RE: Notification of prohibitions for failure to submit Evaluation and Appraisal
Notification Letter
Dear Mayor Hoog:
The purpose of this letter is to inform you of statutory prohibitions outlined in Chapter
163, Part II, Florida Statutes, which will have an impact on your jurisdiction's ability.to adopt
comprehensive plan amendments in the future.
Section 163.3191(4), Florida Statues states that if a local government fails to submit its
Evaluation and Appraisal Notification letter prescribed by subsection 163.3191(1), F.S, it may
not amend its comprehensive plan until such time as it complies by submitting the required
notification letter.
According to our records the City has not submitted the Evaluation and Appraisal Letter
which was due on October 1, 2017; and therefore, the City may not submit an amendment to
its comprehensive plan until the letter is submitted to the Department.
