport individuals with minor violations or individuals with employment authorization under DACA, the “Deferred Action for Childhood Arrivals” program instituted by President Obama in 2012, if they have minor criminal violations. o To date, several hundred individuals have been apprehended at a projected annual rate of approximately 30,000 illegal immigrants. o Individuals who have employment authorization may be subject to removal if they have a minor violation. Employers can expect, on occasion, a worker properly verified for employment eligibility to become entangled in a removal proceeding and become unavailable for work. o As of February 21, 2017, two new memos were issued by President Trump which provide instruction to Homeland Security on how to implement the President’s orders on immigration and request the hiring of 10,000 additional border agents. Guidelines for prioritizing the deportation of illegal immigrants focuses on removal of undocumented immigrants who have engaged in fraud or willful misrepresentation in connection with any official matter and empowers Customs Enforcement Agents to deport any alien they have reason to believe is a “removable alien”. While Deferred Action for Childhood Arrivals (DACA) are exempt from deportation “priority status”, DACA immigrants reasonably suspected of criminal involvement, being a risk to public safety or national security are subject to removal. o Employers of foreign born workers are advised to be supportive of said employees, many of which are confused and afraid, and alert them to legal developments. FLORIDA’s WORKFORCE 2013 U.S. Census data reports that immigrants comprised 24.5% of the state’s workforce. Latinos in Florida paid $13.7 Billion in federal taxes and $5.1 Billion in state/local taxes. The Pew Hispanic Center estimates 6.9% of Florida’s workforce (650,000) is comprised of unauthorized immigrants who paid $706 Million in state and local taxes and $79.1 Million of property taxes. HR participated in a City-wide review of progress made in achieving last year’s strategic planning goals offering suggestions for future goals and initiatives. HR is looking forward to developing Staff leadership necessary to achieving the many exciting projects that lay ahead. Florida Municipal Insurance Trust (FMIT) closed the City’s Hurricane Matthew property damage claim on covered assets with eligible damages totaling $38,629.65. After a 5% Hurricane deductible, FMIT paid the City $13,870.34. HR remains dedicated to completing the FEMA claims process in order to recoup expenditures for labor, erosion prevention vegetation, debris removal and the 5% deductible. HR conducted managerial/leadership training for supervisory PWS employees as part of an ongoing effort to develop newly promoted employees and dispense supervisory skills necessary for maintaining an engaged workforce. Utilities Mechanic, Public Works Services HR is currently seeking a qualified candidate for the position of Utilities Mechanic assigned to Public Works Services in the Collections and Reclamation Field Systems Division. Chris Robinson, Code Enforcement Officer assigned to Community Development, comes to us with 17 years of experience working for Brevard County Government in Parks & Recreation and Animal Services as a Supervisor of Animal Control Officers. As a graduate of the Police Academy with extensive related experience, Chris has hit the ground running assisting the Department to effectively complete its objectives. Lori Crowley, Recreation Leader assigned to Culture and Leisure Services, comes to us following a successful career as a pharmacy tech. At this point in the Fiscal Year, the Year to Date Actuals should be 33.3% of the total annual budget. Total General Fund Departmental costs are under target at 22.4%. Administrative Services is running on target. Fire Rescue and Protective Services are over target costs at a combined 3.5%. Community and Economic Development and Building and Code Enforcement are under costs by 10.8%. Leisure Services is 2.6% below its estimated target. Non-Departmental expenditures are over budgetary projections by 2.2%. The Community Redevelopment Agency (CRA) costs are under target costs by 12.6%. The Capital Construction Fund related to construction of the New City Hall has incurred $547,333 in cost this Fiscal