REGULAR MEETING
June 15, 1993
A Regular Meeting of the Cape Canaveral City Council was held on
June 15, 1993 , at the City Hall Annex, 111 Polk Avenue, Cape
Canaveral, Florida. The meeting was called to order at 7 : 32 P.M.
by Mayor Joy Salamone. Pledge of Allegiance was led by Mayor
Salamone.

1. Regular Meeting of June 1, 1993 .
Motion by Mr. Porter, seconded by Mr. Randels to approve the
minutes of the Regular Meeting of June 1, 1993 as presented.

PROCLAMATIONS:
1. Mayor Salamone read a proclamation supporting the construction
of a Local Fire Service Training Facility in Brevard County. She
presented the proclamation to Dave Sargeant, Fire Chief, of the
Cape Canaveral Volunteer Fire Department.
PUBLIC HEARINGS:
Mayor Salamone advised that the State Revolving Loan Fund
Application had been discussed at the workshop meeting held on June
10, 1993 and was to be placed on the regular meeting agenda,
therefore, the item would be included as Item No. 7 of the New
Business portion of the agenda.

Mr. Kancilia advised that the ordinance could not be approved at
this time on final reading due to the amendments pertaining to
Chapter 32 , Roof Coverings, of the Standard Building Code which had
been included since the first reading of the ordinance.

there was a change on the ordinance, but that it was not
substantive. He stated that the City's Deputy Building Official

the ordinance. There was discussion relative to the wording
included in the ordinance which read: " . . .twelve (12) inches above
the crown of any street (measured at centerline) . . . " . Motion

Repealing and Reenacting Chapter 503 , Subdivision of Land, for

FLORIDA, REPEALING AND REENACTING CHAPTER 503 OF THE CITY CODE OF
ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF
CONFLICTING ORDINANCES AND RESOLUTIONS; AND PROVIDING FOR AN
EFFECTIVE DATE.
Motion by Mr. Randels, seconded by Mrs. Calvert to adopt Ordinance
No. 22-93 at first reading. Mr. Randels addressed questions to Mr.
Harold Nantz, Dyer, Riddle, Mills & Precourt, relative to the
proposed ordinance. Mr. Nantz answered Mr. Randels' concerns and
explained the site plan pre-application process. There was
discussion regarding the ten day time limit imposed on the
applicant to resubmit the preliminary plat for approval. Mr. Lamar
Russell, Chairman of the Planning & Zoning Board, stated that the
Board agreed with the provisions included in the ordinance.

Motion by Mr. Randels, seconded by Mr. Porter to approve Resolution
No. 93-15 with the appointment of John C. Thomas as a regular
member of the Commercial Development Board. Motion carried with

4 . Resolution No. 93-16, Appointing Members to the Planning and

No. 93-16 with the appointment of Buzz Petsos as a regular member
and Mrs. Beatrice McNeely as first alternate to the Planning and

A RESOLUTION REMOVING ALTERNATE MEMBERS OF THE CODE ENFORCEMENT
BOARD OF THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING FOR AN
EFFECTIVE DATE.
Motion by Mr. Randels, seconded by Mrs. Calvert to adopt Resolution
No. 93-17 . Ms. Miller advised that her office had spoken to Mr.
Wheaton who apologized for his inability to attend the meetings due
to his heavy work schedule. She was unable to speak to Mr.
Phillips as the only phone number given on his application was
incorrect and he had not attended any Board meetings since his
appointment in November. Mrs. Calvert asked that during the
Boardmember interviews that the individuals be advised of the
requirements of Boardmember alternates. She also asked that
current Board vacancies be listed again in Florida Today's Across
the Space Coast column. There was further discussion regarding
responsibilities of Boardmember alternates. Mrs. Mary Russell,
Chairperson of the Code Enforcement Board, spoke regarding the need
to ensure continuity among the Boardmembers due to the number of
Code Enforcement cases that were tabled or continued to subsequent
meetings.

6 . Motion Re: Authorization to send City representative to
attend House Appropriations Sub-Committee meeting in Washington on
June 30, 1993 re: Sand Transfer Facility.
Mr. Porter stated that since he had spoken to Congressman Bacchus'
office he realized that it was not in the City's best interests to
send representatives to Washington at this time because the public
meetings with witnesses were held several months ago. He suggested
that letters be sent to each of the legislative representatives to
encourage their support of funding for the Sand Transfer Facility.
Mr. Boucher advised that he would forward a copy of Congressman
Bacchus' letter of June 15, 1993 , to Commissioner Andreas and other
beach communities to encourage their support of the Sand Transfer
Facility as well.

7 . Motion Re: Recommendation to Approve the Selection of Dyer,
Riddle, Mills & Precourt to Prepare the State Revolving Loan Fund
Application.
Motion by Mayor Salamone, seconded by Mr. Porter to approve the
selection of Dyer, Riddle, Mills & Precourt (DRMP) to complete the
State Revolving Loan Fund Application at a cost not to exceed
$22 , 400 with a 60-day completion date. Mr. Harold Nantz, DRMP,
explained that the original deadline for the loan application had
been June 1, 1993 , but no one had qualified as of this date for the
funds. He stated that his firm would do everything possible to
meet Mr. Boucher's deadline of August 1st. There was further
discussion regarding the application process.

