REPORTS: 7. City Manager's Report AUDIENCE TO BE HEARD: Comments will be heard on items that do not appear on the agenda of this meeting.Citizens will limit their comments to five (5) minutes.The City Council will not take any action under the "Audience To Be Heard" section of the agenda. The Council may schedule such items as regular agenda items and act upon them in the future. This notice does not constitute consent by the City for the introduction or admission into evidence of otherwise inadmissible or irrelevant evidence,nor does it authorize challenges or appeals not otherwise allowed by law.Persons with disabilities needing assistance to participate in any of these proceedings should contact the City Clerk's office (868-1221) 48 hours in advance of the meeting. \\CAPE-NPcityclerk\CityClk\AGENDA\REGULAR\1999\03-16-99.doc RESOLUTION NO. 99-05 A JOINT RESOLUTION OF THE COASTAL COMMUNITIES OF CAPE CANAVERAL AND COCOA BEACH, LOCATED WITHIN BREVARD COUNTY FLORIDA, IN SUPPORT OF FEDERAL FUNDING FOR THE CONGRESSIONALLY APPROVED SHORE PRTOECTION PROJECT FOR BREVARD COUNTY, AND TO SUPPORT AN INCREASE IN THE FEDERAL PERCENTAGE OF COST-SHARE FUNDING FOR THIS PROJECT. WHEREAS, on March 03, 1999 the City of Cape Canaveral, Florida and the neighboring City of Cocoa Beach, Florida held an historic joint meeting to discuss mutual issues beneficial to both cities; and WHEREAS, both cities recognized the need to address the ongoing severe erosion problem occurring along their Atlantic coastline; and WHEREAS, numerous studies and U.S. Army Corps of Engineers (USACE) reports have indicated that Canaveral Harbor, a federal navigation project, has severely impacted the downdrift (south) Atlantic shoreline, including the beaches within the coastal communities of the Cities of Cape Canaveral and Cocoa Beach; and WHEREAS, as of this date, the USACE has failed to adequately address and mitigate for these erosion damages; and WHEREAS, in December 1996, Congress approved a federal shore protection project for the severely eroding beaches of Brevard County, including those beaches within the jurisdictions of said coastal communities; and WHEREAS, to date, Congress has failed to fund the construction of this project, thereby placing millions of dollars of coastal infrastructure and thousands of human lives vulnerable to potential storm damage and ongoing erosion; and WHEREAS, the federal government has failed to fully recognize and address the erosion impact of Canaveral Harbor on Brevard County beaches, including the beaches of the Cities of Cape Canaveral and Cocoa Beach; and WHEREAS, a non-partisan review of the erosion affects of Canaveral Harbor and a subsequent adjustment of the federal portion of the cost-share of this project is required. Joint Resolution Cape Canaveral and Cocoa Beach Shore Protection Project Funding Page 2 NOW, THEREFORE, BE IT RESOLVED by Joint Resolution of the Cities of Cape Canaveral and Cocoa Beach, Florida to hereby: Section 1. Request Congress to fully fund the federal Shore Protection Project for Brevard County, Florida; and Section 2. Conduct an investigation of the level of federal cost-share participation for the Brevard County Shore Protection Project and adjust the federal cost-share to reflect the extensive damage to our Atlantic coastline attributable to the federal navigation project. DONE, ORDERED AND ADOPTED in Regular Session this the day of 1999 by the City Council of the City of Cape Canaveral, Florida.
