PRESENTATIONS:
Terri Bracher, 45th Space Wing Department of the Air Force, Environmental
Specialist spoke regarding the Air Force involvement in environmental cleanup
activities mandated as a result of lax regulations 30 years ago. The Keystone
Commission mandated that a restoration advisory board act as liaison with the
military and communities adjacent to the military installations. There have been
between 80-100 sites identified. A lot has been accomplished through remedial
action. There are 19 members, only one is a military member on the committee. It
is a community committee based on diversity. The primary criterion is that each
community has at least one member. Ms. Bracher reported that Cape Canaveral
no longer has a member since Art Berger resigned, and they are soliciting a
member. There is one meeting per quarter on the first Tuesday of that month. Mr.
Hans Saurenmann requested another application, as he was not selected
previously in 1995.

CONSIDERATIONS:
1. (506) A motion was made by Mr. Hernandez and seconded by Mr. Petsos to
approve the City Council Regular Meeting Minutes for September 21, 1999,
the Special Meeting Minutes to Adopt the Tentative Millage and Budget for
September 8, 1999, and the Special Meeting Minutes to Adopt the Millage
Rate and Final Budget for September 20, 1999.
The motion passed 4-0, with voting as follows: Mr. Treverton, For; Mr.
Hernandez, For; Mayor Pro Tem Petsos, For and Mayor Randels, For.
2. (561) Collective Bargaining Agreement with the International Union of
Operating Engineers, Local 673 (AFL-CIO)
Mr. Hernandez strongly recommended adding Veterans Day as a paid holiday.
He stated that Veterans Day should be recognized and city employees deserve
the benefit. He related that providing the holiday gives more in terms of morale
which effects productivity. Mr. Petsos is concerned with continually adding
holidays while we are above the national average of ten.
Ms. Sims, City Clerk/Human Resources Director opined that after conducting
research since the last meeting, it became evident that the cost for providing
the holiday is minimal, if there is an actual additional cost. Overtime for
wastewater treatment operators and Recreation department employees are the
only additional expenses, less the cost of operating for the day. Further, most
of the general public historically assumes that City Hall is closed and public
activity is nearly nonexistent. Thus, the service our public expects would be
essentially the same. Meaning that the inconvenience of not receiving
expected services would not be an issue. The Recreation Department is open
during all holidays.
Mr. Treverton spoke in support. Mr. Leo Nicholas spoke in favor of adding the
paid holiday mainly because of employees wanting to participate in some of the
veteran's commemorative activities. It would be doing employees and veterans
a favor. The costs saved from lack of business that day are also a factor.
A motion was made by Mr. Hernandez and seconded by Mr. Petsos to approve
the Collective Bargaining Agreement as presented and include Veterans Day
as the twelfth holiday.

3. (1223) Bid Award — RFP #99-03, Reuse Water Project Phase III Extension

Mr. Gardulski explained the bid results as reviewed by he and Mr. Pekar of
SSA. References have been checked and they recommend awarding the bid to
Carl Hankins.
A motion was made by Mr. Hernandez and seconded by Mr. Petsos to award
Bid #99-03 to Carl Hankins, the low bidder in the amount of $279,592.60. Mr.
Petsos clarified that restoration costs are included.

4. (1395) Evaluation and Design of Sewage Lift Station #4
Public Works Director, Ed Gardulski explained that this is the last canned
station to be upgraded and the capacity will also be evaluated. Mr. Pekar
explained that tasks one and two are highly defined and work could potentially
stop after task two is the reason for the "no more than" clause in the proposal.
He further explained the hours. Permitting is the only area of previous work
done that will be able to be carried forward. Refurbishing does means that
some elements of the station could be salvaged. Council concurred that they
want the lift station designed to be without flaw and upgraded to the best
possible level. Mr. Saurenmann opined that it would be more efficient and cost
effective to have a new lift station. Mayor Randels explained that the design
has to be done regardless. Before a bid can be let, specifications for the lift
station would be required. Mr. Petsos opined that the proposed cost for design
is too high.
A motion was made by Mr. Hernandez And seconded by Mr. Treverton
approve the Evaluation and Design of Sewage Lift Station #4 as proposed by
Mr. Gardulski.
The motion passed 3-1, with voting as follows: Mr. Treverton, For; Mr.
Hernandez, For; Mayor Pro Tem Petsos, Against; and Mayor Randels, For.
5. (1979) Design of Phase IV - Reclaimed Water Program
Public Works Director, Ed Gardulski explained that the City is about a year
behind with the reclaimed water program. He recommended constructing a
new trunk line to tie in from North of Eberwein to Central for the industrial park
and the properties on the west side of Atlantic Avenue. Council concurred that
the loop appears to be a good concept. Clarification was given that Briley Wild

Engineers prepared a feasibility study for the City; Hartman and Associates did
the conceptual design. This engineer design would have all underground
utilities detailed, which were not in the previous design making existing utilities
locations extremely difficult. It will eliminate many problems that were
encountered before. Mr. Pekar stated that the first baffle box would be
constructed in the Canaveral Ditch (creek).
A motion was made by Mr. Hernandez and seconded by Mr. Petsos to approve
the Design of Phase IV of the Reclaimed Water Program, not to exceed
$22,000.
The motion passed 4-0, with voting as follows: Mr. Treverton, For; Mr.
Hernandez, For; Mayor Pro Tem Petsos, For; and Mayor Randels, For.
6. (2466) City Manager Boucher explained that the Redevelopment Plan is a
good document and will help in obtaining grant funds in the future. Mayor
Randels recommended inserting on page 3, the promotion of arts and cultural
activities after the word "themes."
A motion was made by Mr. Hernandez and seconded by Mr. Treverton to
approve the Redevelopment Plan including the promotion of arts and cultural
activities after the word themes.

7. (2693) Amendment to the 1988 Local Option Gas Tax Interlocal
Agreement
Mayor Randels explained that this amendment is not the extra three-cents that
was discussed earlier in the year. Mr. Boucher explained that the only
amendment extends the current gas tax for an extended term of twenty years.
Mr. Petsos queried what the funds are proposed to accomplish? Mr. Boucher
responded that there is a County plan. He stated that only 50-percent of the
cities' population are required to approve for the tax to be approved. Mr.
Saurenmann opined that the tax is smoke and mirror for funding other cities'
roadways and concurred with Council. Mr. Nicholas emphasized that not
having this tax equates to $182,000 revenue shortfall for the City. Mr. Petsos
explained that he wants to vote against the amendment to convey the
message that the City does not benefit to the extent that it contributes.
Although beachside communities are less populous, they draw the majority of
tourists and traffic. Therefore, the formula for distributing the funds should be

changed and specific goals outlined. Mr. Boucher stated that Brevard County
is to prepare for funding projects with a twenty-year bond. He recommended
support, but possibly limit the term to five or ten years. Mr. Treverton queried if
Council could approve the agreement and submit a letter explaining the City's
concerns in regard to term and lack of a spending plan. Mr. Boucher stated that
this item could be tabled to allow for discussion at the Space Coast League of
Cities meeting on Monday. Mr. Petsos agreed to address the issue with the
League. Mr. Boucher related that the only assurance is that the City will retain
its portion of the tax collected.
A motion was made by Mr. Hernandez and seconded by Mr. Petsos to approve
the Amendment to the 1988 Local Option Gas Tax Interlocal Agreement.
The motion failed 4-0, with voting as follows: Mr. Treverton, Against; Mr
Hernandez, Against; Mayor Pro Tem Petsos, Against; and Mayor Randels,
Against.
ORDINANCES — Second Reading:
8. Mayor Randels read Ordinance No.12-99 by title.
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY,
FLORIDA, AMENDING THE PERSONNEL POLICY OF THE CITY OF CAPE
CANAVERAL; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF
CONFLICTING ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE.
A motion was made by Mr. Petsos and seconded by Mr. Treverton to adopt
Ordinance 12-99.
An amending motion was made by Mr. Hernandez and seconded by Mr.
Petsos amending section 1...to add Veterans' Day as a paid holiday in section
10.1 and shall take effect immediately upon adoption.
The amending motion passed 4-0, with voting as follows: Mr. Treverton, For;
Mr. Hernandez, For; Mayor Pro Tem Petsos, For; and Mayor Randels, For.

