CODE ENFORCEMENT BOARD
REGULAR MEETING
NOVEMBER 17, 1988
A regular meeting of the Code Enforcement Board of the City of
Cape Canaveral, Florida, was held on November 17, 1988, at the
City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida.
Chairman Stenglein called the meeting to order at 7:31 p.m. The
Secretary called the roll.

meeting. Mr. Hutchinson seconded motion. Motion carried unan-

Mrs. Hutcherson reported that Mr. Eaton had been given a com-
pliance date of October 27, 1988. She reported that Mr. Eaton was
in compliance and that a Compliance Notice had been mailed on
October 19, 1988.

Mrs. Hutcherson reported that Southern Lakes was mailed an order
with a compliance date of November 10, 1988. Southern Lakes was
sent an .Affidavit of Non-compliance on November 11, 1988. She
noted that no one from Mr. Stotler's office had contacted her.
Ms. Russell moved that the Board find Southern Lakes in Non-com-
pliance of the Board's Order dated October 24, 19881 that Southern
Lakes be fined one hundred dollars ($100.00) per day, for each and
every day until compliance is achieved beginning Monday, November
21, 1988. Ms. Benson seconded motion. Discussion followed.

Mrs. Hutcherson noted that at the October 24, 1988 meeting the
Board found Ms. Harris in violation and recommended that the
building materials be properly stored, the debris be removed, and
the unattended growth be mowed and trimmed. Mrs. Hutcherson
reported that Ms. Harris had cleaned up the property, but there
was still a small accumulation of building materials along the
west fence and concrete blocks that were not supported. She
referecned Section 303, relating to the public nuisance. She
noted that Ms. Harris has made no contact with her. Discussion
followed.
Attorney Bennett advised that the Board could not take a position
on an attractive nuisance, because the State had done away with
this doctrine. He stated that the Board could only act if a
violation of the City Code existed. Discussion continued.
Mr. Stenglein moved that this case be postponed until the Code
Enforcement Officer makes another inspection to determine the
exact violation. Mr. Hutchinson seconded motion. Motion carried
unanimously.

Mrs. Hutcherson reported that the Building Department had received
a complaint from the tenant at 368 Jefferson Avenue, on September
20, 1988, regarding electrical problems. A letter was sent to the
owner, Mr. Joseph Hartnett, on September 23, 1988, advising of the
violations with a list of corrective actions. Mrs. Hutcherson
submitted photographs into evidence of work that had been com-
pleted and work that is still to be done. Discussion followed.

Mr. Moeller moved to reappoint the present officers, Mr. Stenglein
as Chairman and Mrs. Russell as Vice -Chairman. Ms. Russell
seconded the motion. Vote on the motion was as. follows: In
favor, Me. Benson, Mr. Okell, Ms. Russell, Mr. Hutchinson, Me.
Porter -Gabler and Mr. Moeller. opposed, Mr. Stenglein. Motion
carried.
At this time Mr. Leo Nicholas, city Manager, showed a video from
the League of Cities on Code Enforcement. A discussion on the
video followed.
There being no further business, the meeting was adjourned at 8:55

Mrs. Hutcherson submitted pictures into evidence depicting the
existing violations on Hr. Melvin's property. She testified that
Mr. Melvin was out Of town and had requested an extension of his
compliance date to October 31. Discussion followed.
Ms. Benson moved to extend Mr. Melvin's compliance date until
October31, 1988. Mr. Arabian seconded the motion. Hs. Russell
asked HeBenson if she would agree to amend her motion idonor

of a fine commencing after the 31st if Mr. Melvin hot
complied. Ms. Benson agreed and amended her motion to include a
fine of 825.00 per day if Mr. Melvin was not in compliance by
October 310t. Mr.Arabian obiected to the amended motion. Mr.
Okell seconded the emended motion. Vote on the motion was as

