RE: Decision Regarding Variance No. 17-01 (Parcel ID.#24371428*A) at City Council
Hearing -April 18, 2017.
Dear Ms. Pittner:
This letter memorializes the decision of the City Council of the City of Cape Canaveral made
at the properly noticed and advertised public hearing held on April 18, 2017 regarding your
application for Variance No. 17-01. The hearing was held pursuant to applicable provisions
of the City Code.
After considering and weighing all of the testimony and evidence presented by you, City Staff,
all interested parties, including the appellant Mr. Bernie Lennon, and the public, the City
Council rendered the following final decision:
1. The City Council reverse the BOA decision to grant the lot depth variance because said
variance was not required for the property owner to develop the existing, non -conforming
lot of record.
2. The City Council affirm the BOA's decision to grant a 25 foot setback variance from the
50 foot setback requirement from N. Atlantic Avenue as set forth in Sec. 110-536(a)(2),
of the City Code, subject to the following condition:
a. The variance is for the limited purpose of allowing the property owner to construct a
single -story office building not to exceed 60' feet in length located within the southern-
most portion of the subject parcel (See Attachment 6).
Please be advised that an aggrieved party may have a right to appeal the City Council's
decision to the circuit court in accordance with applicable Florida Rules of Court, which
appeal must be filed within 30 days of the City Council's final decision.
