SUBJECT: City Council Agenda Item
Bid Award for Plumbing Services
On June 2 , 1998, the City Advertised for Plumbing Services
for the installation and testing of Back Flow Devices within the
City. The Plumber shall provide the correct type and size of
back flow devise for each residential and or commercial potable
water service, install, test and provide certification for each
device installed. Work will be divided into three phases each
having the following estimated quantities: Phase I 50 units,
Phase II 250 units and Phase III 100 units. The bid quantities
are for evaluation purposes only. Actual quantities are subject
to change. A copy of the advertisement was mailed or faxed to
Plumbers in the area.
Bid opening was on July 14 at 3 : 00 PM at the City Hall
Annex. The City received only one Bidder, Petro Plumbing
Services, Inc. City Staff performed a background check and found
that Petro Plumbing Services meets the requirements of the bid
specifications. Petro Plumbing has performed work for the City
of Cocoa Beach; Water Reclamation and the City of Cocoa; Water
Utilities.

located in Central Brevard County on the Bast Coast of Florida.

The undersigned PROPOSER has carefully examined the Contract Documents, and is
familiar with the nature ans extent of the services required. The undersigned agrees to perform the
requested service, in the manner prescribed therein, in accordance with The Contract Documents.
Pctro Plumbing Services, Inc. (Petro) shall provide the correct type and size of backflow
device required for each residential and/or commercial potable water service. Petro will further
install, test and provide certification for each device installed. All work orders shall be completed
within five (5) working days or less following issuance by The City. Petro understands that no
further wort:orders will be issued if the completion of these work orders becomes delinquent. Petro
further understands that additional wort: orders issued by The City while previous work orders
remain incomplete, will be granted to the second plumber selected by the bid process.
Petro agrees to supply Wilkins and Watts backflow assemblies as specified by The City, to
install same in industry standard boxes, also supplied by Petro, and to provide initial certification
for these devices, copies of such certifications to be sent to The City of Cape Canaveral, The City
of Cocoa, and also to the property owner. All work performed will be in compliance with applicable
local, state and federal laws pertaining to the work specified, and will be completed in a
workmanship manner.

1. The contract will be effective immediately upon approval by the City Council.
2. Terms, conditions and rates proposed are binding for 120 days from July 14th, 1998.

Dear Ms. Sims,
Petro Plumbing is pleased to submit the attached bid in response to your request number 98-08
for the purpose of installing and certifying various backflow assemblies throughout your service area.
We have served the Space Coast area plumbing needs for the past thirty-four years. Currently
we have within our organization, a backflow division comprising three employees who were set up to
respond to the growing needs of the Cocoa Beach water reclamation program. At this time, we are
recertifying approximately five hundred backflow assemblies annually, as well as performing any
necessary repairs. In addition, we are installing, certifying, and recertifying backflow assemblies in
other communities in Brevard County. Additionally, during the years 1995 and 1996, we were selected
to recertify all industrial backflow installations within the City of Cocoa water service area.
In order to maintain efficiency in this program, we have installed a proprietary computer
database, which maintains a complete record of all backflow assembly devices in our area and flags
the upcoming backflow assemblies for recertification. At this time, we are adding the City of Cocoa
water meter serial numbers to our database in order to insure accuracy in our records. During the past
year, we have almost single-handedly brought the backflow assemblies in the Cocoa Beach area into
a state of timely recertification.
The three certified backflow assembly testers in our backflow division are all currently certified
by FW&PCOA. The equipment they have at their disposal includes Watts TK-9A and Midwest 850
test meters which are all currently certified.
By this letter and the enclosed documents, we certify that we fiilly qualified and prepared to
complete all the work as outlined in your request. We look forward to being the successful bidders and
serving the City of Cocoa in this regard.

Petro has continued to lead the way in the City's recertification program in order to keep all backflow
devices in timely compliance with the City's ordinances. Currently maintaining approximately seven hundred

DRUG-FREE G'ORKPLACE CERTIFICATION
IDENTICAL, TIE BIDS - In accordance with F.S. 287.087, preference shall be
given to businesses with drug-free workplace programs. Whenever two or more
bids which are equal with respect to price, quality, and service are received
by the State or by any political subdivision for the procurement of commod-
ities or contractual services, a bid received from a business that certifies
that it has implemented a drug-free workplace program shall be given
preference in the award process. Established procedures for processing tie
bids .will be followed if none of the tied vendors have a drug-free workplace
program. In order to have a drug-free workplace program, a business shall:
1. Publish a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is
prohibited in the workplace and specifying the actions that will be taken
against employees for violations of such prohibition. '
2. Inform employees about the dangers of drug abuse in the workplace, the
business's policy of maintaining a drug-free workplace, any available drug
counseling, rehabilitation, and employee assistance programs., and the
penalties that may be imposed upon employees for drug abuse violations.
3. Give each employee engaged in providing the commodities or contractual
services that are under bid a copy of the statement specified in sub-
section (1) .
4. In the statement specified in subsection (1) , notify the employees that,
as a condition of working on the commodities or contractual services that
are under bid, the employee will abide by the terns of the statement and
will notify the employer of, any conviction of, or plea of guilty or nolo
contendere to, any violation of chapter 893 or of any controlled substance
law of the Untied States or any state, for a violation occurring in the
workplace no later than five (5) days after such conviction.
5. Impose a sanction on, or require the satisfactory participation in a drug
abuse assistance or rehabilitation program if such is .available in the
employee's community, by any employee who is so convicted.
6. Make a good faith effort to continue to maintain a drug-free workplace
through implementation of this section.

