Subject: RE: required City Code Section 110-28 was NOT completed for
10/24/2016 hearing
10/17/2016
To: Mia Goforth, City of Cape Canaveral Clerk
Sheropa LLC built the following 4 homes on a faulty survey:
127 Oak Lane Cape Canaveral, Florida 32920
131 Oak Lane Cape Canaveral, Florida 32920
135 Oak Lane Cape Canaveral, Florida 32920
139 Oak Lane Cape Canaveral, Florida 32920
These are all within 500-foot radius of the subject property, and none
have received notice of this hearing. In fact, because 127 Oak Lane’s
property line has moved, will it move all 4 property lines? The City of
Cape Canaveral issued Certificates of Occupancy to 131, 135, 139 Oak
Lane, knowing about the survey error without informing the new owners of
the error. Then the city had a hearing for variance because of the
survey error and did not inform the new owners of the hearing. I
informed the City of Cape Canaveral on several occasions by certified
mail that 123, 131, 135, and 139 Oak Lane have not been given proper
notice of the 8/23/2016 hearing or the 10/24/2016 hearing. They are the
ones most affected by this problem.
Additionally, the owners of the infringed-on property at 123 Oak Lane
did not receive notice of the hearing.
A signed copy of this letter has been mailed certified [7015 0640 0004

Thank You.

Subject: required City Code Section 110-28 was completed for 10/24/2016
hearing
10/17/2016
To: Cape Canaveral City Manager David Green
Pursuant to Article I, section 24 of the Florida Constitution, and
chapter 119, F.S., I am requesting an opportunity to inspect the public
records that relate to the City of Cape Canaveral mailing a 500-foot
radius package as required by City Code Section 110-28. The Laserfiche
WebLink for the City of Cape Canaveral has the 500-foot mailing list and
the postal receipt for all of the other hearings. I have not been able
to locate the 500-foot mailing list and the postal receipt for 8/23/2016
hearing for Variance Request No. 16-02 or the upcoming 10/24/2016
hearing for Variance Request No. 16-02 appeal.
Can you please direct me to where I can find the receipts that show the
required City Code Section 110-28 was completed for both hearings?
Should you deny my request, or any part of the request, please state in
writing the basis for the denial, including the exact statutory citation
authorizing the denial as required by s. 119.07(1)(d), F.S.
A signed copy of this letter has been mailed certified [7015 0640 0004
1075 1977] to: Mayor Hoog 210 Jefferson Ave. Cape Canaveral 32920.
Thank You.
