Range 37 East- Petitioner,Arthur W. Berger,Property Owner.
The Zoning Board of Adjustment of the City of Cape Canaveral has heard information .
pertaining to the request at the Zoning Board of Adjustment meeting held the 9th day of
February,1998. And based on the information provided, the Zoning Board of
Adjustment has entered the following FINDINGS OF FACT,CONCLUSION OF LAW
AND ORDER.
FINDINGS OF FACT
Arthur Berger is the owner of the real property described in the Petition. The property
is located in the M-1 zoning district classification and is subject to the Land
Development Regulations pertaining to said district. The granting of this special
exception request will not adversely affect the public interest, in that,the request
complies with the city code of ordinances. This special exception is consistent with the
goals,objectives and policies of the Comprehensive Plan;is consistent with the intent of
the M-1 zoning district; this request does not create any adverse impacts to adjacent
property through the creation of noise, light,vibration, traffic,utility requirements,
stormwater runoff that would not have been created had the property been developed
for a principal use permitted in the M-1 zoning district;no unusual police,fire or
emergency services will be required;all the requirements of the zoning district are met
with this special exception.
CONCLUSION OF LAW
That the Zoning Board of Adjustment has lawful power and authority to grant special
exceptions under special conditions and circumstances as set forth in Section 110-354,
Paragraph (C)(1) of the Cape Canaveral Code of Ordinances. The petitioner has met the
minimum requirements for the requested special exception and has demonstrated
entitlement to the special exception which will not adversely affecialp€cgubicoixiterest.

ORDER •
Arthur Berger is granted the special exception with the following limitations,restrictions
• and conditions:
1. The fenced area along AlA and Commerce Street shall be screened.
2. Landscaping shall be installed and maintained along the fenced area
facing AlA and Commerce Street in compliance with Section 110-566,
Landscaping and screening for commercial and industrial zoning
districts,Paragraph (b),Sub-paragraphs (2)(3)(4) and (6) of the Cape
Canaveral Code of Ordinances.
3. If the use or property ownership changes, this granted special exception
shall expire.
Should there be a violation to any part of this Order, the special exception is subject to
revocation according to the City Code.
DONE AND ORDERED on this 9th day of February, 1998 at the City of Cape Canaveral,
Brevard County, Florida.

SUBJECT: Request For Special Exception, "Outside Storage", Vacant Parcel # 785
Commerce Street
This request entails the use of vacant property adjacent and to the rear of 8660 Astronaut
Blvd. An office building owned by Mr. Arthur W. Berger in which his business offices
for Aedile Contractors, Inc. are located.
The request is to allow the outside storage of construction related materials, i.e.; scaffold
material,concrete block, reinforcement materials, miscellaneous wood members, etc. on
the unimproved parcel.
The request was received in response to code enforcement action by the Building
Department relating to storage commencing prior to the granting of a"Special
Exception"by the city.
Code Section 110-354 (1)allows for the granting of a"Special Exception"for outside
storage in the M-1 Zoning District after recommendation by the Planning& Zoning
Board and approval by the Board of Adjustment.
A permit to erect a chain link fence has been issued by the Building Department for the
above referenced location, although no provisions for screening were noted due to the
fact a"Special Exception"has not been granted.
If denied code enforcement action will continue in this matter.

Ordinance), subdivisions (Subdivision Regulations), signage (Sign Ordinance),
and areas subject to seasonal or periodic flooding (Stormwater Management
Ordinance and Federal Flood Insurance Program Regulations).
Policy LU-3.2: The City shall require new development to be compatible
