PRESENTATIONS:
Tape 1, 25
Tim Fadul, USA Waste Services, appeared before Council requesting a garbage collection contract
extension. Mr. Fadul explained that in return for an extension, the recently approved CPI increase will
be rescinded and residential rates held constant through 1999. Then, the CPI increases would be
reinstated at 85 percent. Council concurred to consider the contract extension at a future meeting. City
Attorney, Kohn Bennett, will review the proposed contract beforehand.
CONSIDERATIONS:
1. (Tape 1, 484) A motion was made by Mr. Randels and seconded by Mr. Bruns to approve the
July 1, 1997 Regular City Council Meeting Minutes. The motion passed 5-0, with voting as

2. (Tape 1, 568) A motion was made by Mayor Porter and seconded by Mr. Bruns to let for bid
the Procurement of a Pedestrian Bridge for the Drainage Ditch East of SR AIA. The motion
passed 5-0, with voting as follows: Mr. Bruns, For; Mr. Hernandez, For; Mr. Petsos, For;
Mayor Porter, For; and Mayor Pro Tem Randels, For.
(Pape i, 1 oo7) A motion was made by Mr. Hernandez and seconded by Mr. Bruns to award
Laboratory Cabinet Bid #97-01 to Laboratory Design and Supply, Inc., in the amount of
$26,984. Mr. Randels voiced that the award is not the low bid, stating for the record that the
low bid did not meet all the required bid specifications even though they exceeded in some
areas. The motion passed 5-0, with voting as follows: Mr. Bruns, For; Mr. Hernandez, For;
Mr. Petsos, For; Mayor Porter, For; and Mayor Pro Tem Randels, For.
4. (Pape 1, 1242) A motion was made by Mayor Porter and seconded to approve Annual Audit
Services with Bray, Beck & Koetter, in the amount of $23,825. The motion passed 5-0, with
voting as follows: Mr. Bruns, For; Mr. Hernandez, For; Mr. Petsos, For; Mayor Porter, For;
and Mayor Pro Tem Randels, For.
ORDINANCES:
(Tape 1,1445) A motion was made by Mr. Bruns and seconded by Mr. Hernandez to postpone
Ordinances 02-97 and 03-97, 210 Center Street Rezoning (TWC) August 5, 1997, as
requested by the City Clerk. The motion passed 5-0, with voting as follows: Mr. Bruns, For;
Mr. Hernandez, For; Mr. Petsos, For; Mayor Porter, For; and Mayor Pro Tem Randels, For.
DISCUSSION:
6. (Tape 1, 1466) Reuse Water Policy
City Manager, Bennett Boucher reported that the $75,000 reuse grant awarded by the St.
Johns Water Management District, has been finalized and there is one year allowed to expend
the allocated funds. He explained that Council must develop a formal policy for establishing
fees and distribution areas.
Council concurred that there shall be no monthly usage charge for reuse water.
There was extensive discussion regarding connection fees. Treatment Plant Supervisor, Walter
Bandish, reported that the approximate cost for installing the connector box ($550) and the
backflow preventer ($250) will be $800, depending on the size of the connecting pipe, which
could be substantially more.
Public Works Director, Ed Gardulski, explained that a policy must be set to prevent erroneous
precedent setting. He suggested establishing a time frame for providing reduced cost
installations. He further explained that reuse distribution is an expense and will never become a
revenue source. Therefore, the issue is how to minimize costs while ensuring that water
distribution is directed away from the river and providing an additional service to our residents.

Representatives of Cape Shore Condominiums were present and expressed interest in the
reuse. However, they qualified their interest by stating that it is cost prohibitive at $3,000 -
$6,000 for the installation.
Jim Morris, Aerospace Building representative, stated that they use an artesian well with five
two to four -inch lines that would cost $600 - $800 each to connect to reuse, making it cost
prohibitive to bear the cost.
Mayor Porter suggested that it might be most beneficial to target the largest users first, such as
businesses and condominiums along the west side of AIA. It would provide expeditious
installation and divert the most water from the river in the least amount of time.
Council requested that City Attorney, Kohn Bennett, research for case law on reuse water
connections.
Council concurred that Public Works Director, Ed Gardulski, present alternatives for the a
proposed Reuse Water Distribution/Connection Policy.
7. (Tape 2, 585) Skateboard Park
Mr. Petsos stated that he is supportive of continuing to pursue establishing a skateboard park.
He related that the Youth Advisory Committee will continue on the project. Mayor Porter
suggested that a grant be sought, possibly in a coordinated effort with the City of Cocoa Beach
and the County. Mr. Petsos was designated to speak with city and county representatives in
this regard. Council concurred that liability is the leading obstacle to providing a skateboard
facility and that it should be researched to determine how to circumvent the problem.
REPORTS:
City Manager - Bennett Boucher (Tape 2,1197)
Mr. Boucher reported that a Special Meeting to approve the Tentative Proposed Millage and a
Workshop Meeting to discuss the merits of a proposed C-2 zoning district need to be set.
Council concurred to set the meetings for July 29, 1997 at 4:00 p.m. Mr. Boucher explained that
budget alternatives will be provided at the meeting. Major George McGee stated that new vehicles
are required because there have been no replacement vehicles provided by the city in five years.
Council directed Mr. Boucher to research the matter. Mayor Porter opined that taxes should not be
increased this year due to the sewer utility rate increase, that it would be more appropriate to defer
the increase to fiscal year 1998/99. Mr. Petsos countered that the utility rate is scheduled to
increase again next year; the Canaveral Precinct of the Sheriffs Department operating budget will
increase by $65,000 - $70,000, plus capital equipment; and the COPS FAST Grant Deputy will no
longer be funded and will have to be paid by the city, as well as the new Lieutenant position.
Consequently, compelling a 50 percent millage increase next year. Mr. Boucher stated that if there
is no tax increase, reserves will have to be used. Council concurred to examine the affect of an .25
mills to Police Services.

• (Pape 2, 2581) Mr. Boucher reported that he met with the owner's representative of the Post Office
Building regarding reconstruction of Commerce Street. He related that hard costs need to be
determined before being able to negotiate a settlement agreement or proceed with a special
assessment. Mr. Boucher explained that a settlement agreement is the least costly for the affected
property owners, however it requires full payment up front. Whereas, a special assessment requires
additional costs, but the city would provide three year financing for construction, plus costs and
interest. Council concurred to proceed with soil borings and obtaining cost estimates (which would
be eventually passed on to the affected property owners).
• (Tape 2,2834) Mr. Boucher reported that commercial clamming in the Banana River begins on July
22, 1997.
• (Tape 2, 3163) Mr. Boucher reported that he and City Attorney, Kohn Bennett, met with Burt
Francis and Bill Bancroft of the Canaveral Port Authority regarding the Internal Improvement
Trust Fund (UTF) land lease. He related that there is no survey and no definitive ingress or
egress. He also reported that the Port related that they have plans for the property to the north and
do not want to forfeit riparian rights because we may have conflicting uses. Council concurred to
obtain a survey and request a 50/50 cost share with the Port.
Audience - John Pekar (Tape 2, 3163)
• Mr. Pekar reported that there is a Florida Department of Transportation workshop being held on
July 25, 1997 regarding a Stormwater Park Grant providing funds for mitigation which the city
might consider pursuing.
Canaveral Precinct - Major George McGee
• Major McGee reported that there is no law governing transients sleeping under crossovers. The
law only covers camping in tents or trailers. Council concurred that the City Attorney review case
law on the matter.
• Major McGee also reported that open container signs need to be placed at the crossovers.
Council concurred.
City Clerk - Sandra Sims

City Attorney - Kohn Bennett (Tape 2,3225)
• Mr. Bennett reported that Mr. Applegate did not follow up on the appeal that upheld the Building
Official's decision. He explained that demolition costs are probably very high. However, he stated
that he can bring estimates before Council at a closed meeting if directed. Council concurred to
have the City Attorney present possible alternatives regarding the Applegate case at a closed
meeting.