Year. Wastewater Fund overall costs are under target at 20.9%. The Stormwater Fund is under target by 11.4%. The Enterprise Capital Fund expenditures are below budgetary projections by 26.3%. The City's General Fund investments total $5 ,505 ,210.59; Special Revenue investments total $312,139.05; and Enterprise Fund investments total $1 ,175 ,057.56. The Grand total of all investments is $6,992,40 7.20. The Annual Rate of Return for each Investment is attached. If you have questions or wish anything additional, please contact me. Revenue Ad Valorem Tax City of Cape Canaveral Fund Narrative Period Ended January 31 , 2017 To date, the City has received 79.3% of ad valorem revenue. The City saw a spike in this revenue source during the month of December and will continue in February and March as escrowed taxes are remitted to the County. Local Option Gas Tax This amount represents an accrual for December and January based on actual collections for October and November. Fiscal Year 2016-17 budget is slightly more than Fiscal Year 2015-16. Franchise Fees, Utility Service Taxes and Communications Service Tax This amount represents an accrual for December and January based on actual collections for October and November. This revenue is below target at this point and hopefully this trend will Improve. Permits and Licenses Permits and Licenses are above target at 70.1 %. This is a direct result of business tax renewals and an increase in building permits. State Shared Revenues This amount represents an accrual for December and January based on actual collections for October and November. This revenue source is slightly under target at 32.5%. Garbage and Recycling Revenues This amount represents collections for the months of October, November, December and January. This revenue line is on target at 33.2%. This revenue source, however, tends to fluctuate from month to month. Recreation Fees (Leisure Services) Recreation Fees are under target at 18.3%. Hurricane Matthew caused the cancellation of October's Friday Fest and the resulting loss of revenue to the City. Investment Income Investment Income is under target at 27.1 %. This should change as interest rates appear to be moving upward. Utility Operating Income (Wastewater Fund) Utility Operating Income is on target at 33.2%. Stormwater Utility Fees (Stormwater Fund) Stormwater Utility Fees are slightly under target at 31 .3%, however, this revenue source tends to fluctuate so any shortfall could be made up. The casual meeting brought together Nineteen (19) residents/visitors to inspire positive change in the City. The subject matter was guided by the attendees, but there was a discussion on the current Mobility Plan/Canaveral City Park Design. Some of the ideas brought up in the meeting were: Turning Ridgewood Ave into a one-way street North to South; Turning the presidential streets into one-way streets East to West; Exercise stations at the new park project, but also on pedways throughout the City; More tree shade/shade structures; Bike loop with bike markers throughout the City; Connecting to the existing East Coast Greenway Trail; o http://www.greenway.org; More riding in the street (due to road bikes, street transitions and cars not being aware); Light up speed limit and pedestrian crossing signs; Education for residents in cars and on bikes about the rules of riding in the road. Flexipave is used as a porous and flexible substitute for concrete and pavement in places like sidewalks and around trees. Early this morning without being informed (don't know if I'm supposed to be informed), a very large shed was installed right behind my back fence. I cautioned the installers and owner not to put it flush against my fence as my fence is more than a foot in from my property line. Are there rules for installing a shed on one's property (xx feet from property line, etc.) and is a permit required? Not sure this shed installation is out of code, thus my inquiry/concern. Cost per team will be $175 for kickball and $275 for softball. Each league includes a 10 game regular season and a single elimination playoff tournament. Canaveral City Park Redevelopment – The City acquired a Community Planning Technical Assistance Grant from the State to create a Citywide Mobility Master Plan and a Master Redevelopment Plan for Canaveral City