PRESENTATION: Mr. Doug Schoenberger, Waste Management presented a
check to Lt. Gary Young of the Brevard County Sheriff's Office
for the cost of sponsorships to the Camp Chance Summer
Youth Program. Mr. Bruns related that his granddaughter
attended and explained that it is an excellently run camp for
kids.

A motion was made by Mr. Bruns and seconded by Mr. Petsos to approve
Ordinance No. 07-2000.
There was no public comment.
The motion passed 5-0, with voting as follows: Mr. Weber, For; Mr. Treverton,
For; Mr. Bruns, For; Mayor Pro Tem Petsos, For and Mayor Randels, For.
2. (Tape 1, 389) Mayor Randels read Ordinance No. 08-2000 by title. Amending
Chapter 94, Signs, By Re -Adopting The Chapter In Its Entirety,
Providing Additional Definitions, Exceptions, Lighting, Criteria,
Standards, Conformance Time Limits, Off -Premises Signs,
Awnings And Canopies, And Automotive Service Station Signs;
Amending District Regulations Requirements.
A motion was made by Mr. Treverton and seconded by Mr. Bruns to approve
Ordinance No. 07-2000.
City Planner, Todd Peetz, related that over -referencing was done and spelling
errors were made, but no changes of substance. Mr. Bruns queried why real
estate brokers must display their broker numbers. City Attorney, Mark
McQuagge stated that he is unaware of a legal rationale for the requirement.
Mr. Bruns requested that the requirement be stricken. Beatrice McNeely,
Planning and Zoning Chair also was unaware of its purpose. Morris Reid,
Acting Building Official, did not know of its significance.
Amending motion to incorporate changes of over -referencing and spelling
errors, as well as striking the sentence in section 14-76 by Mr. Treverton and
seconded by Mr. Bruns. Passed 5-0
Mayor Randels queried when enforcement could be accomplished on window
signs in convenience stores. Mr. Peetz opined and Council concurred that it
can be done immediately upon removing the existing advertisements in
windows.

Including clubhouses within the schedule of sewer rates for
Multi -family residential units
A motion was made by Mayor Randels and seconded by Mr. Treverton to
approve Resolution No. 2000-22.
Mayor Randels explained that Villages of Seaport brought this matter to the
City's attention that they pay the commercial rate currently of 410 percent. Mr.
Petsos queried what the revenue impact would be. City Treasurer, Andrea
Bowers reported that it is equivalent to approximately $1700 per month less
revenue amongst the 13 current condominiums. Mr. Petsos expressed
concern that this $20,000 decrease in revenue was not a factor in the recent
sewer fee study that was approved two weeks ago.

4. (Tape 1, 1166) Mayor Randels read Resolution No. 2000-22 by title.
Establishing a Reclaimed Water Rate for the Canaveral Port Authority.
A motion was made by Mr. Weber and seconded by Mayor Randels to
approve Resolution No. 2000-23.
Mr. Petsos expressed concern that this is an inappropriate time to consider
this resolution in light of the conflict resolution with the City of Cocoa Beach.
Mr. Gardulski explained that the Port is ready to receive water and the City
has already agreed to provide reclaimed water. Mr. Treverton agreed with Mr.
Petsos' opinion even though he was initially inclined to approve the
resolution. Council concurred that staff should resolve the current conflict with
Cocoa Beach before going further with the Port. Mayor Randels queried if he
can speak with Mayor Scott. Council said no; staff should do the negotiating.
Ms. Jennifer Woodall, P.E., Hartmann & Associates, representing the Port,
reminded Council that the City of Cocoa Beach relinquished 100,000 gallons
of their initial allocation to be sent to the Port. Mr. Gardulski stated that water
will have to go into the river if we do not send water, is that the directive of
Council? Council concurred that in lieu of sending water to the river, it should
be sent to the Port at no cost. (if Cocoa Beach refuses)
Mr. Bruns made a motion to table the resolution and seconded by Mr. Weber.

CONSIDERATIONS:
5. (Tape 1, 1678) School Resource Officer Agreement with the City of Cocoa
Beach
A motion was made by Mr. Bruns and seconded by Mr. Petsos to approve
the School Resource Officer Agreement with the City of Cocoa Beach.
Mr. Treverton mentioned that this issue was discussed at the Budget
workshop and it is an honorable $3,008 expenditure.

6. (Tape 1, 1812) Alternative Water Supply Cost -Sharing Agreement with the
St. Johns Water Management District
A motion was made by Mr. Weber and seconded by Mr. Petsos to approve
the Alternative Water Supply Cost -Sharing Agreement with the St. Johns
Water Management District.
Mr. Gardulski explained that this is likely the last opportunity for reclaimed
water grant funding. This would essentially complete the City's system. The
cost for this phase (16" line and jack and bore of A1A and the wastewater
plant to Al A) $290,000. The Second Phase of this Reclaimed Water Main at a
future meeting.

