IX. Pursuant to Section 110-33,Cape Canaveral Code,any party aggrieved by any final decision of the
Board of Adjustment shall have the right to appeal the final decision to the City Council. Any such
appeal must be filed with the City Manager within ten (10)calendar days of the date of the Board
of Adjustment's final decision. The City Manager shall schedule the appeal for the next regular City
Council meeting. The City Council shall hear and consider the appeal de novo and consider
evidence and testimony of any interested party. The Council shall have the right to either affirm or
reverse, in whole or in part,the decisions of the Board of Adjustment. The City Council's decision
shall be final and subject to appeal to a Court of Competent Jurisdiction.
FAILURE OF ANY AGGRIEVED PARTY TO APPEAL A DECISION OF THE BOARD OF
ADJUSTMENT TO THE CITY COUNCIL WITHIN TEN (10) CALENDAR DAYS SHALL BE
DEEMED A WAIVER OF THAT PARTY'S RIGHT TO JUDICIAL REVIEW AND THE BOARD

Special Exception Worksheet and Staff Analysis
All special exception recommendations and final decisions shall be based on the following
criteria to the extent applicable:
Land Use and Zoning
a. Is the requested SE consistent with the intent of the Comprehensive Plan?
Yes.
b. Is the requested SE consistent with the intent of the zoning district in which it is
sought? Yes.
c. Will the SE meet all the requirements of the zoning district in which the request is to
be located, such as: lot requirements, building setbacks, lot coverage, height, buffers,
off-street parking, signs, storage, landscaping, etc.? Yes.
Impact to surrounding properties
1. Is the proposed special exception compatible and harmonious with properties and
uses in the surrounding area? Explain why. Yes, ACE is in a commercial area and the
display area is on the south side of the building facing commercial uses.
2. Will the scale and intensity of the proposed special exception be compatible and
harmonious with adjacent land uses? Yes.
3. Will the traffic generated, volume and type, adversely impact land use activities in the
immediate vicinity? No.
4. Will the proposed special exception create any adverse impacts to other properties in
the surrounding area? Address the creation of noise, light, vibration, odor, stormwater
runoff, or other offsite impacts that would not have been created had the property been
developed as a principle use? No.
5. Will there be adequate screening, buffers, landscaping, open space, off-street parking,
other similar site improvements to mitigate any adverse impacts of the SE? Yes. The
property has the appropriate landscaping per code.
6. Will the size and shape of the site, the proposed access, internal circulation, and

The following report is a summary of the Community Development
Department's activities, projects, land-use applications, site plans, selected
construction projects, permitting statistics, code enforcement statistics and
board activities.
Please note that this is the first issue of the monthly report. Previously, the
reports were on a quarterly basis.
Community Development Department— Activities and special projects:
Community Redevelopment Agency — Staff is pursuing the creation of a
CRA. On June 1, 2010, a workshop was held with the City Council to discuss
approach to delineating boundaries of the CRA. After EAR submittal, staff will
readdress CRA boundaries based upon workshop input.
EAR based amendments — Amendments were approved for submittal to DCA
by the City Council on August 2, 2010.
Todd Morley was tasked with developing a sustainable peacock management
program. A community meeting will soon be held.
Concrete in the storm drain issue. The Public Works Department contracted
with an outside company to complete repairs on this code enforcement item.
The City Attorney's office is in charge of ensuring the City is reimbursed.

