Board t:cmbers Present were Frank M. Hoog, Chairman, Don Clayton,

The Hinutes of the previous regular meeting. of July 25, 1962 were read
and npproved as read.
1. 1'OTI0:1 was made by Don Clayton, seconded by Gene Jandreau that we
ask our City Attorney to give the Zoning .Board a complete definition
and meaning of riparian rights on river fronts., passed unanimously.
A request was made by Walter Byrd, Architect for Shuford Mills for
® rezuning a described property from GU to RU -3. A MOTION was made
by Gene Jandreau to start public hearing advertising at earliest
-osslble date, passed unanimously.

Members of the Zoning Board Present were: Frank M. Noog, Chnirman,
Don Clayton, B. B. Purcell and Eugene Jandrenu. Secretary present
Jean K. Taylor.
The first order of business wns'the henring of the Proposed new
setback on new 401. It wns rroposed to establish a 75 foot Ictbncl:
on the entire West side of new 401; to establish a 50 foot retbuck
on the East side of Pew 401 from the Bouthern city boundary north
® to Long Point Road; to establish n 75 foot netbhck on the East
side of new 401 from Long Point Road north to the North City Limits„

Item Number 1: Jnck Hurck.stnted his objection here was in conjunction

strip of land when it was doubtful that the extra lnnd would be used
for road exnansion for some time. Mr. Jack Hurek, builder, stilted
he had a client who desired a commercial building built on a niece
of property of 125' on the highway and 1001 deep and if the proposed
changes pnssed he could only build a 10, x 80t building. on this

stating thnt in the Avon, by the Sea subdivision property hnd been
boufiht with deed restrictions of a 25 foot setback on Enst -West
isstreets and a 15 foot setback on North -South streets. It .would only
be necessnry to enforce the deed restrictions to assure alirnment
of property without resorting to zoning people out of the use of
their land. Mr. Charles, Overby agreed with the statements of
ltr. P. L. Murphy.

and he felt this was indeed confiscation. Mr. Jack Hurck stated

(Temporary City Hall) at 8.30 P.M., Wednesday August 22, 1962. Members
of the Zoning Board present were: Frank M. Hoog, Chairman, Don Clayton,
B. B. Purcell, Eugene Jandreau, Councilman George G. Rogers, Secretary
Shirley S. Jenkins.
The first stst order of business was the request of Shuford Mills for re- zoning
the now existing GU area to RU -3, approximately eighty to ninety acres.
Appearing for the re- zoning were Mr. Walter D. Byrd and Mr. H. H. Simms,Jr.
No one pppeared against this re- zoning.
® The second order of business was a request to re -zone the North line of
Section 23 from 751 to 500 setback. Appearing for this request was Mr.
Ben Lewis, Cape Canaveral, Florida.
DISCUSSION
Item Number 1: Mr. Simms stated that the request to re -zone the GU area
to RU -3 would be a sub - division called Cape Canaveral Beach Gardens, which
is approximately eighty to ninety acres located on Old S. R. #401 and
Washington Avenue, City of Cape Canaveral, Brevard County, Florida.
Eleven of these acres will not be platted, the rest will be platted for
Hotels, Apartments and Office Buildings. After discussion with the
Zoning Board a MOTION made seconded and passed unanimously to approve
the re- zoning of the GU area to RU -3 was made
Item Number 2: A MOTION was duly made seconded and passed unanimously to
start Public Hearing Notice as requested by Mr. Ben Lewis
There being no further business meeting was adjorned at 9:15P.M.

Mr. Dubov was told that the Board could not imme grant him a
Variance according to the Brevard County Zoning Regulations, Section
30, which was read to Mr. Dubov.
A MOTION was made to temporary banning of paving parking areas
unless the builder or owner provides the drainage. The Chairman
asked for MOTION to be withdrawn. A general discussion was held
and MOTION was withdrawn.
