PRESENTATION:
<40 > City Commissioner Pat Poole distributed literature on her topic, the Harbor
City Ambulance Squad. The Harbor City Ambulance Squad has been in service
since 1966. The squad was not aware that their contract would not be renewed.
Ms. Poole reviewed the squad's service in funds versus expenditures. She stated
that the Harbor City Ambulance Squad has been grossly under funded in a time
of substantial growth in the County. Ms. Poole recounted the numerous instances
of Harbor City's benefits to the County. Although the County Commission
reported several reasons to discontinue the service, she stated that there are
facts which disprove.
Mayor Randels clarified for the audience that areas such as, the South Beach
area, and the mainland south of Barnes Boulevard, are maintained by the Harbor
City Ambulance Squad. Ms. Poole answered Mr. Hernandez' question that the
same level of service will be maintained by the County if the Harbor City Squad is
discontinued, however the service will cost three additional dollars. Ms. Poole

affirmed Mr. Hernandez' question that she desires a Resolution from Cape
Canaveral's Council in support of the Harbor City Ambulance Squad. Mayor
Randels expressed his concern that the County Commission did not notify the
cities affected by the loss. Mayor Randels solicited input from Chief Dave
Sargeant. Chief Sargeant reiterated his concern with the County's Emergency
Management Service funding issues. Chief Sargeant emphasized how the
volunteers are essential in assisting the paid staff.
Mayor Randels read Resolution No. 99-17 by title:

COUNTY, FLORIDA, REQUESTING THE BREVARD COUNTY
BOARD OF COUNTY COMMISSIONERS TO RECONSIDER THEIR
VOTE TO TERMINATE THEIR CONTRACT WITH THE HARBOR
CITY VOLUNTEER AMBULANCE SQUAD; AND PROVIDING FOR
EFFECTIVE DATE.
A motion was made by Mayor Pro Tem Petsos and seconded by Mr. Treverton to
adopt Resolution No. 99-17. The motion carried 4-0, with voting as follows: Mr.
Treverton, For; Mr. Hernandez, For; Mayor Pro Tem Petsos, For; and Mayor
Randels, For.
CONSIDERATIONS:
A motion was made by Mayor Pro Tem Petsos and seconded by Mr.
Hernandez to approve the amended Regular City Council Meeting
Minutes of July 20, 1999. Mr. Hernandez recommended striking "due to
her lack of attendance" from page one, paragraph one regarding the
Commercial Development Board member removal and Mr. Treverton
requested a change on page five to reflect that he would give a report on
City Hall, however not at the following Council meeting.
The motion on the amended minutes passed 4-0, with voting as follows: Mr.
Treverton, For; Mr. Hernandez, For; Mayor Pro Tem Petsos, For; and Mayor
Randels, For.

A motion was made by Mr. Hernandez and seconded by Mayor Pro Tem
Petsos to approve Ordinance No. 09-99 for second reading.
Attorney Bennett clarified that this is the disposition of property on private
property. The property in question regards vehicles left on another person's
property, for example at a condominium. Mr. Hernandez questioned
inoperable vehicle at a residence. Attorney Bennett stated that the City could
abate said vehicle as a nuisance, however, he is strictly speaking about
abandoned vehicles.
The ordinance was approved for second reading 4-0 with voting as follows: Mr.

Randels, For.
3. <1866> Mayor Randels read Ordinance No. 10-99 by title:

COMMUNITY DEVELOPMENT, OF THE CODE OF CAPE CANAVERAL,
FLORIDA, BY PROVIDING FOR THE RENAMING OF THE COMMERCIAL
DEVELOPMENT BOARD TO THE BUSINESS AND CULTURAL
DEVELOPMENT BOARD; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF CONFLICTING ORDINANCES AND RESOLUTIONS;
AND PROVIDING FOR AN EFFECTIVE DATE.
A motion was made by Mr. Hernandez and seconded by Mayor Pro Tem
Petsos to approve Ordinance No. 10-99 for second reading.
Mr. Treverton expressed concern with the increase number of members. Mr.
Larry Weber stated that the Board currently has five members with an
alternate due to become a regular member. He noted that the Board's desire
is to encourage more cultural events in the city. Mr. Weber related that the
Board desires more members in order to undertake the additional cultural
projects. Mr. Weber related that the Board requests nine regular members
and no alternates. Attorney Bennett explained that a larger group requires a
larger quorum and he did not recommend that Council concurs with a three-
member quorum. Attorney Bennett explained further that a nine member
Board required a quorum of five and three affirmative votes.

