REGULAR MEETING
NOVEMBER 8, 1990
A Regular Meeting of the City Council of the City of Cape
Canaveral, Florida was held on November 8, 1990, at the City
Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The
meeting was called to order at 7 : 30 P.M. by Mayor Joy Salamone.
Pledge of Allegiance was led by Mayor Salamone.
The roll was called by the City Clerk . Officials present were
Mayor Joy Salamone; Council Members John Porter and Rocky
Randels. Also present were City Manager, Edward Spenik; Deputy
City Attorney, Mitch Goldman; and City Clerk, Jan Leeser. Mr.
Arabian and Mrs . Thurm were out-of-town.
Mr. Porter moved to approve the minutes of the Regular Meeting
of October 16, 1990. Mr. Randels seconded motion. Motion
carried unanimously.
Mr . Porter moved to approve the minutes of the Special Meeting
of October 19, 1990. Mr . Randels seconded motion. Motion
carried unanimously.
At this time Mayor Salamone read a Proclamation regarding
Veterans Day. She noted that the Veterans Memorial Park would
be dedicated on November 11, 1990, at 11 :00 A.M.
Mayor Salamone noted that the City and the Fire Department
wished to acknowledge the donation of materials by Quiet Flight
Surf Shop for the refurbishment of the model Space Shuttle
located in front of City Hall .
Mr. Bennett Boucher, Public Works Director, presented the
Special City Employee Award to Mr . Chris Kulac, Groundskeeper.
Ms. Pat Szapor, Beautification Board Awards Chairman, joined
Mayor Salamone in presenting the Fall Beautification Awards .
The recipients of the awards were: Fred and Rita DiStasio,
Residential Award; Morgan Manor, Multi-family Award; and Gateway
to the Stars, Commercial Award.
UNFINISHED BUSINESS
1 . Ordinance No. 25-90, Floodplain Protection (Second Reading
and Public Hearing)
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY,
FLORIDA, ESTABLISHING CHAPTER 668, FLOODPLAIN PROTECTION,
OF THE CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY;
REPEALING ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE.
Mayor Salamone read the title of the Ordinance. Mr. Randels
moved for adoption. Mr. Porter seconded motion. Mr. Randels
and Mr. Porter spoke in favor of the proposed Ordinance. Vote
on the motion was unanimous . Ordinance No. 25-90 was adopted on
Second Reading.

1 . Resolution No. 90-62 Reappointment of Beautification Board

A RESOLUTION REAPPOINTING MEMBERS TO THE BEAUTIFICATION
BOARD OF THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING AN
EFFECTIVE DATE.
Mayor Salamone read the title of the Resolution. Mr. Porter
moved for adoption. Mr. Randels seconded motion. Motion
carried unanimously. Ms . Dorothy Benko and Mr. William Gleckner
were reappointed to the Board.
2. Resolution No. 90-63 Certifying Results of General Election
A RESOLUTION CERTIFYING THE RESULTS OF THE GENERAL ELECTION
OF NOVEMBER 6, 1990; PROVIDING AN EFFECTIVE DATE.
Mayor Salamone read the title of the Resolution. Mr. Porter
moved for adoption. Mr. Randels seconded motion. Mayor
Salamone read the election results for the benefit of the
members of the audience. Mr. Porter and Mr. Randels voiced
appreciation to the citizens of the City for the passage of the
two referendum items on the ballot. Mayor Salamone noted that
the vote of the people reflected the caliber of the Volunteer
Fire Department and the Sheriff ' s Department .
Vote on the motion was unanimous . Resolution No. 90-63 was
adopted.
3. Motion Re: Ratification of Labor Agreement with Inter-
national Union of Operating Engineers
Mr. Randels so moved. Mr. Porter seconded motion. Discussion
followed. Mayor Salamone noted that the agreement was for a
one-year term. Vote on the motion was unanimous . Mr. Porter
voiced his appreciation to the members of the City' s negotiating
team.
DISCUSSION
City Manager Spenik advised that the Cape Canaveral Library
would have a used book sale on November 10, 1990.
Mr. Randels reported on the Brevard Community College Co-op
program and the Water Shed Action Committee ' s search for a
project to improve the quality of stormwater run-off . He
further requested an item be placed on the agenda of a future
Workshop Meeting regarding the recycling program.
Mr . Porter reported on an article in the Datagram regarding
consulting engineers; the CCVFD monthly report; the Building
Department monthly report; MPO Interjurisdictional Committee
Meeting; and the teenage activities recently held at the Recrea-
tion Center. Mayor Salamone added her appreciation to
Recreation Director, Mrs . Nancy Hanson, for the successful
teenage activities .
Mayor Salamone read a portion of a letter received from a
resident of Cape Shores commending the employees of the
Wastewater Treatment Plant for being "pleasant, polite, quiet-
mannered and neat" during a recent emergency in the area. Mayor
Salamone asked the Public Works Director, Mr. Bennett Boucher,
to pass the Council ' s appreciation on to the employees .
Mayor Salamone questioned Deputy Attorney Goldman on whether or
not the Rich ' s Restaurant lawsuit had been settled. Mr. Goldman
advised that it had not . Mayor Salamone raised some questions
regarding the lawsuit . Discussion followed. Mr. Randels
suggested that the item be placed on the agenda for the next
Workshop Meeting.

There being no discussion from members of the audience, the
meeting was adjourned at 8:15 P.M.
