Mr. Greene,
I am writing this morning in hopes of avoiding further issues on Oak
Lane. The property owners on Oak Lane have been meeting together and
making plans. Recently, other disgruntled Cape Canaveral citizens have
heard about the problems and are showing up to tell their own stories.
We do not want this battle, however, and I hope the city would also be
in favor of taking a more constructive path.
There is really only one issue at the heart of all of this: we do not
want the road on Oak Lane improved. The one person who is pushing this
plan, through his friend Mayor Hoog, is developer (and former mayor)
Patrick Lee. He has bragged to many of us that he is planning to buy and
develop the three acres that lie at the end of Oak Lane.
The people living on Oak Lane know this plan will come at great cost to
all of us. On the south side of the road, driveways have been
constructed (by Mr. Lee’s LCC) in the city right-of-way. Even by the
flawed Sheropa survey, these driveways are 5-8 feet in the easement. We
believe the Sheropa survey is incorrect and the driveways are as much as
12-17 feet in the right-of-way. The developer was informed of the
mistake before the first concrete was poured. The city was informed
after the first house was built.
Those of us—four property owners—living on the north side know this
means the city is likely to come and attempt to take a portion of our
property to develop the road. This is at the core of Bernie Lennon’s
battle, one he absolutely will not give up. This land, which he has
owned for 20 years or more, is his life and his retirement plan. He will
fight to the bitter end and at all costs, as you have surely witnessed.
At this point, neighbors and other citizens are coming to his side.
I heard the reluctance of city council members last night to hire a
Hearing Officer for the variance dispute. The cost to the city will only
grow if plans to improve Oak Lane go forward. This is not to mention the
cost to the reputation of Cape Canaveral, its staff, and its elected
officials.
I believe all of this can be avoided with a simple resolution to the
City Council. I encourage you to negotiate a plan to close the end of
the road on Oak Lane (there is already a gate there to prevent access).
Have Mr. Hayes and Mr. Lee develop a different access road into the
three acres in order to proceed with their building plans. Further, have
the City Council affirm that any plans to improve Oak Lane will not go
forward. If any plans are made in the future, the property owners will
be invited into those discussions from the beginning of planning (which
should have happened in the first place).
Mr. Greene, I write this letter on my own behalf. It represents what I
have heard around the meeting table and the neighborhood, but has not
been vetted or approved by Mr. Lennon or any of the neighbors. This is
simply my own last-ditch effort to avoid the very messy conflict I know
is on the horizon. I believe we are at a crossroads where it is still
possible for a good and peaceful outcome. I urge you to meet with the
people who live on Oak Lane and work with us. Help us protect our land,
our homes, our peace.