Park. The first step included a needs survey to identify deficiencies in the Park, underutilized amenities, barriers to mobility within the Park and desired amenities for redevelopment. A wide demographic from the community were selected to participate in the survey and the result yielded a Master Plan which was unveiled at a public meeting on February 22nd. The Master Plan addresses mobility by connecting the Park from all directions and allows for pedways throughout. It addresses highly desired amenities from the community like a children/family splash pad, a skate park, gathering areas for passive recreation, improved playground equipment that can also be used by teens and a Multigenerational Center for indoor recreation and events. The Master Plan was very well received by attendees and there was excitement as to what the future of the Park could be. Wastewater Treatment Plant (WWTP)/Sanitary Sewer System Oxidation Ditch Rehabilitation Project. Numerous valves, piping, aerators, etc. and other materials already ordered/in fabrication. Consultant staff reviewing/revising/ approving shop drawings. Contractor excavating key valve locations and performing initial surveying. This is one of the projects funded through the City’s State Revolving Fund (SRF) Loan. WWTP Generator Replacement. Staff is reviewing quote for the replacement generator and associated equipment at the WWTP. This is a budgeted item for FY2016-2017. Stormwater Canaveral City Park Ex-filtration Project. Contractor completed punch list items and final cleanup of site. Project is complete with the exception of grant reporting and final invoicing. The Quality Assurance Project Plan (QAPP) for the site was approved by Florida Department of Environmental Protection (FDEP). Staff will monitor the system for the next two years and report results to FDEP as part of the grant requirements. Irrigation of the newly sodded Little League infield – looking northwest. Brevard County Meetings. Staff attended the Save Our Indian River Lagoon (IRL) Project Plan Citizen Oversight Committee Meeting in Viera to answer questions concerning the City’s proposed stormwater improvement projects to be partially funded by Brevard County. Staff will also attend the March County Commission Meeting to answer any potential questions. The Oversight Committee Meeting included a presentation of the County’s Muck Removal Program; a summary of the Program is attached. The February 2017 Progress Report on IRL cleanup activities is also attached. Key topics at the Meeting were as follows: o A website is now dedicated to the Program - http://www.brevardfl.gov/SaveOurLagoon/CitizenOversightCommittee. o The County plans to allocate $34 million per year for IRL restoration projects for a 10-year period. o Additional funds may be forthcomng from the upcoming state budget (up to $60 million per year). o A study is currently being undertaken by UCF to determine ideal locations for future oyster mat projects in the IRL. o The City previously submitted seven projects for funding. The Oversight Committee approved the projects at its Janaury meeting; final approval will be at the County Commission Meeting on March 7. Shoreline Restoration Project. Staff finalized plans and bid specs for the restoration of the shoreline along Manatee Sanctuary Park and Banana River Park and forwarded to FDEP for review. Project will be publicly bid in late-February with construction scheduled for May 2017. Funding for the Project is from a 319 grant from FDEP and the City’s Stormwater Utility. Hannon's observation, Mr. Mason was taken into custody. When Dep. Hannon attempted to place handcuffs on Mr. Mason, he pulled away and tensed his arms. Furthermore, while conducting a drug investigation, I escorted Ms. Ramirez inside to get a cigarette. While she was walking out, she intentionally reached for the dollar bill that was on the table, and threw it into a utility closet. Mr. Nance admitted to possession of the paraphernalia. Upon arriving on scene, it was discovered the victim was intentionally struck in the face approximately 3 times by Ms. Della Taylor (W/F 05/31/65) during an argument on the way to the bar. Pena and FTO Howard requested Mr. Morrell's driver's license, FTO Howard smelled the odor of marijuana emitting from the vehicle. A search was conducted, and