Requested Action:
That the City Council consider approval of the tentative proposed millage rate.
NOTE: Once these rates are adopted, they can only be lowered, not raised.
Summary Explanation&Background:
Staff is recommending we stay with the current adopted millage rate of 1.6139 mills for 1998, which is
1.9134% over the roll back rate of 1.5836.
The City Council may wish to increase the police tax to .6650 mills to cover the $26,400 increase in the
operating budget. Now would be the time to do so; this would be an 8.4298% increase over the roll back rate.
This figure can be reduced later in the budget process.
Please advise.

A RESOLUTION ADOPTING A TENTATIVE PROPOSED
MILLAGE RATE FOR THE LEVY OF AD VALOREM
TAXES FOR 1998 ON ALL TAXABLE PROPERTY
LOCATED WITHIN THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the electors approved in the 1985 referendum election the construction,
maintenance and operation of a library by ad valorem taxes; and
WHEREAS, the electors approved in the 1986 referendum election the imposition of ad
valorem taxes for beautification projects; and
WHEREAS, the electors approved in the 1990 and 1994 referendum elections the
imposition of ad valorem taxes for Fire/Rescue Services; and
WHEREAS, the electors approved in the 1990 and 1994 referendum elections the
imposition of ad valorem taxes for Police Protection; and
WHEREAS,the City wishes to impose said ad valorem taxes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape
Canaveral,Brevard County,Florida, as follows:
Section 1. The total millage for all City operating purposes is 1.6139 mills on the
dollar of taxable value for the 1998/1999 fiscal year for the City of Cape Canaveral, Florida.
This millage is a 1.9134 %increase from the rolled back rate of 1.5836.
Section 2. The City of Cape Canaveral, Brevard County, Florida, hereby adopts and
imposes a tentative proposed millage rate of .4504 mill for the Beautification Dependent

Special District, as approved in the 1.986 referendum election. This tentative ad valorem tax shall
be levied upon the 1998 Tax Assessment Roll for ad valorem tax on all taxable property located
within the City of Cape Canaveral and is to be used for the City's fiscal year beginning October
1, 1998 and ending September 30, 1999.
Section 3. The City of Cape Canaveral, Brevard County, Florida, hereby adopts and
imposes a tentative proposed millage rate of .0385 mill for the Library Dependent Special
District, as approved in the 1985 referendum election. This tentative ad valorem tax shall be
levied upon the 1998 Tax Assessment Roll for ad valorem tax on all taxable property located
within the City of Cape Canaveral and is to be used for the City's fiscal year beginning October
1, 1998 and ending September 30, 1999.
Section 4. The City of Cape Canaveral, Brevard County, Florida, hereby adopts and
imposes a tentative millage rate of .5000 mill for Fire/Rescue Service General Operating
NUage, as approved in the 1990 and 1994 referendum elections. This tentative ad valorem tax
shall be levied upon the 1998 Tax Assessment Roll for ad valorem tax on all taxable property
located within the City of Cape Canaveral and is to be used for the City's fiscal year beginning
October 1, 1998 and ending September 30, 1999.
Section 5. The City of Cape Canaveral, Brevard County, Florida, hereby adopts and
imposes a tentative millage rate of .6250 mill for Police Protection General Operating
Mi_ 'llage, as approved in the 1990 and 1994 referendum elections. This tentative ad valorem tax
shall be levied upon the 1998 Tax Assessment Roll for ad valorem tax on all taxable property
located within the City of Cape Canaveral and is to be used for the City's fiscal year beginning
October 1, 1998 and ending September 30, 1999.
Section 6. This Resolution shall become effective immediately upon its adoption.

A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA; APPOINTING TWO REGULAR MEMBERS TO
THE BEAUTIFICATION BOARD OF THE CITY OF CAPE
CANAVERAL, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Cape Canaveral, Florida, has by Ordinance
No. 11-68 created a Board known as the Beautification Board of the City of Cape Canaveral,
Florida; and
WHEREAS, it is now incumbent upon the City Council of the City of Cape
Canaveral to appoint two Regular Members to said Board.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape
Canaveral, Florida, as follows:
SECTION 1. Nancy "Kacee" Corbin is hereby appointed as a Regular Member of the
Beautification Board of the City of Cape Canaveral, Florida, with a term to expire on November
1, 2000.
SECTION 2. Jean Simoes is hereby appointed as a Regular Member of the Beautification
Board of the City of Cape Canaveral, Florida, with a term to expire on November 1, 1999.
SECTION 2. This Resolution shall take effect immediately upon its adoption.