A motion was made by Mr. Hernandez and seconded by Mr. Petsos To adop
Resolution No. 99-37, inserting the name Leo Nicholas.
The motion passed 4-0, with voting as follows: Mr. Treverton, For; Mr.
Hernandez, For; Mayor Pro Tem Petsos, For; and Mayor Randels, For.
DISCUSSION:
10.Sister City - Kloten, Switzerland
Mr. Hans Saurenmann interpreted the acknowledgment letter from Kloten,
Switzerland. He related that the Kloten Parliament has allocated 5,000
Swiss francs or $3,500 to provide accommodation for the City of Cape
Canaveral City Manager when visiting. They are anticipating a date when
the City Manager can travel to receive their proclamation. Mr. Petsos
queried if a teleconference could be done to initiate the program. Mr.
Hernandez concurred.
Consensus was to send Mr. Boucher to Switzerland and pay his travel, the
date to be determined by the City Manager.
Mayor Randels related that there is funding on the state level for student
exchange Sister City programs and distributed literature.
11.(2,973) City Hall
Mr. Treverton explained his report, which consists of several
recommendations. He requested that a workshop be set to discuss the
matter after the report has been reviewed. He then presented an overhead
presentation. City Clerk opining. Mr. Petsos stated that Johnson Controls
should not be discounted, but cannot be done before year-end. IBM building
should be addressed also. We should tell Mr. Ketchum that we are not
interested. City Manager will do. Mr. Nicholas queried what would be done
with the current buildings. Council concurred to hold a workshop meeting
after the election.

Mr. Nicholas reported numerous street light outages. Mr. Gardulski stated that he
was aware of the problem and has a meeting with FPL on Thursday.
City Clerk — Sandra Sims
• City Government Week— mock election at Capeview with the new Data Vote
equipment and a Candidates Forum. Council concurred.
City Attorney— Kohn Bennett
o Litigation correspondence with Szapor. Recently the City's liability attorney was
able to get everything thrown out except for one issue that is not covered by
our insurance. Mr. Roper charges $120 an hour, but Mr. Bennett opined that it
would be less expensive for Mr. Roper to continue due to the time required
having to become familiar with the case. Further, Mr. Roper has proven to be
successful thus far in the case. Mr. Roper will meet with each Council Member
and a closed session could be set if needed. The trial is scheduled for spring of
2000. Council consensus was to continue with Mr. Michael Roper and have
him address Council at their next meeting.

• Mr. Treverton reported that the City has received a letter from Florida
Communities Trust has awarded the P2000 in the final running for the property
north of Cherie Down Park. He asked that staff be certain to do all the things
necessary to comply with their requests.

• Mayor Randels related that he spoke with students at Capeview Elementary
regarding the meaning of Civility Week
• Mayor Randels queried about the status of the Tower Boulevard paving. Mr.
Boucher replied that Mr. Ed Washburn of the County is to submit a quote
tomorrow.
• US Secretary of Energy— Brevard County recognized for being a clean city.
There being no further business, the meeting adjourned at 9:33pm.

LAW ENFORCEMENT CONTRACT
THIS AGREEMENT dated this day of October, 1999, by and between, Philip B.
Williams, as Sheriff of Brevard County, hereinafter referred to as "Sheriff', and the City of Cape
Canaveral, Florida,a municipal corporation, hereinafter referred to as "City".
WITNESSETH,
WHEREAS, the City wishes to purchase municipal law enforcement services for that area
of land within its municipal boundaries; and
WHEREAS, the Sheriff is desirous of performing those services;
NOW,THEREFORE, for good and valuable consideration, it is mutually agreed as follows:
1. PURPOSE
The Purpose of this agreement shall be to provide the citizens of City with police
services by Sheriff. The Sheriff shall at all times endeavor to provide the citizens of City
with the service similar to that which they would enjoy with a Municipal Police
Department.
2. PERFORMANCE OF CONTRACT
The Sheriff will perform this contract as empowered and limited by the Constitution
and Laws of the State of Florida, which grant powers and duties of the Sheriff as chief
executive and law enforcement officer of Brevard County, the Charter of the City, and the
transfer of the City's police power by reason of this agreement.

3. SCOPE OF SERVICES
The Sheriff shall provide City with the following specified services and all support
services incident thereto:
a. Provide 24-hour law enforcement services to the City and enforce all
laws for which the Sheriff has jurisdiction to enforce.
b. All personnel shall be assigned in accordance with the approved
Personnel Allocation s listed in the Personnel Services section of this
contract.
C. There shall be a minimum of two cars and two deputies on patrol
within the City's corporate limits at all times in accordance with
accepted law enforcement practices. During any exception to the
foregoing because of illness, emergency, or any other reason, patrol
services may be augmented by mutual aid service. Patrol shall be
construed to mean the actual patrolling of the City's streets, case
investigation, attending to an observed or reported incident, or being
available to provide law enforcement services within the response
time set forth in Paragraph two herein above. Additionally, the
Sheriff's deputies will conduct reactive patrol to enforce State laws
and City ordinances, proactive patrol to prevent and deter criminal
activity and traffic patrol to enforce traffic laws and prevent traffic
crashes.

so requested by any member of the City Council or by the City
Manager.
4. PERSONNEL
All personnel used by the Sheriff in the performance of such services, functions and
responsibilities, as described and contemplated herein, shall be and remain Sheriffs
employees or deputies and no one of such persons shall be considered in the employ of the
City for the purpose of pension benefits, compensation, or any status or right. All deputies
shall be fully certified as required by both the State of Florida and the Sheriffs Office.
Deputies assigned to Cape Canaveral will remain assigned to duty in Cape Canaveral unless
they leave the employment of the Sheriff, or unless reassigned by the Sheriff after
notification to the City Manager. The parties recognize the final decision concerning the
assignment of personnel is the responsibility of the Sheriff. The parties agree the Sheriff
has the final decision on determining the rank structure implemented for personnel assigned
to Cape Canaveral. The Sheriff further agrees there will not be more than two deputies
assigned to Cape Canaveral at a time with less than one year of experience as a law
enforcement officer.
However, in the event the City considers any of the personnel assigned under this
contract to be contrary to the best interest of the City, the Sheriff agrees to reassign that
(those) person(s), after reasonable notice. A replacement will be provided within a
reasonable time thereafter.
5. PAYMENT
During the one-year performance period of this contract, October 1, 1999 to
September 30; 2000, the City shall pay to the Sheriff, the sum of $1,228,572 for operations

and $104,700 for capital equipment for performance hereunder. The contract price for
subsequent years shall be established based upon mutual agreement between the City and
the Sheriff. Should a mutually agreeable contract price not be approved before
September 30, 2000, the contract price for the option year shall be equal to the total cost of
services for the first (or base) year, plus four percent. This contract option amount may be
adjusted by mutual agreement after the start of performance under the terms of the option
year contract. Sheriff shall separately account for all services rendered by him hereunder
and to the extent that Sheriffs cost of performance is less than the mutually agreed to
contract price, the City shall receive a rebate to the extent of such surplus. Payments for
personnel services and operating expenses shall be made in twelve monthly installments
payable on or before the fifth day of each month, beginning October 1, 1999. The City,
after receiving proper invoices from the Sheriff shall, within 10 business days, remit to the
Sheriff reimbursement for those invoiced (and previously approved by the City) capital
items purchased by the Sheriff in accordance with the terms of this contract.
The contract price stated herein above includes a portion of Sheriffs indirect
overhead, to cover costs such as dispatch services and other services provided by Sheriff in
support of Cape Canaveral. City's pro rata share of such indirect overhead expenses is
approximately $140,000.00, annually. To provide City with price stability, in the base year
of this contract, Sheriff agrees to use a lower 7% administrative cost standard charging
$80,141. If minimal time and expenses are incurred when transitioning between this
contract and the first option year (FY 2000-2001), the Sheriff agrees to hold the 7%
administrative cost standard charging $80,141 for the first option year.

contemplated herein, the City Manager shall have the authority to negotiate with the Sheriff
regarding modification of the Agreement and shall bring such modification to the City
Council for appropriate action. Any request for modification of service levels shall be
accomplished by written request to the Sheriff, and if necessary, amendment to the contract
price.
6. TERM OF AGREEMENT
This Agreement shall take effect on the 1st day of October 1999, and shall continue
in effect for one year with an option to renew annually thereafter, based upon mutual
agreement between the City of Cape Canaveral and the Brevard County Sheriff s Office.
7. DATA
The Sheriff shall provide the City Manager with quarterly activity reports broken
down by each month. In addition, the Sheriff shall provide to the City Manager such other
information as he/she, from time to time, may reasonably request. The City may retain, at
its own expense, an independent audit firm to conduct a compliance review and/or audit of
this contract.
8. FACILITIES
The City shall provide facilities for use by the Sheriff in performing this contract. In
the facilities provided by the City for use by the Sheriff, the City hereby agrees to provide
for all routine maintenance, repairs and replacement of existing facilities, and shall provide
janitorial services and pay all charges for utilities, telephone and other services required for
the operation of the facilities. The facilities shall be used for the sole purpose of providing
the law enforcement services defined in this contract. Any other use of these facilities shall
be negotiated as to cost and extent.

