Chairperson Russell called the meeting to order at 7:00 PM. The Board Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Waiter Godfrey Vice Chairperson Jeffrey Ratliff Craig Stewart Karen Hartley James Hale MEMBERS ABSENT Charles Biederman Lars Holfve OTHERS PRESENT Anthony Garganese City Attorney James Watson Code Enforcement Officer Todd Morley Acting Building Official Jane Scofield Board Secretary Approval of Meeting Minutes December 19 2002 Motion by Hartley, seconded by Stewart to approve minutes as amended. Vote on the motion carried unanimously. Attorney Garganese swore in all persons giving testimony. It was noted that the next regular meeting would be held on February 20, 2003. PUBLIC HE NGS: 1. Case No. 2002-00228, James Rao — $815 N. Atlantic Avenge — Violation of Section 34-97. Responsible for Property Maintenance- Parking Areas. Mr. Watson testified that Case No.2002-00228 were working with the building dept and needed two more weeks. Motion by Stewart, seconded by Godfrey to table until next month. Motion carried unanimously. 2. Case No. 2002-00232, Marilyn Bissell — 7677 Magnolia Avenue — Violation of Section 104 & 105. Permits and Inspections. Mr. Watson testified that Case No. 2002-00232 was in compliance. Ms. Bissell testified that she took the canopy down but she needs it to cover her electric wheelchair. City Attorney suggested she talk to the Building Dept. 3. Case No. 2002-00233, Herbert Edwards — 103 Justamere Road — Violation of Section 34-97, Responsible for Maintenance of Property Maintenance — Overgrowth Mr. Watson testified that Case No. 2002-00233 was in partial compliance. A short discussion followed. Motion by Stewart, seconded by Hale, to find Mr. Edwards in violation of section 34-97. Mr. Edwards will be fined $25.00 for the first day and $25.00 for every day after until he is in full compliance. This fine will start 7 days after receipt of this order. Motion carried unanimously. 4. Case No. 2002-00234, Herbert Edwards — 103 Justamere Road — Violation of Section 34-98,Building Appearance and Maintenance. Mr. Watson testified that Case No.2002-000234 was not incompliance. He also testified that no effort has been made to correct the violation. Motion by Stewart, seconded by Godfrey, to find Mr. Edwards in violation of section 34-98. Mr. Edwards will be fined$25.00 a day for the first day and $25.00 for everyday after until he is in full compliance. This fine will start 7 days after receipt of this order. Motion carried unanimously. 5. Case No. 2002-00236, James E. Sharpe — 230 Seaport Blvd — Violation of Section 104 & 105. Permits& inspections. Mr. Watson testified that Case No. 2002-00236 was not incompliance but Mr. Sharpe was trying to correct the violation. He asked the board to table this case until next month. Motion by Stewart, seconded by Godfrey to table until next month. Motion carried unanimously. 6. Case No. 2003-00009, Request for Hearing Regarding 72 Hour Towing Notice — Dalton George—242 Canaveral Beach Blvd. Mr. Watson testified there still was not a tag on the trailer. Owner is out of town and will be here in 2 weeks. Motion by Hartley, seconded by Stewart to find Case No. 2003-00009 in violation and should be removed. Motion carried unanimously. 7. Case No. 2003-00010, Request for Hearing Regarding 72 Hour Towing Notice-- James Shively III—7523 Magnolia Avenue Mr. Watson testified that the vehicle was still without a tag. Motion by Hartley, seconded by Godfrey to find Case No. 2003-00010 in violation and should be removed. Motion carried unanimously. 8. Case No. 2003-00011, Request for Hearing Regarding 72 Hour Towing Notice— Jessica Metzger-Fellone—294 Chandler St. Mr. Watson testified that the vehicle was still without a tag. Motion by Godfrey, seconded by Stewart to find Case No. 2003-00011 in violation and should be removed. Motion carried unanimously. 9. Case No. 2003-00012 Request for Hearing Regarding 72 Hour Towing Notice — Brenda Cooper—246 Canaveral Beach Blvd. Mr. Watson testified that Case No. 2003-00012 was in compliance. 10. Case No. 2003-00013, Request for Hearing Regarding 72 Hour Towing Notice— Wym Ellen Rogers--304 Johnson Avenue Mr. Watson testified that Case No.2003-00013 was in compliance. DISCUSSION: 1. Discussion Re: Code Enforcement Forms and Procedures — Jeffrey P. Buak, Assistant City Attorney. (Discussed at previous meeting) Attorney Buak explained the rules of procedures, rehearings, reduction of liens, motions, different formats, etc. The board had a short discussion. Motion by Mr. Godfrey, seconded by Mr. Hale to approve Code Enforcement Forms and Procedures and recommend to City Council for approval. Motion carried unanimously. 