JULY 1998
Two hundred thirty six children from pre-school age to 3,d grade students
participated in the Easter Egg Hunt held at Canaveral City Park on April 1 1 th.
(see attached report)
The Health & Safety Fair was held on the Cape View Elementary School
grounds on April 25th (see attached report)
The semi-annual fishing contest was held on May 16th at Freddie Patrick Park,
Port Canaveral. (see attached report)
Our annual Spring Filing Racquetball Tournament was held on May 1, 2 and
3rd. (see attached report)
The attendance at the Youth Center dropped off dramatically during the past
quarter. The Center has been open since the end of the school year from noon
till 5:00 p.m., Monday through Friday. We're still searching for a qualified person
to fill the Recreation Leader position and reopen the center on Friday &
Saturday evenings and Saturday afternoon. Attendance for April, 316, May, 168
and June 189. A new air hockey game was purchased for the Center last
month.
Summer Recreation activities began in June. Very capable members of staff
conducted arts & Crafts. Our tennis pro has contracted to teach a special
junior's clinic. Movies are being donated by Movies `n' More for the Friday
afternoon free showing - staff is supervising.
Fourteen students from the Canaveral Taekwondo class participated in the
Taekwondo World championship in Little Rock, Arkansas in June. Several came
back with nice trophies, including our staff member, Delores Latherow who
came in 2nd in the world in her division. We are extremely proud of her
achievements.
Upcoming events: continuation of summer activities and classes through July.
In August the fall program will be set and ready for printing and distribution by
September 1 St.

HEALTH & SAFETY FAIR REPORT Jle
The Health.'& Safety Fair was held at Cape View Elementary School from 9
a.m.-12 noon on Saturday, April 2-5, 1998.
The Cape Canaveral Volunteer r Fire Department had the ladder truck on site
and ninety-six people went through the Fire Safety Training Facility, Goldie
Gus made an appearance,
The Brevard County Sheriff's Department was present with the following units:

Canine Unit
Finger Printing
Robot Car
Bicycle Patrol
From the Canaveral Precinct, Ernie Perry was present with a variety of
information on community policing efforts, water safety and a video and
information on skin cancer.
Barbara Meyer from Brevard Metropolitan Planning Agency conducted the
Bicycle Safety Rodeo, assisted by Recreation. Department staff members.
.Members from the VFW Auxiliary were present for Lite-A-Bike and to assist
Cape Canaveral C.Q.P. S with bicycle registration.. The .Auxiliary also donated
four bicycle safety helmets (added to the four purchased by the Recreation
Department) and conducted the drawings for give-aways.
Blockbuster Video provided a great public service with their Kidprint video
taping,
Health First was present with information on cancer, Lifeline and free blood
pressure checks. The American Cancer Society also had an information table.
Trash Bash participants joined us at various times and Vice Mayor Petsos,
Councilmembers Hernandez and Bruns and Mayor Randels cooked hot dogs
for everyone to enjoy.
Attendance was estimated at approximately 125-150 people.

The following is a summary of the Building Department's accomplishments and
on-going projects during the 2nd quarter of 1998.
CODE ENFORCEMENT ISSUES:
• Posted (34) 72 hour towing notices on inoperable/unregistered vehicles; (21)
vehicles in compliance (due to removal by owner or towing by City; (13)
vehicles awaiting compliance time.
• (6) contractors/property owners began work without the required permits.
They were advised of permitting requirements.
• Received/responded to (60) citizen complaints: (38)written, (8) phone, and
(14)walk-in.
• (4) businesses were inspected prior to issuance of new occupational license.
• Greg attended (3) Brevard County Address Assignment Committee Meetings
in Viera.
• Greg worked (2) Saturdays on weekend enforcement program.
• Greg passed the SBCCI Building Inspector's exam.
• Steve passed the SBCCI Zoning & Property Standards exam.

• The department purchased a new digital camera system and a color printer to
assist in report generation, map making, and other information services. The
camera, an Olympus D-500L, can take up to 24 digital photographs, that can
be downloaded onto any personal computer. The camera system also has an
edit/delete feature to allow a person operating in the field to scan and delete
unwanted photos.
• The department purchased a new Hewlett Packard DeskJet 11200 color
printer.
• Staff assisted and prepared (2)proposed ordinances that were transmitted to
City Council after recommendation by the Planning &Zoning Board.
• The department held and attended (18) pre-application meetings for site
plans and community appearance board activities.
• Steve attended (5) Community Appearance Board meetings.
• Greg is continuing the citizen awareness letter which is published in the Cape
Press.
• The Code Enforcement Board held (27) Public Hearings and (10) Compliance
Hearings.
PLANNING ISSUES:
• The Community Appearance Board approved the following applications:
Wingate Hotel- sign; Cape Canaveral Professional Center- sign; an office
building at 160 Polk Avenue; a single family residence at 610 Manatee Bay
Drive; a retail building at 8699 Astronaut Blvd.; a single family residence at
620 Madison Avenue; an ATM at 8625 Astronaut Blvd.; and a change to AJT
building facade at 8910 Astronaut Blvd.