DISCUSSION:
(Tape 1, 2290) City Fireworks Code
Concerned residents presented this issue. City Attorney, there is a specific code
that was intended for larger displays; at this point state statutes have to be referred
to. Legislation can be drafted to prevent folks from using personal fireworks. It
would likely be challenged. It would be a tough sell and tough enforcement effort to

totally prevent fireworks on the beach. The issue currently is one of crowds.
Therefore, there is difficulty in enforcement. Lt. Gary Young stated that public
education is the key to controlling fireworks activities. There are sufficient existing
laws for enforcement. Mr. Treverton suggested that volunteers and police presence
be coordinated with the Fire Department also, as in years past. Lt. Young stated
that he would manage an overlapping schedule in an effort to reduce costs. Mr.
Gardulski suggested designating an area that could be supervised. Staff was
directed to coordinate with police and fire departments to make recommendations.
REPORTS -
14. City Manager — Bennett Boucher (Tape 1, 3600)
o Mr. Boucher reported that next Monday could be used for a last Budget
Workshop. August 1 is when the tentative millage will be set. Consensus
was to cancel the budget workshop.
o The revised Stormwater Master Plan has been completed and is ready
to be scheduled for workshop. Mr. Bruns and Mr. Weber requested mid-
August.
o Thurm Boulevard is near completion.
o Notice was received Monday from Cocoa Beach for a conflict resolution
regarding reclaimed water. Our City Attorneys recommend adoption of a
resolution requesting Cocoa Beach to adopt a procedural resolution for
resolving the conflict. Letter to Cape Canaveral indicates a breach;
response indicates that we see differently and we request primary status.
A motion was made by Mr. Bruns to place an add-on item on the agenda to
adopt the Conflict Resolution, seconded by Mr. Weber.
Mayor Randels read Resolution No. 2000-24by title.
A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, PURSUANT TO §164.1052 FLORIDA STATUTES,
INITIATING THE CONFLICT RESOLUTION PROCEDURES SET FORTH IN
CHAPTER 164, FLORIDA STATUTES, REGARDING THE FOLLOWING
DISPUTE:
The City of Cape Canaveral, Florida & the City of Cocoa Beach,
Florida regarding that certain Interlocal Agreement dated April
6, 9994, as amended by the First Amendment to Interlocal Agreement
dated February 6, 9996.

Resolution No. 2000-24. The motion passed 5-0, with voting as follows: Mr.

There was no public comment. Mr. McQuagge explained that staff would be
represent the City, at this stage of the Conflict Resolution process. If there is
no resolution, then another meeting would be scheduled with joint Councils.

Audience
o Mrs. Lee Vicidonimi, resident, queried will sand fencing continue? Mr. Petsos
responded that we would continue when turtle -nesting season is over.
o Mr. Gene Petri, resident, expressed delight to hear the discussion regarding the
fireworks problems on July 4"'. He queried if the City has bicycle laws, not
using traffic signals, stopping or having lights. Mr. McQuagge related that bikers
are subject to the same traffic laws as vehicles, including illumination
requirements.
Mr. Petri queried if there is a street lighting program. Mr. Gardulski responded
that we have a street lighting and pedestrian lighting programs.
Mr. Leo Nicholas related that he noticed that City Boards were not involved in
the budget process. He suggested that all boards be notified when the process
starts and bring them into the loop. Henceforth, draft budgets will be provided to
the boards.
Mr. Nicholas related that he went to the Library and City Hall to obtain a copy of
the County's Comprehensive Plan and it is unavailable in both places. Mr.
Peetz related that the county only distributes to selected libraries and no cities.
To obtain one, they must be requested from the County.
o Mr. Dennis Franklin, former Building Official, was present and related that he
has taken a position as Building Official with the City of Winter Springs.

RE: City Council Agenda Item for August 15, 2000
Contract Administration and Inspection Service for the Reclaimed Water
Phase IV, Part 1 and Extension by Stottler Stagg and Associates.
The City of Cape Canaveral Council awarded the Change Order to Phase IV, Part I to
Carl Hankins Inc., for the construction of the Reclaimed Water Extension. Attached is a
proposal from SSA for the contract administration and inspection service that is recommended
for a project of this extent. SSA was the design engineer of this project and have satisfactory
performed contract administration and inspection service for other City of Cape Canaveral
reclaimed water projects. Funds are available within the Enterprise Impact Fund for this project.
This project is 100% funded by the City of Cape Canaveral with the aid of matching grants.
SSA's fees are based on an hourly rate and will be invoiced on actual work performed.
Recommend the approval of Task 1 & 2 for contact administration and inspection service
from SSA in the amount not to exceed $9,674 and to appropriate the necessary funds.

