Requested Action:
City Council consider the sole source purchase of a vortechnics stormwater treatment system in the amount of
$16,000 as recommended by the public works director.
Summary Explanation & Background:
The city received a cost sharing grant from the St. Johns River Water Management District in the amount of
$20,900. The public works director estimates the total project cost at $50,000. This project will treat onsite
stormwater at the public works facility.

Stormwater Recovery Project Cost Sharing Agreement
Sole Source Purchase of Vortechnics, Model 4000
SJRWMD Contract #SD631AA
The City of Cape Canaveral made application for funding from St. John's Water
Management District through the Stormwater Cost Sharing Program. On March 23, 2000 the
City received notice for funding in the amount of $20,900 for this project. City of Cape
Canaveral Council approved the cost sharing agreement on August 81h 2000.
The scope of the Stormwater Recovery Construction Cost Sharing project will consist of
the collection and pretreatment of Stormwater at the Public Works Facility. This pilot project
will determine the feasibility of utilizing Stormwater as a supplement for reclaimed water and the
further expansion of the program. Funding for this cost-sharing capital project to be appropriated
for this budget year from the Enterprise Fund. Estimated total cost for this project is $50,000.
The Sole Source purchase of the Vortechnics Model 4000 was approved by SJRWMD as
part of the cost sharing agreement. This product is to be installed for evaluation and testing.
Recommend the approval of the sole source purchase of the Model 4000 system for the
amount of $16,000.

1) Initial Wet Weather Phase
During a two-month storm event the water level begins to
rise above the top of the inlet pipe. This influent control
feature reduces turbulence and avoids resuspension
of pollutants.
3) Full Capacity Phase
When the high-flow outlet approaches full discharge, storm
drains are flowing at peak capacity. The Vortechs System is
designed to match your design storm flow and provide treat-
ment throughout the range of storm events without bypass-
ing. To accommodate very high flow rates, Vortechnics can
assist designers with configuring a peak -flow bypass.
2) Transition Phase
As the inflow rate increases above the controlled outflow
rate, the tank fills and the floating contaminant layer accu-
mulated from past storms rises. Swirling action increases
at this stage, while sediment pile remains stable.
4) Storm Subsidence Phase/Cleaning
Treated runoff is decanted at a controlled rate, restoring the
water level to a low dry -weather volume and revealing a conical
pile of sediment. The low water level facilitates inspection and
cleaning, and significantly reduces maintenance costs. The
system's central baffle prevents transfer of floatables to the
outlet during cleaning or during the next storm.

Vortechs System Inlet/Outlet Configurations

The inlet pipe can enter the end or side of the
tank at right angles - outlet pipes can exit the end

City Council review and comment on this draft resolution that will establish a reuse water operating protocol
for future drought periods.
Summary Explanation & Background:
This is a working draft for settlement of this dispute process with the City of Cocoa Beach. It establishes a
protocol for future drought periods. This does not amend the interlocal agreement; it provides for the
operating protocol that both staffs will follow.
The City of Cocoa Beach city manager has this under review by their legal staff, and I should receive their
comments for our meeting.