• The Planning&Zoning Board recommended approval of(2)proposed
ordinances. The P &Z Board approved a site plan for Sea Era Segundo
Townhomes; recommended approval of special exception to allow vehicle
rentals at 6799 N. Atlantic Avenue (Cape Florist property); recommended
approval of special exception for outside storage behind 190 Center Street;
approved a site plan for Jetty Maritime Park; and approved a site plan for The
Wingate Hotel.
• The Local Planning Agency held (3) meetings to review the proposed
revisions to the Comprehensive Plan and recommended transmittal of the
Ordinance 18-98 to City Council.
• The Code Enforcement Board held (27) Public Hearings and (10) Compliance
Hearings.
• The Board of Adjustments approved (2) special exceptions.
BUILDING ISSUES:
The department issued (160) permits with a total construction valuation of
$1,663,323.00.
The department assessed $27,891.00 in permitting fees. (To date 97/98 FY
$214,663.00).
The department assessed $7,868.00 in sewer impact fees.
The departmental staff finaled (108) permits.
The departmental staff issued (13) Certificates of Occupancy.
The departmental building inspectors performed (160) inspections of permitted
projects. Inspections are ongoing to final old permits still on active status.
The department issued (1) Unsafe Structure Notice at the beach end of Eberwein
Road.

OTHER ISSUES:
• The department is assisting the Public Works Dept. in the Beautification of
Oak Lane and the installation of re-use water.
• The department is re-structuring the proposed ordinance relating to
landscaping point values to include required grading of trees.
• Department staff established a date for the next city auction (Aug. 22) and
prepared auction list of items and instruction sheet for bidders which was
recently approved by City Council.
• The department is actively working with Brevard County Sheriff s
department on issues pertaining to vagrants and vandalism.

RECLAIMED WATER
1. The Budgeted Lift Station Telemetry System approved by City
Council has been purchased and installation is in operation.
Data Flow Systems are providing training for staff.
2 . The City advertised the Phase II & III Reclaimed Water
project. Bid Opening was on April 15, 1998 @ 3 :05 . City
Council awarded the bid to Dial Communication on May 5 . The
Contractor is finalizing material approval with the design
Engineer of record, Hartman and Associates. Contractor
waiting for notice to Proceed.
3 . The cleaning and relining of Phase I of the sewer collection
system Received has been completed.
4 . For the quarter, 42 . 4 Million Gallons of treated water was
discharged to the River. 49.46 Million Gallons of reuse have
been utilized within the distribution system.
Cocoa Beach averaged 53. 6 Million Gallons.
Note: A very dry quarter with record high temp.
5 . Applied for SJRWMD grant funding for phase II & III reuse
projects. The City received $100,000 in grant funding
pending contract adoption scheduled for June. The City of
Cape Canaveral was the only City in Brevard County to
receive funding. City Council approved the Cost sharing
agreements with SJRWMD on June 2 .
6. The City has advertised for plumbing services for the
installation and testing of back flow devices. Bid Opening
is scheduled for July 14 , 1998 at 3:00 PM. Scheduled for
City Council approval July 21 .
7 . Total Reclaimed water connection to date: 41
Quarterly Report, April, May & June 1998
STREET DIVISION
I . Scheduled to begin the annual sidewalk installation program
in April. Target area of the prime path will be along
Atlantic Ave. Also staff will be making necessary sidewalk
repairs as requires throughout the City.
2 . Columbia Ave Street Lamps located along the medians have
been refurbished.
3. Performed repairs to crossovers due to safety hazards, i.e.
Lincoln, & Jackson. The City now has a second Handicap
crossover for beach access located at Buchanan Ave.
4 . Brazilian pepper tree removal from Manatee Park is
completed. Scheduled to plant 250 trees this fall. Waiting
for cooler weather.
5 . Special event activities: 4th of July, Memorial Day, and
Wednesday Friends Day.
6 . The New Patriots Park completed. Installed play equipment,
sidewalk, fencing, irrigation system and landscaping.
7 . Due to the lack of rain and record high temp for this
quarter, staff increased the hand-watering schedule of
trees.
8. The Beach restoration by the Corp of Engineers is complete.
Forward final punch list to the Port Authority for damaged
beach crossovers.
BEAUTIFICATION

Job Descriptions
Job Descriptions are completed for submittal to City Council for consideration.
Salary Survey and Classification Plan
The General Employees' Salary Survey was prepared using three methods and none were
sufficient according to Department Head committee review. Department Heads generally believe
that the Florida League of Cities salary survey for municipalities under 10,000 is not the true
"market."Further, using beachside communities with populations between 6,000 and 10,000 still
did not reflect organizations of real similarity. Conclusively, the true market of where city
employees may be recruited to or from are not likely to be similar in organizational structure, tax
base, or population.
Therefore, we have used the Florida League of Cities Cooperative Survey for 1998 of
populations under 10,000 even though positions and job descriptions are not "perfect" matches.
The Salary Survey and Classification Plan is complete will be submitted to City Council in
August.
Technology
We are anticipating to eventually expand the document scanning station to network and encompass

The Deputy Clerk scheduled Condo Association Meetings for City Council Members.