PUBLIC HEARINGS

Owner to Maintain Premises Free of Litter, and Section
703 03 Public Nuisances Prohibited
Mrs. Hutcherson submitted pictures of the parcels in violation
alone with 'a map depicting their location. She testified that
she had been in contact with various representatives of Southern
Lakes since January 1988 and had been working with Mr. Gailey
since June. She stated that Southern Lakes had been given an
estimate from Don Hatfield of Titusville Mowing for approximately
$2600 to clear the property.
The City Attorney swore in Mrs. Ann Thurm. Mrs. Thurm testified
that one of the parcels had been used as a dumping ground and the
accumulation of debris had increased. Some of the debris cited
were grass clippings, lawn furniture, bottles, tree stumps and
general litter. It was also noted that because of excessive
growth the City mower could not mow the right-of-way. Discussion
followed.
Mr. Okell moved to find Southern Lakes in violation of Section
675.11 and Section 703.03 and that the owner clear the property
of undesirable undergrowth and remove all trash and other debris
from the property by November 10, 1988 and notify Mrs. Hutcherson
in writing upon compliance. Ms. Rirchofer seconded the motion.
Vote on the motion was as follows: In favor, Ms. Benson, Mr.
Okell, Mo. Porter -Gabler, Ms. Rirchofer and Ms. Russell; Opposed,
Mr. Arabian. Motion carried.

Pictures were submitted into evidence depicting the condition of
the property on October 10 and those taken the day of the meeting
of the areas which are still in violation. She noted that there
was a considerable amount of untended growth and debris along
Orange Avenue; building materials along the west fence line, and
concrete blocks. She reported that she had not spoken with Ms.
Harris but had discussed the clean up with the tenant. Mrs.
Hutcherson recommended that Ms. Harris be granted an extension on
her compliance date since the property had been cleaned up
considerably. Discussion followed.
Ms. Russell noted that the untended growth and debris along
Orange Avenue impaired visibility from the driveway to the south.
Concern was expressed over the concrete blocks which may be an
attractive nuisance and a hazard.
Ms. Porter -Gabler moved to extend the compliance date 30 days to
November 10, 1988. Mr. Arabian seconded the motion. Motion
carried unanimously. It was agreed a complimentary letter citing
the efforts the property owner had made would be in order.

1. Motion Re: Election of Officers
Vice -Chairman Russell recommended that due to the absence of
three bonrd. members, the election of officers be postPOned until election of
the next meeting. Hr..Okell moved to. postpone the
officers until the November 17 meeting. Ms- Benson seconded the
motion. Motion carried unanimously.
DISCUSSION
The City Attorney advised the Board to allow the public freedom
to speak with as little restraint as possible. He cited a recent
case that had taken place in Florida ruling in. favor of the
citizen.
There being no further business, the meeting was adjourned at
8:35 P.M.

It was noted there was a typo on the agenda and Section 639.23,
Visibility at Intersections should read 639.25. Mrs. Hutcherson
reported that she had repeatedly tried to contact Mr. Eaton but
had been unable to do so and that he was still not in compliance
as of 5:00 P.M. She submitted pictures into evidence of the
property. Pat Cornell, who lived at that same address, testified
that Hr. Eaton was having truck problems and would be attending
the meeting later in the evening.
Mrs. Russell moved to delay Case No. 88-20 until later in the
meeting or grant a postponement for 30 days. Ms. Benson seconded
the motion. Vote on the motion was as follows: In favor, Ms.
Benson, Ms. Russell and Mr. o'Rell; opposed, Mr. Arabian, Mr.
Hutchinson, Mr. Moeller and Chairman Stenglein. Motion failed.

Douglas Melvin admitted that he was in violation concerning his
property and that he had contacted Mrs. Hutcherson and would

notify the City is writing by October 17, 1988. Mrs. Russell
seconded the motion. Motion carried unanimously.

DISCUSSION
Mrs. Russell noted that Mr. Arabian had not been in attendance at
the last threemeetings and asked what the procedure was
concerning members not attending the meetings. Mr. Nicholas will
research this. Mrs. Russell also noted that alternate members
should attend all meetings.

