Mr. Dickey 1) Did all members of last night’s Board of Adjustment receive copies of all 3 of the certified letters I sent to: Community Development Department, 110 Polk Avenue, P.O. Box 326, Cape Canaveral prior to the hearing? 2) The owner of 123 Oak Lane, Tim Turner, and myself, Bernard Lennon, 126 Oak Lane, both followed your instruction to stop Patrick T. Lee’s LLC from taking our property with a faulty survey. Why was Tim Turner granted a hearing to stop encroachment by Patrick T. Lee and I was denied a hearing? 3) What is required by me to be granted a public hearing on 127 Oak Lane violation of Section 110-297(a)(1), City Code? 4) Do I have a method to appeal your decision to ignore the signed/sealed surveys submitted by 123 Oak Lane, myself, and the one used by the City to locate the current right-of-way markers, when you instead choose to use the survey submitted by Patrick T. Lee that has been proven to be wrong? 5) Why are the current Right of Way markers on Oak Lane not being used? 6) What is the name of the surveyor who installed the original right-of-way markers and what is the name of the surveyor being used to relocate the right-of-way markers to match Patrick T. Lee’s faulty survey? 7) You mentioned that a hearing is required to move the right-of-way of Oak Lane. Will I be notified of the date and time of the hearing at least 30 days in advance to prepare a defense? 8) Since you insist on relocating everyone’s property line 12 feet north, what is required by me to remove the fence located between my property and Sea Spray Town homes and move it 12 feet north? 9) Since you have not yet determined where you are going to locate the new right-of-way, will you be issuing a Certificate of Occupancy to 127 Oak Lane prior to completing the preliminary engineering work to relocate Oak Lane? On August 25 David Dickey said he would answer all questions in 5 to 7 days. It appears that David Dickey is delaying this process because we cannot move on until the questions are answered. Our City’s Zoning Department is prepared and ready to send out the required 500 foot radius notices of the hearing and post the affected property as soon as we have confirmation from all parties, including yourself. We already have confirmation from the variance applicant and the hearing officer. Additionally, certified notices of the hearing will be sent to you, the variance applicant, and the hearing officer. It should be noted that the requirement for such a notice, per City Code (quoted below), is 14 calendar days. (This is above and beyond the State requirement of 7 calendar days.) “Sec. 110-28. - Due process; special notice requirements. (a) All applicants shall be afforded minimal due process as required by law, including the right to receive notice, be heard, present evidence, cross-examine witnesses, and be represented by a duly authorized representative. (b) In addition to any notice requirements provided by state law, all public hearings under this article shall be publicly noticed for at least 14 calendar days prior to the date of the hearing. Said notice shall include the address of the subject property, matter to be considered and the time, date and place of the hearing. The city shall post notice of public hearings in the following manner: (1) Posting the affected property. (2) Posting at city hall and on the city's official website. (3) Notifying all owners of real property (including homeowner's and condominium associations) adjacent to and within 500 feet of the subject property. All notices required by this subparagraph may be sent by regular mail except that public hearings related to applications for rezoning shall be sent by certified mail, return receipt requested. Further, unless otherwise provided by law, notices required by this subsection shall only be mailed for the first public hearing before the first board required to hear an application under this article. Subsequent hearings on the same application shall not be required to be noticed by this subsection. Applicants shall be solely responsible for the costs incurred for notification under this subparagraph. (4) Notifying, by certified mail, the owner(s) of the subject property for which the application is being made. The notice requirements set forth in subsections (1), (2), and (3) above are hereby deemed to be courtesy notices. The failure to provide such courtesy notices shall not be a basis of appealing any decision made under this chapter.” The City is planning to meet the 14 calendar day notice requirement with plenty of time to spare. He then falsified the public records saying he had given notice. For this public hearing to work you need to make certain all laws are being followed from here on out. Can you mail a 500-foot radius with the required 30 days’ notice, for an October 24 hearing?