The Deputy Clerk assembled orientation packets for new Board members: Jean Simoes,

Enforcement Board.
Employee Newsletter
The next Employee Newsletter is scheduled for August. Please feel free to submit articles for
better communication with employees.
Elections
Candidate Packets are prepared and two incumbents, Burt Bruns and Buzz Petsos have filed to
declare their candidacy and begin campaigns.
There are two three-year term seats and one one-year term seat on the ballot in November, as
well as the referendum issue concerning elections.
Ordinance Codification
Supplement No. 5 has been distributed. All ordinances are now being forwarded to Municipal
Code by Email as they are adopted. This process will expedite the publishing time requirements
Risk Management
One bicycle accident occurred on North Atlantic Avenue at the sidewalk construction site by La
Cantina, across from Harbor Heights. The person logged a complaint, but has not submitted
medical evidence to prompt a claim. Photographs were taken immediately to document the
incident. The cyclist proceeded through the construction area, rather than detouring around it.

Brevard County Clerks' Association
The city clerk and Deputy Clerk normally attend monthly meetings; occasionally there are
circumstances that disallow both of us from attending. However, we remain active in the
association.

The city clerk attends monthly BPPRM meetings.
Human Resources
The city clerk completed the Human Resource Course at UCF. Classes and topics covered are
tremendously informative. They are: Management Practices, Benefits and Compensation,
Training and Development and Selection and Placement.
The city clerk is a member of the Florida Public Personnel Managers Association. The annual
conference is held in July, however, I will not attend this year.
International Institute of Municipal Clerks
The city clerk continues involvement on the International Relations Committee.

As of the month of June, 1998, there were a total of 6.275
family units in the City of Gape Canaveral . These include 1 ,599
single family and 4,676 multi-family units. There were 42 rear
load and 151 front load commercial customers and 7 permanent
roll off customers. No new commercial accounts were generated.
April 1 , 1998 through June 30, 1998 the number of documented
concerns from the city total 27 . They are broken down as

reviewing the cases and approval is expected -

Sub): QUARTERLY REPORT
The last three months have been eventful, to say the least. We answered 367 calls, 23 were
providing mutual aid to surrounding communities. 4026 hours of Volunteer service were used to help
accomplish these tasks. In addition to answering these calls, we have been in the process of moving
and opening our new training center. Two weeks ago we received our official training certification
from the United States Coast Guard. In addition to the above, we have tried to carry on our normal
duties in a professional and orderly manner.
I would like to take a few moments to inform you of a project that we have undertaken. It
was suggested to me, that since we have the Volunteer manpower, we should purchase and build a
brush truck. We started looking for a truck on Monday,June 22, and located one on Wednesday,
June 24, in Starke, Florida. Our next step was to find a way to finance this project. On Thursday,
June 24, after hearing of our financial needs, Mr. William Bennix delivered a check for $5000. On
Friday, 2 personnel and Dexter, from Canaveral Auto Clinic, went to Starke and drove home our new
brush truck. The Volunteers and paid personnel worked side by side for 6 days to convert this vehicle
to a fire fighting brush truck. This vehicle was then dispatched to Mims one minute after being placed
into service. We would like to recognize the following for their support and donations to place this
unit in service:
• Mr. William Bennix, Harold Hunter, Canaveral Auto Clinic, Sunshine Welding,
• Mid Florida Freezers, Stan's Hardware,Judy Norton PAFB DRMO, Sunrise Marina,
• Canaveral Port Authority Maintenance Division and Cocoa Beach Fire Department
It should be noted that this vehicle was the only brush vehicle available for the last 7 days in
the central area and has seen its share of fire. On Saturday,July 4, the vehicle's pump went out of
service due to extensive service at approximately 7 p.m. Our personnel worked on this pump until 4
a.m. to place the vehicle back in service. A special thanks goes to Volunteer FF/EMT Brian Bibbo,
FF/1st REP Fred Ross, and Volunteer Lt. FF/EMT Al Studt, for accomplishing the above task. A
final note on this vehicle is that it is a multi-purpose vehicle, the tank and pump are removable,
making it extremely useful for hauling foam and for hurricane recovery.

period. We are currently applying to FEMA for reimbursement. The additional cost for fuel, food

DUI/Possession of a Controlled Substance/Carrying a Concealed Firearm
On the above listed date, Charlie Squad deputies initiated a traffic stop for Failure to
Maintain a Single Lane. Further investigation resulted in the arrest of the driver for DUI.
A search of the vehicle subsequent to arrest revealed controlled substances along with a
9MM pistol underneath the seat. The subject was arrested for the above listed charges.

Kidnapping/Battery
On 12 April, 1998 at approximately 2:20 A.M., a Charlie Squad deputy, while on routine
patrol, observed a truck entering a landfill area. He thought this was suspicious and
followed the vehicle, with his lights blacked out. Once the vehicle stopped, the deputy
used his blue lights and engaged the driver. The deputy observed that the driver was calm

and collected, but the female passenger was visibly upset. He separated the two and
discovered that the female had just been kidnapped and threatened with her life. The
suspect was taken into custody and charged with kidnapping and battery.