approve Ordinance No. 11-99 for second reading. The motion carried 4-0 with

A motion was made by Mr. Hernandez and seconded by Mr. Treverton to
amend Section 74-60, Truck Parking, to read as follows: "It shall be unlawful
fo any truck weighing 6,000 pounds or more to park anywhere within the City
of Cape Canaveral for more then four (4) consecutive hours where so
posted." The motion carried 4-0 with voting as follows: Mr. Hernandez, For; Mr.
Treverton, For; Mayor Pro Tem Petsos, For; and Mayor Randels, For.
Mayor Randels clarified that under the current ordinance, a truck weighing
more than 6,000 pounds could not park anywhere within City limits for more
than four hours unless the property is designated as a transportation facility.
Mr. Treverton related that 6,000 pounds might not adequately differentiate
trucks. Attorney Bennett explained that the previous Building Official
concluded on the 6,000 pound limit after thorough research. Mr. Hernandez
queried if the current ordinance designates where these vehicles can park.
Mayor Randels clarified that the current ordinance prohibits trucks from
parking in undesignated areas for more than four hours. Mayor Pro Tem
Petsos emphasized a proactive stance on this issue and not to create another
enforcement instance. Mayor Pro Tem Petsos suggested that the City
Attorney research posting at the City's entrance. Attorney Bennett amended
Section 74-60, Truck Parking, striking the verbiage after the word "hours" and
inserting "where so posted."
RESOLUTIONS:
5. <3000> Mayor Randels read Resolution No. 99-16 by title:
A RESOLUTION OF THE CITY OF CAPE CANAVERAL, FLORIDA OPPOSING
ANY COST CUTTING METHODS AT NATIONAL LAUNCH RANGES THAT MAY
COMPROMISE PUBLIC SAFETY; SUPPORTING THE RENTENTION OF AN
UPGRADED RANGE SAFETY SYSTEM; AND PROVIDING FOR AN EFFECTIVE
DATE.

A motion was made by Mayor Pro Tem Petsos and seconded by Mr.
Treverton to adopt Resolution No. 99-16.
Mayor Pro Tem Petsos expressed that retention of an upgraded range safety
system is crucial to the security of the cities in the surrounding the space
community.
DISCUSSION:
6. <3250> City Hall
Mayor Randels clarified for the audience that Mr. Treverton's task is to
research on the possibility of renovating the present City Hall facility. Mr.
Treverton reported on alternative parking for staff adjacent to City Hall. He will
report back to City Council at a future meeting with more information.
REPORTS:
7. <3460> City Manager
• Mr. Boucher reported a local concern in motor vehicle title loan
transactions in which private businesses charge exorbitant fees for a loan.
He request that the Board of County Commissioners address this issue
countywide and that the Space Coast League of Cities create awareness
for cities on this issue.
• Due to the League of Cities dinner, the August 9th budget meeting has
been cancelled.

• Mr. Nicholas concurred that the carpet store dumpster problem had been
alleviated but not eliminated.
• Mr. Weber recommended using the emergency light at Jackson Avenue
as a standard traffic light. Mr. Randels stated that such a concept is under
consideration.
• A resident inquired if the Phase III Reuse contract has been awarded. Mr.
Boucher responded that bids would be opened on August 9th. Mayor
Randels confirmed for her that the trees were trimmed on Jackson Avenue
• Ms. Kacee Corbin asked about the status of the Planning Solutions
Incorporated proposal. Mr. Boucher reported that the company is working
on Phases I and II of the tasks.

