HomeMy WebLinkAboutMinutes 05-05-1992 Workshop and Regular CITY COUNCIL COMBINED WORKSHOP AND REGULAR MEETING May 5, 1992 A Regular Meeting of the Cape Canaveral City Council was held on May 5, 1992, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The meeting was called to order at 7 :30 P.M. by Mayor Joy Salamone. Pledge of Allegiance was led by Mayor Salamone. ROLL CALL: Mayor Joy Salamone Present Mayor Pro Tem John Porter Present Councilmember Andy Kedzierski Present Councilmember Rocky Randals Present Councilmember Ann Thurm Absent City Manager Edward Spenik Present City Attorney John Kancilia Present City Clerk Faith Miller Present ADOPTION OF MINUTES: Motion by Mr. Porter, seconded by Mr. Kedzierski to approve the minutes of the Regular Meeting of April 21, 1992 as presented. Motion carried with members voting as follows: Mayor Salamone, For; Mayor Pro Tem Porter, For; Councilman Kedzierski, For; Councilman Randals, For. Mayor Salamone stated that she had received a request to move the order of the agenda and proceeded to do same. NEW BUSINESS: 10. Discussion Re: Forgotten Veterans. Mr. John Kancilia, City Attorney, asked specific questions regarding the Forgotten Veterans ' organization of the representatives, Mr. James Clark and Mr. Joseph Seljan. The Mayor and Council also addressed questions to the representatives also regarding the amount of money collected by the organization ( $135,000) and the amount of charitable contributions ($14,000) listed for 1991. Discussion followed. Mr. Kedzierski stated that the letter submitted by Mr. Seljan indicated that the financial statement had been internally prepared by employees of Forgotten Veterans and had not been compiled, reviewed or audited by its accountant and that all numbers presented were estimates only. It was the consensus of Council to not issue a license to the Forgotten Veterans ' organization for solicitation of donations within the City limits. UNFINISHED BUSINESS: 1 . Ordinance No. 3-92, Amending and Renaming Chapter 301, Per Diem and Travel Expenses of Public Officers, Employees and Authorized Persons, for second and final reading. Mayor Salamone read the title of the Ordinance. Mayor Salamone read the title of the Ordinance. AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, REVISING CHAPTER 535, SEWER IMPACT ASSESSMENT; ESTABLISHING MINIMUM SEWER IMPACT FEES TO BE PAID BY COMMERCIAL AND INDUSTRIAL CUSTOMERS OF THE CAPE CANAVERAL WASTE WATER TREATMENT SYSTEM; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, ADDING SECTION 657. 10 AND SECTION 675. 19 TO THE CODE OF ORDINANCES, TO PROHIBIT THE BURYING OF TRASH, RUBBLE, DEBRIS AND NATURAL COVER WITHIN THE CITY; REPEALING ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH; ESTABLISHING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Motion by Mr. Porter, seconded by Mr. Kedzierski to adopt Ordinance No. 6-92. A RESOLUTION ESTABLISHING A NEW SCHEDULE OF SEWER IMPACT ASSESSMENT FEES, WITHIN THE CITY OF CAPE CANAVERAL, FLORIDA, SERVICE AREA, PROVIDING FOR AN EFFECTIVE DATE. Motion by Mr. Kedzierski , seconded by Mr. Porter to adopt Resolution No. 92-17. Mr. Don Haynes, resident, questioned impact fee rates of other municipalities. Discussion followed. Motion carried with members voting as follows: Mayor Salamone, For; Mayor Pro Tem Porter, For; Councilman Kedzierski, For; Councilman Randals, For. NEW BUSINESS: 9. Discussion Re: Building Official 's letter regarding City Manager. Mr. Porter stated that he valued both employees, the City Manager and the Building Official, and he suggested that they meet with a arbitrator to try to work out an amicable solution to the problems. He stated that he had spoken to a professor from the University of Central Florida who was a member of the American Arbitration Association and was extremely qualified and highly recommended. His arbitration services would be free of charge. He stated that Mr. Morgan and Mr. Spenik were both willing to talk with the arbitrator. He asked for Council 's support. Mayor Salamone stated that she was in support of any administrative decision that needed to be made and that an answer to Mr. Morgan's letter was not in Council 's purview. Mr. Randals stated that there were two areas of concern, the permit for the wall and the attitudes between the individuals. Mr. Kancilia advised that the wall situation would be resolved separately. Mr. Kedzierski advised that he did not want to dwell on the day-to-day operations of the City and that he put his confidence in the City Manager. Mayor Salamone reiterated that the City Charter would not allow the City Council to interfere in the day-to-day operations of the City and she hoped for amicable results of the internal conflicts. Further discussion followed. Mayor Salamone stated that she had received a letter from Councilwoman Thurm which she turned over to the City Attorney. Mr. Kancilia advised that Councilwoman Thurm had written a letter, dated May 5, 1992, to the Mayor and City Council regarding the present situation. He stated that there was no provision in the City Charter or Florida Statutes whereby Councilwoman Thurm could act through a proxy. He stated that he would put the letter in the public record and he summarized the contents of the letter. He stated that Mrs. Thurm was sympathetic to Mr. Morgan and critical of Mr. Spenik and expressed her support for Mr. Morgan. Mr. Hans Sauremann stated that perhaps the City had too many chiefs and not enough indians. 