RE: SSA Fee Proposal for Construction Inspection Services for Phase 4 -Part 1
Re -Use Water Line (Part 1 -Tasks 1 and 2)
Dear Ed.-
Per

Per your request, SSA is pleased to present our fee proposal for construction inspection
services of the Phase 4 -Part 1 Re -Use Line program (Tasks 1 and 2). Task 1 of the
construction will include re -use lines along Tower and Central Avenues from the City's
Wastewater Treatment Plant (WIIVfP) to SR A1A. Task 2 will include the jack & bore
under SR Al A.
As much of the existing road rights-of-way includes open fields for both parts of the
construction, the majority of the work may include open cut line placement. In general,
SSA will perform Contractor coordination and on-site inspection services on a part-time
basis (20± hours per week for 7 weeks, 140+ hours total) and will also review
Contractor provided record drawings of the completed work.
Construction times have been estimated as follows for the Phase 4 -Part 1 re -use work:
• Task 1 - City Plant to SR A1A: 5 weeks
• Task 2 - Jack & Bore under SR Al A: 2 weeks
SSA SCOPE OF SERVICES
Item 1 - Inspection: SSA's Construction Inspector will observe on-going work to
coordinate for the City that construction is in accordance with design drawings
and specifications. Daily inspection reports and photographs will be provided for
inspection activities, SSA will also hold pre -construction and weekly meetings
with the Contractor. SSA inspection work will be coordinated with the selected
Contractor for each of the contract parts. The City will give SSA a Notice To
Proceed for each part.
SCHEDULES AND FEES
Schedules: Upon receipt of written authorization to proceed SSA will coordinate
schedules with the contractor and the City. Once construction starts, it is anticipated
that Item 1 will be the first segment constructed. The City will direct schedules for each
part of the work.

Fees: SSA's budget costs for each part are broken down as follows:
Task 1
Project Engineer: 4 hours x $82.00 = $' 328.00
Field Engineer: 100 hours x $65.00 ='$6L500.00

Task 2
Project Engineer: 3 hours x $82.00 = $ 246.00
Field Engineer: 40 hours x $65.00 = $2,600.00
$2,846.00
(Each Task will also include a $70.00 print/photo charge for inspection work.) Note:
Only actual hours worked will be billed.
If this project phases extend past December 31, 2000, SSA may adjust our hourly rates
above.
Fees will be billed monthly based on hourly work performed with reimbursable expenses
and payment will be due within thirty (30) days of receipt.
Additional work authorized in writing by the City that is not specifically included in this
proposal, such as follow-up coordination work with land owners, contractor special
meetings (such as claims), etc., will be deemed as additional services upon City's
written authorization to proceed and will be billed at SSA's standard hourly rates or
negotiated as a lump sum prior to beginning work. Out-of-pocket expenses for hourly
work and additional printing will be billed with a fifteen percent (15%) mark-up.
Compensation rates are based on ordinances, regulations and procedures in force on
the execution date of this Agreement by the appropriate governing bodies having
jurisdiction over the project. Any significant modification in these ordinance, regulations,
procedures, etc. shall be justification for re -negotiation for the compensation due to the
Consultant for the work involved.
It is understood that any and all professional liabilities incurred by SSA throughout the
course of rendering professional services on this project shall be limited to a maximum
of the net fee received by SSA, not including reimbursable expenses and sub -
consultants, for all services rendered on the project. Should it become necessary to
obtain a third party to collect our fees for services, the City hereby agrees to pay all
costs of such collections including Attorney's fees.
The City and SSA respectively bind themselves, their partners, successors, assigns and
legal representative to the other party to this Agreement and to the partners,
successors, assigns, and legal representatives of such other party with respect to all
covenants to this Agreement. Neither the City nor SSA shall assign, sublet or transfer
any interest in this Agreement without the written consent of the other.

BASED UPON RATE STUDIES; PROVIDING FOR REPEAL OF
CONFLICTING ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED, by the City Council of the City of Cape Canaveral, Brevard
County, Florida, as follows:
SECTION 1. Section 78-152, Monthly Sewer Rates, subsection (a), of the Code
of Ordinances is hereby amended by the deletion of subsection (a) in its entirety and
adopting the following in lieu thereof:
Sec. 78-152, Monthly Sewer Rates.
(a) Any user of the service of the sewer system shall pay a monthly
charge or rate as set forth in Appendix B to this Code. The schedule of fees
is subject to revision as may be necessary to keep rates commensurate with
the changes in the cost of providing service and is otherwise subject to
revision due to any regulatory or environmental factors which increase the
cost of sewage treatment. All revisions shall be done by resolution and shall
become effective as of January 1 of each year. The city council may utilize,
as a basis of any rate increase, a sewer rate study to be conducted, at a
minimum, every five (5) years.
SECTION 2. Any ordinance, or parts of an ordinance, in conflict herewith are
repealed.
SECTION 3. If any section, paragraph, phrase, or word of this Ordinance is held to
be unconstitutional or invalid, such portion shall not affect the remaining portions hereof,

and it shall be construed to have been a legislative intent to pass this Ordinance without
such unconstitutional or invalid part.
SECTION 4. This Ordinance shall take effect immediately upon its adoption.