2. Discussion Re: Proposed Ordinance Procedure — Satisfaction / Reduction Code Liens Attorney Buak also explained the Satisfaction / Reduction of Code Liens. This ordinance is designed to be a formal mechanism for the satisfaction or reduction of Code Enforcement liens. Attorney Buak will bring resolution about the ordinance to the next Code Enforcement meeting. Motion by Mr. Godfrey, seconded by Mr. Hale to approve Ordinance Procedures and recommend to City Council for approval. Motion carried unanimously. STATUS UPDATE: 1. Case No. 2002-DRS-00146, Ocean Park North Condominium Association — 350 Taylor Avenue—Board Order signed for and delivered January 13, 2003. As of this meeting there has been no contact. 2. Case No. 2002-00212, Magma Trading Corporation - 8200 Astronaut Blvd - Board Order signed for and delivered January 14, 2003. As of this meeting there has been no contact. 3. Case No. 2002-00192,Yogi Patel--6850 N. Atlantic Avenue-Board Order in effect since November 21, 2002. Current amount due for noncompliance- $4,700.00 As of this meeting there has been no contact. Motion by Mr. Stewart, seconded by Mr. Godfrey to adjourn the meeting at 8:40 P.M. Motion carried unanimously. Vote on the motion carried unanimously. Attorney Garganese swore in all persons giving testimony. It was noted that the next regular meeting would be held on March 20, 2003. PUBLIC HEARINGS: 1. Case No. 2002-00228, James Rao — 8815 N. Atlantic Avenue — Violation of Section 34-97. Responsible for Property Maintenance - Parking Areas. (Tabled from last month) Mr. Morley testified that the Rao's had fixed some of the drive/parking area, but there was a miscommunication as to how much and where the repairs were needed. He requested that this case be tabled until next month to see if the problem could be corrected. Motion by Mr. Stewart, seconded by Mr. Biederman to table Case No. 2002-00228 until next month. Motion carried unanimously. 2. Case No. 2002-00236, James E. Sharpe — 230 Seaport Blvd -- Violation of Section 104 & 105. Permits& Inspections. (Tabled from last month) Mr. Morley testified that Case No. 2002-00236 was in compliance. 3. Case No. 2003-00001, Eudora George—242 Canaveral Beach Blvd—Violation of Section 104& 105. Permits& Inspections. Mr. Morley testified that window(s) were installed without a permit. There is a question about how many windows were installed. The owner has made no contact with the Building Department. Mr. Morley requested that Case No. 2003- 00001 be tabled until next months meeting. Motion by Mr. Stewart, seconded by Mr. Hale, to table this case until next month. Motion carried unanimously. 4. Case No. 2003-00008, Kenneth Murray — 504 Jefferson Avenue — Violation of Section 110-297. Minimum Setbacks. Mr. Morley testified that Mr. Murray built a portable metal awning in his driveway area. It is covered with a tarp and is not connected to the building. After receiving the notice of violation, Mr. Murray removed 5 feet from the front of the awning to meet the setback requirements. There is still a question as to whether this is in compliance. Mr. Morley asked to table this case until next month. Motion by Mr. Stewart, seconded by Ms. Russell to table Case No. 2003-00008 until next month. 5. Case No. 2003-00019, Request for Hearing Regarding 72 Hour Towing Notice-- G. Schmitz—305 Surf Drive Mr. Morley testified that this vehicle was still in non-compliance. Motion by Mr. Biederman, seconded by Mr. Stewart to find Case No. 2003-00019 in violation and should be removed. Motion carried unanimously. 