A regular meeting of the Code Enforcement Board of the City of

Mrs. Hutcherson submitted 'a copy of Mr. Newman's letters to
Southern Bell and the DonnnlleY Company requesting that the
listing for 350 Taylor Avenue, tB-1 be changed to 7001 North
Atlantic Avenue. She further stated that the recent inspection
of said unit showed no indication of recent use as a business or
work establishment. The musty odor indicated the unit had been

City Attorney Theriac stated that the evidence was conclusive of
compliance in this case.
Ms. Lillian Schiro, Vice -President of Ocean Park, protested that
Ms. Dehaan and Mr. Newman were still operating a business out of
said unit. Mrs. Russell informed Ms. Schiro that the Board would
not be hearing any new evidence in the case since this was a
Compliance Hearing only.
Mr. Moeller moved that Case No. 88-15 be found in compliance.

(A), Garbage Receptacles to be Provided
Mrs. Hutcherson reported that on June 29, 1988 during a routine
inspection, she noticed debris at the mini -warehouse. There was
no trash/garbage/sewer service at this address and no accomo-
dations made for the debris. She submitted into evidence a
letter written to Mr. Weaver notifying him of the violation and
citing the City Codes. She noted that Mr. Weaver had spoken to
Building Official, Jim Morgan and that Mr. Weaver had agreed to
comply by August 5, 1988. On July 7th, Mrs. Hutcherson saw
trash strewn on street in front of the warehouses. Mrs.
Hutcherson requested a compliance date after August 5, 1988 as
Mr. Weaver had agreed to take care of the problem.
Mr. Okell moved that Mr. Weaver be found in violation of Sec.
922.2.3 of the Standard Plumbing Code and Section's 671.01 and
Section 673.02 and further that he come into compliance by the
date of August 11, 1988 and notify Evelyn Hutcherson in writing.
Mr. Moeller seconded motion. Motion carried unanimously.
2. Case No. 88-22, Sharon Royle Lot 1 Block 6 Cape
Canaveral Beach Gardens (8590 Canaveral Boulevard)-

Mrs. Hutcherson reported that a walk-in cooler shed had been
placed on the property without a permit. The property owner,
Sharon Royle, was sent a Notice of Violation with a compliance
date of July 11th. Mr. Howard, a resident at that address,
contacted Mrs. Hutcherson and assured her the cooler would be
removed no later than July 16th. An inspection on July 18th
revealed that the cooler had been moved to the backyard and did
not meet the miniumum setback requirements. She presented a
picture of the location of the shed and noted the debris next to
the fence. Discussion followed.
Mr. Okell moved to find Sharon Royle in Violation of 645.03 (A)
and Section's 639.23, 637.11 and 675.11 and further that she
come into compliance by August 11, 1988 and that she notifiy Mrs.
Hutcherson in writing. Mr. Moeller seconded the 'motion. Motion
carried unanimously.

Chairman Stenglein announced that copies of the Code Enforcement
Board Statement of Procedures were available at the table by the
door.
Chairman Stenglein noted the minutes needed to be corrected in
that they should reflect that Evelyn Hutcherson and Jeffrey
Eckley were also sworn in.by Attorney Theriac. Mr. Okell moved
to approve the minutes of May 19, 1988 as corrected. Mr.
Hutchinson seconded motion. Motion carried unanimously.

stated that as of 5:00 P.M. the date of the meeting, the sign was
still in place. City Attorney Theriac advised that at the last
Code Enforcement Board Meeting the board determined that Mr.
Nasapour's sign would not be allowed under the grandfather clause
because it is a new sign.
Mr. Moeller moved that Mr. Nasapour be found in violaton of
Section 653.20(A) and that a fine of $25.00 per day be imposed