(c) The deposit shall be paid to the city by the
new customer upon occupancy.
(d) The deposit shall be returned to the depos-
itor upon satisfaction of all outstanding balances,
upon termination of the service.
(e) Any deposit pursuant to this section shall
be refunded to the customer upon the satisfactory
completion of 24 months service without a thirty -
day delinquency.

Sec. 78-152. Monthly sewer rates.
(a) Any user of the services of the sewer sys-
tem shall pay a monthly charge or rate as set
forth in appendix B to this Code. The schedule of
fees is subject to revision annually as may be
necessary to keep rates commensurate with the
changes in the cost of providing service and is
otherwise subject to revision due to any regula-
:)ry or environmental factors which increase the
cost of sewage treatment. All revisions shall be
done by resolution and shall become effective as of
May 1 of each year. The city council may utilize,
as a basis of any annual rate increase, the Con-
sumer Price Index U.S. city average "all items"
(1967=100), published by the Bureau of Labor
Statistics of the United States Department of
Labor. The index number for the month of Febru-
ary, 1989, shall be the base index number and the
corresponding index number for the month of
lFebruary in each succeeding year shall be the
current index number. The sewer rate shall be
determined by dividing the current index number
(CIN) by the base index number (BIN), in accor-
dance with the following formula, dropping all
digits after Ihoo:
New rate charge = (CIN) x the current sewer
(BIN)
rate.
(b) It is the intent of this section that all
condominiums or other developments, particu-
larly developments with a mixture of housing
stypes, be charged a sewer rate in accordance with
he type of structure actually built.

Sec. 78.153. Payment of utility charges re-
quired.
(a) Bills for the monthly utility charges and
fees shall be submitted and shall be payable
within 30 days from the billing date. If such
monthly bill shall be and remain unpaid on and
after the 30 -day grace period, water and sewer
service shall be subject to cutoff. If such monthly
bill is not paid in full by the 30th day following
that for which a billing has been rendered, an
amount equal to ten percent of such bill due shall
be added as a late charge. Upon failure of any
user to pay within 60 days from being billed, the
city shall cut off or cause to be shut off the
connection of such user and shall not furnish him
or permit him to receive from the system further
service until all obligations owed by him to the
city on account of the services shall have been
paid in full. If such sewer service is shut off,
before such service shall be restored the user
thereof shall pay a reinstatement fee in the amount
as set forth in appendix B to this Code, in addition
to any other charges, late charges or penalties
due. The city shall also have a lien on any parcel
or property affected by any unpaid balance of
article II of this chapter. Such lien shall be supe-
rior and paramount to the interest on such parcel
or property of any owner, lessee, tenant, mort-
gagee or other person, except the lien of county
taxes, and shall be on a parity with the lien of any
such county taxes. If any such service shall not be

rates 3 % each year to be effective every January 15`.
Summary Explanation & Background:
City Council authorized a sewer rate study and the baseline report indicated that there would be no need Or a
rate increase for the first (4) years of the rate model; a minimal increase was projected in the 5 `h year.
City Council determined that a prudent financial management plan of a 3 % per year sewer rate increase
would provide protection against unanticipated economic factors and would equate to the inflation rate.
Staff recommends approval.

CAPE CANAVERAL CODE OF ORDINANCES FOR SEWER
SERVICE WITH THE CITY OF CAPE CANAVERAL, FLORIDA;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Cape Canaveral, Florida, per Section 78-152 of the Code of
Ordinances, provided for the adjustment of the Sewer Rates by Resolution; based on Regulatory or Environmental
Factors; and
WHEREAS, the City Council of the City of Cape Canaveral, Florida, per Section 78-153 and Section 78-
154 of the Code of Ordinances, provided for the charges for sewer reinstatement, and
WHEREAS, the City's Wastewater Treatment Plant upgrade to an advanced wastewater treatment and the
construction of the reclaimed water facilities as required by the Indian River Lagoon Act, necessitated a rate
increase of 3% per year for the years 2001, 2002, 2003, 2004, and 2005 to meet revenue requirements for debt and
operation of these facilities; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cape Canaveral, Florida,
acting upon the results of a Revenue Sufficiency Analysis, prepared by outside source to forecast future revenues
and obligations of the Wastewater Treatment facilities, as follows:
SECTION 1. The Rate Schedule as set out in Appendix B, Chapter 78, Utilities, Article III, Service
rates, Deposits and Billing Procedures, Subsection (b) Monthly Sewer Rates and Subsection (c) Sewer Service
Reinstatement fee of the City of Cape Canaveral Code of Ordinances is hereby deleted in its entirety and Exhibit A
adopted in lieu thereof:
SECTION 2. This Resolution shall become effective commencing the service month of January 1, 2001.