6. Case No. 2003-00020, Request for Hearing Regarding 72 Hour Towing Notice — G. Schmitz--305 Surf Drive Mr. Morley testified that this vehicle is still in noncompliance. Motion by Mr. Biederman, seconded by Mr. Stewart to find Case No. 2003-00020 in violation and should be removed. Motion carried unanimously. DISCUSSION: City Attorney's office had not finalized the Code Enforcement Forms/Procedures, Proposed Ordinance Proposal as of this meeting. City Attorney Garganese will deliver them when they are completed. He also stated that the City Council had passed the Satisfaction/Reduction of Lien Proposal. Ms. Russell received a letter from Magma Trading Corporation's lawyer, Eisenmeyer, Berry & Peters, P.A. The letter states that the City of Cape Canaveral failed to comply with the notice requirements 162.12, of the Florida Statutes. He would also like proof of service. Motion by Mr. Stewart, seconded by Mrs. Russell to adjourn the meeting at 8:02 P.M. Motion carried unanimously. Code Enforcement Board Meeting Minutes March 20, 2003 Page 2 PUBLIC HEARINGS: 1. Case No. 2002-00228 James Rao -- 8815 N. Atlantic Avenue_ — Violation of Section 34-97. Responsible for Pro.perty Maintenance - Parking Areas. Tabled from last month). Mr. Morley testified that the work was not completed. Mrs. Rao had advised that Mr. Rao was out of town and would return on March 24'h and at that time, the work would take approximately 1 to 2 days to complete. Mr. Morley respectfully requested that this Case be postponed until the next scheduled meeting. Motion by Mr. Stewart, seconded by Mrs. Hartley to postpone Case No. 2002-00228 until the next scheduled meeting. Vote on the motion carried unanimously. 2. Case No. 2003-00001, Eudora George—242 Canaveral Beach Blvd.-Violation of Section 104 & 105. Permits & Inspections. (Tabled from last month). Mr. Morley testified that Case No. 2003-00001 was in compliance. 3. Case No. 2003-00008 Kenneth Muga — 504 Jefferson Avenue — Violation of Section 110-297. Minimum Setbacks. (Tabled from last month) Mr. Morley testified that Mr. Murray had removed the tarp from the driveway and was in compliance. There is still some concern about the appearance of the property. Ms. McNeely testified that Mr. Murray seems to be living in his driveway. She showed pictures (Exhibit A, B, & C) of furniture other than lawn furniture. A short discussion followed. Motion by Mrs. Russell, seconded by Mrs. Hartley to find Case No. 2003-00008 in compliance. Motion carried unanimously. 4. Case No. 2003-00020 Request for Hearing Regarding 72 Hour Towing Notice — G. Schmitz—305 Surf Drive. Mr. Schmitz testified that he was not notified or aware of last months hearing and explained to the Board that he would like both Case No.2003-00019 and Case No.2003- 00020 withdrawn. Code Enforcement Board Meeting Minutes March 20, 2003 Page 3 Mr. Morley testified that one of the vehicles in 2003-00020 remained in violation. Mr. Schmitz testified that the vehicle was still in violation and that he planned to donate the vehicle to charity. Chairperson Russell asked Mr. Schmitz how much time he needed. Mr. Schmitz responded that he would need seven days. Motion by Mr. Stewart, seconded by Mr. Hale to withdraw Case No. 2003-00020, based on testimony and intent to have vehicle removed from the premises within seven days (March 27, 2003). Motion carried unanimously. It was noted that Case No. 2003-00019 was not listed on the Agenda. Mr. Schmitz testified that there was no reason to find this vehicle in violation simply because it had a flat tire. He further testified that he had repaired the tire. Mr. Morley testified that the wording of the Ordinance indicates "inoperable vehicles" are defined as vehicles, which do not have a current tag, and that a flat tire does not qualify as a violation by the Section cited. Motion by Mr. Stewart, seconded by Mrs. Russell to find Case No. 2003-00019 to compliance. Vote on the motion carried unanimously. 5. Case No. 2003-00022, Rene Pulido — 7204 Ridgewood Avenue - Violation of Section 110-469. Visibility at Intersections — Bushes at intersection can not be over 2.5' high. Mr. Morley testified that this Case was in compliance. 6. Case No. 2003-00025 Request for Hearing Regarding 72 Hour Towing Notice— Deborah Benzal— 8401 N. Atlantic Avenue #A-17. Mr. Morley testified that he was concerned that Ms. Benzal was not properly notified of this Hearing. Mr. Morley respectfully requested that the Board postpone this Case until the next scheduled meeting. Motion by Mr. Stewart, seconded by Mr. Holfve to postpone Case No. 2003-00025, until the next scheduled meeting. The request is to pass this information on to the appropriate City Officials who may be able to help with our problem. Last month in the front yard of 504 Jefferson Avenue a structure was erected which is an eye sore, probably not approved by the building Department. The covered area is littered with furniture, bar-b-cues, trash and a large metal drum located next to the road which is frequently loaded with wood and burned day and night. The smoke