It contains the instructions for complying with the annual special district fee and update requirement using the enclosed combined Fiscal Year 2015 I 2016 Annual Special Di$trict Fee Invoice and Update Form (the •torm"). The Purpose of the Annual Fee Chapter 189, Florida Statutes (the Uniform Special District Accountability Act), requires the Departmenfs Special District Accountability Program (the "Programn}, to perform a number of duties and responsibilities as they relate to special districts. The Leglslature does not appropriate general revenue to pay the costs involved. Instead, Section 189.018, Florida Statutes, requires the Department to collect an annual fee from each special district to pay the costs involved. The annual fee remains at $175 per special district, unless the special district certifies that it is eiigible for a zero fee. The Purpose of Reviewing and Updating the Special District's Profile One of the Program's responsibilities is to continuously maintain specific information about each special district and make it publically available through the Official List of Special Districts Online (www.FloridaJobs.org/Officiallist). More than 685 state and local agencies use this list to coordinate activities with special districts, classify and compile financial information, and monitor Florida's 1,650-plus special districts. Therefore, it is very important for each registered agent to annually review all information about the special district to determine if anything needs to be corrected or updated. Please remember that Section 189.014(2), Florida Statutes, requires a special district to notify the Department immediately upon making a change to its registered agent I office information. Furthermore, Section 189.016(2), Florida Statutes, requires a speclal district to file charter and boundary map amendments with the Department within 30 days after adoption. Reminder: All Special Districts Must Have an Official Website For all special district in existence on October 1, 2014, the deadline to post all required content to its official website and submit the website address to the Program was October 1. 2015. First, review the special district information on the form (you may download a duplicate form and our W-9 Form from www.FloridaJobs.org/SpecialDistrictFee): a. Make any needed changes I additions directly on the form by marking through the outdated or incorrect information and writing in the new information. Be sure to include a valid email address and the special district's official website address, If it has one. b. Indicate whether the information does or does not need to be changed. c. Sign and date where indicated. 2. Next, pay the $175 fee or, if eligible, complete the "Zero Annual Fee Certification Section": a. Payments submitted after December 3, 2014, must include the appropriate late fee. b. If not paying online, prepare a check payable to the Department of Economic Opportunity. c. To finish, prepare and return the form, along with a check and other forms if applicable: a. Keep the lower portion of the form (bottom two inches) for your records. b. Discard the "Zero Annual Fee Certification Section" if not applying for the zero fee. c. Do not cut along the dotted line-it is for our use only. d. If payment was made on line, write "PAID ONLINE" on the top portion of the form (above the "Zero Annual Fee Certification Section") and email or mail the form to the address below. d. If payment is not being made online, attach a check to the form to ensure the payment is properly credited to the correct special district and mail to the address below. e. If qualifying for a zero fee, email or mail the form to the address below. f. If the form indicates the Department needs the special district's boundary map and I or creation document, email or mail to the address below. g. In summary, this legislation: • Organized Chapter 189, Florida Statutes, into eight parts • Renamed the "Special District Information Program· to the "Special District Accountability Program· • Increased special district accountability, oversight, and transparency by: o Providing a process by which an appropriate oversight entity may hold a public hearing when certain special districts do not comply with financial reporting requirements o Providing a process by which an appropriate oversight entity may conduct a general oversight review of a special district o Requiring the Program to electronically publish special district noncompliance status reports to its website for public review (see www.FloridaJobs.org/Noncompliance) o Requiring each special district to have a website and to provide its website address to the Program; requiring the Program to provide a link to each special district's website from its website (keep reading for more details) New Website Requirement for All Special Districts By October 1, 2015, all special districts must maintain an official website as follows: • All Independent special districts must maintain a separate website • All dependent special districts must be preeminently displayed (hyperlink to the specific pages) on the home page of its local governing authority's website or must maintain a separate website Each special district must post the following information, at a minimum, on its official website: 1. General Information: a. Full legal name (as cited in creation document) b. Public purpose c. Boundaries I service area (a map may be useful) d. Services provided e. Full text of the Charter I creation document (community development districts may reference Chapter 190, Florida Statutes, as the uniform charter, but must include information relating to any grant of special powers) f. Statute or statutes under which the special district operates, if different from the statute or statutes under which the special district was established. g. Date established (effective date per creation document) h. Establishing entity (legislature, county(ies), municipality(ies), or Governor and Cabinet) 2. Contact lnfonnation: a. Mailing address b. Email address c. Telephone number d. Website address e. Registered agent I registered office (name and address) f. For each governing body member: i. Name ii. Address iii. Email iv. Fiscal year period (most special districts use October 1 -September 30; a few, including some housing authorities, use other fiscal year periods) b. Tentative budget (post at least two days before the budget hearing, held pursuant to Section 200.065, Florida Statutes (method of fixing millage), or other law to consider such budget, if applicable) c. Final adopted budget (post within 30 days after adoption) d. Budget amendments, if applicable e.