Re: RESOLUTION 2000-26 TO ADJUST SEWER RATES
The City Council has requested that the Sewer Rates be adjusted annually over the
next 5 years in accordance with the recent Sewer Rate Study performed by Burton
and Associates. I believe the attached Resolution 2000-26 accomplishes this. I
have also taken the liberty of adjusting the reconnect fee to correspond with Council's
intent of not overcharging for service reinstatement. With this change in place,
Cocoa's penalty is $20.00 and Cape Canaveral's is $30.00 instead of the $60.00
currently charged.

THIS AGREEMENT dated this day of , 2000, by and between,
Philip B. Williams, as Sheriff of Brevard County, hereinafter referred to as "Sheriff', and the City
of Cape Canaveral, Florida, a municipal corporation, hereinafter referred to as "City".
WITNESSETH,
WHEREAS, the City wishes to purchase municipal law enforcement services for that area
of land within its municipal boundaries; and
WHEREAS, the Sheriff is desirous of performing those services;
NOW, THEREFORE, for good and valuable consideration, it is mutually agreed as follows:
The Purpose of this agreement shall be to provide the citizens of City with police
services by Sheriff. The Sheriff shall at all times endeavor to provide the citizens of City
with the service similar to that which they would enjoy with a Municipal Police'.

The Sheriff will perform this contract as empowered and limited by the Constitution
and Laws of the State of Florida, which grant powers and duties of the Sheriff as chief
executive and law enforcement officer of Brevard County, the Charter of the City, and the
transfer of the City's police power by reason of this agreement.

emergency calls within the City's corporate limits within three (3) minutes
after a call has been dispatched. This response time may be extended during'

periods of mutual aid service with other entities.
The Sheriff shall provide City with the following specified service and all support
services incident thereto:
a. Provide 24-hour law enforcement services to the City and enforce all
laws for which the Sheriff has jurisdiction to enforce.
b. All personnel shall be as listed in the approved Personnel Allocation
listed at Appendix A to this contract.
C. There shall be a minimum of two cars and two deputies on patrol
within the corporate limits at all times in accordance with accepted
law enforcement practices. During any exception to the foregoing
because of illness, emergency, or any other reason, patrol services
may be augmented by mutual aid service. Patrol shall be construed to
mean, the actual patrolling of the City's streets or investigation or
attending to an observed or reported incident or availability to
provide law enforcement services within the response time set forth
in paragraph two herein above. Reactive patrol to enforce State laws
and City ordinances, proactive patrol to prevent and deter crimina]
activity, traffic patrol to enforce traffic laws and prevent traffic
crashes.

so requested by any member of the City Council or by the Cit

All personnel used by the Sheriff in the performance of such services, functions and
responsibilities as described and contemplated herein for the City, shall be and remain,
Sheriff employees or deputies, and no one of such persons shall be considered in the employ
of the City for the purpose of pension benefits, compensation, or any status or right. All
deputies shall be fully certified as required by both the State of Florida and the Sheriffs
Office. Deputies assigned to Cape Canaveral will remain assigned to duty in Cape
Canaveral unless they leave the employment of the Sheriff, or unless reassigned by the
Sheriff after notification to the City Manager. The parties recognize that the final decision
concerning the assignment of personnel is the responsibility of the Sheriff. The parties agree
that the Sheriff has the final decision on determining the rank structure implemented for
personnel assigned to Cape Canaveral. The Sheriff further agrees there will not be more
than two deputy(ies) assigned to Cape Canaveral at a time with less than one year of
experience as a law enforcement officer.
However, in the event the City considers any of the personnel assigned under this
contract to be contrary to the best interest of the City, the Sheriff agrees to reassign that
(those) person(s), after reasonable notice and a replacement will be provided within a
reasonable time thereafter.

contract price established by budget, and approved by the City. Should a mutually
agreeable contract price not be approved before September 30, 2001 the contract price for
the second year shall be equal to the total cost of services for the first year, plus four
percent. This amount may be adjusted by mutual agreement after the start of the contract
year after a budget is approved by the City. Sheriff shall separately account for all services
rendered by him hereunder and, to the extent, that Sheriffs cost of performance is less than
the contract price for any given year, City shall receive a rebate to the extent of such surplus.
Payments for personnel services and operating expenses shall be made in twelve monthly
installments payable on or before the fifth day of each month, beginning October 1, 2000.
The City will with the November monthly installment remit to the Sheriff the capital
appropriation for the fiscal year.a

The contract price stated herein above includes a portion of Sheriffs indirect
overhead, to cover costs such as dispatch services and other services provided by Sheriff in
support of Cape Canaveral. City's pro rata share of such indirect overhead expenses is
approximately $140,000.00, annually. To provide City with price stability, in the first year
of this contract, Sheriff agrees to use a lower 7% administrative cost standard charging
$80,141.00. If minimal time and expenses are incurred when transitioning between this
contract and the first option year (FY 2001-2002), the Sheriff agrees to hold the 7%
administrative cost standard charging $80,141 for the first option year.
Should the City desire that the Sheriff provide services at a higher level than that
contemplated herein, the City Manager shall have the authority to negotiate with the Sheriff
regarding modification of the Agreement and shall bring such modification to the City
Council f a to n. Any request for modification of service levels shall be

accomplished by written request to the Sheriff, and if necessary, amendment to the contract
price then in effect. The City agrees that in the event of a catastrophic event, additional
funding shall be provided by the City for vehicles, equipment and supplies, less any disaster
relief funding provided by another agency.