JOINT RESOLUTION NO. 2000-
A RESOLUTION OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, PURSUANT TO §164.1057,
EXECUTION OF RESOLUTION OF CONFLICT AS SET
FORTH IN CHAPTER 164, FLORIDA STATUTES,
REGARDING THE FOLLOWING DISPUTE:
The City of Cape Canaveral, Florida & The City of
Cocoa Beach, Florida regarding that certain
Interlocal Agreement dated April 6, 1994, as
amended by the First Amendment to Interlocal
Agreement dated February 6, 1996;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS The City of Cape Canaveral, Florida and The City of Cocoa Beach, Florida
entered into an Interlocal Agreement dated April 6, 1994 regarding the supply of reuse water for
public irrigation; and
WHEREAS said Interlocal Agreement was amended by the parties' adoption of the First
Amendment to Interlocal Agreement dated February 6, 1996; and
WHEREAS a dispute has arisen between The City of Cape Canaveral. Florida and The City
of Cocoa Beach, Florida as to their respective rights and obligations under the Interlocal Agreement,
as Amended; and
WHERE AS Chapter 164, Florida Statutes, provides a means for dispute resolution amongst
local governmental entities; and
WHEREAS the parties' having availed themselves of the resolution procedures set forth in
Chapter 164, however, not having completed all of the requirements of Chapter 164, do hereby agree
to a Joint Resolution pursuant to §164.1057 Florida Statutes executing a resolution of this conflict;
and
WHEREAS the Interlocal Agreement, as Amended, provides in paragraph 4, amending sub-
paragraph 9 stating that operating protocols shall be mutually established such that both systems may
operate as an integrated reclaimed water system or such that both may also operate independent of
each other; and
WHEREAS this Joint Resolution shall establish an operating protocol between the parties
pursuant to the Interlocal Agreement, as Amended.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CAPE CANAVERAL, FLORIDA, and THE CITY COMMISSION OF THE CITY OF
COCOA BEACH, FLORIDA, as follows:
Section 1: The foregoing findings are incorporated herein by reference and made a part
hereof.
Section 2: It is the intention of The City Council of The City of Cape Canaveral and the
City Commission of The City of Cocoa Beach to resolve the present conflict
between the parties related to the supply of reuse water for public irrigation.
Section 3: The present conflict between the parties shall be resolved by the adoption of
this Joint Resolution extending to the upcoming drought periods.
Section 4: The resolution of the present conflict shall be the adoption of Joint
Resolution which will establish a reclaimed water transfer operating protocol
to be implemented as follows:
1. The Reclaimed Water Treatment Protocol shall be implemented when
both of the following occur:
a. 'When a severe drought trend exists, as indicated by a PDSI
value of -3.0 or below - OR - the St. Johns River Water
Management District issues a Water Shortage Emergency
Order for the North Brevard area.
b. The total wastewater influent flow to Cape Canaveral Water
Reclamation Facility decreases to 7.0 million gallons per
week or below.
2. On a daily basis, the percentage of the total wastewater influent flow
to Cape Canaveral Water Reclamation Facility transferred to Cocoa
Beach may vary from the amount shown in Table 1 (below). On a
weekly basis, the percentage of total wastewater influent flow to Cape
Canaveral Water Reclamation Facility transferred to Cocoa Beach
should approximate the amount show in Table 1.
3. Table 1 provides the reclaimed water transfer protocol for the drought
period anticipated for the year 2001. Table 1 represents the average
amount of reclaimed water to be transferred to the Cocoa Beach
North Storage Tank as a percentage of the total wastewater influent

flow to the Cape Canaveral Water Reclamation Facility on a weekly
basis.

5. Reclaimed water will be transferred to Cocoa Beach on a daily basis,
at a rate of approximately 800 - 840 gallons per minute. The.Cocoa
Beach flow control valve shall be set to operate at this approximate
flow rate under Cape Canaveral distribution system operating
pressure. The amount of time that flow is transferred to Cocoa Beach
on a daily basis will be increased or decreased so that the total
quantity of reclaimed water transferred in a week will approximate
the amount shown in Table 1 for the respective wastewater influent
flow to Cape Canaveral Water Reclamation Facility.
6. Since wastewater influent flow quantities cannot be predicted in
advance, implementation of the protocol will necessarily occur on a
reactive basis. Implementation of the protocol requires Cape
Canaveral and Cocoa Beach staff to coordinate during the drought
period. Staff of both Cities will have access to wastewater influent
flow records for Cape Canaveral Water Reclamation Facility and will
independently calculate the total flow required by the protocol for
transfer to the Cocoa Beach North Storage Tank on a weekly basis.
Staff of both Cities will have access to reclaimed water transfer flow
records as recorded by the Cocoa Beach flow meter at the Cocoa
Beach North Storage Tank.