City Clerk
• Ms. Stills reported the cost of legal ad publication as well as the cost of
postal charges for sending certified notices to the adjacent property
owners affected by the C-2 zoning district ordinance. Council concurred to
perform both forms of notification. Mayor Pro Tem Petsos queried about
the Blarney Inc. agreement and the necessity to post notice regarding
adoption of the C-2 zoning map. Council withdrew public notices on the
ordinance at this time.
City Attorney
• Recommended a closed session regarding Blarney 67 and the Fairvilla
settlement. Council concurred.
Council Member Hernandez
No report.
Mayor Pro Tem Petsos
Mayor Pro Tem Petsos announced that October 23rd is National Make
Difference Day. He noted the need assistance from the Florida
Department of Environmental Protection with Sea Turtle marking before
attempting a send fence project.
Mr. Petsos also reported on Civility Week, sponsored by the Interfaith
Alliance. Civility Week is based on kindness toward your neighbor. More
information will be forthcoming.
Mayor Randels
• Mayor Randels reported that Mayor Pro Tem Petsos greeted the new
Disney Wonder Cruise ship.
• Mayor Randels reported that he spoke with Principal Joy Salamone
regarding the need for School Crossing Guards.
• Mayor Randels queried about the 22 signs within a six block area for
reclaimed water stating that this is too many signs.
• Mayor Randels reported on a Florida Today article regarding future
development in Avon -by -the -Sea.
• Mayor Randels reported on the lower cost School Resource Officer
contract due to a reduced actual number of students from Cape
Canaveral.
• Mayor Randels expressed concern that Washingtonian trees were topped.
• Mayor Randels queried why trees are not being planted during the wet
season.
• Mayor Randels announced that Northwinds Ministries would provide
computer training.

Mayor Randels reported on alternative fuel vehicles.
Mayor Randels announced that the Department of Transportation has
approved new florescent green school crossing signs.
Mayor Randels queried if the City's sign ordinance approved walking

SUBJECT: QUARTERLY BUDGET REPORT & TRANSFERS FOR THE PERIOD
ENDING 6/30/99
It is with great pride in our City and its accomplishments that I report on the financial
activities for the three quarters ended 6/30/99. Reuse Phases II and III have been
completed and $100,000 has been received from the St Johns River Water Management
District. Phase I is almost complete, with an August 31" deadline for grant expenditures.
Revenues are well within projections, with approximately 89% collected for the General
Fund and Sewer Fund, taking into consideration the accruals for the end of the year. The
increase in construction activity has continued to increase revenues for Building Permits
and all Impact fee accounts, both for general government and Sewer Department. It
should also be noted that the full amount of expenditure was reimbursed for the purchase
of Patriots Park.
Following is an evaluation of budget amendments requiring attention. It should be noted
that only those items representing a significant change in fiscal policy have been offered
for adjustment. Some of these items have previously been approved. It is not the intent
of these amendments to adjust each account to reflect actual activity.

GENERAL FUND
Revenues:
Revenues for the third quarter have continued to increase beyond projections. It is our
request that budgeted revenues for Cable TV Franchise fees and Bell South Utility Taxes
be increased. Building revenue for the General Fund is also increased to reflect the
construction activity. $8,994 has been received from DCA for Manatee Park and $12,218
over grant amount was received for the Patriots Park purchase. The increased revenues
has allowed the city to reduce the Appropriated Fund Balance by $80,245.
Expenditures:
Legislative: It is requested that the Legislative Budget be increased by $4,200 to fund the
activities associated with the promotion of our City. Accounts to receive increased
funding are Travel & Per Diem, Promotional Activities and Memberships and
Training.
Administration: It is requested that the Operating Supplies be increased to fund the
needs of the administrative staff
Planning & Zoning: Adjustments to the Comprehensive Plan and publishing of
"Lessons Learned" requires an additional $20,530.
Public Safety -Police: It is requested that $900 be appropriated to fund the training video
for the Brevard County Triad.
Street Department: The Street Repairs and Street Signs accounts have been increased
by $5,000 and $3,000 to cover costs associated with current activity.
Non Departmental: The $3,101 of increased revenue over expenditures not used to
reduce Appropriated Fund Balance is recorded in the Contingency account.

FIRE PROTECTION FUND
Construction activity has greatly increased the revenues garnered for fire protection. This
money is transferred directly to the General Fund.
SEWER FUND
• Receipt of the SJRWMD Grant, $100,000 has been recognized.
• The projected Utility Operating Income has been decreased by $100,000. Much of
this reduction can be attributed to the increased use of reuse water for irrigation.
• Sewer Assessment fees have increased due to the increase in new construction.
• Reuse Hook -Up fees have continued to increase as more citizens become interested
in acquiring this alternative irrigation source.
• Interest Income for both Expansion and Revenue Investment accounts has
exceeded projected figures and is adjusted accordingly.
• Cash Forward is decreased by $147,700 (expansion funds) due to the increased
current revenue from new construction. These funds are used to build out the Reuse
System.
EXPENDITURES:
An additional $7,000 is needed to fund the replacement of the Sand Filters in the plant.
Appropriations have been increased in Phases I, II and III to cover the costs associated
with the projects. Phase IV appropriations have been reversed. The balance of operating
revenue has been used to increase the Contingency Account by $30,000.