Injured/Ill Person
On the above listed date, an Alpha Squad deputy was flagged down while patrolling the
area of Cherie Down Park in Cape Canaveral. The deputy was informed that a male was
unconscious in the men's room at Cherie Down Park. The deputy immediately forwarded
the call to Brevard County Fire & Rescue, and administered C.P.R. until they arrived on
scene. The subject was treated and transported to Cape Canaveral Hospital.

Arrest for Escape/Fugitive Warrant
Bravo Squad deputies responded to the area of Buchanan Avenue and AIA in Cape
Canaveral in reference to a suspicious person. A white male was observed walking toward
the rear of a closed bank during late evening hours. The subject was identified; further
investigation revealed an outstanding fugitive warrant. The suspect fled while the deputy
was attempting handcuffing procedure. After a brief foot chase, the suspect was
apprehended, arrested and transported to the Brevard County Detention Center.

26 April, 1998
Attempted Murder/Aggravated Battery
On the above listed date, Echo Squad deputies responded to a report of a shooting in the
area of Monroe and Orange Avenues. Upon arrival, deputies learned that two black males
had been shot. Witnesses were located and interviewed. Deputies learned that the shots
came from the direction of a white Dodge Neon which was last seen heading south on
Magnolia toward Cocoa Beach. Both victims were transported to Cape Canaveral Hospital
Emergency Room for treatment. One suspect sustained a gunshot would to the face, the
other sustained a gunshot wound to the shoulder. A crime scene was established and
maintained until Agents Barker and Goodyear arrived to assume the investigation. After
extensive interview and investigation, this case was later closed by arrest.

Battery
A Bravo Squad deputy responded to the parking lot of a Circle K Store in reference to a
report of a man who had been beaten. The deputy learned that the victim had been
punched in the face several times and that his head had been slammed against the concrete
parking lot. This apparently occurred after the victim had asked the suspect to stop going
through his personal belongings, which were located in a basket on the victim's bicycle.
The suspect was located sitting on the front porch of his residence. The suspect was
arrested for battery of the victim. Further investigation revealed an outstanding warrant for
the arrest of the suspect.

Aggravated Stalking
On the above listed date, Bravo Squad deputies met with a female who reported that her
former boyfriend had been stalking her. This was the second report of stalking initiated by
the victim, initially she did not wish to press charges. The victim learned through a mutual
friend that her former boyfriend intended to kill her, which prompted her second report.
The suspect was located in Cocoa and transported to the Canaveral Precinct where he
confessed to all incidents of stalking and aggravated stalking. The suspect was arrested
and transported to the Brevard County Detention Center where he was placed on a suicide
watch.

Possession of Cannabis, more than 20 Grams/Possession of Cannabis with Intent to
Deliver/Possession of a Controlled Substance(Cocaine)/Possession of Drug Paraphernalia
While on routine patrol, a Charlie Squad deputy observed a vehicle traveling slower than
the flow of traffic. The vehicle was stopped for failure to maintain a single lane. When the
driver exited the vehicle, a cloud of smoke was observed by the deputy, which had the odor
of Marijuana. A search of the vehicle revealed 120 grams of Marijuana and Cocaine. The
driver and passenger were arrested for Possession of Marijuana, Paraphernalia and
Possession with intent to distribute.

Aggravated Battery(Domestic Violence)
On the above listed date, a Charlie Squad deputy was dispatched to the Beach Club
Condominiums in reference to a disturbance. Upon arrival, the deputy met with the victim
who informed him that her live-in boyfriend had beaten her about the face, pulled her hair
and cut her neck with a knife. The suspect was arrested for Aggravated Battery/Domestic
Violence.

Possession of Cannabis over 20 Grams/Possession with Intent to Distribute
Possession of Drug Paraphernalia/Possession of Concealed Weapons
On the above listed date, Echo squad deputies performed a traffic stop. During the stop,
the passenger of the vehicle threw a bag containing 65.5 grams of Cannabis from the
vehicle. The Cannabis was recovered; both driver and passenger were arrested. A search
of the vehicle incident to arrest produced a panga knife, a pocket knife, brass knuckles and
rolling papers.
Echo Squad reports an increase in juvenile/young adult activity during the evening hours;
increased activity after 2400 hours. Several groups of juveniles, loosely connected , are the
major cause of this. These incidents include noise disturbances, drug traffic, juvenile
intoxication, assaults and batteries. Close patrols of the local "hang outs", vigilant traffic
enforcement and arrests for various charges have curtailed some of the activity.

A Merit Award was given to Deputy Jonathan Potter for his actions in preventing a
kidnapping/assault on a Cape Canaveral citizen. Deputy Potter was additionally named
Deputy of the Month for the month of March.
Administrative Secretary Sarah McKillop was presented with a Commendable Service
Award for her dedication and efforts in completing the Canaveral Precinct Budgets. She
was additionally named Employee of the Month for the month of March.
Deputy Joe Zykwicz was named Deputy of the Month for the month of February with
respect to his initiative in taking charge of the scene following a tornado which touched
down in the Canaveral area.