from this fire/health hazard permeates the neighborhood when initially lit off, almost daily. But the real complaint is that the structure is used almost every day for loud party making until well after midnight and often until 4 AM, in violation of the City's noise ordnance (Article V , Cape Canaveral City Code). The noise is not loud music or fighting - just loud yelling and screaming party noise. Loss of sleep at night because of the unnecessary noise and irritation is the major concern. The police have been called in the pas:. They have responded very quickly and the noise at night goes away for a short period of time after their visit, but stars again with the next can cf deer. Landscaping and screening for commercial and industrial zoning districts. Any visual screening that solely consists of vegetation,with the exception of trees as defined under Chapter 102 of this Code, shall reach a density of at least 80 percent within two years of planting. All visual screening shall be maintained in accordance with all other applicable ordinances or regulations affecting vegetation or landscaping; and (4) Have a minimum of one ten-point tree value as defined in 110-567 which shall be planted every 35 feet with at least two five-point trees on the minimum 50-foot C-1 or C-2 lot and three five-point trees on the minimum 75-foot M-1 lot unless a greater restriction is otherwise provided for in this chapter. * * * Sec. 110-567. Interior landscaping for offstreet parking areas. (a) Offstreet parking areas in C-1, CC=2, M-1 and R-3 districts shall have internal and perimeter landscaping as follows: * * * (4) Parking areas in the C-1, C-2 and M-1 districts and parking areas in the R-3 districts that contain 16 or more parking spaces shall be planted to a width of at least two feet of the entire perimeter facing the public right-of-way, except for ingress and egress and sidewalks. The perimeter shall be planted with decorative shrubs and bushes not less than three feet in height to form a visual screen with a density of at least 80 percent within two years of planting. Perimeters facing such public right-of-way shall, in addition, have five tree value points planted every 35 feet with at least ten tree values on a minimum 50-foot C-1 or C-2 lot, and fifteen tree values on the minimum 75-foot R-3 lot unless a greater restriction is otherwise provided for in this chapter. * * * Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Council, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Case No. 03-20 -Violation of Section 34-181, Storing, Parking or Leaving on Private Property, 305 Surf Drive - (Inoperable Vehicle was to be Removed b March 27th). Code Enforcement Officer, Jim Watson testified that the vehicle had been removed and therefore this Case was in compliance. Case No. 03-21 - Violation of Section 34-38, Owner(s) Maintenance of Premises of the Cape Canaveral Code of Ordinances Section 14 Township 24 South Range 37 East, Block„4, Lot 14, Cape Canaveral Beach Gardens - Unit 2 Subdivision, Brevard County, Florida - Giuseppe and Louise Conoscenti, Property Owners. Code Enforcement Officer, James Watson testified that this Case was not in compliance. He explained that a letter had been received from the property owner advising that the property was going to be cleared for new construction on Friday, April 18th and the vehicle should be removed at that time. Mrs. Conoscenti testified that the vehicle was abandoned on her property and she has had a very difficult time with people using her property as a dumping ground. Officer Watson respectively requested that the Board table this Case until the next meeting to allow the property owner additional time to remove the vehicle. The Board members reviewed the letter from the Conoscenti's entered into the record as Exhibit A. Motion by Mr. Holfve, seconded by Mr. Hale to postpone Case No. 03-21 until the next scheduled meeting. Vote on the motion carried unanimously. 2. Case No. 03-25 - Violation of Section 34.181, Storing, Parking or Leaving on Private Property at 8401 N. Atlantic Avenue, Unit#A-17 - Deborah Benzal, Vehicle Owner. Code Enforcement Officer, James Watson testified that this Case was not in compliance. He explained that the vehicle was still parked at the residence. Chairperson Russell noted that Deborah Benzal was not present at the meeting. Officer Watson further testified that he hand-delivered the Notice to Appear to Ms. Benzal. Motion by Mr. Stewart, seconded by Mr. Hale to find this Case in non-compliance and that the City have the vehicle be towed no later than Friday, April 18th. Vote on the motion carried unanimously. Officer Watson advised that he would contact the towing company to have the vehicle towed as soon as possible. 