SPECIAL MEETING
OCTOBER 19, 1990
A Special Meeting of the City Council of the City of Cape
Canaveral, Florida was held on October 19, 1990, at the City
Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The
meeting was called to order at 1 :07 P.M. by Mayor Joy Salamone.
The roll was called by the City Clerk. Officials present were
Mayor Joy Salamone; Mayor Pro Tem, Ann Thurm; Council Members
Don Arabian; John Porter, and Rocky Randels . Also present were
Acting City Manager, Bennett Boucher; City Attorney, Jim
Theriac; and City Clerk, Jan Leeser.
NEW BUSINESS
1 . Discussion Re: City Manager Compensation
Mayor Salamone explained that Mr . Spenik would not be in atten-
dance at the meeting but he would be available via telephone.
She noted that Mr. Spenik had advised her he could start
employment on October 29, 1990.
Mr. Arabian suggested that Mr . Spenik be offered a three-year
contract . It was pointed out by Mr. Randels that it would be in
the best interest of the City to have the City Manager serve at
will. Discussion followed. It was the consensus of Council not
to offer Mr. Spenik a contract.
Mayor Salamone noted that in the last year former City Manager
Leo Nicholas was paid a base salary of $35, 580 plus bonuses for
a total of $42, 731 .00. Mr . Arabian and Mr. Porter voiced the
opinion that Mr. Spenik should be offered $43, 000.00. Mrs.
Thurm suggested that Mr . Spenik be offered $40,000 during a six-
month probationary period, and then increased to $43, 000.00, if
his performance review is favorable. Mayor Salamone pointed out
that the review would be conducted as it had in the past, which
was formal, individual, written evaluations with public discus-
sion on overall performance. After discussion, it was the
consensus of Council to go along with Mrs . Thurm' s suggestion.
Mayor Salamone advised that Mr. Spenik was requesting twenty
executive days a year, to be utilized at his own discretion, in
lieu of sick leave, vacation and comp time. Discussion followed.
It was noted that he was requesting the days be accumulative and
the suggestion was made that a cap of thirty-five days be put on
the accumulation, which is in line with the City' s personnel
policy. It was the consensus of Council to agree with the
request, if the cap was put on the amount that could be accumu-
lated.
Mayor Salamone advised that with the exception of the above
request, Mr . Spenik would receive the same benefits as other
City employees, including the use of a City vehicle for City
business. She further noted that the City would pay for
training and subscriptions to trade magazines.
Discussion was held on reimbursing Mr. Spenik for moving
expenses . It was the consensus of Council that since Mr. Spenik
was relocating within the State he should not be reimbursed for
moving expenses. Mayor Salamone noted that Mr. Spenik would be
returning to Fort Lauderdale on the weekends until he sells his
house there.

At this time Mayor Salamone called a recess so she could tele-
phone Mr. Spenik. The meeting reconvened at 2 :07 P.M.
Mayor Salamone advised that Mr . Spenik would agree to starting
at $40, 000.00, with an evaluation and increase to $43, 000. 00 on
Decmeber 31, 1990, if the evaluation is favorable. Mr. Porter
and Mr. Arabian suggested Mr. Spenik be started at $43, 000.00.
Discussion followed. It was the consensus of Council to start
Mr. Spenik at $40, 000.00, with an increase to $43, 000.00 at the
end of December upon a favorable evaluation.
Mayor Salamone called a recess to allow the City Attorney to
prepare the Resolution. The meeting was reconvened at 2 : 30 P.M.
2. Resolution No. 90-61 Appointment of City Manager
Mr. Theriac read the Resolution in full. Mr. Arabian moved for
adoption. Mrs . Thurm seconded motion. Motion carried unani-
mously.
3 . Motion Re: Removing Bennett Boucher as Interim City
Manager
Mr. Randels moved to relieve Mr . Boucher of his duties as
Interim City Manager effective October 29, 1990. Mrs . Thurm
seconded motion. Motion carried unanimously.
There being no further business, the Special Meeting was
adjourned at 2 : 35 P.M.