amount required by the protocol, staff of both Cities will mutually
determine adjustments to be made to the daily operating schedule to
recover the deficit or surplus during the following week.
8. That both parties shall be exempt from the Reclaimed Water Transfer
Protocol in the event of maintenance/failure of either parties
wastewater or reuse system.
Section 5: MONITORING OF DROUGHT CONDITIONS
The Palmer Drought Severity Index (PDSI) and Crop Moisture Index (CMI)
are indices of the relative dryness or wetness effecting water sensitive areas,
and will be utilized to indicate the demand for irrigation. Drought conditions
shall be monitored as follow:
Starting on the first Monday in March (approximately the first week
of the growing season), operating staff of the reclaimed water systems
for Cape Canaveral and Cocoa Beach shall each begin to keep a
weekly log of:
a. Palmer Drought Severity Index (PDSI)
b. Weather spell index (P - Preliminary or F -Final)
C. Crop Moisture Index (CMI)
d. Change in CMI from previous week.
Values for each parameter shall be recorded on Monday each week
up until the first Monday of September.
2. Weekly values for these parameters shall be obtained from the
Southern Region page for Region 3 from the National Oceanographic
and Atmospheric Administration (NOAA) website at
http://w-,vw.cpc.neep.noaa.gov/products/analysis_ monitoring/cdus/
palmer_drought
3. Starting on the first Monday in March, operating staff of the
reclaimed water systems for Cape Canaveral and Cocoa Beach shall
record weekly interpretations of the published value of each
parameter. Each staff shall utilize weekly interpretations of the
parameters in conjunction with weekly Cape Canaveral wastewater
influent data to independently determine the need for increased or

decreased conservation measures throughout the respected reclaimed
water service areas. Interpretations shall be as follows:
a. PDSI - A severe drought trend exists if the PDSI
value is -3.0 or below. A severe drought trend does
not exist if the PDSI is -2.99 or above.
b. Weather spell index - If a "P" (preliminary) is listed,
this indicates that the PDSI could revert to a different
value in the upcoming weeks if the current weather
trend (dry or wet) reverses to an opposite trend before
it becomes established. If a "F" (final) is listed, this
indicates that a weather spell is well established for
the upcoming weeks.
C. CMI - A CMI value of -3.0 or below indicates
drought conditions are predicted for a short term (the
upcoming week).
d. Change in CMI from previous week - When the CMI
value increased (or did not change) from the previous
week the drought is expected to be less severe (or
similar) throughout the upcoming week. When the
CMI value decreased from the previous week, the
drought is expected to become more severe
throughout the upcoming week.
Section 6: Should conflict in operation arise, both parties, under this resolution, shall
retain the right to call an emergency meeting between staffs, to maintain
adherence to the operating protocols.
Section '7: The staff of The City of Cape Canaveral, Florida and its City Attorney and
the staff of The City of Cocoa Beach, Florida and its City Attorney, are
authorized to take all actions required to implement and maintain compliance
with this Joint Resolution and operating protocols contained herein.
Section 8: This Resolution shall become effective immediately upon its adoption in
accordance with the Charter of The City of Cape Canaveral and the Charter
of The City of Cocoa Beach, Florida.

