Dear Mr. Dismore,
As per City of Cape Canaveral Code of Ordinances, Chapter 110, Section 110-28, you are hereby
notified that an Independent Hearing Officer will conduct an evidentiary hearing regarding an
appeal, filed pursuant to Section 110-33 of the City Code, contesting the City Board of
Adjustment's approval of Variance No. 16-02 to allow a four (4) foot setback from the adjacent
residential lot line, rather than the eight (8) feet required by Section l 10-297(a)(2), City Code
for property at 127 Oak Lane.
The hearing will be held on Monday, October 24, 2016 at 4:30 p.m. at the City of Cape Canaveral
Public Library, 201 Polk Avenue, Cape Canaveral, Florida. As the applicant for Variance No.
16-02, your rights could be affected. This is a de nova evidentiary hearing and you have the right
to present evidence regarding Variance No. 16-02. You have a right to attend in person and be
represented by legal counsel. Your attendance is required or you may waive legal rights. After
the hearing, the Hearing Officer will deliver a written recommendation to the City Council for
its final decision at its December 20, 2016 regular meeting to be held at 6:00 p.m. in the Cape
Canaveral Public Library, 201 Polk Avenue, Cape Canaveral, FL.