Mayor Pro Tem - Rocky Randels (Tape 2,3359)
• Mr. Randels reported that the Diamond Royale appears to be using the city's sewer without
paying. Wastewater Supervisor, Walter Bandish, stated that the sewer connection has been locked
and can not be used.
• Mr. Randels reported that the Sunrise Marina has opened and queried if they have paid sewer
impact fees. City Attorney, Kohn Bennett, responded that he and City Manger Boucher are
currently developing a solution to the issue of new businesses connecting to the sewer which will
be diverted before the year 2000.
• Mr. Randels queried if the city could receive a status report on the City of Cocoa Beach's Code
Enforcement Citation Program. Mr. Boucher will inquire.
Council Member - Buzz Petsos (Tape 2, 3656)
Mr. Petsos reported that the Police Athletic League is up and running at no cost to the cities. He
queried if they could use the Youth Center one night per week for the Explorers' Program? Council
concurred for approval.

Mayor Porter reported that a groundbreaking ceremony will be held on Friday, July 18, 1997 at the
corner of Polk Avenue and SR AIA to commence the AlA eastside sidewalk construction
project.

Requested Action:
That the City Council consider the type of reuse connections and who will pay the cost of installation.
Summary Explanation & Background:
Our Public Works Director, Ed Gardulski, has provided you with two memos outlining reuse connection and the
associated costs. Being that our FDEP permit requires that the city make efforts to expand reuse water use and
staff has budgeted $225,000 next year for Phase II, I would recommend that we allow both in -ground irrigation
and hose bib connections. Further, I would also favor the city paying all the hook-up charges less a $50
application/connection fee to be paid by the system user. _

At thQ time the City does not have any resolution
establishing fees for reuse connections and/or user fee. The
City's Code K Ordinances does allows for the cotleeLiou of
appropriate Ves to connect to the reuse system.

Ittacbed is a itemized list of cost associated with the
installnKon of reclaimed water services for a sdngle famiJy
residential home, The cost of each service varies due to the
5ize and dopth of Ube reclaimed water main, size of the service
line, equipnent and labor requived. Tho installation cost ran
from $604 to $1,092. The average cost per service is about $700.
Also attached is a Connection Foe Comparison sheet for
council review. For each City jisted are the connection foe and
moDWY rates for a siogle family residential unit. All the
Cities contacted stated that they experienced a Problem of
Potential reuse water customers not connecting to the system due
to " most. Of the connection fee, bonne, a reduced connection
fee wOs utilized. To off set construction and/or operating cost
a monthly rate in used. For a Comparison, the monthly rate was
extended for a thirty (30) Year period. The only city that may
he breaking even is Ormond Beach. All oLher reclaimed wate)--
sYstem are subsidized by the sewer rates and impact fees. All
"VjOs uhilined a monthly user rate. most Single famijjns prefe r
to Pay a monthly fee then an expensiva connection fee.
Council needs to make the determination of one of the
following type of reclaimed water connection fee which shall be
utilized within the City:
1. No Connection fee,
2. The customer pays the actual cost for installahlop,
wl)i(-.,h may range from $600 to $1 noo.
3. All customers poy a fixed fee for connection determined
by Council, i.e. $100, $200, $000, $400... $1,000.
A rate structure is detenmined by the size of the
service.
5.Single families pay a fixed connection fee and all

SUBJECT: Reclaimed Water Hose Bib Connection Policy
Council needs to make a determination on what type(s) of
reuse connection will be allowed; direct connection to an in -
ground irrigation system or hose bibs or both.
Direct connection to an in -ground irrigation system is one
Of two options. The City of Cocoa Beach is one reclaimed water
Provider in the area who restrict all connections to the system
to in --ground irrigation systems.
The advantages of this -type of connection policy is that it
greatly reduces the risk of a cross connection of the reclaimed
water system with the potable water system. For example, once
the system is installed underground and inspected there is little
risk of -the public tampering with the system and making a cross
connection.
The disadvantages of an in ground irrigation system is that
it restricts -the public from fully utili.2.ing reclaimed water for
Other permitted water conservation uses such as: washing a car,
boat, motor vehicle, sidewalks, drive ways and pressure cleaning
a building. In addition, potential reclaimed water customer who
may not be financial able to afford an in --ground irrigation
system, will. not be Permitted to connect to the system.
The second type of connection to the City's reclaimed water
system is through hose bibs in lieu of an in -ground irrigation
system. This type of connection is permitted by the Department
of Environmental Protection (DEP) Rule 62.--610.469(2), which
states: "Hose bibs shall be located in locked, below grade vaults
which shall- be labeled as being nonpot=able quality." There are
many variations of the enforcement of the DIIP rule. The City of
St. Petersburg require their customers to purchase from the City
a purple hose with a special connector to be utilized. The City
of Port Orange and Cocoa permit install a standard locking holes
Bib connection and irrigation stub out all within a single
underground box with a locking valve.
The advantages of a hose bib connection to the reclaimed
water system is that is allows the user by fully utilize water
conservation measures such as washing a car, boat, motor vehicle,
sidewalks, drive ways and pressure cleaning. A second advantage
is that it allows for potential customers, who can not afford to
install. an in --ground irrigation system, have reclaimed water
available.
The disadvantages of hose bid connection are that it
increases the risk public utilizing reclaimed water for nort
permitted uses such as children playing in the water and the
public mistaking reclaimed wager for potable water. These
probl ems can be minimized through a public education program and
by the City providing an inspection program. However, no
guarantees can be provided. Therefore, the customer should be
required to complete a Hold harmless Agreement as part of the
application for the connection to the reclaimed water system.
Council needs to make the determination of one of the
following types of reclaimed water connection which shall be
PL-rtnitted within the City:
1. In -ground irrigations systems only.
2. In -ground irrigations system or in -ground hose bid type
connection.
3. Both in --ground irrigations system and in -ground hose
bid type connection.

Attached for your consideration is a list of suggested budget amendments for fiscal quarter ended
June 30, 1997. Only those items representing a significant change in fiscal policy have been
adjusted.
GENERAL FUND
Revenues
We have realized a marked increase in Building Permit and Fines and Forfeiture revenue over
budget in amounts of $30,000 and $41,000, respectively.
A new account line item (001-334.9) was established to record the emergency management grant
with a budgeted amount of $39,163. Expenditures connected with this grant are recorded in the
appropriate capital accounts.
Storm Drainage/Debt Service Fund has been retired with the final balance of $21,700 being
transferred to General Fund Revenue. $20,000 is requested to be added to the Brevard County
sidewalk project to record new monies receivable from the county. The remainder of General Fund
Revenues is being collected within acceptable parameters with an overall collection percentage of
73%. The decrease in cash forward reflects the material decrease in reliance on reserves for this
fiscal year.