Legislative Priorities 2001
REVISE "SCHOOL HAZARD" DEFINITION
The City of Cape Canaveral supports the review of the effectiveness and applicability of the
criteria defining hazardous walking conditions for elementary school students contained in
s. 234.021 (3) F.S. The criteria are used to determine where hazardous busing can be
established within the normal 2 -mile school walking zone, the cost of which is reimbursed by
the state. Statute also directs local governments to correct any hazards so identified. The
statutory definition does not cover students in grades 7-12, does not address bicycling or
access to bus stops and is inconsistent with established engineering practice on the design
and location of sidewalks. The City of Cape Canaveral supports a cooperative effort by
school and local government officials to evaluate the current definition, to identify possible
improvements and to recommend how the criteria can be consistently applied throughout the
state.
CREATE INDIAN RIVER LAGOON INITIATIVE
The City of Cape Canaveral supports the creation of a state initiative to improve water quality
in the Indian River Lagoon. The City of Cape Canaveral recommends the initiative address
roadway drainage, which is an important source of pollutants, by assisting in the retrofit and
upgrade of existing storm water systems. The program should coordinate with other local,
state and federal transportation and water quality improvement programs. The City of Cape
Canaveral supports dedicated, multi-year funding that will maximize the program's benefits
and potentially leverage additional revenue.
FUND CRITICAL ROADWAY WIDENING PROJECTS
The City of Cape Canaveral supports the widening of the following regional roadways to
enhance motorist safety, economic vitality and hurricane evacuation:
US 192 from Interstate 95 to St. Cloud
SR 520 from Interstate 95 to SR 50
Interstate 95 from Fort Pierce to Daytona Beach
INDEX LOCAL OPTION GAS TAXES
The City of Cape Canaveral supports legislation that provides for the indexing of the local
option gas taxes. Indexing will permit the actual local option gas tax levy to vary in relation to
the overall level of inflation. Indexed gas taxes help offset increases in costs associated with
road improvements. State gas taxes are already indexed but local option gas taxes are not.
The basis for the indexing would be the general, broad-based Consumer Price Index. The
indexing would be independent of the price of gasoline FDOT indicates that for the past few
years the average change in the levy due to indexing has been only $0.001 per year. Such a
change in Brevard County would generate approximately $215,000 more in gas taxes that
would then be distributed to the local governments.
Emergency Management
The City of Cape Canaveral supports legislation that provides disaster preparedness and
hazard mitigation planning resources, training and financial assistance to municipalities in
order to prepare and respond to natural and human -made disasters / emergencies that may
threaten Florida's communities.
Land Use / Comprehensive Planning
The City of Cape Canaveral supports legislation that would streamline municipal
comprehensive planning functions to reduce unnecessary requirements and provide flexibility
for local governments to take into consideration the diverse characteristics of local
communities in adopting and implementing their local comprehensive plans.
Coastal Management
The City of Cape Canaveral supports legislation that provides for the funding of the purchase
of publicly owned coastal land emphasizing public beach access, shoreline recreation,
restoration, environmental education and hazard management. The City of Cape Canaveral
supports related programs such as Florida Forever, Florida Communities Trust, Save Our
Coast, Conservation and Recreation Lands (CARL) and other state and federal funding
programs.
Public Safety
The City of Cape Canaveral supports legislation that would increase the drug free "safe zone"
from 200 to 1000 feet for the purposes of enforcing special criminal penalties for drug dealing
in or near public parks.
Stormwater
The City of Cape Canaveral supports legislation that would provide local governments with
funding mechanisms and regulatory authority sufficient to achieve state or federally
mandated pollutant loading reductions.
Public Education
The City of Cape Canaveral supports legislation that would eliminate barriers to allow
municipal and school district property to be shared or co -located.

Reclaimed Water Project Phase IV, Part 1
Carl Hankin's Inc. Change Order
As a requirement of the City's Wastewater Treatment Permit requirement, the City of Cape
Canaveral is to construct a reclaimed water distribution system. The Operation Permit outlined four (4)
Phases of construction. Three of the four phases have been substantially completed. City is on schedule as
required by our DEP Operating Permit.
The City advertised requests forbid for the construction of Phase III Extension. The scope of this
project is to construct the reclaimed water distribution system with services. The City of Cape Canaveral
advertised that the methodology of construction to be directional boring. The scheduled bid opening was
held on September 29, 1999 at 3:15 p.m. at the City Hall Annex. The City received three (3) bids. On
October 5`]' City Council awarded Bid 99-03 to the low bidder, Carl Hankins, Inc. The bid award of the
project is a unit bid price contract.
On August 1" 2000, City Council approved the proposal submitted by Carl Hankins Inc for Phase
IV, Part 1. This project is 100% Impact Fund eligible and funds have been budgeted for the 2000-2001
fiscal year. In addition, the City of Cape Canaveral has received a grant from St John's River Water
Management District (SJRWMD) in the amount of $72,180 for the construction of the first half of this
project, i.e. from the treatment facility to A IA.
The change order for Phase IV Part 1 resulted in changes in the number of units utilized in the
construction of the project. The number of units installed in Phase IV Part 1 has been checked and verified
by the City of Cape Canaveral's Inspector in the amount if $25,393.55. In addition, Carl Hankins, Inc.
submitted a claim for the extra cost incurred for the A I A casing bore in the amount of $29,996.53 (see -
attached claim). After careful consideration by city staff, it was agreed upon that the claim for additional
rock, sheeting and trench boxes were justifiable in the amount of $12,200.77. More so, Carl Hankins, Inc.
agreed to credit the City of Cape Canaveral $2,638.23 for the additional time required by the City's
Inspector. The total requested change order for Phase 1V Part 1 is $34,956.09.
($25,393.55+$12,200.77 less $2,638.23).
Note: The City of Cape Canaveral is holding retainage in the amount of $30,244.73 from purchase order
no. 618. This change order will require a new purchase order in the amount of $65,200.82 for FY00/01.
Recommend the approval of Change Order for Phase IV, Part 1, in the amount of $34,956.09 and
the appropriation of necessary funds.