1 . Discussion Re : Cape Sierra's request for placement of a Tiki Hut on their property. Mr. Ken Detwiler, General Manager of Cape Sierra, explained the nature of request. Discussion followed. Mayor Salamone questioned if Mr. Detwiler would have any problem with fencing the area, posting signs, and a 10:30 P.M. curfew on the Tiki Hut selling alcoholic beverages. Mr. Detwiler advised that he would comply with same. City of Cape Canaveral, Florida Combined Workshop and Regular Meeting May 5, 1992 Page 4 Motion by Mayor Salamone, seconded by Mr. Kedzierski to allow Cape Sierra to proceed with the process to procure whatever permits were necessary to build the Tiki Hut under the appropriate ordinances of the City of Cape Canaveral. Mr. Randals questioned if it would be feasible to limit the request to a six month time period. Mayor Salamone felt that if there were any problems with the Tiki Hut then the Council could revisit the issue. Motion carried with IP members voting as follows: Mayor Salamone, For; Mayor Pro Tem Porter, For; Councilman Kedzierski, For; Councilman Randals, For. 6. Scavenging in dumpsters - Western Waste Industries. Mayor Salamone stated that she wanted to reconsider requiring individuals to be permitted and licensed to scavenge because she had not been aware that they wanted to scavenge what already belonged to the citizens of Cape Canaveral through the recycling program. Mr. Randals stated that his concern was the City's liability in the event that an individual was injured while scavenging in the dumpsters. Mr. Robert Quinn questioned whether or not he could pick up cans within the City limits. Mayor Salamone stated that he could not take cans and recyclables out of the dumpsters. Mr. Jim O'Toole spoke against denying individuals the right to scavenge cans and other materials from the dumpsters. Mr. Ed Hammitt and Mr. Quinn both spoke against denying scavengers the right to pick up cans. Discussion followed. Mr. Robert Hyres, Division Manager of Western Waste Industries, began a discussion relative to the separation of yard waste from other types of garbage. Brevard County requested that the separation begin July 1, 1992. Mr. Hyres further reviewed an option referred to as 2-1-1 for twice a week garbage, once a week yard trash and once a week recycling pick-ups. He also spoke in reference to converting the City to a curbside collection system. Discussion followed. Mr. Hyres indicated that he would be leaving a video with Council for its review prior to the next workshop. Discussion followed. Council concurred to schedule the item for discussion at the next Council workshop. Mr. Fred Distastio stated that he had organized Spring Clean-Up the previous year and it would be done again in June 1992 and he suggested educating the citizens during Spring Clean-Up regarding the green waste program. 2. Resolution No. 92-22, applying for federal anti-drug abuse funds to the State of Florida, Department of Community Affairs. lw Mayor Salamone read the title of the Resolution. A RESOLUTION OF THE CITY OF CAPE CANAVERAL, FLORIDA, SUPPORTING THE BREVARD COUNTY BOARD OF COUNTY COMMISSIONERS APPLICATION PROCESS OF APPLYING FOR FEDERAL ANTI-DRUG ABUSE FUNDS TO THE STATE OF FLORIDA, DEPARTMENT OF COMMUNITY AFFAIRS, APPROVING THE DISTRIBUTION OF THE ANTI-DRUG ABUSE FUNDS AVAILABLE FOR THE DRUG TASK FORCE INTERDICTION TEAM AND THE DRUG INTERVENTION PROJECTS; PROVIDING FOR AN EFFECTIVE DATE. Motion by Mr. Randals , seconded by Mr. Porter to adopt Resolution No. 92-22. City of Cape Canaveral, Florida Combined Workshop and Regular Meeting May 5, 1992 Page 5 3. Discussion Re : Proposed Ordinance on Irrigation (Rain Sensor Law, Section 373. 62, Florida Statutes. Mr. Spenik reviewed recent State of Florida legislation which required that any person who purchased and installed an automatic lawn sprinkler system also had to install a. rain sensor device or switch which would override the irrigation cycle of the sprinkler system when adequate rainfall had occurred. Mayor Salamone asked Mr. Kancilia to research the item further. 4. Brevard Metropolitan Planning Organization (MPO) information re: public workshops and a public hearing regarding transportation planning area boundaries. Mr. Spenik advised that he was concerned about the reapportionment issue which was scheduled for discussion at the June 10th hearing of the MPO. Discussion followed regarding which Councilmember would be available to attend the meeting. Mr. Kancilia spoke in reference to the possibility that one of the new seats would be given to Port Canaveral. Mayor Salamone stated that the Governor made the appointments to the MPO. She asked Mr. Kancilia to assist the City in its request for a seat on the MPO. 5. Discussion Re : Audit of revenues from Cable T.V. franchise. Mr. Spenik referenced material the Council had received from Robert Butterworth, Attorney General, regarding the audit of cable franchise fees. He suggested authorizing the City Attorney to amend Chapter 415 of the City 's Code of Ordinances to allow for audits of cable franchise fees owed to the City. Mayor Salamone