approximately 6.0 grams of field tested positive marijuana and approximately 1.0 grams of field tested positive cocaine was located in the vehicle. Mr. Overbee admitted to possession of the drugs, and to the plastic baggies individual packaged with "$20 purple" labeled on the front belonged to him as well. A search of the front right passenger, Mr. Nathan Cole, revealed half of a Hydrocodone pill as well as a rolled up dollar bill with a blue pill residue inside. Both occupants were then asked to exit the vehicle and a search was conducted of the vehicle and their persons. A search revealed one marijuana cigarette on Ms. Egert. A glass pipe that field tested positive for methamphetamine, multiple straws that field tested positive for cocaine and two small baggies of marijuana were located inside of her purse. Cejda-Sturm, W/, 11/11/1992 FTOs Vaughn and Behringer conducted a foot patrol of the area near the 300 block of Harrison. During this patrol a white female was observed in a truck and consensual contact was made. While speaking with the female, later identified as Ms. Taylor Cejda-Sturm, FTO Vaughn observed two syringes and a silver case poking up from her cleavage. A subsequent investigation revealed Ms. Cejda-Sturm was in Possession of Crack Cocaine, Crystal Methamphetamine, and Controlled substances w/o a Prescription. Additionally, Ms. Cejda was in possession of multiple forms of Drug Paraphernalia including baggies, glass smoking pipes, dozens of syringes and a spoon. Ms. Cejda-Sturm was charged accordingly and transported to BCJ where she was held on a no bond status due to already being out on Felony bond from a separate arrest. , Deputy/Agent : FTO Vaughn 17-061223 Narcotics Arrest Possession of controlled substance (MDMA) 200 block Caroline Street, Cape Canaveral Ms. Eveling Cespedes,W/F, 9/22/1997 FTO Behringer noticed a parked vehicle with the engine running, the lights shut off and two occupants inside. FTO Behringer then detected the odor of burned marijuana emitting from inside of the vehicle. Contact was then made with the driver, and the front seat passenger, Ms. Eveling Cespedes, W/F, 9/22/97 (arrestee). FTO Behringer then had the occupants exit the vehicle and a search was conducted which revealed a small amount of marijuana and one used marijuana cigarette inside of the vehicle. A search was then conducted of the purse Ms. Cespedes had which revealed a blue tinted clear baggie with a pink rounded pill stamped with a crown. The pill was field tested which yielded the positive result for MDMA. Possession of the marijuana could not be proven and it was seized for destruction. Pena observed a suspicious male later identified as Mr. Kejal Patel, W/M, 12/22/88 walking directly in the middle of the roadway where sidewalks are available. Contact was made with Mr. Patel, who appeared to be under the influence. Mr. Patel stated he ingested prescription meds earlier in the day in order to get high, as well as consumed alcoholic beverages. By walking in the roadway in his intoxicated state, Mr. Patel posed a danger to himself and the motoring public. When told to move out of the roadway, Mr. Patel refused and caused a public disturbance by acting erratically. Atlantic Ave., Cape Canaveral Jack Bettis, W/M, 4/4/1959 Deputies responded to the area of 117 Pierce Ave., in reference Mr. Jack Bettis, W/M, 4/4/59, making threats. Several calls indicated Mr. Bettis was highly intoxicated and would not leave the area. Dep. Moore located Mr. Bettis at the BP Gas Station, stumbling about and bleeding from the arm. Due to his level of intoxication, Mr. Bettis kept falling down, which caused the arm injury. BCFR responded and bandaged Mr. Bettis' arm. Mr. Bettis was extremely belligerent and caused a disturbance in the parking lot of the BP Gas Station, an open business with customers actively walking in and out. Dep. Moore attempted to take Mr. Bettis into custody. Mr. Bettis became aggressively resistant, and attempted to hit Dep. Moore. With the assistance of FTO Howard and Dep. Pena, Mr. Bettis was subsequently arrested. A search of his person revealed a blue pipe which field tested positive for marijuana. Atlantic Ave., Cape Canaveral Gabriella Chavannes, W/F, 8/5/1998 Dep. Habart conducted a traffic stop on a vehicle for failing to obey a stop sign. Contact