9. EQUIPMENT
All equipment purchased by the Sheriff for use in the performance of this contract,
funded with monies in accordance with this contract, shall remain in the exclusive
possession of the Sheriff until the contract terminates. Ownership, of such equipment shall
remain with the City at all times and possession shall be surrendered to the City upon
contract termination or expiration. All equipment leased to the City shall remain the
property of the Sheriff upon contract termination or expiration. The Sheriff shall maintain
an inventory of equipment, continually updated, and shall, upon request, provide written
inventory reports to the City Manager.
10. FINES, FORFEITURES AND FEES
All fines, forfeitures and fees collected by the County Court on cases made by law
enforcement officers within the City limits, will continue to be returned to the City in
accordance with the existing law of Florida. Sheriff agrees that within the provisions of
Florida Statute Chapter §932, money collected from operations where Sheriff's deputies,
assigned to the City under the terms of this contract, directly participate will be distributed,
pro rata, to the Sheriff and held in trust for the Cape Canaveral Precinct in direct
relationship to the percentage contribution the City-assigned Sheriffs personnel represent as
a proportion of the total law enforcement officers involved in the operation from which the
money is collected. These proceeds shall be dedicated solely for the Sheriffs law
enforcement function within the City, in accordance with Florida Statute Chapter §932.
Funds not expended by September 30`h of each fiscal year will be returned to the Sheriff.
Properties taken in contraband forfeiture cases within the City of Cape Canaveral
shall be forfeited to the City. Should the City accept the forfeited property, the City shall

assume all legal costs related to the forfeiture. Should the City refuse to accept the forfeited
property, the Sheriff may elect to transfer the property to the Sheriff's Office or may sell the
property, whereupon all proceeds will be the sole property of the Sheriff.
Sheriff shall apply to the Court to recover investigative fees upon successful
prosecution of active cases and shall remit recovered fees to the City in January, April, July,
and October of each year.
11. TRAINING
In October of each fiscal year, the City will transfer$10,000 of Police Education
Income Funds (Second Dollar)to the Sheriff for the sole purpose of training deputies and
support staff assigned to the City.
12. RULES AND REGULATIONS
The Sheriff shall have sole authority to promulgate rules and regulations for the
operation of the Brevard County Sheriff's Office personnel who perform law enforcement
functions within the City in accordance with the terms set forth by this contract.
13. CONTRACT PURCHASES
The Sheriff shall have sole power to determine and to contract for or purchase
services,equipment, supplies, facilities and other property for law enforcement needs within
the City, provided the Sheriff can do so with funds allocated to him under the terms and
conditions of this contract.
14. FEDERAL OR STATE AID
The City will determine when to apply for, with assistance and cooperation from the
Sheriff, federal or state grants, aid, loans, assistance or other acquisitions for law

approved Federal and State grants shall be the responsibility of the City.
15. INSURANCE
The Sheriff agrees to provide law enforcement officers' professional liability
insurance coverage for bodily injury and property damage for City-assigned Sheriff's Office
personnel during the contract performance period. The Sheriff will provide automobile
liability insurance for bodily injury and property damage for vehicles used by the Sheriffs
Office under the terms and conditions of this contract. Alternatively, the Sheriff at his
election, may become part of a recognized self-insurance program with other law
enforcement agencies to provide such protection. Costs of such protection described above
will be part of the funds provided by the City.
The City will provide its own fire, storm, flood, property damage and public liability
insurance for bodily injury/property damage for the facilities furnished by the City to the
Sheriff, and shall name the Sheriff as an additional insured, at no cost to the Sheriff. Both
parties to this contract, Sheriff and City, will upon request, provide the other with a copy of
each insuring agreement mentioned in Paragraph 15.
16. DISPUTES OR DISAGREEMENTS
During the contract performance period, all disputes or disagreements between the
parties relative to either party's performance under the terms of this contract, will be
presented, specifically, in writing, by the party claiming dispute. The responding party will
answer, specifically, in writing, within thirty (30) days to the claimant. Within fifteen (15)
days thereafter, the parties will meet at a mutually agreeable time and place to either settle
the dispute, or mutually agree to the facts and issues. Thereupon, if not settled, each party
shall submit the issues to binding arbitration. The parties will choose a retired circuit judge

as arbitrator. If the parties cannot agree on an arbitrator, then an arbitrator will be selected
by the court pursuant to Florida Statute §682.
17. HOLD HARMLESS CLAUSE
The City and Sheriff each indemnify and will hold the other whole and harmless
from any and all manner of action and actions, cause and causes of action, suits, trespasses,
judgments, executions, claims and demands and losses and damages, costs and expenses of
any kind whatsoever, including reasonable attorney's fees and court costs which may be
claimed by any third party to have resulted from or arise out of the intentional or negligent
acts of the employees, officers or agents of the other, whether occurring before or after the
City and Sheriff assumed the obligations of this Agreement.
18. NOTICE
Notice or other writings required or permitted under this agreement shall be given to
the Sheriff at 700 Park Avenue, Titusville, Florida 32780; and to the City at 105 Polk
Avenue, Post Office Box 326, Cape Canaveral, Florida 32920.
19. MODIFICATIONS
This contract shall be subject to modifications at any time upon written mutual
consent of the parties hereto.
20. MARKINGS
The City shall have the right to mark the Sheriffs cars used in Cape Canaveral with
a specific Cape Canaveral designation provided that the markings are not contrary to any
Statute or Regulation for marking Sheriffs Office vehicles.
21. TERMINATION
Either party may terminate this contract without cause or further liability to the

days prior to the requested termination date, said notice to be deemed delivered when a copy
is delivered to the other party and receipted for. Upon any such termination, all further
obligations shall cease, except for those related to payment for services rendered prior to the
effective date of contract termination.
22. LEGALITY OF AGREEMENT
Any obligations created by this agreement, which are hereafter determined by a
court of competent jurisdiction to be illegal are void, and neither party will be obligated to
further perform as to such obligations.
23. TOTALITY OF AGREEMENT
There are no other agreements or conditions, written or oral, between the parties.

for accomplishing this positive image. His recent honor of being selected as

Comments: (1) Meeting city hall's inadequate building space requirements. (2)
Extending reuse to more residents (3) A1A study by DOT. (4) Widening
N. Atlantic Avenue for. Solana. Strong points: Low key manner, but the results
are there.

constructive, positive ideas as to how the city Manager can improve these areas?
Comments: (1) Continue to post vacant land through code enforcement to reduce
illegal camping. (2) I am trying to learn that it is impossible to please
all the people. We both have to learn that! Department heads sometimes are
not as aware of your workings in their department as they should be.

a. Continue. to require Sheriff's Department to continue DUI observations and
expand the use of community policing in electric vehicle and bicycle patrol

all of the areas of evaluation are in this category,the overall rating is one that demands this level
for consideration. Based upon his very positive performance for the past year,I have confidence
in his ability to implement the decisions and policies of council for the future FY 1999/00.

Summary Explanation & Background:
This agreement will help to ensure proper address assignment within the city for new development.
The only issue I have is on Section 1.(e), the payment of the address assignment fee to the county. Mrs.
Sharon Camp of the county address assignment office indicated that most of the cities require the applicant to
pay the fee at her office in Viera, and the applicant presents a receipt to the local building department office
Mrs. Camp will be in attendance to answer any questions or concerns you may have.
I recommend approval.