Mr. Eckley stated that this item had been postponed from the Code
Enforcement Board meeting of April 19, 1988, to gather further
evidence that the board requested. Mr. Eckley presented into
evidence an application submitted by Mr e. Dehaan and Mr. Newman
requesting an advertisement be placed in the local tourist
guides of the Brevard County Tourist Development Board.
William Witman, Lillian Shero and William Sheridan, residents of
Ocean Park gave testimony that they had personal knowledge that
business transactions were being conducted in this unit and
presented into evidence advertisements from the newspaper and
telephone book with the address and telephone number of 350
Taylor Avenue, }B-1.
Mr. Newman stated that he has an occupational license at 7001 N.
Atlantic Avenue. He noted that the telephone number listed also
rings at his real estate office and Mrs. Dehaan's residence. He
noted that Ocean Park Development was the owner of that unit and
that he was president of Ocean Park Development. He stated that
he usedtheunit for storage 'of personal property and that the
unit was not used for business purposes.
Mrs. Dehaan testified that this address is being used only for
mailing purposes, and that no business was being conducted there.
Chairman Stenglain stated that the telephone number and address
should have been changed if there was no business being conducted
at this address.
Mrs. Russell moved that in Case No. 88-15, Mr. Newman and Mrs.
Dehaan, 350 Taylor Avenue, fB-1 be found in violation of Section
721.11 by operating a business without an occupational license
and engaging in business in an R-2 zone) that Mr. Newman and Mrs.
Dehaan cease conducting business at the address, including
removing the telephone equipment and that they shall comply by
June 14, 1988 and notify Mrs. Hutcherson. Mr. Moeller seconded
motion. Motion carried unanimously.

Mrs. Russell noted a typographical error on the agenda in that
Section 703.3 should read 703.03. Mr. Burton Greene, Attorney
representing Mr. Eaton, stated he would be participating in this
case.
Mrs. Hutcherson gave a brief history of this case and presented
into evidence photographs of the property and the Notice of
Violation.
Mr. Greene requested that Mrs. Hutcherson draw a map showing the
location of the undergrowth and presented this into evidence. He
then questioned Mrs. Hutcherson on certain aspectsof the case.
Discussion followed on the various aspects of the case.
Mr. Paul Eaton gave testimony and submitted photographs of his
property into evidence. He stated that his property had recently
been cut and he would be willing to cut more greenage should the
board desire. He also stated that he would be willing to
relocate his greenhouse to comply with the setback requirements.
Mr. Eaton stated that all other violations had been complied
with.
Mr. Moeller moved tofind that Case No. 88-20, Paul D. Eaton,
in violation of Section 639.23 and Section 639.25, and that the
respondent shall comply by taking the following action: trimming
the vegetation to an acceptable height and relocating the
accessory structure to conform to the setback requirements] and
that he be in compliance by July 14, 1988 and notify Mrs.
Hutcherson for an inspection of the property.
Mr. Eaton requested a longer period of time to comply due to
having a heart attack in January and he can only work a short
period of time per day.
Mr. Moeller restated his motion to read Mr. Eaton should comply
by September 15, 1988.. Mrs. Russell seconded motion. Motion
carried unanimously.

Mr. Eckley stated that this case had been cited as the result of
a citizens complaint filed with the Building Deportment. He
noted that there was some question as to the legal description of

as both parties received the notice of violation.
Mr. Eckley reported that he had no evidence that the unit was
being used for a business and requested the Board to make this
determination.
Mr. Newman submitted evidence that he has an occupational license
and a real estate brokers license at 7001 North Atlantic Avenue.
He stated that the telephone at his real estate office also

