Are you in receipt of my public records request from October 14 2016?
Will you respond before October 21 2016? It has been almost 2 months
since I submitted that request to you. Two months ago you told me you
would respond in 5 to 7 days. That deadline was August 31 2016!

Hi Bernie. The City is in receipt of your public records request of
October 18, 2016. The following is provided in response.
As indicated in the Planning Department staff report to the Board of
Adjustment dated August 23, 2016, the City received a second survey
showing a discrepancy (completed by Riehl Reliable Surveying) with the
original survey on or near January 15, 2016 from the property owner of
123 Oak Lane.
Regarding your request to inspect City files/documents, you can arrange
a time with the City Clerk where the City files will be made available
to you. The City Clerk’s phone number is 321-868-1220, ext. 221. I have
copied her on this email so she will be aware of this correspondence.

To: City of Cape Canaveral Community Development Director David Dickey
Pursuant to Article I, section 24 of the Florida Constitution, and
chapter 119, F.S., I am requesting the opportunity to inspect the City
of Cape Canaveral records to determine when Tim Brather first complained
about the encroachment by the Sheropa LLC development. His claim that
you told him a stop work order would be issued if he could prove the
surveying error. The date you became aware that surveyors Walker Land
Surveying Inc. and Riehl Reliable Surveying and mapping concluded Walker
surveying error and they stopped communicating.
Should you deny my request, or any part of the request, please state in
writing the basis for the denial, including the exact statutory citation
authorizing the denial as required by s. 119.07(1)(d), F.S.
A signed copy of this letter has been mailed certified [7015 0640 0004
