RE: Special Exception Request No. 96-11 to Allow an Automotive Service Station in a C-1
Zoning District, (RaceTrac Petroleum), Section 15, Township 24 South, Range 37 East,
Part of Parcel 750, Located on Astronaut Boulevard, (Immediately North of Jungle
Village) - Petitioner is Max E. McBrayer, Jr. for RaceTrac Petroleum, Inc.
The Zoning Board of Adjustment of the City of Cape Canaveral has heard information pertaining
to the request at the Zoning Board of Adjustment meeting held the 19th day of August, 1996,
and based on the information provided, the Zoning Board of Adjustments has entered the
following FINDINGS OF FACT, CONCLUSION OF LAW AND ORDER.
FINDINGS OF FACT
RaceTrac Petroleum is the designated agent of the real property described in the Petition. The
property is located in the C-1 zoning classification and is subject to the Land Development
Regulations pertaining to said district. The granting of this special exception request will not
adversely affect the public interest. This special exception is consistent with the goals, objectives
and policies of the Comprehensive Plan; is consistent with the intent of the C-1 zoning district;
this request does not create adverse impacts to adjacent property through the creation of noise,
light, vibration, traffic, utility requirements, or stormwater runoff that would not have been
created had the property been developed for a principal use permitted in the C-1 zoning district;
no unusual police, fire or emergency services would be required; all the requirements of the
zoning district are met with the special exception request.
CONCLUSION OF LAW
That the Zoning Board of Adjustment has lawful power and authority to grant or deny special
exception requests under special conditions and circumstances as set forth in Section 110.334
(c)(3) of the Cape Canaveral Code of Ordinances. The petitioner has met the minimum
requirements for the requested special exception and has demonstrated entitlement to the special
exception which would not adversely affect the public interest.

ORDER
RaceTrac Petroleum is granted the special exception with the following noted limitations,
restrictions and conditions: The special exception is granted for that portion of the property
shown on the engineered drawing attached to the application which the applicant has intended to
be used for a service station.
Said special exception shall run concurrently with the property identified in the application as
shown within the petition.
DONE AND ORDERED this 19th day of August, 1996 at Cape Canaveral, Brevard County,

Ordinance 3-96, maximum width 35 ft. (40' shown).
2. Property abutting residentially zoned areas require screening. (See
attached Code Section 110-334 (3)(f) and 110-556). This may be addressed
on Landscape Plan.
3. Note: Signs will require separate plans and permits. (Unable to
determine compliance with City Ordinance with submittal).
4. Landscaping shall be addressed at site plan review.