Reclaimed Water Project Phase III Extension Bid 99-02 Award
The City advertised requests for bid for the construction of Phase III Extension. The
scope of this project is to construct the reclaimed water distribution system with services. The
City of Cape Canaveral advertised that the preferred the methodology of construction to be
directional boring, but the City would consider all other methods. The scheduled bid opening was
held on August 5, 1999 at 3:15 p.m. at the City Hall Annex. The City received four (4) bids. The
three- (3) lowest bidders elected to utilize open cut construction. The high bidder elected
directional boring as preferred by the City. Attached is the result of the bid tabulation from each
bidder. The City's Engineer Stoller Stagg and Associates ( SSA) reviewed the bid package. The
Public Works Director conducted background reviews of the Bidders.
The Bid Ranking Committee met at a public meeting at the City Hall Annex at 9:00 am on
August 12, 1999. The Committee reviewed the alternative construction methods and the unit
cost of construction. The three low bidders that elected open cut construction did not wish to
perform directional boring construction at the bid price, as noted by the Public Works Director via
telephone contact of each of the Bidders. The low bidder was Santa Cruz in the amount of
$277,816.65. The high bidder, Carl Hankins, Inc. bid was for direction boring type construction
in the amount of $350,788.96. The Committee elected to allow City Council to select the desired
means of construction of direction boring or open cut type construction and to award the bid
according. The bid award of the project will be at the unit bid price. All Bidders will be advised
of this City of Cape Canaveral Council agenda item.

INVITATION FOR BIDS FOR THE
CONSTRUCTION REUSE WATER PHASE III EXTENSION WITH SERVICES
Bid No. 99-02
The City of Cape Canaveral is a political subdivision of the State of Florida with a
population of 8,500 with approximately 1.9 square -miles within its City limits. The City will
accept written bids from qualified and properly licensed contractors interested in the construction
of approximately 8,000 linear feet reclaimed water distribution main. Pipe sizes will range from 4
inch to 6 inch with 1 & 2 inch services to its sewer customers. Qualified firms will be
knowledgeable, competent and experienced in construction of reclaimed water projects.
Contractors with demonstrated expertise in this field are invited to submit a bid. Instructions for
bid may be obtained from Canaveral Technigraphics located at 7980 N. Avenue, Cape Canaveral.
Bid Packages are available for the amount of $40 per set and is non-refundable. Proposals shall
be accepted until 3:00 P.M. Thursday, August 5, 1999.
SPECIFIC CRITERIA
The contractor performing this service shall have a strong background in providing a
positive working relationship with City, a Mayor/Council and City Manager type government and
a history of construction of municipal reclaimed water systems. The City of Cape Canaveral
prefers the methodology of Construction to be directional boring, but will consider all other
methods.
Reviewing and ranking of the firm's proposals will be by the Public Works Director and the City's''
Engineer. There will not be a need for any presentation by firms. The final selection will be based
on the short list and presented to the City Council. The City reserves the right to withdraw this
Request for Bid or any portion at any time to protect its best interest.

Requested Action:
That the City Council consider the amendment that increases the property disposition limit for the disposition of
property from $250 to $1,000.
Summary Explanation & Background:
The increase in the disposition limit will follow the city to sell inoperable motor vehicles valued less than
$1,000, and those vehicles valued over $1,000 will be sold at auction.
Our staff recommends this amendment; it would help free up space at our public works facility where we
currently impound towed vehicles.