Expenses:
Administration - Due to retirement forfeitures in 1995-96 and the credit it generated, the
expenditure for 1996-97 retirement decreased significantly. Workers Compensation was also
billed at a lower rate than originally expected. This allowed a release of budgeted funds to provide
for an increase in activity in Contractual Services ($725) and Memberships and Training ($600).
Building - The Building Department had the opportunity to acquire a much needed "forfeited"
pick-up truck from the Sheriff's Department for a nominal price ($3,500). Excess budgeted funds
from Workers Compensation provided the funds needed to purchase this truck and offset the
unexpected increase in contracted services ($1,300) which increased along with Building
Department generated revenue. The balance of $530 will be used to purchase a fax machine.
Street - Again, the lower actual Workers Compensation ($5,345) along with decreased Utilities
($1,500) are requested to be reallocated to fund increased activity in Building and Grounds
Maintenance ($2,000), Equipment Maintenance ($2,000) and Street Repairs ($5,000) and offset
the increase in General Insurance ($5,650)
Parks and Recreation - Excess budgeted Workers Compensation funds ($3,620) along with
Special Events ($1,800) and Summer Recreation ($2,500), due to lack of participation in pool
splash, are requested to be reallocated to fund the replacement of roofs on utility shed and tennis
shelter ($2,890) and purchase a computer ($2,000). The balance ($3,030) would be returned to the
General Fund Reserves.
Community Development - It is requested that funds be diverted from Travel & Per Diem ($200),
Postage ($760), Operating Supplies ($400) and Membership and Training ($500) and a transfer of
$190 from General Fund Reserves to finance the completion of the marketing video.
Non -Departmental: Expenditures were less than budgeted for and it is requested that ($7,000)
from Special Pay, ($585) from Christmas Bonus, ($1,280) from Professional Services and
($37,325) from Transfers to Capital Improvements be returned to General Fund Reserves less
$20,000 held as contingency.
LIBRARY FUND
Revenues in excess of budget generated through Ad Valorem Taxes ($110) and Interest from
Investments ($2,250), are requested to offset increased expenditures in Insurance ($695) and
Operating Supplies ($1,665).

STORM DRAINAGE
This fund, as stated in the General Fund Revenue section of this memo, is being retired. It is
requested that Fund Balance ($21,700) be transferred to General Fund Reserves.
CAPITAL PROJECTS FUND
In order to cover the actual cost of (4) new police vehicles, ($615) is requested. $30,000 is
requested to provide needed funding for new sidewalks ($20,000 of this is to be provided by
Brevard County). ($6,640) is requested to offset expenditures required to complete renovation of
the restrooms at the ball field ($50,000 of this project was funded with a FRDAP Grant). To fund
these requirements, excess budgeted funds in Recreation ($22,065), Library Expansion ($37,520)
and Capital Equipment Administration ($14,995) will be used with the balance of $57,325 being
returned to General Fund Reserves.
CAPITAL EXPANSION
The Long Point Park project was not budgeted, but it is requested that $15,000 of Park and
Recreation's Contingency Funds be allocated.
Sewer Fund:
Reserves - The Sewer Enterprise Fund has profited well above expected returns on investments and
requests an increase in budget amount on Interest Income Expansion ($15,000) and Interest Income
Revenue ($10,000). Utility Service Termination Fees have also exceeded expectation, and it is
requested to raise budgeted figure by ($2,500). The new wastewater treatment facility completed
in December, 1996 required $321,380 more than projected to reach completion. An adjustment to
budget is requested to bring into line. The remainder of Sewer Enterprise Revenues are being
collected within acceptable parameters with an overall collection rate of 74%.
Expenditures: - Due to the increase in funds available and the activity of outfitting a new facility, it
is requested that excess funds in the following accounts be reallocated:
Special Pay ($14,800)
Retirement Contribution ($10,000)
Workers Compensation ($ 8,925)
Sludge Disposal Fees ($23,000)
Reallocation of the above funds would be to Utilities ($74,800) to cover costs of increased usage,
Facility Improvements ($4,250) to cover increased cost of lab cabinets and ($28,100) to fund the
purchase of (2) computers ($7,200) A flow meter ($1,900) and Boring/Compressor Equipment
($19,000). A planned return of funds to reserves in the amount of $33,555 completes this request.

Sewer - Non -Departmental - To start implementation of Phase H of the wastewater system,
($10,000) is requested. These funds will be matched by the St. Johns River Water Management
District up to $75,000 over the coming year. It is also requested that the balance of $254,900 be
budgeted for construction in progress to allot the needed funding to finish the project.
RECAP
At the close of the third quarter of our fiscal year, overall revenue collection is at an average of
77%, an increase over third quarter, 1996's 69%. A conservative fiscal policy has allowed a
return to reserves of $135,038 in General Fund and $33,555 in Sewer Enterprise Fund.

A RESOLUTION OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA SUPPORTING EFFORTS
TO PERSUADE PRESIDENT CLINTON TO DESIGNATE
THE ST. JOHNS RIVER AS AN AMERICAN HERITAGE
RIVER; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the 310 -mile long St. Johns River is the state's longest river and
creates a drainage basin that serves fully a fifth of the land area of Florida; and
WHEREAS, the St. Johns River is an economic backbone of communities all
along is course; and
WHEREAS, the St. Johns River holds a rich and diverse history as it served
Florida's native residents, Florida's settlers and the state's earliest tourists as a
transportation route; settlements of Florida as the river provided a cargo lifeline, an
almost limitless supply of water, rich flood plan soil for farming and habitat for fish and
wild game that served as a food source for Florida's pioneers; and
WHEREAS, the very nature of the St. Johns River helps shape a culture unique
to Florida; and
WHEREAS, the diverse nature of the river - from its marsh headwaters west of
Vero Beach to its mighty expanse where it meets the Atlantic Ocean in Jacksonville -
provides great recreational opportunities for Floridians and millions of visitors each year;
and
WHEREAS, the St. Johns River and its preservation is key to the quality of life
throughout northeast and central Florida;

NOW, THEREFORE, BE RESOVED BY THE CITY COUNCIL OF THE
CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, that:
SECTION 1. The City Council does hereby support the effort to designate the
St. Johns River as an American Heritage River.
SECTION 2. The City Council encourages all neighbors throughout the St.
Johns River Basin to also recognize the benefits they reap from this unique and beautiful
waterway.
SECTION 3. A copy of this resolution shall be forwarded to the St. Johns River
Water Management District.
SECTION 4. This resolution shall become effective immediately upon its
adoption.
DONE AND RESOLVED at a regular meeting of the City Council on the 5th
day of August , 1997.

110.482 ENTITLED "WIRELESS TELECOMMUNICATIONS
TOWERS AND ANTENNAS"; PROVIDING DEFINITIONS;
PROVIDING FOR PERMITTED LOCATIONS; PROVIDING
CONDITIONS FOR PERMITTED USES, ACCESSORY USES,
AND SPECIAL EXCEPTIONS; AND PROVIDING FOR
PERMITS AND LEASE AGREEMENTS; AND AMENDING
SECTION 110-354, SPECIAL EXCEPTIONS PERMISSIBLE
BY THE BOARD OF ADJUSTMENT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF PRIOR
INCONSISTENT ORDINANCES AND RESOLUTIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Federal Government, through the Federal Communications Commission
(FCC), has issued wireless communication licenses for personal communication services and other
wireless technologies in order for those license holders to provide wireless services throughout the
United States of America; and
WHEREAS, the demand by citizens for new wireless communications services has produced
an increased need for installations of wireless antennas and wireless communications facilities to serve
the public, including the citizens in the City of Cape Canaveral; and
WHEREAS, wireless communications facilities are supportive of the public health, safety and
welfare in that they provide useful portable communications services for personal convenience,
business and emergency purposes; and
WHEREAS, the FCC has required license holders to provide coverage to areas where
wireless communications licenses have been acquired; and
WHEREAS, the Federal Telecommunications Act of 1996 ("Act") preserves local zoning
authority to regulate wireless communication facilities; provided, however, that the Act states the
government may not unreasonably discriminate among wireless communications providers that
compete against one another and that government may not prohibit or have the effect of prohibiting
the provision of wireless communication services, and the Act gives the FCC sole jurisdiction over
radio frequency emissions of wireless communications facilities so long as the wireless
communications facilities meet FCC standards therefore; and
WHEREAS, additional wireless communications facilities may be required to provide quality
communication services to meet the growing needs of the public and businesses for wireless