INTERLOCAL AGREEMENT
THIS INTERLOCAL AGREEMENT, entered into this day of 1999, by
and between the BOARD OF COUNTY COMMISSIONERS OF BREVARD COUNTY, a political
subdivision of the State of Florida, hereinafter referred to as the "County," and the
, a municipal corporation created under the Laws of Florida,
hereinafter referred to as the "City."
WITNESSETH
WHEREAS, the Board of County Commissioners of Brevard County, Florida in regular session
on August 21, 1980, issued a letter of intent that allowed Southern Bell Telephone and Telegraph
Company (n.k.a. BellSouth) to proceed with the implementation of the enhanced emergency telephone
system for Brevard County,Florida; and
WHEREAS, this emergency telephone system, known as the "E 9-1-1 Telephone System," was
implemented in the incorporated as well as the unincorporated areas of Brevard County; and
WHEREAS, the County and City have entered into an Interlocal Agreement previously, dated
, providing for the exchange of information necessary to implement and maintain
the emergency telephone system throughout Brevard County and wish to update this agreement by
executing a new agreement; and
WHEREAS, changes incurred by the Telecommunication Act of 1996 and the Federal
Communication Commission mandates of Report and Order 94-102 have greatly increased the
complexity of maintaining the 9-1-1 database. Therefore, modifications of existing procedures and
implementation of new procedures are required to maintain the high degree of accuracy of the
countywide 9-1-1 system;and
WHEREAS, in order to continue to effectively maintain the accuracy and consistency of the
countywide Automatic Location Identification (ALI) database used with the emergency telephone
system, certain address information within the purview of the City shall be transmitted to the County;
and
WHEREAS, the County and the City have determined that it is in the best interest of the health,
safety, and welfare of all citizens of and visitors to Brevard County to enter into this Interlocal
Agreement.
NOW THEREFORE, it is mutually agreed between the County and City as follows:
1. The City shall submit to the County, or require applicants to submit, prior to any permanent
assignment and to alleviate duplication of street names in the same Geographic Community Area,
the following information and documents, for review,comments,and approval of street names:
a) All subdivision plans with proposed street names annotated as submitted to the City regarding
development projects within its municipal boundaries.
b) All site plans submitted to the City.
c) Any proposed street names for private or public streets located within the City's municipal
boundaries. The City agrees to require all private streets located within all new mobile home
parks,condominium complexes, and business complexes be named.
d) Any correspondence that proposes changes or corrections to addresses or street names within
the City boundaries.
e) The City agrees to pay the County, or require the developer to pay, the sum of $5.00 per
address, with a maximum of $350.00 per new development, to assist in deferring the
administrative cost of this function.
2. Assignment of addresses.
a) The City shall provide the County's designated agency notices of site plan approval, one (1)
recorded copy of resolutions or ordinances naming or re-naming streets, and two (2) copies of
newly recorded plats.
b) At the request of the City, the County shall assign the addresses for each newly recorded plat,
approved site plan, or recorded street name within the City. This request should be submitted
in writing. The County will return to the City one (1) copy of newly recorded plats or notices
of site plan approval with addresses indicated thereon. The County will provide the City with a
list of addresses assigned on street names recorded by resolution or ordinance.
c) The County shall update the E 9-1-1 ALI database system, update the property management
files, notify all concerned agencies,and provide mapping and computer updates for the City.
3. The City agrees to submit to the County the following information and documentation for the
purposes of proper identification and location of addresses within the E 9-1-1 ALI database:
a) One copy of any City ordinance or regulation relating to annexation or detachment of property.
b) One copy of any correspondence related to numbering or renumbering of private or public
streets located within the City's municipal boundaries.
c) One copy of any City ordinance currently authorizing addressing and any future amendments to
such ordinances.
4. The City agrees to cooperate with the maintenance of the E 9-1-1 ALI database by providing for
timely updates and corrections of any discrepancies in the emergency database system.
a) The County will notify the City of any discrepancies located within their municipal boundaries
for the purpose of verification and correction. The City shall respond within 10 working days
of receipt of notice.
b) Upon written notice from the City indicating an error cannot be resolved within the approved
time frame, Brevard County may grant an extension on a case-by-case basis.

c) After proper notice by the County, the City agrees to be responsible for any or all errors within
the emergency ALI database system that are not resolved or corrected by the City within 10
working days of notice.
5. The City and County hereby agree to mutually cooperate in maintaining the flow of communication
necessary to properly and effectively maintain the E 9-1-1 ALI database throughout Brevard
County, Florida.
a) This document supersedes and replaces any and all previous agreements regarding
9-1-1 addressing interlocal agreements.
b) Documentation to the County shall be submitted to:

alleviate the possibility of street name duplication throughout
the county.
(a) All preliminary subdivision plats or engineer's
drawings with proposed street mimes annotated thereon submitted to
the City in regard to development projects within its municipal
boundaries. Said copies shall be submitted prior to the recording
of said subdivision plats.
(b) One, copy of a list of any proposed street naming
or name changes for private or public streets located outside

North Courtenay Parkway, Merritt Island, Florida, 32952, the following

Extension of Nick's Landscaping Contract
On September 15, 1998, City Council awarded RFP 98-10 for Landscaping Contract to
Nick's Landscaping. This Contract was an annual document that was renewable yearly up to five
years. During this contract period, Council awarded a Landscape Service to Lawns by Scott for
mowing the Wastewater Treatment Facilities. In addition, Council had requested that Staff
arrange the City's two mowing contracts to terminate at the same time so that one larger contract
could be advertised for bid. In order to meet City Council direction, it was requested that Nick's
Landscaping Contract to be extended to February 1, 2000. This is the same contract expiration
date of the landscaping service being performed at the Treatment Facility by Lawn by Scott.
During the December/January time period the City will advertise for landscape services for the
City right-of-ways and the Treatment Facility.
Recommend the extension of Nick's Landscaping Contract to February 1, 2000.

SECTION 1. Subsection (b)(2)c of Section 110-551, Location of Recreational Vehicles,
Camping Equipment , Boats and Boat Trailers, of the Code of Ordinances, is hereby deleted
in its entirety, and the following are adopted in lieu thereof:
Sec- 110-551. Location of recreational vehicles, camping equipment,
and boat trailers.
(b)(2)c. In multifamily developments, if boats, utility or boat trailers
recreational vehicles or special purpose vehicles are allowed to be parked pursuant
to its organizational documents and covenants, then in that event, the parking of
boats, utility or boat trailers, recreational vehicles or special purpose vehicles shall
be contained within a special parking facility. As used herein, a special pat
facility shall consist of at least ten percent additional parking spaces.
Notwithstanding the foregoing, if a multifamily development amends its
organizational documents or covenants to allow previously prohibited parkii
boats, utility or boat trailers, recreationai vehicles or special purpose vehicles, then
in that event, a special parking facility shall be added to the existing facilities and
parking of the foregoing shall be prohibited until such times as the special parking
facility is constructed. Nothing contained herein shall be deemed a waiver by the
City of its setback, lot coverage or other zoning regulations in the addition of a
special parking facility. This subparagraph (b)(2)c shall be effective for
multifamily developments for which the building permit for initial construction is
issued after the effective date hereof.

SECTION 2. Any ordinance or parts of an ordinance in conflict herewith are repealed.

cles, camping equipment, boats
and boat trailers.
(a) No person shall occupy or reside in any trav-
el trailer, camper trailer, camper (truck mounted),
motor travel home or tent in any location within
the city other than a duly licensed and approved
trailer park, except as provided in this section.
(b) (1) Definitions. For the purpose of this sec-
tion, the following definitions shall apply
unless the context clearly indicates or re-
quires a different meaning, all of which de-
fined terms may be generally referred to as
"vehicles" in this subsection (b).
Boat means any contrivance designed to be
propelled through or upon the water.
For -hire vehicle shall include recreational ve-
hicle and special purpose vehicle and have the
meaning so set forth in F.S. 320.01, as amend-
ed.
Multifamily development means the real prop-
erty and single structure in which six or more
dwelling units are located, but does not include
any combination of townhouses.
Recreational vehicle means any vehicle or por-
table structure designed primarily to provide
temporary living quarters for recreation, camp-
ing, travel or similar use; either mounted on
wheels or designed to be mounted upon and car-
ried by another vehicle. This definition is in-
tended to include a travel vehicle, motor home,
camping trailer, camp bus, house bus and truck
camper unit of walk-in capacity.
Special purpose vehicle means a vehicle espe-
cially designed primarily for unusual terrain and
conditions, and not usually licensed for or used
on the public roads, including, but not limited
to, swamp buggies and tracked vehicles.
Utility trailer means a trailer designed to
transport materials, goods, equipment or boats.

WHEREAS, the City Council of the City of Cape Canaveral, Florida, has by Ordinance
No. 11-68 created a Board known as the Beautification Board of the City of Cape Canaveral,
Florida; and
WHEREAS, it is now incumbent upon the City Council of the City of Cape Canaveral to
reappoint regular members to said Board.