PROPERTY REMOVED BY CITY (adding to the Code0. , OF THE CODE OF CAPE
CANAVERAL, FLORIDA; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES AND
RESOLUTIONS; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1.(adding to the Code). Paragraphs (a) and (b) of Section 34-186, Disposition of Property (adding to the Code)
Removed by City, adding to the Code). are hereby deleted in their entirety, and the following are adopted in
lieu thereof:
Sec. 34-186. Disposition of Property Removed by City
(a) If, in the opinion of the city manager, the value of any abandoned property
or an inoperable motor vehicle is less than $1,000.00, and after the
notices have been given as provided in section 34-185, the city manager
may summarily dispose of the abandoned property or inoperable motor
vehicle on terms deemed advisable by the city manager after the passage
of thirty (30) days from the date of the notice required in section 34-185. If
notice has been published, disposition may take place after thirty (30)
days of the date of publication.
(b) If, in the opinion of the city manager, the value of the abandoned property
or an inoperable motor vehicle exceeds $1,000.00, the abandoned
property or inoperable motor vehicle shall be disposed of at public sale in
accordance with the provisions of subsection (c) of this section. Any public
sale shall be held not sooner than 30 days from the date on which the
notice is given pursuant to section 34-985.
SECTION 2. SEVERABILITY.(adding to the Code). If any section, paragraph, phrase, or word of this
Ordinance is held to be unconstitutional or invalid, such portion shall not affect the
remaining portions hereof and it shall be construed to have been a legislative intent to
pass this Ordinance without such unconstitutional or invalid part.

SECTION 3. CONFLICTING PROVISIONS. Any ordinance or resolution, or
parts of an ordinance or resolution, in conflict herewith are repealed.
SECTION 4. EFFECTIVE DATE. This Ordinance shall take effect immediately
upon its adoption.

day of 1999.

Sec. 34-186. Disposition of property removed by city. EXISITNG CODE
(a) If, in the opinion of the city manager, the value of any abandoned property or an
inoperable motor vehicle is less than $250.00, and after the notices have been given as
provided in section 34-185, the city manager may summarily dispose of the abandoned
property or inoperable motor vehicle on terms deemed advisable by the city manager
after the passage of 30 days from the date of the notice required in section 34-185. If
notice has been published, disposition may take place after 30 days of the date of
publication.
(b) If, in the opinion of the city manager, the value of the abandoned property or an
inoperable motor vehicle exceeds $250.00, the abandoned property or inoperable motor
vehicle shall be disposed of at public sale in accordance with the provisions of
subsection (c) of this section. Any public sale shall be held not sooner than 30 days from
the date on which the notice is given pursuant to section 34-185.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, as follows:
SECTION 1. (adding to the Code) Section 74-60, Truck Parking(adding to the Code). is hereby deleted in its entirety, and
the following is adopted in lieu thereof:
Sec. 74-60. Truck Parking.
It shall be unlawful for any truck weighing 6,000 pounds or more to park
anywhere within the City of Cape Canaveral for more than four (4) consecutive
hours where so posted.
SECTION 2. SEVERABILITY. (adding to the Code). If any section, paragraph, phrase, or word of this
Ordinance is held to be unconstitutional or invalid, such portion shall not affect the
remaining portions hereof, and it shall be construed to have been a legislative intent to
pass this Ordinance without such unconstitutional or invalid part.
SECTION 3. CONFLICTING PROVISIONS. (adding to the Code). Any ordinance or resolution, or parts
of an ordinance or resolution, in conflict herewith are repealed.
SECTION 4. EFFECTIVE DATE. (adding to the Code). This Ordinance shall take effect immediately
upon its adoption.

Sec. 74-58. Authority to establish no park-
ing zones.
(a) Except as provided in subsection (b) of this
section, the chief law enforcement officer may
establish no parking zones by designating those
places where motor vehicles are prohibited from
parking. The chief law enforcement officer shall
place a sign or other identifying mark indicating
no parking zones.
(b) The city fire chief shall designate all fire
lanes in which it shall be unlawful for any vehicle
to park in accordance with the provisions of
section 74-62. The city fire chief or designee is
designated as a parking enforcement specialist
who may enforce prohibitions against parking in
fire lanes.

section, the term "beach end street" means a
street within the city that has as its east terminus

Sec. 74-62. Designation of fire lanes.
(a) The city fire chief shall be authorized to
designate fire lanes on or in a public street, alley
roadway or premises, or on any public property
which, in his opinion, would be necessary or
desirable for the free movement of fire apparatus
or of firefighting personnel responding to or oper-
ating at a scene of a fire or other public emer-
gency.
(b) Designated fire lanes authorized by the city
fire chief shall be appropriately identified with
signs bearing the words "Fire Lane, No Parking"
The signs and lettering shall be standard infor-
mation type traffic signs, with red letters on white
background. In addition, the city fire chief may
require diagonal striping placed on or in any
public street, alley, roadway or premises or on any
public property or any private property to which
the public has access and the words "Fire Lane
No Parking" painted thereon in letters no less
than 18 inches in length.