communication; and
WHEREAS, wireless communications facilities should be reasonably regulated to minimize
potential aesthetic impacts to the surrounding area; and
WHEREAS, there is a need for new provisions in the zoning code to address the siting of
wireless communications facilities; and
WHEREAS, the City of Cape Canaveral has received or expects to receive requests to site
wireless communications towers and antennas within its municipal boundaries; and
WHEREAS, the City Council of the City of Cape Canaveral finds that it is in the public
interest to permit the siting of wireless communications towers and antennas within the municipal
boundaries of Cape Canaveral; and
WHEREAS, it is the intent of the City of Cape Canaveral to permit the siting of wireless
communications towers and antennas within the municipal boundaries of City of Cape Canaveral, as
lawfully regulated herein; and
WHEREAS, it is the intent of the City of Cape Canaveral to protect and promote the public
health, safety and welfare by regulating the siting of wireless communications towers and antennas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1. Section 110-354, Special Exceptions Permissible by Board of Adjustment, of
the Code of Ordinances is amended by amending subparagraph (c ) to add new clause (15) as follows:
110-354 (c ) Special exceptions may be granted for the following:...
(15) Telecommunications towers, subject to the provisions
of Section 110-482.
SECTION 2. Section 110-354(15) is hereby established and added to the City of Cape
Canaveral Code of Ordinances as follows
1. Purpose. The purpose of this ordinance is to establish general guidelines for the siting
of wireless communications towers and antennas. The goals of this ordinance are to: (1) protect
residential areas and land uses from potential adverse impacts of towers and antennas; (2) restrict
the location of towers in non-residential areas; (3) minimize the total number of towers throughout

the community; (4) strongly encourage the joint use of new and existing tower sites as a primary
option rather than construction of additional single -use towers; (5) encourage users of towers and
antennas to locate them, to the extent possible, in areas where the adverse impact on the community
is minimal; (6) encourage users of towers and antennas to configure them in a way that minimizes
the adverse visual impact of the towers and antennas through careful design, siting, landscape
screening, and innovative camouflaging techniques; (7) enhance the ability of the providers of
telecommunications services to provide such services to the community quickly, effectively, and
efficiently; (8) consider the public health and safety and welfare and the safety of communication
towers; and (9) avoid potential damage to adjacent properties from tower failure through engineering
and careful siting of tower structures. In furtherance of these goals, the City of Cape Canaveral shall
give due consideration to the regulations of this Ordinance, the City of Cape Canaveral's
comprehensive plan, zoning map and regulations, existing land uses, and environmentally sensitive
areas in approving sites for the location of towers and antennas.
Section 2. Definitions. As used in this ordinance, the following terms shall have the meanings
set forth below:
(a) "Alternative tower structure" means man-made trees, clock towers, bell steeples, light
poles and similar alternative -design mounting structures that camouflage or conceal
the presence of antennas or towers.
(b) "Antenna" means any exterior transmitting or receiving device mounted on a tower,
building or structure and used in communications that radiate or capture
electromagnetic waves, digital signals, analog signals, radio frequencies (excluding
radar signals), wireless telecommunications signals or other communication signals.
(c) "Backhaul network" means the lines that connect a provider's towers/cell sites to one
or more cellular telephone switching offices, and/or long distance providers, or the
public switched telephone network.
(d) "Collocation" means the location of two ormore antennas on a single tower or
structure.
(e) "FAA" means the Federal Aviation Administration.
(f) "FCC" means the Federal Communications Commission.
(g) "Height" means, when referring to a tower or other structure, the distance measured
from the finished grade of the parcel to the highest point on the tower or antenna,
including the base pad and any antenna.

(h) "Nonconforming towers and nonconforming antennas" means any tower or antenna
for which a building permit, special exception, or other development order has been
properly issued by the City prior to the effective date of this ordinance, including
permitted towers or antennas that have not yet been constructed so long as such
approval is current and not expired.
(i) "Personal Communication Services" is a relatively new technology of wireless voice,
video and data communication systems which are licensed by the Federal
Communications Commission over two new frequency bans as defined in the Federal
Telecommunications Act of 1996.
"Tower" means any structure that is designed and constructed primarily for the
purpose of supporting one or more antennas for telephone, radio and similar
communication purposes, including self-supporting lattice towers, guyed towers, or
monopole towers. The term includes radio and television transmission towers,
microwave towers, common -carrier towers, cellular telephone towers, alternative
tower structures, and the like. The term includes the structure and any support and
appurtenances thereto.
(k) "Wireless Communication" is the transmission and reception of voice, data or video
transmission via radio frequency (RF) signals through electromagnetic energy.
Section 3. Applicability.
(a) New Towers and Antennas. All new towers or antennas in Cape Canaveral shall be
subject to these regulations, except as provided in Sections 3(b) through (e), inclusive.
(b) Amateur Radio Station Operators/Receive Only Antennas. This ordinance shall not
govern any tower, or the installation of any antenna, that is under seventy (70) feet
in height and is owned and operated by a federally -licensed amateur radio station
operator or is used exclusively for receive only antennas.
(c) Nonconforming Towers or Antennas. Nonconforming towers and nonconforming
antennas shall not be required to meet the requirements of this ordinance, other than
the requirements of Sections 4(f) and 4(g).
(d) AM Array. For purposes of implementing this ordinance, an AM array, consisting of
one or more tower units and supporting ground system which functions as one AM

broadcasting antenna, shall be considered one tower. Measurements for setbacks and
separation distances shall be measured from the outer perimeter of the towers
included in the AM array. Additional tower units may be added within the perimeter
of the AM array by right. For purposes hereunder, AM or amplitude modulation shall
be defined as the encoding of a carrier wave by variation of its amplitude in
accordance with an input signal.
(e) Residential Use Antennas. This Ordinance shall not govern the installation of television
satellite antennas or other antennas used solely in conjunction with residential use as
defined and regulated by Section 110-478 of the Code of Ordinances of the City of
Cape Canaveral, Florida.
Section 4. General Requirements.
(a) Principal or Accessory Use. Antennas and towers may be considered either principal
or accessory uses. A different existing use of an existing structure on the same lot
shall not preclude the installation of an antenna or tower on such lot.
(b) Lot Size. For purposes of determining whether the installation of a tower or antenna
complies with zoning district development regulations, including but not limited to
setback requirements, lot -coverage requirements, and other such requirements, the
dimensions of the entire lot shall control, even though the antennas or towers may be
located on leased parcels within such lot.
(c) Inventory of Existing Sites. Each applicant for an antenna and/or tower shall provide
to the Building Official an inventory of its existing towers, antennas, or sites approved
for towers or antennas, that are either within the jurisdiction of the City of Cape
Canaveral or within one mile of the border thereof, including specific information
about the location, height, and design of each tower. The Building Official may share
such information with other applicants applying for administrative approvals or special
exceptions under this ordinance or other organizations seeking to locate antennas
within the jurisdiction of Cape Canaveral, provided, however that the Building Official
is not, by sharing such information, in any way representing or warranting that such
sites are available or suitable.
(d) Aesthetics. Towers and antennas shall meet the following requirements:
(1) Towers shall either maintain a galvanized steel finish or, subject to any
applicable standards of the FAA, be painted a neutral color so as to reduce
visual obtrusiveness.