As of September 30, 1999, there were a total of 7350 residential units in the City of Cape
Canaveral. The single family homes (1607) received a total of 26 garbage collections in
the 3rd quarter, which equates to 41,782 pickups and 13 green waste collections totaling
20,891 pickups. In addition to single family residences, we also provided service for
4,428 multi -family units, 39 commercial can customers, 88 commercial customers and 7
permanent rolloff customers.
For the period July 1, 1999 through September 30, 1999,the number of documented
concerns from thew City totaled 50.The concerns are broken down as follows:

On Sunday, September 19, 1999 (Hurricane Debris), we did additional cleanup in the
City of Cape Canaveral, and again on Saturday October 1, 1999, which at this time the

With the approaching end of my first year with the city, I believe I'm beginning to see
the light at the end of the tunnel.
BUILDING OFFICIAL ISSUES:
■ Steve Bapp, Planning & Zoning Technician, has resigned to accept a planning
position with the City of Cocoa.
■ Ken Grinstead, Part-time Plans Examiner/Building Inspector, has retired.
■ Morris Reid, hired full-time to replace Ken Grinstead as Plans
Examiner/Building Inspector. With not quite three weeks under his belt,
Morris has made a significant showing in his knowledge and motivation. I
am very encouraged that Mr. Reid, full—time in this position will be a great
asset to the City.
■ The office has been re -arranged in an effort to become more productive,
providing the employee the opportunity to better arrange their work space,
while placing key personnel in areas which will better serve the customers.
■ We are in the process of establishing and introducing a permit tracking system
policy, which we feel, will become more positive and expeditious for the
benefit for our customers.
■ Our Administrative Assistant has been purging the street address files. This
enables us to clear the files of outdated material and transfer them to archives.
■ We have completed computer preparation for Y2K compliance.
■ We are updating our SBCCI computer software to include the SBCCI plan
review program. We also are scheduling SBCCI to provide training for the
entire program, which was purchased several years ago. Each employee in the
department will be instructed on the usage of the system to provide a more
effective cross -trained staff.
■ The SBCCI computer program has not been utilized to its fullest capacity and
we are progressing to that end to more effectively monitor the statistics of the
department.
■ We are researching a thought to archive plans, permit packages, etc. to
database which will assist our ability to recall and more effectively archive
information for the future. Canaveral Technigraphics Co. and department staff
are facilitating this.
■ Outstanding permits have slowly been diminished through this quarter,
however, with the new full-time Inspector, we have instituted a policy for both
inspectors to attend to five of these outstanding permits daily. The
outstanding projects on E. Central Boulevard continue to progress in a more
positive direction than we have ever seen in the past.
■ Within the next few weeks, we will be receiving permit applications at the
front counter, entering them immediately into the computer system and
presenting the customer with a permit number for reference prior to permit
issuance. This will assist in tracking the status of processing the application.
■ Re -roof and Heat and Air Conditioning permits are now being issued as they
are submitted. This is proving to cut down on paperwork being stacked for a
couple days as well as eliminating the number of trips the customer must make
to the department. (One stop permitting).
■ I was very encouraged with the teamwork displayed during the evacuation
exercises. The staff pulled together as damage assessment was performed as
well. Although evacuation was a new experience for me and a loss of
productivity, it did provide an opportunity to positively effect organization a
re -organization of the department.
MAJOR PROJECT STATUS:
■ Solana — Working on site work for the entire project with the first
building of the Shores project coming out of the ground.
■ Radisson — Building "C" is entering the final stages, Building "B"
completed the shell and Building "A" is now finishing the structural and
dry -in.
■ Budget Rental — The structure is finally up and work is proceeding on a
regular basis.
■ Kelsey's — It has been a while for them to secure the confusion on the
wastewater problem, but it appears we're rolling once again.
■ Flores Ocean Suites — Have reached the structural point to the roof. All
has gone fairly well and we look forward to getting in and inspecting
each unit now that the super -structure is completed.

SECRETARY OF THE BOARDS REPORT:
■ (4) Planning & Zoning Board meetings were held, with (2) site plan
applications approved (1) fence exemption, (1) preliminary plat, (1) special
exception and (1) variance application.
■ (3) Community Appearance Board meetings were held, with (6) applications
approved.
■ Research has been accomplished regarding procuring a Laptop Computer for
our Board Secretary, (5) Boards. This is an effort to assist proficient of this
responsibility.
BUILDING OFFICIAL - PROFESSIONAL MEETINGS:
■ Attended the Building Code Administrators & Inspectors Board (BCAIB)
meeting in Jacksonville on July 15th and 16th; and the BCAIB meeting in
Tallahassee on Sept. 30th and Oct. 1st. (The Building Official is continuing to
seek appointment to this board by the Governors' office).
■ Attended the Building Official Association of Florida (BOAF) Board of
Directors meeting on August 19th & 20th.
■ Attended (3) Building Officials Association of Brevard County Chapter
meetings and was recently elected and installed as Vice President.

As the CRS Coordinator, submitted to FEMA, re -certification for the
Community Rating System flood insurance program prior to October 1. We
are continuing to strive for a class 7 CRS rating with several upcoming
programs under works, Master Storm Water plan, letter of map
amendments, and higher regulatory standards for several flood prone areas.
Code Enforcement:
Five contractors were stopped for performing work without obtaining
permits, and double fees were assessed with permits.
Posted unsafe structure notices at 299 E. Central Blvd, Ebb Tide Condo's
due to fire damage, also 128 Adams Avenue duplex, electric meter pulled
due to electrical hazards and roof condition. Both properties
violations/damages were corrected by contractors/home owners obtaining
permits for repairs.
Posted 16 Notice to Remove on inoperable motor vehicles, 8 brought into
compliance, 5 vehicles impounded, 1 appealing the posting to the Code
Board, 2 awaiting compliance time.
Pro -active code enforcement throughout city enforcing property
maintenance standards, lot mowing of improved and unimproved properties,
illegal sign placement, yard sale and snipe sign removal.
Responded to 48 citizen complaints, phone; verbal, written, staff generated,
and council requested.

Worked three Saturday's for the City Council monthly weekend enforcement
program.
Attended Board of Adjustment Meeting for Special Exception request for
outside storage of vehicles, RV's, boats, etc.
Submitted to Cape Press an article on recently obtained Flood Insurance rate
discounts for properties located within special flood hazard areas, additional
5%, allowing for a overall rate reduction of 10% on affected citizens
insurance policy premiums.
Performed multiple discipline inspections with Morris Reid, newly hired
Building Inspector/Plans Examiner for obtaining required on the job
experience for multi -discipline licensing requirements with the Department
of Business and Professional Regulation, Building Code Administrators and
Inspector Board.
Continuing address assignment for all new construction projects,
verification of existing addresses, coordinating errors/corrections with the
County Address Assignment, and all other affected agencies. Amending
ordinances to comply with the County E-911 inter -local agreement, which
is scheduled for City Council approval.
Applied for two classes through FEMA, CRS and Floodplain
Protection/Management being held in Emmittsberg MD, in the early
upcoming year, in which FEMA fully fiords.
Continuing to test for SBCCI building inspector certifications for licensing
requirements.

This quarter the Personnel office was fortunate to obtain the interest of several
Cape View Elementary students' mothers for the job of School Crossing Guard.
Anne McElroy trained the new guards and she remains with the department in
the afternoons on the Al and Columbia Avenue post. The new guards are
earnest in public safety toward the children. Brenda Revet has suggested posting
a sign on Canaveral Beach Blvd. to warn the oncoming traffic when children are
crossing at her North Atlantic Avenue intersection. (See attached letter)
Susan Stills, Assistant City Clerk received her CMC designation. Most people do
not realize the effort and dedication required to attain certification as a municipal
clerk. It requires a minimum of four years to acquire the educational and
experience credentials necessary to be considered for certification. Active
membership in the international and state associations is mandatory. That
interaction can be difficult without provision for attendance at conferences. Susan
has contributed her personal and technical resources to making our service
delivery from the Clerk's office better than ever. She has indelibly imposed her
expertise and commitment to the City; and in doing so provides an accurate and
accessible record of our City's history while carrying out the innumerable tasks of
daily administration. Susan is an extraordinary employee with tremendous
knowledge to back up her certification.