felt that it was in the City 's best interests to add a clause in the cable t.v. contract to allow the City the ability to request an audit of the franchise fees. 7. Discussion Re : Cherie Down Lane located in Beach Park Village. . Mr. Kancilia reviewed his research relative to Cherie Down Lane located in Beach Park Village. He further explained why Cherie Down Lane was not eligible to be dedicated to the City as a City street. The road was not built with an intention to meet City requirements. Mr. Jim Camp, Cherie Down Lane, spoke in reference to the problems in his area. Mr. Joseph Abbott, Public Works Director, stated that he had contacted the developer and Mr. Newman would be picking up drawings from Mr. Abbott which would assist him in fixing the sewer problem. Discussion followed. L8. Police Department and Animal Control Capitol . Mr. Spenik advised that he had a beach vehicle for sale which would serve the needs of the police department for night patrols at the beach and beach ends. Mayor Salamone asked Mr. Kancilia to further research the matter and schedule it for consideration at the next workshop. DISCUSSION: Mr. Spenik advised that he had received communication from the Attorney General 's office relative to changes in convenience store security provisions. Training sessions on the provisions would be held in Tampa on June 15-17, 1992 and Mr. Spenik requested Council 's approval to expend funds to send police personnel to the sessions. Council concurred to schedule this item for the next workshop. City of Cape Canaveral, Florida Combined Workshop and Regular Meeting May 5, 1992 Page 6 Mr. Spenik advised that the Cocoa Beach Fire Department had sent a letter of thanks to the Cape Canaveral Volunteer Fire Department for its assistance in controlling a fire on the second floor of the Cocoa Beach Hilton. Mr. Spenik advised that he had received a request from the City of Cocoa for a resolution in regard to Amtrak passenger service at a passenger station between Cocoa and Rockledge. VOINIMINIS Mayor Joy Salamone, City Council City of Cape Canaveral Cape Canaveral, Florida RE: Building Official James Morgan' s Memo titled "Confusion" dated April 28 , 1992 (Attached) I am sorry that, at this time, I am not physically able to be with you at this meeting to make this statement in person. In view of my temporary disability I would appreciate your reading these remarks into the record at the appropriate time, either at the discussion on Building Official ' s Memo (#9 - New Business) , or , in the event this item is deleted from Agenda, then read it under the "Discussion" portion of the meeting. I ask the Council to consider how many of our loyal and conscientious employees have resigned or are leaving the employ of the City. To date, in the last year and a half, we have lost two (2) secretaries with tenured investments of 3 and 4 years , respectively, two (2) City Attorneys, one (1) certified City Clerk with more than 10 years City-invested training, and possibly, others, of which I am not aware. Add to this list, persons being demoted, employees hearing talk of transfers or reduction of full time work hours to part time. All this is very disturbing to our employees and I believe morale is at an all time low, as a result. It seems almost no one feels happy and relaxed any more in their work for the City. It disturbs and concerns me very much to think that yet another of our long-term, experienced employees, Mr. Morgan, may have to resign because, as he has stated, he cannot work under Mr. Spenik. Mr. Spenik' s obvious hostility toward the employees , especially the long-term employees, is appalling to me. (He has expressed this hostility to me, personally, on several occasions. ) I do not believe that a professionally educated and trained manager would do the things this person is doing, resulting in a steady turnover in valuable personnel and in great loss of operational expertise for our City. Mr. Spenik has expressed much criticism regarding our employees to me and has undoubtedly repeated the same faultfinding opinions to the Council Members. He has indicated, in our personal conversations, that City employees, in general are, and I quote, "bad, " not "up to par, " are "liars, " and some are, as he puts it, "out to get me! " Those are, I repeat, direct quotes. His refusal to allow Council to know where he lives or his home phone number is yet another example of an unusual attitude. In my opinion, and of course I am no Doctor, it appears his conduct is very paranoid; others have expressed to me the same feelings . ATTACHMENT TO: Combined & Regular Workshop Meeting May 5, 1992 TOTAL of 7 pages Mr. Spenik has stated to me that people are "plotting" against him. He accused the former City Clerk, the former City Manager and myself, on one occasion, of having a secret meeting in the City Hall, in order to plot against him. Not true, of course. He has stated that he thinks people are entering City Hall at night and on weekends (March 11 Memo attached) , and as a result, he has changed locks not once, but several times, at City expense. He has written the attached memo to Council, fraught with his concerns, titled "Incidents that have occurred to the City Manager. " At his January 1992 evaluation, I discussed with