was made with the occupants, who were acting suspicious. Dep. Habart requested a K-9 unit respond. Cpl. Lovell responded and utilized his assigned K-9 to conduct a free air sniff around the vehicle. Probable cause was established to conduct a search, which revealed 1.5 grams of field tested positive marijuana and associated paraphernalia in the center console. Pena observed a suspicious vehicle parked with the running lights on in the parking lot of Lido’s. Contact was made with the only occupant of the vehicle, a black male later identified as Mr. Leon King, B/M, 03/18/93. The distinct odor of cannabis was detected emitting from within the vehicle. A probable cause search revealed a brown rolled cigarette containing 1 gram of field tested positive marijuana. An FCIC/NCIC query was conducted, and it was discovered Mr. King is currently on felony probation for possession of marijuana more than 20 grams. Once in custody, a search of Mr. King’s person revealed an e-cig in his left front pocket, which contained a small amount of field tested positive marijuana wax. Habart conducted a traffic stop on a pickup truck for driving westbound in the eastbound lanes of Canaveral Blvd. Additionally, the vehicle had an expired tag. Contact was made with occupants of the vehicle and their ID's were obtained. A FCIC/NCIC check revealed the passenger, Mr. Adam Nicolaou, W/M, 10/14/84, is on felony probation for possession of cocaine and possession of a controlled substance. Mr. Nicolaou consented to a search of his person, and the vehicle owner consented to a search of the truck. Dep. Habart located two clear baggies which field tested positive for crystal methamphetamine in Mr. Nicolaou's left front pants pocket. Additionally, on the passenger floor board, just below where Mr. Nicolaou was sitting, a clear baggie containing a hard brown substance was located. The substance field tested positive for heroin. Mr. Nicolaou was charged with Possession of Heroin, Possession of Methamphetamine, Possession of Drug Paraphernalia, and On Site VOP. He was transported to jail without incident., Deputy/Agent : Dep. Habart 17-063110 DUI / Narcotics Arrest DUI, Poss. controlled substance w/o prescription 8167 Canaveral Blvd. , Cape Canaveral Kathryn Grace Tittle, W/F, 10/30/1960 Deputies responded to a crash at 8167 Canaveral Blvd. A caller reported a grey vehicle hit a parked vehicle and advised the driver was leaving the area. Corporal Shields observed a vehicle matching Brevard County Sheriff’s Office Cape Canaveral Precinct Weekly Update (continued) Page 17 of 19 the description traveling Southbound on Poinsetta Ave at the intersection of Tyler Avenue. The vehicle had front end damage and smoke was coming from the front passenger side under the hood. A traffic stop was initiated and contact was made with the driver of the vehicle, Mrs. Kathryn Tittle. Mrs. Tittle stated she hit a vehicle while backing up and spoke to the owner of the vehicle before leaving. She slurred her speech and stumbled when she got out of the vehicle to look at the damage. FTO Galligan completed the traffic crash investigation and Dep. A. Walkington initiated a DUI investigation. Mrs. Tittle advised she had not consumed any alcoholic beverage nor prescription medications. Mrs. Tittle consented to perform FSE's and did not perform them to standard. She was placed under arrest for DUI. During a search, a small Crown Royal bag was located in her purse along with seven (7) Carisoprodol 350mg tablets, a schedule IV controlled substance. She was transported to East Precinct where she provided a breath sample of .000 and .000. Atlantic Ave./Canaveral Blvd., Cape Canaveral Sharon Nicole Kirk, W/F, 1/6/1997 Sgt. Sarivola conducted a traffic stop on vehicle for a defective tail light. Contact was made with the driver, Ms. Sharon Nicole Kirk, W/F, 1/6/97. Ms. Kirk exhibited signs of being under the influence of marijuana. When questioned, Ms. Kirk admitted to recently smoking marijuana. FTO Howard Dep. Pena responded to conduct the DUI investigation. Ms. Kirk was subsequently arrested for DUI and she agreed to provide a urine sample. A presumptive urine test cup was utilized, which revealed the presence of THC in Ms. Kirk's system. Habart observed a white male, later identified as Mr. Jeffrey Meadows, W/M, 12/16/71, staggering