Elections
City Clerk prepared four candidates to qualify for this year's election on
November 2nd . The Supervisor of Elections office will use the County's new Mark
Sense Voting System at this election. A workshop to demonstrate the system for
the City Clerk's office staff of Precincts 13/115 will be held on October 12, 1999,
at 9 A.M.
Ordinance Codification
Supplement 7 to the City Code is complete. We will perform distribution to City
Council, staff and Board members during the next quarter.
Records Management
As a preventative measure, the Streets/ Maintenance Department removed the
Clerk's office active records on electronic and paper mediums from City Hall prior
to Hurricane Floyd.
Susan Stills and Susan Chapman, Building Department, attended a
demonstration of site plan scanning at Canaveral Technigraphics. Ms. Chapman
is looking for a system that will allow her to scan the large building plans for use
in an electronic format. The system viewed was favorable for scanning, but did
not have the capability to index the scanned images for retrieval. Tentative plans
are set for a visit to the City of Rockledge Building Department to view the
Alchemy system that provides scanning and optical disk retrieval for building
plans.
MEETINGS/SEMINARS/CONFERENCES
Collective Bargaining with the International Union of Operating Engineers
Negotiations were settled and Council approved the union contract.
International Institute of Municipal Clerks
The City Clerk continues involvement on the International Relations Committee.
Brevard County Clerks' Association
The July meeting covered 1999 Election information and a review of local
municipal practices during the hurricane evacuation in September. Susan Stills is
very active during her presidency here in the City and throughout the County.

Assistant City Clerk attended one in the series of meetings to Rewrite the GS -1
Records Retention Guidelines. Representative segments of local government
involved in the record's management process were invited to attend.
Employee Relations
An informal lunch meeting was held for discussion among various City
Department's administrative support staff. The meeting included the both the City
Clerk and Assistant Clerk, Finance Clerk and Water Reclamation Administrative
staff. The meeting was productive and covered a broad scope of procedural
issues and addressed changes in workflow processes that will benefit efficiency.
As an outcome of the meeting, administrative support scheduled a once a month
informal meeting to enrich communication among departments and to keep one
another aware of work efforts and projects.

City Clerk attended the Local Government TV information session on August
20th .

A number of liability claims were filed as a result of the stormwater flooding prior
to Hurricane Floyd.

RECLAIMED WATER
The Reclaimed Water Project Phase I Extension along Holman Road is
complete and on line. This completes Phase I.
2. The Reclaimed Water Project Phase II and III Grant reimbursement requests
have been forwarded to SJRWMD and funds have been received.
3. For the quarter, 142.5 MG of Wastewater was treated: 76.09 Million Gallons of
treated water was discharged to the River; 58.3 Million Gallons of reuse has
been utilized within the distribution system; and 6.5 Million Gallons was used by
Cocoa Beach. A total of 64.8 Million Gallons was utilized. Note: This has been
another very wet quarter, total rainfall 19.52 inches.
4. Total Reclaimed water connection to date: 233 as of 10/1/99. See attached
list. Note: additional residents have paid for service.
5. The engineering design work for Phase III Reclaimed Water Extension has
been completed. Advertisement for the Invitation for Bids was published in
the Orlando Sentinel. Bid award for this project was approved by City
Council on October 5, 1999. Carl Hankins, Incorporated located in Tampa
will be performing this work.

STREET DIVISION
The City received minor damage from Hurricane Floyd. City staff is busy
cleaning up debris such as trees, sand off roads, and cleaning storm sewer
and beach area. Staff is in the process of collecting data for FEMA report.
2. Developing the Manatee Park shoreline restoration plan. Engineering has been
completed for scheduled work in October. Engineering and conceptual design
of the Boardwalk is completed. The City of Cape Canaveral is seeking
alternative funding for construction through grants.
3. Lot mowing is behind schedule for the quarter due to the Hurricane. Due to
all the rain this period, the grass is growing tall. Having problems cutting
low, wet areas.
4. The engineering design work for Tower Boulevard extension and the
Banana River Park Road has been completed. The Invitation for Bids was
published in the Orlando Sentinel. No Bids were received. Scheduled to
re -bid this project this fall.
5. The City submitted a grant reimbursement request for the Sand Fence
Project to the Port Authority for processing.
6. City Council awarded SSA the task of developing the City's Stormwater
Master Plan. Additional work by Staff correcting current drainage problem is
ongoing.

The City has made application for DOT certification. On September 29, the
DOT Certification Board interviewed the Public Works Director Ed Gardulski
and his Administrative Assistant, Marianne Huston. The interview process
was very positive. The City of Cape Canaveral is looking forward to
receiving a general -type Certification within four to six weeks. After the City
receives DOT certification, we can begin our beautification pilot project.
3. FPL will be installing concrete poles along A1A extending down North
Atlantic Ave. The poles will be on the corner of the President's streets;
therefore, Christmas decorations can only be displayed on the east side of
A1A from now on. According to the City Manager, we can wire the light
poles only for lighted decorations, at our own expense. He prefers lighted
decorations that are showy during the day.
4. Street Division employees have completed installation of Queen Palms,
landscaping and irrigation at Cape View Elementary Kindergarten.

QUARTERLY REPORT
JULY, AUGUST & SEPTEMBER 1999
Summer special interest classes & activities for kids were held
during the months of June and July, a report is attached. In
addition to the special classes,'Tackwondo (karate) classes
continued throughout the summer months. The Youth Center was
open from 12 noon to :5:00 p.m. Monday through Saturday during
the school break and once school resumed, the hours changed to
Monday through Friday, 3:00-6:30 p.m. and Saturday 12 noon-
5:00 p.m. The Center remains closed on Sunday:s and all City
holidays.
The YMCA will be holding a t -Ball league, utilizing our Little
League field (small field on corner of Monroe and Magnolia
Avenues). This will be a coach/pitch league for ages 4-10. This is
the first event in our newly formed partnership with the YMCA.
The league will play November through mid December.
The Brevard Youth Soccer Organization requested the use of the
City's fields for practice (using the outfields), and the organization,
through Alan Beal, was informed that the City is happy to
cooperate. I made several telephone calls to the league
representative to assure the organization that the city is anxious to
be of service to the soccer players and, as yet, I have not been
contacted for scheduling, soccer season began last month.
Two FRDAP (Florida Recreation Development Assistance
Program) grant applications were submitted prior to the
September 30th deadline. One, for the Manatee Park Boardwalk in
the amount of $150,000, which will require a 25% match from the
City (837,500) and one to include a basketball court, eight sets of
bleachers, two electronic scoreboards and converting the
multipurpose ballfield to a softball field. That grant, in the amount
of 849,800,would require no match. It will be after the 2000
legislative session before we will be informed as to our success or
failure to receive the grants.
Upcoming events include the Halloween haunted Forest on
October 28th , 24th Anniversary Racquetball Tournament on
November 5th, 6th & 7th, Seniors Health Fair, November 10th, Kids
Fishing Contest. November 13th, Kids Christmas Craft Class on
December 4th and the Holiday Tree Lighting December 12th.
The Cocoa Reach Christmas Parade will be held December 11th. I
have already sent in the City's entry form in anticipation that the
Council wishes to participate, as in past ,years, so mark your
calendar now for that event. I will give you the particulars on where
to meet, and the time, a couple of weeks before the parade.

Subj: QUARTERLY REPORT
The last three months have been eventful to say the least. We ran 407 calls, evacuated the Port
twice, and evacuated the general populous once. Overall, we did not encounter any major problems
with the evacuation, recovery, or re-entry of the Island. Minor problems that occurred have already
been worked out or are in the process of being corrected.
CCVFD Volunteers provided 2583.1 hours of volunteer time to accomplish the above. We
currently have 33 volunteers and 15 full-time personnel. We have recently been faced with two
personnel issues that have hit the county as well as the country. The first being the decline of
Volunteers and the time they are willing to give. We are combating this with a new effort to recruit,
train, and retain them. This is difficult as many Volunteers are younger and have to work two jobs
just to survive. We will continue to look at all areas to retain personnel so that we can keep the
experienced. The second problem that we are facing is the shortage of Paramedics and the low pay
scaled in Brevard County. Several Brevard municipalities are or have upgraded to ALS. This and the
County upgrading to 3 person ALS engines, has led to a revolving door for Paramedics. Additionally,
counties all around us start Medics at almost $7000.00 more a year than we do. To combat the above
we are working with several cities to adequately assess and mitigate this problem. We hope to
accomplish this before our next fiscal year.
I wish to thank you for your cooperation during this year's long budget season. I feel that we
are adequately funded for yet another year. Thank you for your continued support and cooperation

Sexual Battery
On the above listed date, an Alpha Squad deputy responded to a report of Sexual
Battery. The case involved an adult who was reporting sexual battery which occurred
during her youth. This case was referred to the Sex Crimes Unit and is currently under
investigation.