(2) At a tower site, the design of the buildings and related structures shall, to the
extent possible, use materials, colors, textures, screening, and landscaping that
will blend them into the natural setting and surrpunding buildings.
(3) If an antenna is installed on a structure other than a tower, the antenna and
supporting electrical and mechanical equipment must be of a neutral color that
is identical to, or closely compatible with, the color of the supporting structure
so as to make the antenna and related equipment as visually unobtrusive as
possible.
(e) Lighting. Towers shall not be artificially lighted, unless required by the FAA or other
applicable authority. If lighting is required, the lighting alternatives and design chosen
must cause the least disturbance to the surrounding views.
(f) State or Federal Requirements. All towers must meet or exceed current standards and
regulations of the FAA, the FCC, and any other agency of the state or federal
government with the authority to regulate towers and antennas. If such standards and
regulations are changed, then the owners of the towers and antennas governed by this
ordinance shall bring such towers and antennas into compliance with such revised
standards and regulations within six (6) months of the effective date of such standards
and regulations, unless a different compliance schedule is mandated by the controlling
state or federal agency. Failure to bring towers and antennas into compliance with
such revised standards and regulations shall constitute grounds for the removal of the
tower or antenna at the owner's expense.
(g) Building Codes; Safety Standards. To ensure the structural integrity of towers, the
owner of a tower shall ensure that it is maintained in compliance with standards
contained in applicable state or local building codes and the applicable standards for
towers that are published by the Electronic Industries Association, as -amended from
time to time. I� upon inspection, the City of Cape Canaveral concludes that a tower
fails to comply with such codes and standards and constitutes a danger to persons or
property, then upon notice being provided to the owner of the tower, the owner shall
have thirty (30) days to bring such tower into compliance with such standards.
Failure to bring such tower into compliance within said thirty (30) days shall
constitute grounds for the removal of the tower or antenna at the owner's expense.
(h) Measurement. For purposes of measurement, tower setbacks and separation distances
shall be calculated and applied to facilities located in Cape Canaveral irrespective of
municipal and county jurisdictional boundaries.

(i) Not Essential Services. Towers and antennas shall be regulated and permitted
pursuant to this ordinance and shall not be regulated or permitted as essential services,
public utilities, or private utilities.
(j) Franchises. Owners and/or operators of towers or antennas shall certify that all
franchises required by law: for the construction and/or operation of a wireless
communication system in Cape Canaveral have been obtained and shall file a copy of
all required franchises with the Building Official prior to issuance of a building permit.
(k) Public Notice. For purposes of this ordinance, any special exception request, variance
request, or appeal of an administratively approved use shall require public notice to
all abutting property owners and all property owners of properties that are located
within the corresponding separation distance listed in Section 7(b)(5)(ii), Table 2, in
addition to any notice otherwise required by local and state law.
(1) Signs. No signs as defined in Section 94-1 shall be allowed on an antenna or tower.
(m) Buildings and Support Equipment. Buildings and support equipment associated with
antennas or towers shall comply with the requirements of paragraph 8.
(n) Multiple Antenna/Tower Plan. Cape Canaveral encourages the users of towers and
antennas to submit a single application for approval of multiple towers and/or antenna
sites. Applications for approval of multiple sites shall be given priority in the review
process.
Section 5. Permitted Uses.
(a) General. The uses listed in this paragraph are deemed to be permitted uses and shall
not require administrative approval or a special exception.
(b) Permitted Uses. The following uses are specifically permitted:
(1) Antennas or towers located on property owned, leased, or otherwise
controlled by the City of Cape Canaveral provided a license or lease
authorizing such antenna or tower has been approved by the City Council of
Cape Canaveral.
Section 6. Administratively Approved Uses.

(a) General. The following provisions shall govern the issuance of administrative
approvals by the Building Official for towers and antennas.
(1) The Building Official may administratively approve the uses listed in this
paragraph 6.
(2) Each applicant for administrative approval shall apply to the Building Official
providing the information set forth in Sections 7(b)(1) and 7(b)(3) of this
ordinance and a nonrefundable fee as established by the City Council to
reimburse Cape Canaveral for the costs of reviewing the application.
(3) The Building Official shall review the application for administrative approval
and determine if the proposed use complies with paragraphs 4, 7(b)(4) and
7(b)(5) of this ordinance.
(4) The Building Official shall respond to each such application within sixty (60)
days after receiving a fully completed application by either approving or
denying the application. If the Building Official fails to respond to the
applicant within said sixty (60) days, then the application shall be deemed to
be approved.
(5) In connection with any such administrative approval, the Building Official
may, in order to encourage shared use, administratively waive any zoning
district setback requirements in Section 7(b)(4) or separation distances
between towers in Section 7(b)(5) by up to fifty percent (50%).
(6) In connection with any such administrative approval, the Building Official
may, in order to encourage the use of monopoles, administratively allow the
reconstruction of an existing tower to monopole construction.
(7) If an administrative approval is denied, the applicant shall file an application
for a special exception pursuant to Section 7 prior to filing any appeal that
may be available under the Zoning Ordinance.
(b) List of Administratively Approved Uses. The following uses may be approved by the
Building Official after conducting an administrative review:
(1) Locating antennas on existing structures or towers consistent with the terms
of subsections (a) and (b) below.

(a) Antennas on existing structures. Any antenna which is not attached
to a tower may be approved by the Building Official as an accessory
use to any commercial, industrial, professional, institutional, or multi-
family structure of eight or more dwelling units, provided:
(i) The antenna does not extend more than thirty (30) feet above
the highest point of the structure;
(ii) The antenna complies with all applicable FCC and FAA
regulations; and
(iii) The antenna complies with all applicable building codes.
(b) Antennas on existing towers. An antenna which is attached to an
existing tower may be approved by the Building Official and, to
minimize adverse visual impacts associated with the proliferation and
clustering of towers, collocation of antennas by more than one carrier
on existing towers shall take precedence over the construction of new
towers, provided such collocation is accomplished in a manner
consistent with the following:
(i) A tower which is modified or reconstructed to accommodate
the collocation of an additional antenna shall be of the same
tower type as the existing tower, unless the Building Official
allows reconstruction as a monopole.
(ii) Height
(a) An existing tower may be modified or rebuilt to a taller
height, not to exceed thirty (3 0) feet over the tower's
existing height, to accommodate the collocation of an
additional antenna.
(b) The height change referred to in subsection (ii)(a) may
only occur one time per communication tower.
(c) The additional height referred to in subsection (ii)(a)
shall not require an additional distance separation as
set forth in Section 7. The tower's premodification

height shall be used to calculate such distance
separations.
(iii) Onsite location
(a) A tower which is being rebuilt to accommodate the
collocation of an additional antenna may be moved
onsite within fifty (50) feet of its existing location.
(b) After the tower is rebuilt to accommodate collocation,
only one tower may remain on the site.
(c) A relocated onsite tower shall continue to be measured
from the original tower location for purposes of
calculating separation distances between towers
pursuant to section 7(b)(5). The relocation of a tower
hereunder shall in no way be deemed to cause a
violation of Section 7(b)(5).
(d) The onsite relocation of a tower which comes within
the separation distances to residential units or
residentially zoned lands as established in Section
7(b)(5) shall only be permitted when approved by the
Building Official.
(2) Installing a cable microcell network through the use of multiple low -powered
transmitters/receivers attached to existing wireline systems, such as
conventional cable or telephone wires, or similar technology that does not
require the use of towers.
Section 7. Special Exceptions (M-1 Zoning District Only).
(a) General. The following provisions which shall govern the issuance of special
exceptions for towers or antennas:
(1) If the tower or antenna is not a permitted use under paragraph 5 of this
ordinance or permitted to be approved administratively pursuant to paragraph
6 of this ordinance, then the construction of a tower or the placement of an
antenna is only permitted on real property with an M-1 Zoning District
designation.