This Agreement shall take effect on the 1 st day of October 2000, and shall continue
in effect for one year with an option to renew annually thereafter, based upon mutual
agreement between the City of Cape Canaveral and the Brevard County Sheriff's Office.
7. DATA
The Sheriff shall provide to the City Manager the quarterly activity reports for each
month. In addition, the Sheriff shall provide to the City Manager such other information as
he, from time to time, may reasonably request

8. FACILITIES AF]
The City shall provide facilities for use by Sheriff in performing this contract. In the
facilities provided by the City for use by the Sheriff, the City hereby agrees to provide for all
routine maintenance, repairs and replacement of existing facilities, and shall provide
janitorial services and, pay all charges for utilities, telephone and other services required for
the operation of the facilities.
The facilities shall be used for the sole purpose of providing the services as defined
in this Contract. Any other use of these facilities shall be negotiated as to cost and extent.

All equipment purchased by the Sheriff, for use in performance of this agreement,
which purchases are funded with monies from this contract shall remain in the exclusive
possession of the Sheriff until the contract terminates. Ownership, of such equipment shall
remain with the City at all times and possession shall be surrendered to City upon
termination hereof. All equipment leased to the City shall remain the property of the
Sheriff, upon termination hereof. The Sheriff shall maintain an inventory of equipment,
continually updated, and shall, upon request, provide written inventory reports to the City
Manager.

A. All fines, forfeitures and fees collected by the County Court on cases made by
law enforcement officers within the City limits, will continue to be returned to
the City in accordance with the existing law of Florida.
B. Sheriff agrees that within the provisions of Florida Statute Chapter §932,
money collected from operations where the officers employed by the City are
assigned will be distributed pro rata to the Sheriff, held in trust for the Cape
Canaveral Precinct in direct relationship to the percentage contribution of City
assigned personnel are as a proportion of the total law enforcement officers
involved in the operation from which money is collected. These proceeds shall
be dedicated solely for the Sheriff s law enforcement function within the City, in
accordance with Florida Statute Chapter §932. Funds not expended by
September 30th, of each fiscal year will be returned to the Sheriff.

Canaveral shall be forfeited to the use of the City. Should the City accept the
forfeited property, the City shall assume all legal costs related to the forfeiture.
Should the City refuse to accept the forfeited property, the Sheriff may elect to
transfer the property to the Sheriff's Office or may sell the property, where upon
all proceeds will be the sole property of the Sheriff.
D. Sheriff shall apply to the Court to recover investigative fees upon successful
prosecution of active cases and shall remit recovered fees to the City in January,
April, July, and October of each year. Sheriff wil also provide copies of all cost
affidavits monthly.

The City will determine when to apply for, with assistance and cooperation from the
Sheriff, federal or state grants, aids, loans, assistance or other acquisition for law
enforcement needs within the City. Responsibility for accounting and administration of
approved Federal and State grants shall be the responsibility of the City.
Sheriff agrees to provide law enforcement officer's professional liability insurance
coverage for bodily injury and property damage caused by an occurrence arising out of the
scope and performance of duties by law enforcement officers and support personnel covered
by this agreement. The Sheriff will provide automobile liability insurance for bodily injury
and property damage for vehicles used by the Sheriffs Office under the terms and
conditions of this agreement.
Alternatively,the Sheriff at his election may bine'parr a recognized self -

insurance program with other law enforcement units to provide such protection. Costs of
such protection described above will be part of the funds provided by the City.
The City will provide for its own fire, storm, flood, and property damage and public
liability insurance for bodily injury and property damage, for the facilities furnished by City
to Sheriff, and shall name the Sheriff as an additional insured, at no cost to the Sheriff.
Each, Sheriff and City, will upon request, provide the other with a copy of each insuring
agreement mentioned in Paragraph 15.

During the duration of this agreement, all disputes or disagreements between the
parties relative to either party's performance under the terms of this agreement, will be

presented specifically, in writing, by the parry claiming dispute. Thereafter, the responding
party will answer specifically in writing within thirty (30) days to the claimant. Within
fifteen (15) days thereafter, the parties will meet at a mutually agreeable time and place to
either settle the dispute, or mutually agree to the facts and issues. Thereupon, if not settled,
each parry shall submit the issues to binding arbitration. The parties will choose a retired
circuit judge as arbitrator. If the parties cannot agree on an arbitrator, then an arbitrator will
be selected by the court pursuant to Florida Statute §682.