05 July, 1999
Battery (Domestic Violence)
On the above listed date an Alpha Squad deputy responded to the 300 block of
Washington Avenue in reference to a Domestic Battery on a person over the age of 65.
The victim's daughter advised that her brother had battered her mother. She said that
the brother resides with the victim and that he has been under a lot of stress because he
lives with the elderly victim (his mother) and his father cares for them. The victim was

uncooperative, would not sign affidavits and kept telling deputies to leave. The victim
eventually reported that the suspect (her son) had pushed her down and that she had
received a bruise to her lip and neck. Deputies observed swelling and open bleeding to
the lip and redness and bruising on her neck. The victim refused medical attention.
Later this date, the suspect returned to the residence and was arrested for Domestic
Battery on a person Over the age of 65.
10 July, 1999
Numerous burglaries (to residences and vehicles)
On the above listed date, deputies responded to a burglary in Ocean Woods wherein the
victim advised that he had chased the suspects from his garage during the early morning
hours. The victim advised that he did not call the Sheriff's Office at that time, but
waited until later in the morning. Several fishing rods and reels were stolen. Deputies
also responded to numerous vehicle burglaries at the Royal Mansions this same
morning. Radar detectors, change and other items were taken. Entry to these vehicles
was gained by breaking out windows and cutting convertible tops, causing considerable
damage. Several suspects were later developed, arrested and charged in these cases.
16 July, 1999
Burglary to a Business
On 16 July, Bravo Squad deputies responded to the construction trailers at the Radisson
Resort. Several power tools were stolen. The foreman provided all serial numbers for
the stolen articles. Entry was gained by cutting off the pad lock to the trailer door.
There are no suspects at this time. Several latent lifts were obtained, however they were
lifted from common areas, open to several people. This case was referred to the
Canaveral General Crimes Unit for further investigation.

Vehicle Burglary
On the above listed date Charlie Squad deputies responded to a vehicle burglary that
had just occurred on Oleander Court. While searching the area, three suspects were
found hiding behind a vehicle with property from the vehicle burglary. These subjects
were suspects in numerous other burglaries. A Canaveral General Crimes agent was
notified and asked to respond to interview the suspects.

26 July, 1999
Battery
On 26 July, a Charlie Squad deputy responded to the precinct in reference to a 16 year
old victim of a battery. The victim was seen by Cape Canaveral Fire and Rescue,
however, refused treatment. The victim reported that earlier on the afternoon of the 25th ,
his father punched him in the face at an unknown location. Later, while in the parking
lot of the Dolphin Apartments, his father choked him until he passed out. The victim
did have definite marks around his neck as well as injuries to his face and back. A
check of the area for the suspect met with negative results. Both the suspect and the
victim are from Pompano Beach. The Department of Children and Families was
contacted as well as the Brevard County Sheriffs Office Major Crimes Unit. A Capias
request was completed and forwarded to the State Attorney's Office.
Case Report No. 99-125195
04 July, 1999
Possession of Cocaine
On the above listed date at approximately 0336 hours, while on routine patrol of
Ridgewood Avenue a Delta Squad deputy observed a vehicle traveling southbound on
Ridgewood. A traffic stop was conducted and the passenger was extremely nervous.
The passenger was asked to step out of the vehicle and he tried to dispose of a tissue
containing approximately twenty dollars worth of crack cocaine. The passenger was
arrested and it was determined that the driver had a warrant for his arrest. The driver
had a strong odor of Cannabis smoke on his clothing and a brown ring around his
mouth. It appeared that he had just ingested Cannabis through a water bong, but
sobriety tests determined that he was not impaired. The vehicle was searched incident
to arrest which produced a small amount of Cocaine near the driver's door. The
suspects were transported separately. The passenger attempted to hide several more
grams of Cocaine in the back seat of the patrol vehicle.

05 July, 1999
Aggravated Battery
On 05 July, 1999 Delta Squad deputies responded to a report of an Aggravated Battery
on Jackson Avenue in Cape Canaveral. The suspect was gone upon the deputies'
arrival. The victim refused medical treatment, but had severe swelling on his arms. The

suspect had struck him with a chain several times after the victim told the suspect that
he had to move out. The suspect was located and charged with Aggravated Battery. It
was determined that the suspect had served prison time in Georgia for murder.

08 August, 1999
Attempted Burglary
On the above date at 0035 hours, S.I.D. Agents were working in the Canaveral area.
they observed a white male subject kneeling behind a blue Chevrolet in the parking lot
of the Spaceport Amoco, which was closed at the time. The subject rode away on his
bicycle carrying a long orange extension cord. The agents identified themselves and the
subject fled eastbound. He was caught in the 200 block of Harrison Avenue after a brief
struggle. The subject has an extensive criminal history for burglary, robbery, grand
theft auto and drug related charges. He was released earlier this year from the
Department of Corrections. Further investigation revealed that the extension cord was
stolen from the shed at the Space Port Amoco.

Possession of Cocaine and Paraphernalia
Parole Violation
On the listed date, two Charlie Squad deputies were looking for an older model white
pick up in reference to a theft. They observed a similar truck on S. R. A1A and
followed behind it. The truck slowly pulled off the roadway and the passenger put his
arm out and dropped a small red bundle. The truck was pulled over and the red bundle
located. The bundle was a red handkerchief that contained a crack pipe and a piece of
Crack Cocaine. The subject was arrested for Possession of Cocaine and Paraphernalia
in lieu of $1,000. Bond. The driver of the truck was also arrested in reference to a
parole violation issued by the Florida Parole Commission, and taken to jail under no
bond.

09 August, 1999
Burglary
On the above listed date, a Delta Squad deputy responded to 8702 N. Astronaut
Boulevard in reference to a burglary not in progress. Upon arrival, the investigation

revealed that while the motel guest was out eating, person(s) unknown entered his room
and removed a laptop computer. There are no suspects at this time. the Raddison has
experienced several cases such as this in the past several months.
Case Report No. 99-152416
11 August, 1999
Battery (Domestic Violence)
On the above listed date, an Alpha Squad deputy responded to Adams Avenue in
reference to a 911 hang-up call. Upon arrival, the deputy conducted an investigation,
which revealed that a pregnant female had been battered by her husband. The female
advised that he had grabbed her by the right arm. Deputies observed bruising to the
female's right arm. The male was arrested and charged with Domestic
Violence/Aggravated Battery.

11 August, 1999
Death Investigation
An Alpha Squad deputy responded to Jefferson Avenue in Cape Canaveral in reference
to a possible Suicide. Upon arrival, the deputy met with the landlord of the apartment
complex. The landlord advised that he had received a call from the mother of one of his
tenants, who asked him to check on her son as she could not get in contact with him.
She went on to advise the landlord that her son was 65 years old and in poor health.
The landlord went to the residence to check on the tenant and found him on the bed with
a gun shot wound. The deputy checked the residence and located the tenant, deceased
on his bed with a gun shot wound to his head. The gun shot appeared to be self
inflicted. The case is currently under investigation by the Brevard County Sheriffs
Major Crimes Unit.

11 August, 1999
Aggravated Assault (Domestic Violence)
A Charlie Squad deputy investigated a report of aggravated assault. The suspect was
arguing with her 16 year old step -son. She slapped him and choked him. He pushed
her away and she left to get a gun. She put the gun to his head saying she always
wanted to kill him. The step -son left the residence and went to a friend's house, where
the call was placed to the Sheriff's Office. Later, the suspect admitted to threatening her

step -son with a gun. She was arrested for Aggravated Assault/ Domestic Violence and
Domestic Violence/Battery on her husband. She was transported to the Brevard County
Detention Center.
Case Report No. 99-154658
14 August, 1999
Burglary
On the above listed date, a Delta Squad deputy responded to 7700 North Atlantic
Avenue in reference to a burglary that had just occurred. Upon arrival, a description of
the suspect and his vehicle was circulated. Minutes later, the suspect vehicle was
located in the area of the 210 building on Caroline Avenue. A search of the area for the
suspect yielded negative results. Approximately one hour later, the Sheriff's Office
received a call from an individual who stated that he had been car jacked. The vehicle
matched the description of the vehicle used in the robbery, which was in our custody.
The original victim was taken to the scene, during which she identified the individual
who was trying to report his car stolen as the person who robber her. he was
subsequently arrested and transported to the Brevard County Detention Center.

Possession of Controlled Substance/Possession of Drug Paraphernalia
On the above listed date, an Alpha Squad deputy conducted a traffic stop on a vehicle at
the intersection of Adams Avenue and Magnolia Avenue. A black male was passed out
under the wheel of a four door Pontiac. The deputy's investigation led to the discovery
of Crack Cocaine and a pipe used to smoke the drug. The black male was arrested and
charged with Possession of a Controlled Substance (Crack Cocaine) and Possession of
Drug Paraphernalia (Crack pipe). The suspect was transported to the Brevard County
Detention Center.