3. Case No. 02-228 - Violation of Section_34-97. Duties & Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances, Section 14, Township 24 South Range 37 East Parcel A.18 Teutons Subdivision Brevard Count Florida - James and Mary Rao, Property Owners Code Enforcement Officer, James Watson testified that this Case was in compliance. Responsible for Property Maintenance - Parking Areas. (Tabled from last month). Mr. Morley testified that the work was note completed. Mrs. Rao had advised that Mr. Rao was out of town and would rcturn on March 24th and at that time, the work would take approximately 1 to 2 days to complete. Mr. Morley respectfully requested that this Case be postponed until the next scheduled meeting. Motion by Mr. Stewart, seconded by Mrs. Hartley to postpone Case No. 2002-00228 until the next scheduled meeting. Vote on the motion carried unanimously. 2. Case No. 2003-00001, Eudora George—242 Canaveral Beach Blvd—Violation of Section 104 & 105. Permits & Inspections. (Tabled from last month). Mr. Morley testified that Case No. 2003-00001 was in compliance. 3. Case No. 2003-00008, Kenneth Murray — 504 Jefferson Avenue — Violation of Section 110-297. Minimum Setbacks. (Tabled from last month). Mr. Morley testified that Mr. Murray had removed the tarp from the driveway and was in compliance. There is still some concern about the appearance of the property. Ms. McNeely testified that Mr. Murray seems to be living in his driveway. She showed pictures (Exhibit A, B, & C) of furniture other than lawn furniture. A short discussion followed. Motion by Mrs. Russell, seconded by Mrs. Hartley to find Case No. 2003-00008 in compliance. Motion carried unanimously. 4. Case No. 2003-00020, Request for Hearing Regarding 72 Hour Towing Notice — G. Schmitz—305 Surf Drive. Mr. Schmitz testified that he was not notified or aware of last months hearing and explained to the Board that he would like both Case No.2003-00019 and Case No.2003- 00020 withdrawn. • Code Enforcement Board Meeting Minutes March 20, 2003 Page 3 Mr. Morley testified that one of the vehicles in 2003-00020 remained in violation. Mr. Schmitz testified that the vehicle was still in violation and that he planned to donate the vehicle to charity. Chairperson Russell asked Mr. Schmitz how much time he needed. Mr. Schmitz responded that he would need seven days. Motion by Mr. Stewart, seconded by Mr. Hale to withdraw Case No. 2003-00020, based on testimony and intent to have vehicle removed from the premises within seven days (March 27, 2003). Motion carried unanimously. It was noted that Case No. 2003-00019 was not listed on the Agenda. Mr. Schmitz testified that there was no reason to find this vehicle in violation simply because it had a flat tire. He further testified that he had repaired the tire. Mr. Morley testified that the wording of the Ordinance indicates "inoperable vehicles" are defined as vehicles, which do not have a current tag, and that a flat tire does not qualify as a violation by the Section cited. Motion by Mr. Stewart, seconded by Mrs. Russell to find Case No. 2003-00019 to compliance. Vote on the motion carried unanimously. 5. Case No. 2003-00022, Rene Pulido — 7204 Ridgewood Avenue - Violation of Section 110-469. Visibility at Intersections — Bushes at intersection can not be over 2.5' high. Mr. Morley testified that this Case was in compliance. 6. Case No. 2003-00025, Request for Hearing Regarding 72 Hour Towing Notice— Deborah Benzal— 8401 N. Atlantic Avenue =A-17. Mr. Morley testified that he was concerned that Ms. Benzal was not properly notified of this Hearing. (a) Boats, utility trailers, recreational vehicles, special purpose vehicles, automotive vehicles or trailers of any kind or type without current license plates shall not be stored on any residentially-zoned property, other than in completely enclosed buildings. (b) Construction trailers located on a construction site may be used as an Advanced Search office or a work or security trailer. Use of these trailers as living quarters is expressly prohibited. In each case and for every trailer, temporary permits shall be