through the parking lot with an open bottle of beer. Mr. Meadows then began aggressively shouting obscenities at an employee dancer in the parking lot. Mr. Meadows' behavior caused a crowd to form, disturbed the peace of other guests entering and exiting the facility, and constituted a nuisance to the open business. Mr. Meadows was subsequently arrested for violation of the open container ordinance and disorderly conduct. Mr. Meadows was transported to jail without incident., Deputy/Agent : Dep. Steuerwald and his assigned K-9 responded to the scene and established probable cause to search the vehicle. During the search, approximately 3 grams of field tested positive heroin packaged in 10 separate bags was located near the driver's seat. Atlantic Ave., Cape Canaveral Bruce Robert Gray, W/M, 3/15/1980 While conducting a foot patrol of 8401 N. Atlantic Ave., Dep. Lakeman came upon a vehicle parked near a building known for drug sales. There were three individuals in the vehicle, none of whom reside at the complex. All three occupants consented to a search of their person. The back seat passenger, Mr. Bruce R. Gray, W/M, 3/15/85, was found to be in possession of a syringe, which he admitted he uses to inject heroin. Mr. Gray was arrested for Possession of Paraphernalia and was transported to jail without incident. Once there, a secondary search of Mr. Gray's person was conducted. Three small white pills were located hidden in Mr. Gray's pants. The pills were labeled with "PLIVA 433." A check of Drugs.com revealed the pills were Trazadone, which is not a controlled substance, but still requires a prescription. Mr. Gray admitted he does not have a prescription for the pills. Mr. Gray was additionally charged with Possession of a Legend Drug without a Prescription and Introduction of Contraband into a Detention Facility., Deputy/Agent : Dep. Lakeman 17-063751 Traffic Arrest Driving While License Suspended w/Knowledge 8900-block of Astronaut Blvd., Cape Canaveral Cheryl Wilson, W/F, 9/19/1972 Ms. Cheryl Wilson, W/F, 9/19/72, was the driver of the red in color Ford Explorer that Dep. Lakeman came upon at 8401 N. Atlantic Ave (CR #17-063731). A FCIC/NCIC check revealed Ms. Wilson's license is suspended. Ms. Wilson stated she was aware of the suspension. After Mr. Gray was arrested, Ms. Wilson was told to leave the area, but not to drive. A short time later, Dep. Moore observed Ms. Wilson driving the vehicle. Dep. Thomas, W/M, 7/6/79, FTO Howard observed obvious signs of impairment. Mr. Thomas was requested to perform FSE's, and did not perform them to standard. Mr. Thomas submitted to a breath test with the following results: .044/.044. Mr. Thomas' breath test was not consistent with his FSE's, and a urine sample was requested. Mr. Thomas was transported to jail without incident., Deputy/Agent : FTO Howard 17-064894 Burglary Burglary to an Occupied Dwelling Tyler Avenue, Cape Canaveral Anthony J. Mackin, W/M, 3/2/1990 Victim called 911 after being awakened to a stranger opening the bedroom window and partially entering the bedroom. The victim jumped out of bed and successfully forced the suspect back out the window before suspect fully gained entry into the residence. Victim described the male as approximately 5'09", light skinned, and unshaven, with short brown hair. While responding to the initial call, Deputy Barrett located Mr. Anthony Mackin one block away on Harrison Avenue. Mr. Mackin matched the suspect description. He was detained and a Show Up was conducted with the victim, who positively identified Mr. Mackin as the suspect who committed the Burglary. Mr. Mackin was placed under arrest for Burglary to an Occupied Dwelling and transported to BCDC., Deputy/Agent : Behringer/Barrett 17-064860 Traffic Arrest Driving While License Suspended W/Knowledge 8300 Astronaut Blvd, Cape Canaveral Terry Lydon Ward, White, Male, 11/21/1975, 5-10, 225 FTO Vaughn observed a vehicle traveling northbound on Astronaut Blvd with inoperative tag lights. A traffic stop was conducted and contact was made with the driver Mr. Terry L. Ward, W/M, DOB 11/21/1975, (arrestee). Mr. Ward provided a New York State ID card when asked for his driver’s license. Then he stated to FTO Vaughn that he did not have a valid DL. A DL status check revealed Mr. Ward's Florida DL was suspended on 11/15/2016.