Award Stormwater Master Plan to SSA
On February 1, 1999 a City Council Workshop was held at the Annex about the
Stormwater Management. (This Powerpoint presentation is available at the Public Works
Department for review). As the result of this presentation by the Public Works Department and
SSA, Council was informed of the Nation Pollutant Discharge Elimination System (NPDES)
Stormwater Program. In keeping the City in compliance with Phase II of this rule, Council had
requested a proposal for a Stormwater Master Plan from Stottler Stagg and Associates (SSA).
Attached is a copy of the detailed proposal from SSA. This plan is a critical component in
meeting the requirements of the NPDES Stormwater Program. The most important items are
improvement of our water quality, and public information, education and involvement of our
citizens. Due to the complexity of this plan, the fee for this proposal from SSA is in line with
similar plans completed by other cities
Recommend the approval of the proposal for the Stormwater Master Plan from SSA in the
amount of $43,500 and the appropriation of the necessary funding.

RE: SSA Revised Fee Proposal for Stormwater Master Plan for the City of Cape Canaveral
Dear Ben:
Per your request, Stottler Stagg & Associates, Architects, Engineers, Planners, Inc. (SSA) is pleased to
present our fee proposal for a stormwater master plan for the City of Cape Canaveral. In general, the goal
of this propoal is to provide a stormwater quality plan that addresses the major Banana River Lagoon
outfall basins of the City's stormwater system. This water quality program will be directed toward assisting
the City's compliance with Phase II of the National Pollutant Discharge Elimination System (NPDES)
Stormwater Program. Under this program, all regulated small municipal stormwater systems will be
required to develop and implement an overall stormwater quality management program. The program
compotllents will include at least the following measures:
• Public education and outreach on stormwater impacts.
• Public involvement and participation.
• Illicit discharge detection and elimination.
• Construction site runoff control.
• Post -construction stormwater management in new development and re -development.
• Pollution prevention and good housekeeping of municipal operations.
It is proposed that eight (8) task orders will be followed in completing the City's stormwater quality master
plan. Each of these tasks are defined in our following scope of services.
SSA's specific scope of services includes the following:
SSA SCOPE OF SERVICES
Task 1 - Lula Collection and Field Investigations: SSA will begin work by reviewing the City's historic
database as it relates to drainage basin delineation's, FDOT surveys of culverts underneath SR
A1A, City stormwater systems discharging into the Banana River Lagoon, existing aerial
photography, water quality data of the Lagoon, soil surveys, land use maps, zoning maps, and
rights-of-way maps showing available easements to the river.
Task 2 - Sub -Basin Delineation: To generate a cost effective plan, it is proposed by SSA that sub -basin
delineation be coordinated with earlier City work. As this is a w,-er Quality study it is proposed that
10 to 12 sub -basins be modeled for runoff into the Banana River Lagoon. The sub -basins will
include those lands east of SR A1A in which the DOT culverts will be used as a control for those
basins. The western basins will be tied to the stormwater outfall pipes which discharge directly to
the Banana River. SSEwill provide limited field surveys to coordinate DOT culverts and those
inverts of outfall pipes to the Banana River Lagoon.