Mr. Spenik, personally, my concerns, i.e. his dealings with employees, to no avail. At that time, I mentioned in comments entered on the flip side of the City' s standard evaluation sheet, my concerns about his apparent mood changes, but Mr. Spenik and I had no discussion on that point, although the mood changes, noticed by myself, have come to the attention of other City employees and have caused comment. Spenik has complained many times , about the former City Manager coming into the City Hall Building, as is Mr. Nicholas ' right as a resident of our City. Mr. Spenik expressed suspicions that those visits always had to do with some actions concerning himself, even though Mr. Nicholas was a candidate in 1991, and was required to come to City Hall to attend to business. Mr. Spenik has even objected to my getting copies of record from the City Clerk and expressed definite wish that I obtain further copies through his personal office! Additionally, Mr. Spenik is not always truthful to us , the Council, or, as I have been told, the employees. An example of this is a recent memo, dated March 12, 1992 (attached) which was written and circulated widely, concerning my purported absence (s) from Beach Erosion Committee Meeting (s) . The facts indicated in the memo were simply not true, and resulted in a disturbing flurry of activity based on Spenik' s falsehoods. Brevard County Appointees to County Committees, incidentally, are in no way within the scope of City Manager' s responsibilities. I could cite many other instances of untruthfullness , cavalierly, disruptive statements and apparent paranoid behavior, but what I have cited above is sufficient to illustrate my feelings. At -this time, as a result, I would ike to_je-g1P t_that you consider asking for Mr. Spenik' s res�gna dn, rather than accepting Jim Morgants Building Official Resignation. Such an action, at this -time, I feel is in the best interests of the City. It is not a personal grudge on my part since I have honestly tried to both, like and cooperate, with City Manager Spenik, but, have found it an impossibility. Anyone who knows me can say that I have tried consistently to do what is best for our City in countless different ways over the past 30 years. I feel that Edward Spenik will never be able to operate compatibly and harmoniously within the workplace of the City of Cape Canaveral. The incidents are not isolated to one location , and were not coincidental. - There were several plants in the City Manager ' s office that died after hot coffee was poured on them. On a number of occasions I was left telltale indication that the City Manager ' s office was entered, without permission, after hours . These incidents were reported to the Police Department, ' i .e. , office door, pry marks , exterior door left open on two occasions ( discovered in the morning) . Files in the desk were found missing , including the Library plans , which were not available during the insurance investigation with the Library carriers . Mysteriously, these files have reappeared. A sewer/recycling bill and check were put in the incoming tray at the Finance Office but were never received by Finance . The check was never found nor a copy of my bill. • The City car assigned to me and three separate personal vehicles have been damaged with air pellets. An apartment that I leased had a post light shot by an air gun. The screen to a window and the window were damaged. The same weekend, my mail box was knocked off it' s mounting. There was no damage to other properties in the area on this particular weekend, November 5, 1991. PRINTED ON RECYCLED PAPER Page 2 March 11, 1992 - Incidents My wife has had anonymous letters sent to her from this area . She has also experienced a number of disturbing telephone calls. Until I feel some progress has been made in the apprehension of the perpetrators , I am not publishing any vital personal information regarding myself . There is a safety concern . AT/he jc-1-v, l 1 5 2_ Foam Ann 1i-/ I would suggest to this manager that he would run a smoother ///// operation if he tried to utilize the prior knowledge , experience and loyalty of longer term employees , rather than show a hostile attitude toward same . I would request that he refrain from any involvment in city pol- itics . This practice is always , without fail , the safest practice for any employee of the city. I sense at times , a wide and somewhat erratic mood swing for no observable reason which appears to result in some hostility toward other workers . I would definitely like to see some improvement in this area. I would appreciate a completely honest answer to all my questions at all times and I request that the manager treat all council members with the same respect and consideration. I suggest that the manager be extremely careful and explicit when conveying information to the consultants to the city, from council members or what they do or do not expect from the consultants . ( Same for the City Attorney. ) I expect the manager to realize that he takes direction from the BODY OF THE CITY COUNCIL, rather than from an individual councilperson or mayor. One person has no auth- ority under the City Charter. I appreciate the usual way we are kept informed of various functions in and around the City. That is good .
