HomeMy WebLinkAboutAppeal of August 23 2016 Variance Request No 16-02 Hearing 8/26/2016 Mia Goforth, I am requesting an appeal to the hearing held by the Board of Adjustment on August 23, 2016 regarding Variance Request No. 16-02. The reason for the appeal is: The notice sent to my home on August 11, 2016 stated comments can be sent to Cape Canaveral, Community Development Department, 110 Polk Avenue, P.O. box 326, Cape Canaveral, FL, 32920-0326. David Dickey assured me the following information would be given to the Board of Adjustment members prior to the August 23, 2016 hearing. Without this information it was impossible for the board members to make an informed decision on Variance Request No. 16-02. On August 16, 2016 Mike Toscano signed for certified letter 7015 0640 0004 1075 6866 titled Regarding Variance Request No. 16-02. The same day Mayor Hoog signed for certified letter 7015 0640 0004 1075 6859 titled Regarding Variance Request No. 16-02. On August 17, 2016 The City Manager signed for certified letter 7015 0640 0004 1075 6842 titled Regarding Variance Request No. 16-02. On August 19, 2016 Kim Kopp’s office signed for certified letter 7015 0640 0004 1075 6835 titled Regarding Variance Request No. 16-02. On August 22, 2016 Mike Toscano signed for certified letter 7015 0640 0004 1076 4557 titled Regarding Variance Request No. 16-02. On August 22, 2016 Mike Toscano signed for certified letter 7015 0640 0004 1076 4984 titled Regarding Variance Request No. 16-02. David Dickey did not give any of this information to the Board of Adjustment members before or during the meeting. I requested an appeal of Variance Request N0. 16-02. David Dickey said he conferred with the City Attorney and I had lost my right to appeal because I did not attend the hearing. I suggested he did not have the authority to make that decision. David Dickey said he told the City Attorney two days before the hearing that I would not be attending. The Attorney told him then I would lose any right to appeal. (I was never informed of this). I asked for a copy of the official record. David Dickey said it was upstairs in his office and refused to let me see it saying I had to go across the street and put in a request for the record. I said let’s go across the street right now and do it. After arriving at City Hall David Dickey asked to see Mia Goforth. While waiting for Mia to arrive David Dickey said he was sorry I was not at the meeting. I reminded him I had sent an e-mail prior to the hearing that 13-day notice was not enough time for me to cancel prior commitments. David Dickey told Mia I needed a records request. I told Mia I was also appealing variance request 16-02 while being interrupted by David Dickey. David Dickey continued interrupting and raising his voice in a manner I perceived to be threating while I was talking to Mia. I then requested Mia to have the police from next door oversee this meeting. Mia refused to involve the police while David Dickey is yelling “you think I am threating you Bernie?” Mia asked me what was the threat from David Dickey. I requested that David Dickey leave the room while I complete my business with Mia. David Dickey asked in a threating tone why do I need to leave the room. I asked again would he please leave the room. John Deleo came from behind a divider and said he did not hear any threats. David Dickey continued to interrupt all of us. Once again I asked David Dickey to leave the room. He continued a loud protest he had not made any threats at the same time Mia was agreeing with him, saying no threats were made. David Dickey refused to leave the room so I asked Mia if we could go to her office. Mia said she would not be comfortable with that because now she felt I could be threating. I again requested the police oversee this meeting. David Dickey asked why the police were needed? I said because I need to request an appeal. John Deleo said I was standing here and did not hear any threats. I asked all three if I could speak to Mia without being interrupted and all agreed. The interruptions continued until John Deleo said he wanted to hear what I had to say and if they would stop interrupting me. Without interruptions I told Mia I wanted to file an appeal to variance request 16-02 and to do that I need a copy of verbatim record. Mia told me I would need an attorney to request the record on my behalf. Mia explained that State law did not require her to give me that information unless its requested by an attorney. She said she could provide me with a draft of the minutes and an audio of the meeting. I said yes I will need that and also the official record to verify that all the board members had in fact received all three of my certified letters prior to the meeting. Mia then explained to Davis Dickey the board secretary needs to go on Laserfiche and in the folder for that meeting add an additional item to that meeting and on the letter need to be added as presented on that date that needs to be written on there so the public knows it was presented to the board. Mia said she has my email address and will send me information on how to access Laserfiche from home everything except for the draft of the minutes which she will email separately. I asked David Dickey if he would respond to all 9 questions I sent him by e-mail. After a very long pause David Dickey said “Yes”. I asked when would he respond to the questions David Dickey said “as soon as I am able to”. I ask the next day or two. David Dickey said “as soon as I am able to”. I asked less than a week David Dickey said “as soon as I am able to”. I asked will you respond before issuing a certificate of occupancy to 127 Oak Lane David Dickey said “I don’t know”. David Dickey said “Bernie you are not going to put me in a corner”. I said your attempt to certify before answering the questions were to deny my rights. David Dickey said that was my opinion. I asked if anyone else agreed with that. Mia told me I would need an attorney to address that. John Deleo spoke up and recapped my request for a draft copy, audio and answers to the 9 questions submitted to David Dickey in a reasonable time. John Deleo said the City defines reasonable time to be 5 to 7 days. John Deleo asked David Dickey if 5 to 7 days were reasonable to him. David Dickey said “Yes”. I asked David Dickey if he would be issuing a C.O. to 127 Oak Lane in the next 5 to 7 days. David Dickey said “I don’t know”. Box 326, Cape Canaveral prior to the hearing? 