HomeMy WebLinkAboutP&Z Minutes 5-24-2017PLANNING & ZONING BOARD MEETING MINUTES May 24, 2017 A Meeting of the Planning & Zoning Board was held on May 24, 2017 at the Cape Canaveral Public Library, 201 Polk Avenue, Cape Canaveral, Florida. Chairperson John Price called the meeting to order at 6:00 p.m. The Secretary called the roll. ROLL CALL: MEMBERS PRESENT John Price Lamar Russell Ron Friedman Harry Pearson Dr. John Fredrickson Albert Franks, Jr. MEMBERS ABSENT None OTHERS PRESENT Chairperson Vice Chairperson Anthony Garganese City Attorney David Dickey Community Development Director Patsy Huffman Board Secretary PUBLIC PARTICIPATION: None NEW BUSINESS: 1. Approval of Meeting Minutes: March 22, 2017. Motion by Mr. Friedman, seconded by Mr. Russell to approve the Meeting Minutes of March 22, 2017. Vote on the motion carried unanimously. 2. Quasi Judicial and/or Public Hearing: Consideration and Recommendation to City Council Re: Ordinance No XX -2017, amending Chapter 98 of the Cape Canaveral Land Development Code relating to submittal and review procedures for Final Plats and Lot Splits; providing for the repeal of prior inconsistent Ordinances and Resolutions, incorporation into the City Code, Severability, and an Effective Date — City of Cape Canaveral — Applicant Mr. Dickey presented Staff s report/photos and recommended approval. Planning & Zoning Board Meeting Minutes May 24, 2017 He suggested the process for Lot Split and Plat review be streamlined to bypass Planning & Zoning Board review and, instead, present request to the Development Review Committee (DRC) and City Council. Discussion ensued to include who are members of the DRC; review process for DRC; use of a third party surveyor per Florida statues; Lot Line Adjustments administratively reviewed; added responsibilities for Council Members/Staff, present duties of P&Z Board; checks and balances of the review process and keeping P&Z Board in the review process. City Attorney Garganese gave further clarification regarding the recommended Ordinance, and how it applied to property owner's division of land as well as the process for Plats, Lot Splits and adjusting property lines. He stressed the importance of improvements/additional criteria made to Lot Split procedures worth serious consideration for a recommendation to City Council. He addressed pertinent pages within the Ordinance and made a correction to Page 2 of 14, Sec. 98-4. — Variance. (a) Hardship. Where the Planning n zoning board City Council ..... Discussion ensued to include Mr. Friedman's recommendation that the P&Z Board be kept in the process, even without a public hearing and type of recommendation to make to City Council. Motion by Mr. Friedman, seconded by Mr. Price to recommend to City Council that P&Z Board remain in the review process for Lot Splits, Plats and Variances. The roll call was interrupted when Mr. Pearson felt the motion warranted further clarification of a recommendation to not have a public hearing and asked for guidance from the City Attorney. The issue was addressed. City Attorney Garganese felt the 1St motion on the table stood. Vote on the motion carried unanimously. Motion by Mr. Franks, seconded by Mr. Friedman to recommend approval of the Ordinance to City Council as it stood. Vote on the motion carried unanimously. 3. Quasi Judicial and/or Public Hearing: Consideration and Recommendation to City Council Re Ordinance No XX 2017, amending Section 110-470 of the Cape Canaveral Land Development Code to allow fences and walls six (6) feet in height or less to be located within fifteen (15) feet of public right-of-way on a nonconforming corner lot of record, providing for the repeal of prior inconsistent Ordinances and Resolutions, incorporation into the City Code, Severability, and an Effective Date — City of Cape Canaveral — Applicant Mr. Dickey presented Staff s report/photos to include a nonconforming lot with side yard setback issues regarding fence height, which could pose privacy and/or security problems for homeowner's. Staff recommended approval. Discussion included research of property before purchasing; setting limitations; visibility concerns; history of current rules and correcting the problem with this Ordinance. Planning & Zoning Board Meeting Minutes May 24, 2017 Motion Mr. Friedman, seconded by Mr. Pearson to recommend to City Council to allow fences and walls six (6) feet in height or less to be located within 15 feet of public right-of-way on a nonconforming corner lot of record. Vote on the motion carried unanimously. REPORTS AND OPEN DISCUSSION: Coastal Management Element Update - Effective July 1, 2015, F.S. Chapter 2015-69 went into effect that amends the requirements of the City's Comprehensive Plan, specifically the Coastal Management Element, which largely targets climate change, sea level rise and how the City will protect itself and residents. In response, the City must update the Coastal Management Element to bring it into compliance with this new law. Staff will prepare and work with City Attorney on a draft ordinance to consider at the June meeting. Mr. Friedman suggested at a future meeting addressing six (6) foot fences. Staff agreed to place an item on June's agenda. ADJOURNMENT: Motion by Mr. Friedman, seconded by Mr. Franks to adjourn the meeting at 7:27 p.m. Vote on the motion carried unanimously.