Child Neglect
Deputies responded to Oleander Court in Cape Canaveral, in reference to a report of
Child Neglect. Upon arrival, the investigation revealed that a parent of a two-year-old
boy had left him unattended in a condo, while she went to a bar in Merritt Island.

DUI Arrest
A traffic stop was conducted on a red Corvette, which was suspected of drunk driving.
As the driver stopped his vehicle, he placed the vehicle in reverse instead of park. As
the vehicle started to move backwards, the driver stepped on the gas pedal, causing the
vehicle to accelerate, striking the deputy's patrol unit. The driver was subsequently
arrested for two counts of DUI.

Child Abuse (Domestic Battery)
Deputies responded to Caroline Street in reference to a child Abuse/Domestic Battery.
The 13 year-old white female victim advised that her mother, a 38 year-old white
female had kicked her in the side and hit her in the face with her fist. The victim said
she ran to a neighbor's residence to get away. The victim had swelling and redness
under her left eye. The victim was removed from the residence by the Division of
Children and Family Services. The suspect was located the following day and arrested
for Child Abuse/Domestic Battery.

Aggravated Battery/Domestic Violence
This case involved a suspect who was arguing with her husband in the kitchen area of a
residence on Ridgewood Avenue. During the argument she threw a set of car keys and
a knife at him. The knife struck the victim in the left arm, causing a cut approximately
1/2" long. The suspect fled the area and was arrested later in Cocoa Beach and charged
with Aggravated Battery/Domestic Violence and transported to the Brevard County
Detention Center.

22 September, 1999
Attempted Suicide
Deputies responded to N. Atlantic Avenue in reference to an Attempted Suicide. Upon
arrival, a 52 year-old white female witness advised that the victim, a 35 year-old white
female had told her the previous evening that she was going to take some pills and go to
sleep forever, but that she did not take her seriously. The witness said that she could not
wake the victim up that morning and called 911. The victim takes numerous
prescription medications and it is not clear which ones she may have ingested. The
victim was transported to the Cape Canaveral Hospital by Brevard County Fire and
Rescue.

Child Neglect
Deputies responded to Oleander Court in reference to a panic alarm and 911 open line.
The caller was screaming hysterically for the police and for an ambulance. Upon
arrival, deputies observed that the subject was extremely intoxicated and was arguing on

the phone with her husband who was in Wyoming. While speaking with her in the
residence, the subject ran off and laid down in the middle of Ocean Woods Boulevard.
There were two small children in the residence at the time. It was apparent that she
could not care for the children in her intoxicated state. The subject was arrested for
Child Neglect and the children were removed from the residence by the Division of
Children and Family Services. It was also discovered that the subject had a warrant for
retail theft.

Burglary to a Vessel
Deputies responded to 809 Central Avenue in Cape Canaveral in reference to a Burglary
to a Vessel in progress. According to the complainant, two white males were on his
boat attempting to commit a theft. The complainant chased after the subjects who left
the area in their own boat, westbound in the Banana River. The complainant gave chase
and lost sight of them when they blacked out (turned off their running lights). No
physical evidence was obtained. This case is pending and referred to the Canaveral
General Crimes Unit.

Credit Card Fraud
Deputies responded to Manatee Bay Drive in reference to a credit card fraud. Upon
arrival, the victim advised that person(s) unknown had obtained his First USA Credit
card number and purchased items by computer via A.O.L. totaling $500.00. The
victim advised that he was in possession of his credit card and is unaware of how the
number was acquired. This case was referred to the Canaveral General Crimes Unit for
further investigation.

SUBJECT: Community Policing Activity for August
On August 3, 1999, the residents of the Plaza Condominiums hosted the National Nite
Out program. Representatives from Canaveral Fire Rescue, Cape Canaveral Precinct,
and the Dive Team, Jail Van, and K -9s were present. Displays included the new
Alternative Fuel Vehicle, a BCSO Patrol Vehicle, Fire Trucks, and an ambulance.
On August 7, 1999, National Nite Out was celebrated at Kiwanis Island. Displays
included the SWAT Team, Aviation Unit, Motor Units, BATMobile, Ag -Marine,
Canaveral Precinct's Alternative Fuel Vehicle and Jet Boat. Awards were presented to
the most active and involved neighborhood watches in the county area. The Plaza
Condominiums won an award for the second straight year.
On August 10, 1999, the Residential Property Managers held their monthly meeting in
the Council Chambers.
On August 11, 1999, the TRIAD Executive Board held its regular monthly meeting at the
HealthFirst office in Rockledge. Representatives from the board were selected to attend
the National TRIAD Conference in September. During this meeting I resigned as the
Chairman of the Central SALT Council and Needs Assessment Committee; however, I
retain seats on both, as well as the Crime Prevention Committee.
From August 13-15, 1999, I worked on light duty in the Communications Center due to
an injury suffered on August 3.
Between August 18-22, 1999, I attended Critical Incident Stress Management training in
Naples, Florida. Certification was received in Advanced Critical Incident Stress
Management and Peer Support.
On August 28, 1999 at the annual RSVP Awards Banquet, Canaveral Citizen Observer
Patrol member Ruth Talada was recognized with an award for the volunteer hours she has
given to the Brevard County Sheriff s Office.

SUBJECT: Community Policing Activity for July
Meetings:
On July 1, 1999, I attended a meeting held with the Brevard Federation of Teachers and
Sheriff Phil Williams, at the Sheriff's request concerning school safety issues.
On July 10, 1999, Sheriff Williams and I attended the monthly meeting of the Central
Chapter of NAACP where the Sheriff addressed community crime issues.
On July 11, 1999, the Residential Property Managers held their monthly meeting in the
Council Chambers with Greg Mullins and Mayor Rocky Randels.
On July 14, 1999, the TRIAD Executive Board held its monthly meeting at HealthFirst in
Rockledge.
On July 20, 1999, a meeting was held with the Space Coast Tourist Development Council
concerning locations to host the 2001 Reducing Crime in the Black Community
Conference. The 1999 conference brought over 4,000 people to the Orlando area. The
meeting was held with Ms. Bonnie King, Commander Jimmy Jackson, Crime Prevention
Coordinator Joe Davis. I also attended the meeting as a committee member designated
by the Sheriff.
Between July 20 and 27, 1999, the Critical Incident Stress Management Team conducted
four defusings and debriefings after the tragic loss of Deputy James Adcock.
On July 25, 1999, patrol of the Banana River was conducted in the jet boat to provide a
law enforcement presence during Sea Ray's Customer Appreciation Day.
The Citizen Observer Patrol volunteered a total of hours during the month of July.

SUBJECT: Community Policing Activity for September
On September 7, 1999, the TRIAD Crime Prevention Committee met at the Cocoa Police
Department. On the agenda was to develop training programs about elder issues for law
enforcement and to develop crime prevention programs for seniors.
On September 7 and 9, 1999 emergency equipment was mounted on the Alternative Fuel
Vehicle.
On September 8, 1999, the TRIAD Executive Board met at the HealthFirst Office in
Rockledge. General discussion concerning the upcoming National Conference was
discussed. A special speaker from Palm Bay Police Department's Domestic Violence
Unit described the function of their unit and how it was working. Several issues appeared
to be workable ideas for this precinct.
On September 8, 1999 a check of previously posted trespassing signs was conducted
throughout the city. Only one of the posted signs has been removed and could not be
located.
On September 10, 1999, a patrol of coastal waters was conducted with the jet boat to
determine its capabilities in open water. A single deputy also did it to determine the
launching and retrieval capabilities. Some issues were noted and corrective actions will
be implemented.
On September 13, 1999, Hurricane Floyd created a need to evacuate the barrier islands.
Based on the estimates given at the time, it appeared catastrophic damage could occur in
the Canaveral area. Telephone poles were marked with paint to indicate a three foot
water mark and several streets were marked in the event street signs were down and
assistance from other areas had to be brought in to locate certain locations.
September 20 the Community Policing Unit was designated to conduct follow up
investigations of Domestic Violence occurring in our community and the task of
analyzing data to determine if a drop in repeat crimes can result.

From September 22-24, 1999, I attended training in Elder Abuse sponsored by
Hillsborough County and the Department of Elder Affairs.
From September 26-29, 1999, I attended the TRIAD National Conference and sessions,
which will assist our local chapter. In addition I presented a session on Alzheimer's
Disease from a course developed for Emergency Service Workers.