(98-055349) Located a Hit 8 Run driver and vehicle for the Cocoa Beach Police
Department. The suspect was a Cape Canaveral resident, who left the scene.
(98-056156) Kidnapping of College coed home on spring break by her ex-boyfriend.
Suspect abducted a coed from a Cape Canaveral residence then drove her to an
isolated area of Cape Canaveral. An observant patrol deputy observed the suspect
pull into a deserted area of Port Canaveral and was able to apprehend the suspect and
free the victim.
(98-046529) Aggravated Assault with a hand gun case, occurred at a local apartment
complex. Suspect threatened several persons with a handgun. Victims were a
roommate and friends that were helping the roommate move out. Suspect was later
arrested without incident.
(98-064189) Drive by shooting at Cape Canaveral Ballfield. Two victims were shot.
One was a minor gunshot wound to the arm, the other was a gunshot wound to the
face. Suspect fled jurisdiction.

(98-064189) Warrant obtained for suspect in the April drive by shooting at the
Canaveral Ballfield. Warrant obtained for suspect. Investigation tracked the suspect to
Virginia. Suspect arrested by Virginia authorities.
(98-077286) Residential burglary of a local breeder of exotic birds. Theft of a number
of birds. Investigation resulted in the arrest of four suspects and the recovery of five
birds.
(98-063241) Cleared a local auto theft and recovered the stolen vehicle in St. Lucie
County. Suspect was arrested by St. Lucie County authorities.
(98-065467) Closed out a case reference interference with child custody/parental
kidnapping case. Investigation found that the child was residing in New Jersey. Ruling
and decision between New Jersey and Florida courts found that there was no crime
committed, that the matter was civil in nature and that venue and jurisdiction were in
New Jersey.

(98-086757) Aggravated Battery/Stabbing case. Juvenile slashed by adult male with a
box cutter. Victim required approximately forty stitches. Suspect arrested without
incident and confessed to the stabbing.
(98-094347) Residential burglary arrest. Burglary at local trailer park. Suspect fled
from investigator on follow-up investigation. Alert neighbor made this case, suspect
was another neighbor.
(98-064189) Suspect from April drive by shooting waived extradition and was returned
to Florida for trial.
Assisted the State of Connecticut in locating two witnesses in a upcoming murder trial.
Witnesses had resided in Cape Canaveral, but had recently moved. One witness was
tracked to the Ft. Lauderdale area and one witness had returned to Connecticut.

Otis McNealy, black male, 11/15/58, was arrested for selling crack cocaine to
undercover agents in the Ridgewood and Roosevelt Avenue area of North Cocoa
Beach. Sources advised investigators that McNealy was a resident of Cape Canaveral
that sold crack cocaine just south of the city limit to avoid law enforcement efforts in
the city. Upon arrest, McNealy stated that he was homeless, sleeping where he could
in Cape Canaveral. His last arrest gave a 109 Pierce Avenue, #4, address in the city.
Investigators received anonymous citizen complaints of drug activity at 208 Caroline
Avenue, #502. After exhausting most investigative means, the agent conducted a
knock and talk at the residence that produced a consent to search. The search
produced Lorazepam pills, six(6)grams of cannabis and assorted drug paraphernalia.

During the month of June, the Special Investigations Division began
culmination of a year-long Federal level investigation that required an oral intercept.
The unit, as well as an additional 20 officers from the Sheriff's Office, were utilized
for 33 straight days. Still, there were two investigations initiated in June in Cape
Canaveral. One is a residence where it is reported that cannabis sales occur. The
second is a business where cocaine and prescription drug sales are reported to be
occurring.

Last month's investigation targeting a heroin dealer is continuing, but the
suspect has moved out of the City of Cape Canaveral.
On the last day of the month of June, two separate informants were developed
in the city. It is expected this will lead to the initiation of several cases in July.

Award Purchase Order to Dial Communications, Inc.
For Phase I Reclaimed Water Services
The City advertised requests for bid for the construction of
Phase II and III of the reclaimed water distribution system with
services, on March 22, 1998. The bid opening was on April 15,
1998 at 3:00 p.m. at the City Hall Annex. The low bidder was Dial
Communications, located in Tallahassee, Florida. City Council
awarded the bid for the construction of Phase II and III on May
5, 1998. At the time of the bid award no provisions were made
for Phase I of the reclaimed water program.
Funds from the St John's River Water Management District are
available and are unencumbered. Within the grant agreement these
funds are to be utilized by June 1998 (Contract #97H306). The
Public Works Director requested (April 21, 1998) and received an

Purpose of Agreement: This cost share agreement is authorized by the St. Johns River Water
Management District ("DISTRICT") from funding designated for identification and use of
alternative water supplies, including reclaimed water.
1. Scope of Project: RECIPIENT will commence work within fifteen (15) days after approval is
received from District's Project Manager to begin, prosecute the work diligently, and
complete the entire work in accordance with Exhibit "A" (attached), "Alternative Water
Supply Cost Share Program Contract Outline," and Exhibit "13", `Project Specifications," and
will be completed within the time frames specified above unless extended in writing by
DISTRICT.
2. Permits: A fifteen (15) day period has been included in the time allotted for completion to
allow for mailing of the AGREEMENT, RECIPIENT submission of proof of all required
permits, and any other documentation required by District's Project Manager. Any work
completed without proper permits will not be considered in compliance with this
AGREEMENT, and will not constitute as work performed under this AGREEMENT.
RECIPIENT acknowledges understanding that any work not properly permitted prior to
implementation will not be approved for invoicing to the DISTRICT, and that RECIPIENT
may be fined per appropriate regulatory channels and/or may be required to remove said
unauthorized construction.