inspectors and plans examiners willing to work part-time or by contract to help
fill the need on an as-needed basis.
Todd and Duree Alexander updated the status of the Top 5 lists. (commercial
and residential).
Todd and Barry Brown attended all-day leadership training class.
Todd attended a FDEP / NPDES compliance audit with Jeff Ratliff re
stormwater management and improvement. One of the results of this meeting is
that, beginning now, the CDD will send an informational handout to each
commercial business regarding stormwater BMP's. We will send them with the
Local Business Tax renewals.
The Economic Development Council has engaged Brevard communities with
an initiative to streamline the site plan permitting process. Todd Morley
continues to represent our City. The group's goal is to identify best practices
and assist with implementation strategies, understanding that there is no "one-
size-fits-all" approach. Our relatively small size affords us efficiencies that
match many identified best practices. The completion of the "wish list" will
result in revised administrative procedures and/or recommendations for
ordinance changes and possible board consolidation.
The Outdoor Entertainment Event Permit Code was revised. Several events
have been processed. Recently, City Council requested staff re-visit this
chapter and include revisions related to:
• Tiered applications, fees and submittal deadlines, and
• Administrative approval of fee waivers and temporary alcohol service.
Other Cities ordinances are being studied for guidance.
6395 N. Atlantic Ave (old Azteca II Restaurant) — In January, the Code
Enforcement Board made a recommendation that Council authorize City
funding for the demolition of this property to remove an unsafe condition and
eyesore. Duree obtained written estimates from demolition contractors. Bids
range from $8,000 - $10, 500. City Council authorized the City Attorney to
seek permission from the courts to demolish the structure, however the property
owner is not barred from seeking a permit to repair.

Land use applications and site plans
ACE Hardware - Marvin Nichols has requested a special exception for
outdoor display at the ACE hardware. This will be heard by P&Z on August
11, 2010.
Puerto del Rio assisted living facility - On Thursday July 29 staff met with
Danny Ringdahl, developer of Puerto del Rio condominiums, regarding the
construction of an assisted living facility on an undeveloped portion of the
Puerto del Rio property. Mr. Ringdahl was accompanied by his business
consultant, architect, and engineer as well as representatives of a firm that
manages assisted living facilities. While this project has the potential to
provide a currently unavailable housing option, there are density, emergency
services, and other issues. Barry is in communication with DCA and will
determine what options exist to address the current density limitation.
Martin Marietta Materials Lot Split - Earlier this year, Ambassador Services,
Inc. (Randy May's aggregate storage facility) was sold to Martin Marietta
Materials, Inc. In an effort to expedite the sale, the property was sold in its
entirety with the understanding that a portion of the property would be returned
to Mr. May. A lot split application has been received that separates the
Ambassador Services building and surrounding grounds from the larger
aggregate operation. The application has been distributed to staff for review.
Mutter Annexation - Jack Mutter has requested that the City annex his
apartment complex at 315 Grant Ave. (corner of Ridgewood and Grant). Our
code does not call for the P&Z Board to make a recommendation as to whether
or not a property should be annexed, but it does call for the P&Z to recommend
a zoning classification for the property if it is annexed. On May 12, 2010 the
P&Z board recommended that the property be assigned an R-2 zoning
designation if annexed. The annexation request is scheduled to be heard by the
City Council on August 17, 2010.
Young Subdivision - The Young's want to split one residential lot into two.
They have submitted an application for a preliminary plat to subdivide the
property. The subdivision as proposed by the Young's will not meet our code
for length of a private drive which is limited to 200 ft. in length. The lot can be
reconfigured to meet code, but then it will not meet the Young's desired
configuration. Sandra Young submitted an application for a variance to allow a
private drive to be greater than 200 ft. in length. Upon review of the
application, the City Attorney determined that our code does not allow for a
variance to the length of a private drive. The preliminary plat was scheduled

for P&Z Board on August 11, 2010. However, without the possibility of a
variance, the lot will have to be reconfigured and this will postpone the hearing
with P&Z until at least August 25, 2010.
Status of selected construction projects
Monroe Carwash — The Board of Adjustment will meet Thursday August 5th
to discuss possible revisions to the Monroe Street (Kappernaros) Carwash
Special Exception. Mr. Kappernaros is requesting to be relieved of the
requirement to provide a sidewalk along the west (No. Atlantic) side of his
property. The right-of-way belongs to FDOT and they will only allow a
sidewalk constructed to their standards. There is not enough right-of-way width
to construct a sidewalk to FDOT standards so a sidewalk or other type of
pedestrian way cannot be built. Mr. Kappernaros is attempting to acquire the
right-of-way from FDOT so he can construct the sidewalk to City standards. It
may take 6 to 12 months to obtain the right-of-way, if at all. Therefore, the
Board Order needs to be amended so Mr. Kappernaros can receive a final
inspection.
Brighthouse Networks — Permit has been issued for a thorough updating of the
interior environment of the facility. Additionally the parking lot has been
repaired and a new dumpster pad and driveway approach have been completed
in accordance with City specs.