2) The owner of 123 Oak Lane, Tim Turner, and myself, Bernard Lennon, 126 Oak Lane, both followed your instruction to stop Patrick T. Lee’s LLC from taking our property with a faulty survey. Why was Tim Turner granted a hearing to stop encroachment by Patrick T. Lee and I was denied a hearing? 3) What is required by me to be granted a public hearing on 127 Oak Lane violation of Section 110-297(a)(1),City Code? 4) Do I have a method to appeal your decision to ignore the signed/sealed surveys submitted by 123 Oak Lane, myself, and the one used by the City to locate the current right-of-way markers, when you instead choose to use the survey submitted by Patrick T. Lee that has been proven to be wrong? 5) Why are the current Right of Way markers on Oak Lane not being used? 6) What is the name of the surveyor who installed the original right-of-way markers and what is the name of the surveyor being used to relocate the right-of-way markers to match Patrick T. Lee’s faulty survey? 7) You mentioned that a hearing is required to move the right-of-way of Oak Lane. Will I be notified of the date and time of the hearing at least 30 days in advance to prepare a defense? 8) Since you insist on relocating everyone’s property line 12 feet north, what is required by me to remove the fence located between my property and Sea Spray Town homes and move it 12 feet north? 9) Since you have not yet determined where you are going to locate the new right-of-way, will you be issuing a Certificate of Occupancy to 127 Oak Lane prior to completing the preliminary engineering work to relocate Oak Lane? A hearing is scheduled for tomorrow evening before the City’s Board of Adjustment to consider a setback variance being requested by the owner of 127 Oak Lane. The City has a codified process for notification of land use actions. This notice provides the date, time and location of the board meeting so that interested property owners can speak on the issue. The process does not include sending out an individual notice to property owners regarding the outcome of a hearing. Yes, the setback matter will need to be remedied before a CO is issued. This code requires a minimum front setback to be 25 feet. This violation has been determined by using the "right of way markers" (ROW) installed by the City of Cape Canaveral on Oak Lane to define the (ROW) limits of Oak Lane Cape Canaveral, Florida. The (ROW) markers installed by the City of Cape Canaveral are in agreement with the survey I gave to Duree Alexander (Cape Canaveral Code Enforcement) and Michael German (Cape Canaveral Building Official) for the purpose of defending my property from encroachment by the Sheropa LLC. developer, prior to Sheropa LLC starting construction on 127 and 131 Oak Lane. The (ROW) markers installed by the City of Cape Canaveral are also in agreement with the surveying markers that the owner of 123 Oak Lane had to pay out of pocket for the purpose of defending their property from encroachment by the Sheropa LLC developer. This violation has created a cascade of problems. Sheropa LLC has removed asphalt and installed paver bricks and dug a large hole for installing utilities in the wrong location that is extending as much as 14 feet into Oak Lane's right of way. Because of this, the heavy volume of two-way construction traffic of large trucks caused by the Sheropa LLC development on Oak Lane has caused the trucks to veer towards my property and brush the low hanging power lines. I assume the rubber tires protect the drivers from electrocution. The large hole continues to remain open and unprotected for more than 6 months. On February 23, 2016 I received an e-mail from David Dickey (Community Development Director of Cape Canaveral) that stated "Please note that a Certificate of Occupancy will not be issued until this issue is resolved," and again on March 16 2016 "In my email to you on February 23rd, I explained the situation and assured you that a Certificate of Occupancy would not be issued until this issue was resolved." "You ask whether you will be informed of the outcome of this survey dispute and have a chance to have input or appeal. The affected parties will be notified of the results of the review." All of my attempts to resolve this issue have been ignored by David Dickey, and on 5/16/2016 he covertly issued a Certificate of Occupancy to 131 Oak Lane without informing me or informing the new owners of the violations. All 4 homes also have issues with elevation that can potentially cause problems with flooding and sewage backing up into their homes. By allowing these homes to be built into the right of way, the city is inferring that the right of way has been moved, thus changing my property lines, in effect stealing my property without notice or a hearing. Just because Patrick T. Lee is a former Mayor of Cape Canaveral does not give him the authority to confiscate a large portion of my property for his own financial gain or create safety hazards for the citizens of Cape Canaveral.