required. The temporary permits shall be limited to 90 days with 90- Document day extensions permitted, subject to the need thereof as determined by the Previous Document building official. Code Enforcement Officer, James Watson testified that this Case was not in compliance. Mr. Baldwin had installed a fence without the required permit and inspection. Officer Watson explained that he contacted Mr. Baldwin two months ago and faxed him a building permit application to correct the violation. Officer Watson stated that there has been no word since. James Watson, Code Enforcement Officer testified that Mr. Baldwin had contacted the Building department and requested a building permit application be faxed to him. No other contact has been made since. The Board members reviewed the Case documents. Following discussion, the Board requested that Mr. Watson send a letter to Mr. Baldwin outlining the remaining items required to bring the Case into compliance. Case No. 03-41 - Violation of Sections 104 & 105 Florida Building Code - Permits & Inspections of the Cape Canaveral Code of Ordinances (7822 N Atlantic Avenue) - Robert Kennedy, Property Owner. (Tabled at previous meeting). James Watson, Code Enforcement Officer testified that this case was not in compliance. He advised that Mrs. Kennedy had started work without the required permit. He further advised that Mrs. Kennedy has applied for the necessary permit and the plans reviewer is waiting for additional information from her architect. Mrs. Kennedy testified that two plans review letters had been sent to her architect since she had applied for the permit. At the request of the Board Chairperson, Mrs. Kennedy read the second plans review letter into the record. Mrs. Kennedy further testified that the bottom two units have always been commercial and had been vacant for a long time and that she was living on the 2nd floor where she was making non-structural repairs and improvements. She did not know why the Plans Examiner was requiring her to hire a general contractor because she lived in the residential part of the building where she was making the renovations. Mr. Watson advised that the Building Official would be the only one to answer that question. Discussion followed. Following discussion, Code Enforcement Officer Watson respectfully requested that this case be tabled until the next meeting. Motion by Mr. Stewart, seconded by Mr. Hale to table Case No. 03-41 until the next scheduled meeting to allow Mrs. Kennedy additional time to comply with the requirements for obtaining the required building permit. Code Enforcement Officer Watson testified that an inspection on Monday, June 17, 2003 revealed that the bees and bee hives had been removed with the exception of one remaining in Mr. Milliken's garage. City Attorney Garganese reported that he filed a lawsuit on behalf of the City for an injunction. No contact has been made since. He noted that if Mr. Milliken is claiming homestead then the city could not foreclose on the property. Officer Alexander recommended, on behalf of the City, that the tree be trimmed. Officer Alexander testified that the sign was in violation due to the location of the sign on the property. Mr. Beasley testified that he had the sign moved in 1996 to bring the sign into compliance and that the Sign Ordinance had been revised causing the sign to be in violation. Code Enforcement Board Meeting Minutes July 17, 2003 Page 3 DISCUSSION: Code Enforcement Officer, Duree Alexander asked the Board to consider an urgent matter regarding a code enforcement lien imposed on Case #2002-DRS-001-, Yogi Patel at 6850 N. Atlantic Ave. Officer Alexander stated that Todd Morley, City Building Official requested that the Coded Enforcement Board consider a reduction or elimination of the lien due to financial hardship to the respondent. Mr. Patel testified that the repairs to the parking lot were completed on Oct 26, 2002 within a few days of the Board Order on October 18, 2002. The repairs were not called in to the Building Department for inspection, and the case was not found in compliance until May 1, 2002. Mr. Stewart stated he believed that there were two different cases involving Mr. Patel and there is not enough information for the Board to make a determination of this request to reduce the imposed fine. Motion by Mr. Holfve to reduce the lien 90%. Mr. Stewart stated that he was against the motion because the case is