(2) Applications for special exceptions under this Section shall be subject to any
applicable procedures and requirements of the Zoning Ordinance, except as
modified in this paragraph.
(3) In granting a special exception, the Board of Adjustment may impose
conditions to the extent the Board of Adjustment concludes such conditions
are necessary to minimize arof adverse effect of the proposed tower on
adjoining properties.
(4) Any information of an engineering nature that the applicant submits, whether
civil, mechanical, or electrical, shall be certified by a licensed professional
engineer.
(5) An applicant for a special exception shall submit the information described
both in this paragraph and Section 110-46 and a non-refundable fee as
established by the City Council to reimburse Cape Canaveral for the costs of
reviewing the application.
(b) Towers.
(1) Information required. In addition to any information required for applications
for special exceptions pursuant to the Zoning Ordinance, applicants for a
special exception for a tower shall submit the following information:
(i) A scaled site plan (no greater than one inch to fifty feet) clearly
indicating the location, type and height of the proposed tower,
on-site land uses and zoning, adjacent land uses and zoning
(including when adjacent to other municipalities),
Comprehensive Plan classification of the site and all properties
within the applicable separation distances set forth in
paragraph 7(b)(5), adjacent roadways, proposed means of
access, setbacks from property lines, elevation drawings of the
proposed tower and any other structures, topography,
parking, and other information deemed by the Building Official
to be necessary to assess compliance with this ordinance.
Legal description of the parent tract and leased parcel (if
applicable).

The setback distance between the proposed tower and the
nearest residential unit, platted residentially zoned properties,
and unplatted residentially zoned properties.
(iv) The separation distance from other towers described in the
inventory of existing sites submitted pursuant to Section 4(c)
shall be shown on an updated site plan or map. The applicant
shall also identify the type of construction of the existing
tower(s) and the owner/operator of the existing tower(s), if
known.
(v) A landscape plan showing specific landscape materials.
(vi) Method of fencing, and finished color and, if applicable, the
method of camouflage and illumination.
(vii) A description of compliance with Sections 4(c), (d), (e), (f),
(g), 0), (1), and (m), 7(b)(4), 7(b)(5) and all applicable federal,
state or local laws.
(viii) A notarized statement by the applicant as to whether
construction of the tower will accommodate collocation of
additional antennas for future users.
(ix) Identification of the entities providing the backhaul network
for the tower(s) described in the application and other cellular
sites owned or operated by the applicant in the municipality.
(x) A description of the suitability of the use of existing towers,
other structures or alternative technology not requiring the use
of towers or structures to provide the services to be provided
through the use of the proposed new tower.
(xi) A description of the feasible location(s) of future towers or
antennas within Cape Canaveral based upon existing physical,
engineering, technological or geographical limitations in the
event the proposed tower is erected.
(2) Factors Considered in Granting Special Exceptions for Towers. In addition

to any standards for consideration of special exception applications pursuant
to the Zoning Ordinance, the Board of Adjustment shall consider the
following factors in determining whether to issue a special exception, although
the Board of Adjustment may waive or reduce the burden on the applicant of
one or more of these criteria if the Board of Adjustment concludes that the
goals of this ordinance are better served thereby:
(i) Height of the proposed tower;
Proximity of the tower to residential structures and residential
district boundaries;
(iii) Nature of uses on adjacent and nearby properties;
(iv) Surrounding topography;
(v) Surrounding tree coverage and foliage;
(vi) Design of the tower, with particular reference to design
characteristics that have the effect of reducing or eliminating
visual obtrusiveness;
(vii) Proposed ingress and egress; and
(viii) Availability of suitable existing towers, other structures, or
alternative technologies not requiring the use of towers or
structures, as discussed in Section 7(b)(3) of this ordinance.
(3) Availability of Suitable Existing Towers, Other Structures, or Alternative
Technology. No new tower shall be permitted unless` the applicant
demonstrates to the reasonable satisfaction of the Board of Adjustment that
no existing tower, structure or alternative technology that does not require the
use of towers or structures can accommodate the applicant's a proposed
antenna. An applicant shall submit information requested by the Board of
Adjustment related to the availability of suitable existing towers, other
structures or alternative technology. Evidence submitted to demonstrate that
no existing tower, structure or alternative technology can accommodate the
applicant's proposed antenna may consist of any of the following:
(i) No existing towers or structures are located within the

geographic area which meet applicant's engineering
requirements.
Existing towers or structures are not of sufficient height to
meet applicant's engineering requirements.
Existing towers or structures do not have sufficient structural
strength to support applicant's proposed antenna and related
equipment.
(iv) The applicant's proposed antenna would cause electromagnetic
interference with the antenna on the existing towers or
structures, or the antenna on the existing towers or structures
would cause interference with the applicant's proposed
antenna.
(v) The fees, costs, or contractual provisions required by the
owner in order to share an existing tower or structure or to
adapt an existing tower or structure for sharing are
unreasonable. Costs exceeding new tower development are
presumed to be unreasonable.
(vi) The applicant demonstrates that there are other limiting factors
that render existing towers and structures unsuitable.
(vii) The applicant demonstrates that an alternative technology that
does not require the use of towers or structures, such as a
cable microcell network using multiple low -powered
transmitters/receivers attached to a wireline system, is
unsuitable. Costs of alternative technology that exceed new
tower or antenna development shall not be presumed to render
the technology unsuitable.
(4) Setbacks. The following setback requirements shall apply to all towers for
which a special exception is required; provided, however, that the Board of
Adjustment may reduce the standard setback requirements if the goals of this
ordinance would be better served thereby:
(i) Towers must be set back a distance equal to at least seventy-five
percent (75%) of the height of the tower from any adjoining lot line.

(ii) Guys and accessory buildings must satisfy the minimum zoning district
setback requirements.
(5) Separation. The following separation requirements shall apply to all towers
and antennas for which a special exception is required; provided, however,
that the Board of� Adjustment may reduce the standard separation
requirements if the goals of this ordinance would be better served thereby.
(i) Separation from off-site uses/designated areas.
(a) Tower separation shall be measured from the base of the tower
to the lot line of the off-site uses and/or designated areas as
specified in Table 1, except as otherwise provided in Table 1.
(b) Separation requirements for towers shall comply with the
minimum standards established in Table 1.

Separation distances between towers.
(a) Separation distances between towers shall be applicable for
and measured between the proposed tower and preexisting
towers. The separation distances shall be measured by
drawing or following a straight line between the base of the
existing tower and the proposed base, pursuant to a site plan,
of the proposed tower. The separation distances (listed in
linear feet) shall be as shown in Table 2.

(6) Security fencing. Towers shall be enclosed by security fencing not less than
six feet in height and shall also be equipped with an appropriate anti -climbing
device; provided however, that the Board of Adjustment may waive such
requirements, if the goals of this Ordinance are better served thereby and the
public health, safety, -and welfare is not adversely affected by such waiver.
(7) Landscaping. In addition to any other applicable landscaping requirements in
the Zoning Ordinance, the following requirements shall also govern the
landscaping surrounding towers for which a special exception is required;
provided, however, that the Board of Adjustment may waive such
requirements if the goals of this ordinance would be better served thereby.
(i) Tower facilities shall be landscaped with a buffer of plant materials
that effectively screens the view of the tower compound from
property used for residences. The standard buffer shall consist of a
landscaped strip at least four (4) feet wide outside the perimeter of the
compound.
(ii) In locations where the visual impact of the tower would be minimal,
the landscaping requirement may be reduced or waived by the Board
of Adjustment if the goals of this Ordinance would be better served
thereby.
(iii) Existing mature tree growth and natural land forms on the site shall be
preserved to the maximum extent possible. In some cases, such as
towers sited on large, wooded lots, natural growth around the
property perimeter may be sufficient buffer.
Section 8. Equipment Cabinets and Accessory Structures.
(a) Antennas Mounted on Structures or Rooftops. The equipment cabinet or structure
used in association with antennas shall comply with the following:
(b)
(1) The cabinet or structure shall not contain more than thirty square feet (36') of
gross floor area or be more than six feet (6) in height.
(2) Equipment storage buildings or cabinets shall comply with all applicable
building codes.

