RE. Encroachment ofresnlrnce under construction into the setback line
Dear Mr. CGarganese•
This firm represents Tim Bratcher with regard to the encroachment of the residential
home being constructed on the adjacent lot of John Dinsmore to the west of my client's
property which home encroaches into the side setback. Currently the east side of the home
lies within 3 ':_ feet from my client: property line. The residence under construction intrudes
5 or 6 feet into the side setback as stated in the city code. I have the following comments.
My client has informed code enforcement on numerous occasions and other officials
of the City of Cape Canaveral about the encroachment and has been told that the city cannot
take any action until my client has a survey showing the encroachment. One month ago, my
client delivered a current boundary survey of his property which shows the location of the
new construction on the Dinsmore tot adjacent to my client's property. After delivering the
survey to code enforcement, my client was advised that they could not take any action until
they were tole! to do so by the City Attorney.
In addition to the encroachment to the side setback, approximately two feet of fill has
been placed on the Dinsmore lot as a base for the residence under construction and in the
front portion of the lot. The recent rains have caused my client's property to be flooded and
it appears that the Dinsmore property does not have adequate drainage to prevent the water
cascading from the Dinsmore lot to my client's lot. Apparently the City has approved the
construction of 3;esidence which has inadequate drainage which also violates the city's code.
1 i2a ve enclosed a copy of the boundary survey prepared by Riehl Reliable, Inc.
Surveying & '\rapping and a copy, of the Dinsmore survey that was used by the city in
granting the permits to Dinsmore fol the construction of the residence. My client advises me
that John Walker of Walker Land Survey Inc., who prepared the survey of the Dinsmore
property, has -idmitted that his survey is incorrect and that the Riehl survey is correct. My
client intorm:: nne that he has made the city aware of these problems, particularly code
enforcement. since he saw Walker Surveying making the survey of the Dinsmore property
approximately one year ago.
All m client wants is that the city do its duty and make the builder of the residence
on the Dinsmore property comply with the code and ordinances of the City of Cape
Canaveral as everyone else is re ;,. le.: to do. The problems created by the construction of the
residence on the Dinsmore property has created serious problems for my client because of the
city's failure to insist on compliance with its code and ordinances.
Please instruct the city t_ expire Dinsmore to remove the residence from the side
setback and require the installation of an adequate drainage system to stop flooding of my
client's property as required by the code and ordinance of the city.