3. Legislative Requirements: The Florida Legislature requires recipients of funds granted through
this program to meet several specific conditions. The applicant must provide District with
written assurance of their continued qualification under these requirements throughout entirety
of project or forfeit funding. Details concerning these requirements appear in Subsections
373.1961(2)(b) and (c), F.S.
4. Status Report: RECIPIENT shall submit a brief final project report summarizing the project to
DISTRICr's Project Manager, who is' the Administrator, or his designee, describing the
activities of the project.
5. Records: RECIPIENT shall maintain its books and records in such a manner that the receipts
and expenditures of the cost share funds will be shown separately from other expenditures in an
easily checked form RECIPIENT shall keep the records of receipts and expenditures of cost
share funds, copies of all reports submitted to DISTRICT and copies of all support
documentation for at least three (3) years atter expiration of the agreement period. In
accordance with generally accepted governmental auditing standards, DISTRICT shall have
access to and the right to examine any directly pertinent books, documents, papers, and records
involving transactions related to this agreement.
6. Liability and Insurance: Each party to the agreement is responsible for all personal injury and
property damage attnbutab:e to the negligent acts or omissions of that party and the officers,
employees and agents thereof. The parties further agree that nothing contained herein shall be
construed or interpreted as denying to any party any remedy or defense available to such
parties under the laws of the State of Florida, nor as a waiver of sovereign immunity of the
State of Florida beyond the waiver provided for in Section 768.28, Fla. Stat. Each party shall
acquire and maintain throughout the term of this agreement such liability and automobile
insurance as required by their current rules and regulations.
7. Payment of Funds: Approved funds shall be paid to RECIPIENT by DISTRICT in one
payment following completion of project. Payment will be made following submission and
approval of final invoice, including proper documentation, from recipient and verification of
satisfactory completion of project by District's Project Manager, Don Brandes. Invoice shall
include original receipts from contractors and/or suppliers for the specified construction
expenditures, and verification of project passing all local and state building requirements,
including verification of permits needed. Once all required documentation is received, and
verified to be complete and correct, by District Project Manager aril the Division of Finance,
the District will remit an amount not to exceed $75,000 (50% reimbursement of identifiable
costs) to RECIPIENT within 30 -days. Any inquiries shall be submitted to the Director, Office
of Financial Management, P.O. Box 1429, Palatka, Florida 32178-1429. Disbursements due
and unpaid under this agreement shall not bear interest.

8. Rescission of Agreement: Payment made under this agreement shall be subject to full or
partial rescission if, during the term of the agreement, DISTRICT's Project Manager
determines that RECIPIENT is using funds for purposes other than those specified in Exhibits
"A" and "B", or that RECIPIENT has failed to complete the tasks specified in Exhibits and its
failure cannot be remedied within the agreement tcrn-L Funds shall be subject to rescission after
expiration of the agreement term if, upon a post -project audit examination, District finds
RECIPIENT has spent funds for purposes other than those specified in Exhibits "A" and `B".
This agreement may be fully or partially rescinded upon 10 days written notice to RECIPIENT.
9. Non -lobbying: Pursuant to Section 216.347, Fla. Stat. (as amended), RECIPIENT agrees that
funds received from DISTRICT under this agreement shall not be used for the purpose of
lobbying the Legislature or any other state agency.
10. Governing Law: This agreement shall be construed according to the laws of the State of
Florida. In the event of litigation between the parties arising from or pertaining to this
agreement, the prevailing party shall be entitled to recover from the other, reasonable trial and
appellate attorney's fees and costs.
This agreement is entered into on 0_30_, 1997, by the Governing Board of the St.
Johns River Water Management trict, whose address is Post Office Box 1429, Palatka, Florida
32178-1429, and RECIPIENT.

THIS AMENDMENT is entered into this _4�S day of1998, by and between the GOVERNINGRICT
BOARD of the ST. JOHNS RIVER WATER MANAGEMENT ST("DISTRICT"), whose address is Post
Office Box 1429, Palatka, Florida 32178-1429, CITY OF CAPE CANAVERAL ("RECIPIENT'), whose address is
Post Office Box 326, Cape Canaveral, FL 32920-0326.
WHEREAS, DISTRICT and RECIPIENT entered into an Agreement on June 30, 1997, for construction of a
reclaimed water system; and
WHEREAS, DISTRICT and 1afWIENT desire to modify the Agreement.
NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and
valuable consideration, DISTRICT and RECIPIENT hereby agree to the following amendment:
AGREEMENT PERIOD shall be revised as follows:
The original agreement period, and time allotted for completion of project, will be extended to September 30, 1998.
DISTRICT and RECIPIENT agree that all other terms and conditions of the original Agreement are hereby
ratified and continue in full force and effect.