(b) Antennas Mounted on Utility Poles or Light Poles. The equipment cabinet or
structure used in association with antennas shall be located in accordance with the
following:
(1) In residential districts, the equipment cabinet or structure may be located:
(i) In a rear or side yard provided the cabinet or structure is no greater
than six feet (6) in height or thirty-six square feet (36) of gross floor
area and shall otherwise conform to the requirements of Section 110-
468 as an accessory structure.
(ii) The structure or cabinet shall be screened from view.
(2) In commercial or industrial districts the equipment cabinet or structure shall
be no greater than six feet (6) in height or thirty-six square feet (36) in gross
floor area and shall otherwise conform to the requirements of Section 110468
as an accessory structure. The structure or cabinet shall be screened from
view.
Section 9. Removal of Abandoned Antennas and Towers. Any antenna or tower that is not
operated for a continuous period of twelve (12) months shall be considered abandoned, and the
owner of such antenna or tower shall remove the same within ninety (90) days of receipt of notice
from the City of Cape Canaveral notifying the owner of such abandonment. Failure to remove an
abandoned antenna or tower within said ninety (90) day shall be grounds to remove the tower or
antenna at the owner's expense. If there are two or more users of a single tower, then this provision
shall not become effective until all users cease using the tower.
Section 10. Nonconforming Uses.
(a) Not Expansion of Nonconforming Use. Towers or antennas that are constructed, and
antennas that are installed, in accordance with the provisions of this ordinance shall
not be deemed to constitute the expansion of a nonconforming use or structure.
(b) Preexisting towers. Nonconforming towers or antennas shall be allowed to continue
their usage as they presently exist. Routine maintenance shall be permitted on such
nonconforming towers or antennas. New construction other than routine maintenance
on a nonconforming tower or antenna shall comply with the requirements of this
ordinance.

(c) Rebuilding_ Damaged or Destroyed Nonconforming Towers or Antennas.
Notwithstanding paragraph 9, bona fide nonconforming towers or antennas that are
damaged or destroyed may be rebuilt without having to first obtain administrative
approval or a special exception and without having to meet the separation
requirements specified in Sections 7(b)(4) and 7(b)(5). The type, height, and location
of the tower onsite shall be of the same type and intensity as the original facility
approval. Building permits to rebuild the facility shall comply with the then applicable
building codes and shall be obtained within 180 days from the date the facility is
damaged or destroyed. If no permit is obtained or if said permit expires, the tower
or antenna shall be deemed abandoned as specified in paragraph 9.
(d) Collocation. To accommodate collocation, nonconforming towers may add additional
antennas (belonging to the same carver or other carrier) subject administrative review
pursuant to paragraph 6 of this Ordinance.
(e) Repair. Nothing in this Ordinance shall be deemed to prevent the strengthening or
restoring to a safe condition of any nonconforming tower or antenna or part thereof
declared to be unsafe by the Building Official or any other City official authorized
to protect the public, health, safety, and welfare.
Section 11. Repeal of Prior Inconsistent Ordinances and Resolutions. All ordinances and
resolutions or parts of ordinances and resolutions in conflict herewith are hereby repealed to the
extent of the conflict.
Section 12. Incorporation Into Code. This ordinance shall be incorporated into the Cape
Canaveral City Code and any section or paragraph number or letter and any heading may be
changed or modified as necessary to effectuate the foregoing.
Section 13. Severability. Should any section or provision of this ordinance, or any portion
hereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the remainder hereto as a whole or part
thereof to be declared invalid.
Section 14. Effective Date. This ordinance shall become effective immediately upon adoption
by the City Council of the City of Cape Canaveral, Florida.

FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1. Section 10-1, Definitions, of the Code of Ordinances is hereby amended
by the deletion of the definition for Earth station antenna, and adopting a new definition for
Antenna and Satellite Dish, as follows:
Antenna means any exterior transmitting or receiving device mounted on
a tower, building or structure and used in communications that radiate or capture
electromagnetic waves, digital signals, analog signals, radio frequencies
(excluding radar signals), wireless telecommunications signals or other
communication signals.
Satellite dish means any device incorporating a reflective surface that is
solid, open mesh, or bar configured that is shallow dish, cone, horn, or cornucopia
shaped and is used to transmit and/or receive electromagnetic signals. This
definition is meant to include, but is not limited to, what are commonly referred to
as satellite earth stations, TVROs, and satellite microwave antennas.
SECTION 2. Section 110-478, Earth Station Antennas, of the Code or Ordinances is
hereby repealed in its entirety, and the following is adopted in lieu thereof:
Sec. 110-478. Residential use antennas/satellite dishes.
Residential use antennas shall mean the residential or personal, noncommercial use of
any of the following:
(i) a ground - or building - mounted receiver - only radio or TV antenna;
(ii) a ground - or building - mounted citizens band radio antenna;
(iii) a ground - or building - mounted panel antenna with a face area of less than four
and one-half (4 1/2) square feet;
(iv) a ground - or building - mounted satellite dish antenna less than ten (10) feet in
diameter.
Installation of the foregoing antennas shall comply with the following restrictions:
(a) No owner, occupant or tenant of any residential use property shall erect, construct
or install any antenna, or satellite dish antenna over one (1) meter or thirty-nine
(39) inches in diameter or on a mast in excess of twelve (12) feet in height
without first obtaining a permit from the building official.
(b) Prior to the issuance of any permit for the erection, construction or installation of
any antenna, the building official shall require an approved design placement
drawing and engineering specifications, signed and sealed by an engineer licensed
in the state, to meet all city and state laws and ordinances relating to attachment
and anchoring to achieve compliance with one hundred ten (110) mile per hour
wind zone requirements as referred in Chapter 16, Section 1606 of the Standard
Building Code.
(c) All materials that make up the installation of such antennas and supporting
structures shall be of a non -corrosive material to prevent metal fatigue from
maintenance neglect.
(d) No earth station antenna exceeding one (1) meter or thirty-nine(39) inches in
diameter shall be mounted onto the top of side of any single-family building
duplex or triplex.
(e) Earth satellite dish antennas in excess of one (1) meter or thirty-nine (39) inches
in diameter shall be allowed only in the rear or side yard in all zoning districts.
Placement shall not be allowed in the front yard of any lot or parcel in any zoning
district. Compliance with the side setback is required. The rear setback should be
complied with, except when compliance prevents installations.
(f) All electrical installations for the purpose of erection of antennas shall be in
accordance with the electrical code adopted in Section 82-116 and all applicable
city ordinances. Installation of all antennas shall not be within ten (10) feet
horizontally of any overhead power transmission line.
(g) In all zones, ground -mounted earth station antennas shall be erected at the
minimum height which allows satellite reception, not to exceed seven (7) feet in
R-1 and R-2 zones and twenty-two (22) feet in all other zones. The measurement
shall be calculated from the established grade to the dish center.
(h) The maximum outside diameter allowed for a dish receiver is ten (10) feet, and
only one (1) satellite dish antenna exceeding one (1) meter or thirty-nine (39)
inches in diameter shall be allowed on any lot or parcel of land.
(i) Any ground -placed antenna drive mechanism, less than six (6) feet high to its
lowest point, shall be fenced or screened by a six (6) foot high fence at least
eighty (80) percent opaque at its base.
SECTION 3. SEVERABILITY. If any section, paragraph, phrase, or word of
this Ordinance is held to be unconstitutional or invalid, such portion shall not affect the
remaining portions hereof, and it shall be construed to have been a legislative intent to
pass this Ordinance without such unconstitutional or invalid part.
SECTION 4. CONFLICTING PROVISIONS. Any ordinance or resolution, or
parts of an ordinance or resolution, in conflict herewith are repealed.
SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect
immediately upon its adoption.