at his residence in Ocean Park South, Unit #B-1,
and Dehaan's residence. He noted that Ocean Park Development was the
owner of that unit and that he was President of Ocean Park
Development. He stated that he used the unit for storage of
personal property and that he did not use the unit for business.
Discussion followed.
Mr.. William Sheridan, representative of the Condominium
Association, submitted a petition with fifteen names of residents
who contend that business was being conducted in this unit. He
submitted a document from the State of Florida, Division of
corporations, which stated that Ocean Park Development, Inc. had
been involuntarily dissolved.
Mr. Sheridan also noted that Mrs. Dobson handled the rental of 18
units and collected rent and met prospective tenants in the unit.
He also submitted a brochure published by the Brevard County
Tourist Development Council which listed Ocean Park North
Condominiums at 350 Taylor Avenue, #B-1.
Attorney Bennett swore in Mr. George Ruffel. Mr. Ruffel stated
that he still owned a unit in Ocean Park and that he had resided
there from August 1978 until October 1985. He said he had
personal knowledge of business transactions during that period.
Attorney Bennett recommended that the Board consider the
following: (1) .The petition submitted did not indicate that they
had personal knowledge that the unit was being used for a
business and (2) There was no evidence that the tourist brochure
was valid. Discussion followed.
Mr. Moeller moved that in Case No. 88-15, Mr. Newman and Mrs.
Dehaan be found in violation of Section 721.11, and that they
come into compliance by May 12, 1988, without penalty, and upon
compliance Mr. Newman and Ms. Dehaan shall notify Evelyn
Hutcherson. Mr. Okell seconded the motion. Discussion followed.
The motion failed by a unanimous vote.
Mrs. Russell moved that Case No. 88-15 be continued until the May
19, 1988, meting, pending additional information. Mr. Stenglein
seconded the motion. Vote on themotion was as follows: For; Mr.
Arabian, Mr. Okell, Mrs. Russell, and Mr. Stenglein; Against; Mr.
Hutchinson and Hr. Moeller. Notion carried.

DISCUSSION
Chairman Stenglein read a policy statement from the City Clerk,
i.e., The City Council will made board appointments without
recommendation from the board.
Mr. Moeller stated that, after reviewing the information
presented at the last meeting, he believed the board had made a
serious error in the decision at the last meeting on On -Site
Development's construction of Royal Mansions without a permit.
Discussion followed. It was the consensus of the Board that
pertinent information on a case of this nature should be provided
with the agenda packet.
Chairman Stenglein questioned the rental policy at Royal Mansions
and inquired about clearing the property north of Royal Mansions.
Chairman Stenglein introduced Jean Porter -Gabler, the newly
appointed First Alternate to the Code Engorcement Board.
There being no further business, the meeting was adjourned at
9:50 p.m.

AUGUST 15, 1986 - A REQUEST FROM CLIMATROL SALES TO CONSTRUCT A SCREEN
ROOM WAS DENIED BECAUSE IT DID NOT MEET THE REQUIRED SETBACK REQUIRE-
MENTS.
OCTOBER 23, 1987, MR. LARRY KING APPLIED FOR A PERMIT FOR A SCREEN ROOM
AND WAS ADVISED OF THE PREVIOUS DENIAL AND OF THE CHANGE IN THE ORDI-
NANCE WHICH WOULD ALLOW A SCREEN ENCLOSURE WITH A SCREEN ROOM. THAT
SAME DAY, CONSTRUCTION WAS STARTED WITHOUT THE BENEFIT OF A PERMIT
AND A STOP WORK ORDER WAS ISSUED. SUBSEQUENTLY, PERMIT #5308 WAS ISSUED
FOR A SCREEN ROOM WITH A SCREEN ROOF.

MR. OKELL DECLARED A CONFLICT ON THIS ITEM BECAUSE OF A NEIGHBOR-
ING RELATIONSHIP. ATTORNEY THERIAC EXPLAINED THAT UNLESS MR. OKELL
HAD A PECUNIARY INTEREST IN THIS ITEM, HE SHOULD NOT DECLARE A CONFLICT.
MR. OKELL STATED THAT HE WOULD VOTE IF THAT WERE THE CASE, BUT HE WANTED
IT ON RECORD THAT IIB WISHED TO ABSTAIN.

RECEIVED FOR FINES, LIENS, ETC. IMPOSED BY THE CODE ENFORCEMENT BOARD
SINCE ITS INCEPTION. CHAIRMAN STENGLEIN COMMENTED THAT THE BOARD COULD
BE A GREAT VALUE TO THE CITY IF THESE FINES WERE COLLECTED.