not clear. He does not believe the case was initially about two potholes but rather the issue was for Mr. Patel to pave his parking lot. Ms. Bowers presented a copy of the delinquent letter sent to Mr. Harris (Exhibit B). Ms. Bowers stated that the letter was sent on January 6, 2003 and August 19, 2003. Mr. Hale questioned the extenuating circumstances noted in the September Code Enforcement Board minutes. Mr. Godfrey replied that Mr. Harris is battling hepatitis and has been in and out of the hospital. Also his father had a heart attack in Alabama and Mr. Harris was out of town caring for him. Mr. Godfrey further stated that this is the reason the City has not been able to contact Mr. Harris. Motion by Mr. Stewart, seconded by Mr. Hale to find Michael Harris in violation of Section 70-69 of the Cape Canaveral Code of Ordinances. Vote on the motion carried by a six (6) to one (1) vote, with the Board members voting as follows: Charles Biederman, for; Walter Godfrey, against; James Hale, for; Karen Hartley, for; Jeffrey Ratliff, for; Mary Russell, for; Craig Stewart, for. Mr. Stewart stated that the Board needed to know what their options are to determine the penalty. Attorney Buak stated that Florida Statute provides a maximum penalty of 25% of the Occupational License fee, in addition to any administrative costs incurred by the City based on staff testimony. Chairperson Russell asked what the additional administrative costs included. Ms. Bowers testified that Florida Statue allows for a $250.00 penalty to be incurred at the Board's discretion. Ms. Bowers further stated that she estimated seven (7) man- hours at $12.00 per hour; and a total of four (4) certified letters at $4.42 each. Motion by Mr. Stewart, seconded by Chairperson Russell to impose the minimum fine possible. Following discussion, the Board agreed that the imposed penalty shall include the occupational license fee including late fees, bad check fee, and administrative fees (hours & postage), for a total amount of$307.75. Officer Alexander respectfully requested that the Board find the Respondent in violation of Section 110-334(11) and be required to obtain a Special Exception for the property to continue the use. Mr. Gould, property trustee, testified that he thought the outside storage was okay. He stated that he remembered back to the 1980's when the Building Official, at that time, concluded that it was permitted. Mr. Hoog, City Council Member, testified that between 1983 and 1987 the City Council granted outside storage. Motion by Chairperson Russell, seconded by Mr. Hale, to find Howard & Betty Gould, Trustees, in violation of Section 110-334, of the City of Cape Canaveral Code of Ordinances and Order that they apply for a Special Exception within Ninety (90) days or before the February 19, 2004 Code Enforcement Board Meeting. Vote on the motion carried unanimously. 2. Case No. 03-131 —Violation of Section 82-371 Posting & Specification of Numbers of the Cape Canaveral Code of Ordinances (501 Jackson Ave ) — Penny Corcoran Property Owner. Case No. 03-139 — Violation of Section 34-181 Storing Parking or Leaving on Private Property, of the Cape Canaveral Code of Ordinances (505 Fillmore Ave ) — Vincent Marino, Property Owner. Code Enforcement Officer, Duree Alexander provided an overview of the Case history and presented Exhibits for the Board's review. Officer Alexander testified that the vehicle was tagged on October 14, 2003 with a 72 hour Notice to remove. On October 15, 2003 Nathan West requested to appeal the Notice. Officer Alexander further testified that prior to the October 23, 2003 Code Enforcement Board meeting the vehicle had been moved off the property and the Case was found in Compliance. On October 27, 2003 she received a call that the vehicle was back on the property. Nathan West, Respondent's son, testified that his Mother has been out of the State and they are trying to sell the vehicle. Motion by Mr. Stewart, seconded by Mr. Hale, to find Vera Bonner, Respondent, in violation of Section 34-181, of the City of Cape Canaveral Code of Ordinances and to Order the Respondent to obtain the current vehicle registration within ten (10) days after which time a fine of twenty-five dollars ($25.00) per day shall be assessed. Discussion followed. Motion amended to extend the compliance date to fourteen (14) days or before December 4, 2003. Vote on the main motion, as amended, carried unanimously.