To the extent provided by Florida Statute, the City and Sheriff each indemnify and
will hold the other whole and harmless from any and all manner of action and actions, cause
and causes of action, suits, trespasses, judgments, executions, claims and demands and
losses and damages, cost and expenses of any kind whatsoever, including reasonable
attorney's fees and court cast which may be claimed by any third party to have resulted from
or arise out of the intentional or negligent acts of the employees, officers or agents of the
other, whether occurring before or after the City and Sheriff assumed the obligations of this

Notice or other writings required or permitted under this agreement shall be given to
the Sheriff at 700 Park Avenue, Titusville, Florida 32780; and to the City at 105 Polk
Avenue, Post Office Box 326, Cape Canaveral, Florida 32920.

The City shall have the right to mark the Sheriffs cars used in Cape Canaveral with
a specific Cape Canaveral designation provided that the markings are not contrary to any
Statute or Regulation for marking Sheriff Office vehicles.
21. TRRMTNATTO
Either party may terminate this Agreement without cause or further liability to the
other, upon written notice to the other party, said written notice to be given not less than 180
days prior to the requested termination date, said notice to be deemed delivered when a copy
is delivered to the other parties and receipted for. Upon any such termination all further
obligations shall cease, except for those related to payment for services rendered prior to the
effective date of such termination.
22. LEGALITY OF AGREEMENT
Any obligations created by this agreement, which are hereafter determined by court
of competent jurisdiction to be illegal are void, and neither party will be obligated to further
perform as to such obligations.
23. TOTALITY OF AC~TRF.RMF.NT

In partnership with the citizens of Cape Canaveral and Port Canaveral, we are dedicated to provi�i
superior law enforcement services to reduce crime and improve the quality of life for all.
Cape Canaveral and Port Canaveral are currently experiencing rapid growth. To keep up with this gro h,
our agency must be able to adapt in order to meet the needs of our citizens. We must be responsible and
accountable to our citizenry. Our responsibilities and obligations to our citizens shall be faithblly
discharged. Being ever mindful of these values, the Brevard County Sheriff's Office is dedicated to
meeting each challenge with a diverse and intellectual approach. Our continuing efforts will be directed to
meet the present and future needs of the communities in which we serve.
FY 1999-2000 ACCOMPLISHMENTS:
The Brevard County Sheriffs Office, Canaveral Precinct, continues to place the highest priorit on
proactive policing, education and crime prevention programs presently in place. National trend as
applicable, will be incorporated into our existing programs.
We must keep pace with new technologies in order to provide the best possible service. Deputy Sheriff s
must continuously attend training sessions and obtain formal education in order to work with these ew
technologies. We must set realistic and achievable goals, which are in harmony with the communi in
which we serve. We must keep our employees informed; who will therefore keep the public informed.
The following are last years goals and objectives and performance measurement for each following
1. Improvement in the perception of safety in the community: Surveys sent out to the citizens of
Cape Canaveral rated the law enforcement services provided by the Brevard County Sheriffs
Office. The results of the returned surveys gave the Precinct high marks. The vast majority of
those surveyed felt safe in their community.
2. Improvement in satisfaction of the community in regard to services provided: jThe
aforementioned surveys gave high marks to the Deputies who provide law enforcement services to
the City of Cape Canaveral. In addition, a multitude of letters of appreciation were received from
citizens during the year, commending deputies for a wide range of duties and commendable acs of
kindness. Several employees were honored by local organizations such as Veterans of Foreign
War, Mothers Against Drunk Drivers and the Brevard County School Board, just to name a fev .