8 . Monthly Activity Reports.
Mr. Porter congratulated Ms. Miller for attaining the Advanced
Academy Certification (AAE) for City Clerks from the International
Institute of Municipal Clerks (IIMC) . Mr. Porter read a letter
from Christina Wilder, President of the IIMC, dated April 29, 1993 ,
regarding Ms. Miller's acceptance into the Academy. Mr. Randels
advised that there were 10, 000 municipal clerks and only 6% have
achieved the AAE designation. Council commended Ms. Miller for her
achievements.
Mayor Salamone commented on the reduction in the number of false
alarm calls and she commended the Fire Department for its efforts.
9 . City Manager's Report.
Mr. Boucher advised that Mr. Ronald McDevitt had agreed with the
City's purchase of his lot (Avon-by-the-Sea, Lot 12 , Block 46) at
a cost of $25, 000 with no closing costs. Council concurred to
proceed with the purchase of the property.
Mr. Boucher advised that Mrs. Sherwin had made another offer to the
City for a purchase price of $57 , 500 for two lots (Avon-by-the-Sea,
Lots 13 & 14 , Block 46) . Council concurred to counteroffer Mrs.
Sherwin $50, 000 for the two lots with no closing costs.
Mr. Boucher advised that dumpsters would be provided at three
locations within the City for June Clean-up on June 21st through
July 2nd.
Mr. Boucher stated that the City had received $1, 000 from the
Florida Contraband Forfeiture Act which had to be used to support
drug abuse education, drug and crime prevention, etc. Mr. Porter
suggested utilizing the money for the D.A.R.E. program. Mr. Leo
Nicholas suggested replacing the Neighborhood Crime Watch signs
throughout the area. Mr. Boucher would research the costs of the
signs.
Mr. Boucher encouraged Councilmembers attendance at the Florida
League of Cities convention scheduled for August 12 - 14 , 1993 .
Mr. Randels stated that the Council needed to designate a voting
delegate for the convention. Motion by Mayor Salamone, seconded by
Mrs. Calvert to add an item to the agenda. Motion carried with

Motion by Mayor Salamone, seconded by Mrs. Calvert to ask Mr.
Randels to be the voting delegate for the City at the Florida
League of Cities annual convention in Fort Lauderdale on August 12-
14 , 1993 . Motion carried with members voting as follows: Mayor
Salamone, For; Mayor Pro Tem Porter, For; Councilman Berger, For;
Councilwoman Calvert, For; Councilman Randels, For.
Mr. Boucher stated that Mr. Morgan had passed the Legal and
Management exam given by the Southern Building Code Congress
International, Inc. and Mr. Tom Kleving had received his Mechanical
Inspector certification. Council congratulated both Mr. Morgan and
Mr. Kleving.
Mr. Boucher advised that the traffic light at AlA and Central
Boulevard was working properly. He also stated that the stakes
placed at the side of the A1A indicated where the new street lights
were to be installed by Florida Power & Light.

Mr. Boucher thanked Mrs. Ann Thurm for his efforts in obtaining and
placing the photographs of all former City mayors and Mayor
Salamone in the City Hall Annex. Council asked Mr. Boucher to
forward a letter of thanks to Mrs. Thurm.
Ms. Miller introduced Bob Billingsley, graduate of the University
of Central Florida (UCF) , who was assisting the City in the
revision of its personnel policies and procedures during a summer
internship program sponsored by UCF.
Mr. Boucher stated that Cocoa Beach had requested a donation of
$2 , 000 from the City towards their fireworks display. Mayor
Salamone felt that it was a good idea to work together to foster
good community spirit in joining with the neighboring community to
sponsor this annual event. Mrs. Calvert expressed her disagreement
with contributing to the fireworks. Chief Sargeant felt that the
City could have its own fireworks for $3 , 000.
There was further discussion among Councilmembers regarding the
requested donation. Mr. Berger suggested that the City participate
in a joint venture next year after this item was budgeted for next
year. Mr. Porter expressed his support of contributing $1, 000 to
Cocoa Beach for the fireworks.
Motion by Mayor Salamone, seconded by Mrs. Calvert to add an item
regarding the fireworks contribution to the agenda. Motion carried
with members voting as follows: Mayor Salamone, For; Mayor Pro Tem
Porter, For; Councilman Berger, For; Councilwoman Calvert, For;
Councilman Randels, For.
Motion by Mayors Salamone, seconded by Mr. Porter to donate $500. 00
to the City of Cocoa Beach for the 4th of July fireworks. Motion
carried with members voting as follows:

Mr. Porter asked that the City's contribution be included in
Florida Today's Across the Space Coast column. Mr. Boucher advised
that the City's contribution would also be included in Cocoa
Beach's newsletter to their City residents.
DISCUSSION:
1. Mr. Randels spoke in reference to an open house for the
beginning of a 9-mile dredge project at Long Boat Key and stated
that the Mayor was invited to attend.
2 . Mr. Randels spoke regarding a Worker's Compensation seminar he
had attended and he gave reference material to Mr. Boucher.
3 . Mr. Randels distributed copies of the proposed health care
bill from Governor Chiles' office.
4 . Mr. Randels spoke in reference to environmental concerns and
gave examples of cases whereby a developer donated property to a
city and later it was discovered that an underground storage fuel
tank was located on the property and it cost the city a substantial
amount of money to clean up the area. He explained the provisions
included in new environmental insurance called Safe Environmental
Site Insurance which was similar to title insurance.

Mr. Kancilia stated that property purchasers were now conducting
environmental audits of property prior to the actual purchase. Mr.
Nantz further explained the environmental audit process.
There being no further business, the meeting adjourned at 9 : 42 P.M.