Task 3 - Evaluation of Stormwater Quality Problems: For this task SSA will coordinate with regulatory
agencies and Brevard County to review available data on the water quality of the Lagoon system.
SSA will also investigate major outfalls from the City's stormwater system into the Lagoon.
Task 4 - Development of a Level of Service Matrix: SSA will develop a level of service matrix for
stormwater quality. This matrix will provide a distinct and measurable criteria which can be
presented to the agencies. This criteria will also provide a basis for the maintenance of the system
as it relates to stormwater quality.
Task 5 - Hydrologic Modeling: SSA will use the adICPR program to generate preliminary hydrologic
models for each of the City's outfalls. This modeling will review both the mean annual storm and
the 10 -year design storm for the City's systems. This primary purpose of this work will be to
establish loading rates for each of the City's outfalls in terms of transported pollutants. Land use
maps will be used in the modeling with average pollutant runoff rates for each of the sub -basins.
Pollutant parameters will be determined for each of the outfall systems.
Task 6 - Capital Improvement Protects: Based on the hydrologic modeling and pollutant determinations,
SSA will develop preliminary stormwater designs for each point source outfall into the Banana
River Lagoon. (It is anticipated that 5 to 7 existing outfalls will be evaluated.) Preliminary cost
estimates will be prepared for each of the outfall designs.
Task 7 - Review of Funding Alternatives: SSA will review potential funding alternatives for the City's
stormwater outfall system. Recommendations will include potential grants.
Task 8 - Team Meetings (City Commission Presentation & Progress Review): This SSA work task will
include coordination meetings throughout the development of the stormwater quality plan. It is
anticipated that the following meetings be held:
1. Kick-off meeting with City staff to review the available database.
2. Review of sub -basins and cutfalls with City staff.
3. Review of Level -of -Service Matrix with City staff.
4. Review of pollutant loadings with City staff.
5. Review of Capital projects and funding services with City Staff.
6. Presentation of plan to City Commission.
SCHEDULES AND FEES
Schedules: SSA will begin work immediately upon receipt of written authorization to proceed from the City.
Approximately forty (40) working days will be required for tasks 1 through 4 above. The remaining work
tasks (5 thru 7) will be scheduled following the City meeting in which the Level -of -Services are reviewed.

The above fees include reproduction costs for six (6) stormwater quality plan reports. Additional printing
requested in writing by City will be invoiced at SSA's cost plus 10%.
SSA's fees will be invoiced once per month based on a percentage of work being completed and payment
w"! be due within thirty (30) days of receipt. Additional work authorized in writing by the City of Cape
Canaveral that is not specifically included in this proposal will be billed at SSA's standard hourly rates or
negotiated as a lump sum.
The City of Cape Canave al and SSA respectively bind themselves, their partners, successors, assigns and
legal representative to the other party to this Agreement and to the partners, successors, assigns, and legal
representatives of such other party with respect to all covenants to this Agreement Neither the City of
Cape Canaveral nor SSA shall assign, sublet or transfer any interest in this Agreement without the written
consent of the other.
The terms and conditions of this proposal are effective through October 1, 1999. Acceptance after this date
may necessitate increased fees or altered conditions.

The city recently received the attached correspondence from the United States
Environmental Protection Agency indicating the proposed regulations for storm water
that may affect our community will be in place by November 1, 1999. Our Public
Works Director has a copy of the regulations if you want a copy to review.
Additionally John Pekar, our city engineer has submitted a proposal to
develop a storm water master plan and he is scheduled to present his proposal to
city council on 8-17-99.
I would also want an opinion from staff and our city engineer as to how the
city could meet the (6) minimum measures mentioned in EPA's letter.

The National Pollutant Discharge Elimination System (NPDES) existing storm water
program is resulting in significant improvement in surface water quality in the United States by
reducing polluted runoff from a large number of priority sources, including large and medium
municipal separate storm sewer systems (MS4s). Currently, EPA Region 4 is the NPDES
permitting authority for facilities discharging storm water that are subject to the Phase I
regulations. These regulations are applicable to eleven categories of industries and municipalities
with greater than 100,000 population. Those municipalities with lesser populations are
considered to be Phase 2 MS4s and regulations applicable to these municipalities were proposed
on January 9, 1998, copy enclosed. Final regulations are expected to be in place by November 1,
1999. The intent of this letter is to notify your municipality that it is listed in the proposed
regulations as one that may be subject to having to get coverage under an NPDES permit.
In this proposed rule, EPA is planning to establish a cost effective, flexible approach for
reducing negative environmental impact by storm water discharges from this unregulated source.
For instance. EPA believes that the implementation of the six minimum measures, which focus on
"best management practices" (BMPs) approach, identified for small municipalities in this
proposed rule, should significantly reduce pollutants in urban storm water runoff in a cost
effective manner. If after implementing the six minvnum measures there is still a water quality
problem, the municipality can expand or use better tailored BMPs in the minimum measures to

The rule provides for an NPDES program approach that encourages the use of general

Phase II Source Decisions on how a municipal entity may be covered by the rule. This is found
on page 1549 of the enclosed Federal Register.(adding to the Code). Please be aware that the State of Florida
Department of Environmental Protection is expected to be the permitting authority when
decisions are to be made in implementing the Phase 2 storm water program. Authorization of the
storm water NPDES program to the State is scheduled to occur in the year 2000.