3. Reduction in the percentage of alcohol related traffic accidents: There were no alcohol rel a ed
traffic fatalities within Cape Canaveral or Port Canaveral this year. DUI arrests were significantly
higher for both Cape Canaveral and Port Canaveral. Traffic citations were also significantly hig ier
within both entities. Aggressive enforcement strategies are credited with our success in a zero
fatality year.
4. Increases in the number of volunteers involved in crime prevention programs: The Citize 's
Observer Patrol and Community Policing Unit have enjoyed unprecedented growth and succ ss
during the past year. The COP program has been very beneficial to both the community and he
agency. Further expansion of this program is anticipated for the coming year.
FY 2000-2001 OBJECTIVES:
1. Increase the amount of arrests and investigations with regard to illegal drugs: The amoun of
complaints regarding illicit drugs within the City of Cape Canaveral and within Port Canaveral is on
the rise. This type of complaint and citizen inquiry is indicative of what could be a more seri us
problem on the horizon. We propose to remedy this problem with directed enforcement With
particular participation of the uniform patrol division. We propose to conduct specific training of
the uniform Deputy Sheriffs assigned to Cape Canaveral and Port Canaveral. Such "street level"
interdiction will be aimed at both identifying potential suspects and development of confidential
informants. Uniform deputies will communicate with the Special Investigations Division' to
disseminate criminal intelligence. Such training is widely available at local institutions. The ben fits
of such training and schools are evident in agencies where such strategies have been employed.
Perhaps the most important element of a successful drug suppression program is the employment of
a drug detection canine. Currently the Canaveral Precinct relies upon the canine units of other
precincts and outside agencies. This practice has, on many occasions proved impractical, as time
delays in such cases can be detrimental. We propose that the Cape Canaveral and Port Canaveral
Precinct procure their own canine for this reason. Canine teams are also dually trained and will be
trained and employed for building searches at burglary and alarm calls, tracking suspects and finding
lost children.
2. C.A.L.E.A. accreditation: The Brevard County SherifFs Office is currently undergoing, an
accreditation process with the Commission on Accreditation for Law Enforcement Agencies Inc.
This is a nationally recognized agency that seeks to improve the delivery of services to the public.
Two broad purposes are served in this endeavor. First, sworn and civilian personnel are Trude
aware of the actions and attitudes expected of them and can therefore act without hesitation in
harmony with the agencies values and policies. Second, members of the public are provided with a
general standard by which they can measure the performance of the agency. Certification by
C.A.L.E.A. will serve to bring further improvements to this agency in terms of operational readiness
and a favorable public image.
3. Further expansion of the Citizen's Observer Patrol and other Community based programs:
The Canaveral Precinct has enjoyed a successful year with regard to expanded participation and
partnerships with our citizens. Members of our Citizen's Observer Patrol have contributed
enormously to our efforts to make Cape Canaveral and Port Canaveral a safer environment. They
have further aided us greatly in administrative duties, particularly with regard to preparation for the
aforementioned C.A.L.E.A. accreditation. We are looking forward to the coming year and _}{rave
plans to expand both the membership and duties of our civilian volunteers.

existing enterprises. Over the past several years, many businesses and private investors
have recognized the potential of the City of Cape Canaveral and the surrounding area.
New growth is evident throughout the City, future growth, development and
redevelopment is inevitable. The rapid expansion of neighboring Port Canaveral will
impact the City of Cape Canaveral as well. With these increases in commercial growth,
there will come increases in population. This growth will impact government services,
which will include law enforcement services.
RESIDENT/SEASONAL POPULATION AND TOURISM:
Employment opportunities and a strong local economy continue to make the City of Cape
Canaveral an attractive place to reside. The availability of employment and affordable
housing within the community will continue to draw people to relocate here. Our pleasant
subtropical climate has always given us a strong seasonal population of winter guests and
part time residents. That same pleasant climate, coupled with our beautiful natural
resources make this area an attractive destination for tourism. This influx of people
presents many benefits and opportunities for the City of Cape Canaveral. With these
positive aspects will come many challenges to both the private and public sector. The
Brevard County Sheriff's Office, as the guardian of our community, is one of the vital
partners of the citizens of Cape Canaveral in maintaining and improving the quality of life
here. The personnel of the Canaveral Precinct are tasked with a wide range of both
emergency and public service. Delivery of these services is directly impacted by the influx
of population and visitors.
INCREASE IN CRIME RATE AND CALLS FOR SERVICE:
As with other communities within Brevard County, the City of Cape Canaveral has
experienced an increase in reported crime. This increase can be attributed to factors such
as the aforementioned growth. Other factors such as "spill over" from neighboring
communities with less aggressive law enforcement strategies can, and often do impact our
community. In response to the rising crime rate our pro -active response has demonstrated

increased enforcement actions; arrests, traffic enforcement operations and other law li
enforcement activities have increased in direct proportion.
IMPACT ON TRAFFIC:
As a direct result of the growth in population, commerce and tourism within our
community, there continues to be ever increasing amounts of traffic. Vehicular and
pedestrian traffic alike will continue to increase. A successful public safety strategy to
reduce traffic fatalities, injuries and property damage must continue to be a priority. Law
enforcement must maintain high visibility on our highways and streets. We must
aggressively enforce our traffic laws to maintain a safe environment for all. Vigorous
enforcement is a proven tool in saving lives.
TERRORISTIC THREATS:
Our world famous space center, along with one of the nation's premier deep water
seaports and international tourism, lends itself to be an opportunistic target for terrorist
activity. This threat assessment has defined the continuing need for updated specialized
training in disciplines of intelligence gathering, response and containment.
COMMUNITY POLICING:
With the recent addition of another Community Policing Deputy, the citizens of Cape
Canaveral will enjoy the added benefits of many specialized programs which are directed
at the reduction of crime through community education and direct involvement. These
programs are community based and community controlled. Programs such as the Citizens
Observer Patrol, T.R.I.A.D., Neighborhood Crime Watch and numerous other programs
are in place and enjoying tremendous success and popularity.
FY 1999-2000 SERVICES PROVIDED:
The law enforcement officers assigned to the Cape Canaveral Precinct are charged with
the protection of the citizenry and their property. This includes the enforcement of City,
State and Federal statutes and ordinances. In addition, precinct personnel respond to
numerous requests concerning issues, non -criminal in nature, in order to resolve the needs
of our citizens.
