HomeMy WebLinkAboutResolution No. 2016-14 RESOLUTION NO. 2016-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, BREYARD COUNTY, FLORIDA; APPOINTING AND REAPPOINTING MEMBERS TO THE PLANNING AND ZONING BOARD OF THE CITY OF CAPE CANAVERAL;PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Cape Canaveral, Florida, has by City Code Section 110-3 established a Board known as the Planning and Zoning Board; and WHEREAS, it is now incumbent upon the City Council of the City of Cape Canaveral to appoint a Member and reappoint Members to said Board. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL,BREYARD COUNTY,FLORIDA,AS FOLLOWS: Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby incorporated herein by this reference as a material part of this Resolution. Section 2. Appointment to Planning and Zoning Board pursuant to Section 2-171(e) of the Cape Canaveral City Code, the City Council of the City of Cape Canaveral hereby appoints the following individual to the Board indicated below: Albert Franks,Jr. shall be appointed to the Planning and Zoning Board,to serve until September 15, 2019. Following the completion of his first term,this appointee shall be eligible for reappointment to the Planning and Zoning Board for one additional term consistent with the limitations set forth in section 2-171(f), City Code. Section 3. Reappointment to Planning and Zoning Board pursuant to Section 2-171(e) of the Cape Canaveral City Code, the City Council of the City of Cape Canaveral hereby reappoints the following individuals to the Board indicated below: John Price and R. Lamar Russell shall be reappointed to the Planning and Zoning Board, to serve until September 15, 2019. Following completion of their second terms,these appointees may be eligible for reappointment to the Planning and Zoning Board for additional terms, if no other qualified applicants submit applications seeking appointment, consistent with the limitations set forth in section 2-171(f),City Code. Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. 1 City of Cape Canaveral Resolution No.2016-14 Page 1 of 2 Section 5. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 6. Effective Date.This Resolution shall become effective immediately upon adoption by the City Council of the City of Cape Canaveral, Florida. ADOPTED at a Regular Meeting of the City Council of the City of Cape Canaveral, Florida, assembled this 16th day of August, 2016.
