As we discussed early today the property known as 123 Oak Lane, owned by Gerry Beecher, Trustee, is the one disputing the location of the new home, located at 127 Oak Lane, owned by Sheropa LLC. Once we received the property survey from the 123 Oak Lane property we contacted the developer Turner Key Construction and provided them with a copy of the survey. If the survey from the Beecher property is correct the new home does not meet the setback requirement as stated in R-2, for the side interior lot line, which is eight feet, or ten percent of the width of the lot, or whichever is greater up to 15 feet. Should Staff take any action to stop the developer from moving forward with the construction or is this a civil matter.