Attached for your consideration is a list of suggested budget amendments for fiscal quarter ended
June 30, 1997. Only those items representing a significant change in fiscal policy have been
adjusted.
GENERAL FUND
Revenues
We have realized a marked increase in Building Permit and Fines and Forfeiture revenue over
budget in amounts of $30,000 and $41,000, respectively.
A new account line item (001-334.9) was established to record the emergency management grant
with a budgeted amount of $39,163. Expenditures connected with this grant are recorded in the
appropriate capital accounts.
Storm Drainage/Debt Service Fund has been retired with the final balance of $21,700 being
transferred to General Fund Revenue. $20,000 is requested to be added to the Brevard County
sidewalk project to record new monies receivable from the county. The remainder of General Fund
Revenues is being collected within acceptable parameters with an overall collection percentage of
73%. The decrease in cash forward reflects the material decrease in reliance on reserves for this
fiscal year.

Expenses:
Administration - Due to retirement forfeitures in 1995-96 and the credit it generated, the
expenditure for 1996-97 retirement decreased significantly. Workers Compensation was also
billed at a lower rate than originally expected. This allowed a release of budgeted funds to provide
for an increase in activity in Contractual Services ($725) and Memberships and Training ($600).
Building - The Building Department had the opportunity to acquire a much needed "forfeited"
pick-up truck from the Sheriffs Department for a nominal price ($3,500). Excess budgeted funds
from Workers Compensation provided the funds needed to purchase this truck and offset the
unexpected increase in contracted services ($1,300) which increased along with Building
Department generated revenue. The balance of $530 will be used to purchase a fax machine.
Street - Again, the lower actual Workers Compensation ($5,345) along with decreased Utilities
($1,500) are requested to be reallocated to fund increased activity in Building and Grounds

Parks and Recreation - Excess budgeted Workers Compensation funds ($3,620) along with
Special Events ($1,800) and Summer Recreation ($2,500), due to lack of participation in pool
splash, are requested to be reallocated to fund the replacement of roofs on utility shed and tennis
shelter ($2,890) and purchase a computer ($2,000). The balance ($3,030) would be returned to the
General Fund Reserves.
Community Development - It is requested that funds be diverted from Travel & Per Diem ($200),
Postage ($760), Operating Supplies ($400) and Membership and Training ($500) and a transfer of
$190 from General Fund Reserves to finance the completion of the marketing video.
Non -Departmental: Expenditures were less than budgeted for and it is requested that ($7,000)
from Special Pay, ($585) from Christmas Bonus, ($1,280) from Professional Services and
($37,325) from Transfers to Capital Improvements be returned to General Fund Reserves less
$20,000 held as contingency.
LIBRARY FUND
Revenues in excess of budget generated through Ad Valorem Taxes ($110) and Interest from
Investments ($2,250), are requested to offset increased expenditures in Insurance ($695) and
Operating Supplies ($1,665).

STORM DRAINAGE
This fund, as stated in the General Fund Revenue section of this memo, is being retired. It is
requested that Fund Balance ($21,700) be transferred to General Fund Reserves.
CAPITAL PROJECTS FUND
In order to cover the actual cost of (4) new police vehicles, ($615) is requested. $30,000 is
requested to provide needed funding for new sidewalks ($20,000 of this is to be provided by
Brevard County). ($6,640) is'requested to offset expenditures required to complete renovation of
the restrooms at the ball field ($50,000 of this project wasfunded with a FRDAP Grant). To fund
these requirements, excess budgeted funds in Recreation ($22,065), Library Expansion ($37,520)
and Capital Equipment Administration ($14,995) will be used with the balance of $57,325 being
returned to General Fund Reserves.
CAPITAL EXPANSION
The Long Point Park project was not budgeted, but it is requested that $15,000 of Park and
Recreation's Contingency Funds be allocated.
Sewer Fund:
Reserves - The Sewer Enterprise Fund has profited well above expected returns on investments and
requests an increase in budget amount on Interest Income Expansion ($15,000) and Interest Income
Revenue ($10,000). Utility Service Termination Fees have also exceeded expectation, and it is
requested to raise budgeted figure by ($2,500). The new wastewater treatment facility completed
in December, 1996 required $321,380 more than projected to reach completion. An adjustment to
budget is requested to bring into line. The remainder of Sewer Enterprise Revenues are being
collected within acceptable parameters with an overall collection rate of 74%.
Expenditures: - Due to the increase in funds available and the activity of outfitting a new facility, it
is requested that excess funds in the following accounts be reallocated:
Special Pay ($14,800)
Retirement Contribution ($10,000)
Workers Compensation ($ 8,925)
Sludge Disposal Fees ($23,000)
Reallocation of the above funds would be to Utilities ($74,800) to cover costs of increased usage,
Facility Improvements ($4,250) to cover increased cost of lab cabinets and ($28,100) to fund the
purchase of (2) computers ($7,200) A flow meter ($1,900) and Boring/Compressor Equipment
($19,000). A planned return of funds to reserves in the amount of $33,555 completes this request.

Sewer - Non -Departmental - To start implementation of Phase H of the wastewater system,
($10,000) is requested. These funds will be matched by the St. Johns River Water Management
District up to $75,000 over the coming year. It is also requested that the balance of $254,900 be

RECAP
At the close of the third quarter of our fiscal year, overall revenue collection is at an average of
77%, an increase over third quarter, 1996's 69%. A conservative fiscal policy has allowed a
return to reserves of $135,038 in General Fund and $33,555 in Sewer Enterprise Fund.

Attached for your consideration is a list of suggested budget amendments for fiscal quarter ended
June 30, 1997. Only those items representing a significant change in fiscal policy have been
adjusted.
GENERAL FUND
Revenues:
We have realized a marked increase in Building Permit and Fines and Forfeiture revenue over
budget in amounts of $30,000 and $41,000, respectively.
A new account line item (001-334.9) was established to record the emergency management grant
with a budgeted amount of $39,163. Expenditures connected with this grant are recorded in the
appropriate capital accounts.
Storm Drainage/Debt Service Fund has been retired with the final balance of $21,700 being
transferred to General Fund Revenue. $20,000 is requested to be added to the Brevard County
sidewalk project to record new monies receivable from the county. The remainder of General Fund
Revenues is being collected within acceptable parameters with an overall collection percentage of
73%. The decrease in cash forward reflects the material decrease in reliance on reserves for this
fiscal year.

Expenses:
Administration - Due to retirement forfeitures in 1995-96 and the credit it generated, the
expenditure for 1996-97 retirement decreased significantly. Workers Compensation was also
billed at a lower rate than originally expected. This allowed a release of budgeted funds to provide
for an increase in activity in Contractual Services ($725) and Memberships and Training ($600).
Building - The Building Department had the opportunity to acquire a much needed "forfeited"
pick-up truck from the Sheriff's Department for a nominal price ($3,500). Excess budgeted funds
from Workers Compensation provided the funds needed to purchase this truck and offset the
unexpected increase in contracted services ($1,300) which increased along with Building
Department generated revenue. The balance of $530 will be used to purchase a fax machine.
Street - Again, the lower actual Workers Compensation ($5,345) along with decreased Utilities
($1,500) are requested to be reallocated to fund increased activity in Building and Grounds
Maintenance ($2,000), Equipment Maintenance ($2,000) and Street Repairs ($5,000) and offset
the increase in General Insurance ($5,650)
