COMBINED WORKSHOP AND SPECIAL MEETING
APRIL 18, 1990
A Combined Workshop and Special Meeting of the City Council of
the City of Cape Canaveral, Florida was held on April 18, 1990,
at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida.
The meeting was called to order at 7: 30 P.M. by Mayor Joy
Salamone.
The roll was called by the City Clerk. Officials present were
Mayor Joy Salamone, Mayor Pro Tem, Ann Thurm; Council Members
111, Don Arabian, John Porter and Rocky Randels. Also present were
City Attorney, Jim Theriac; and City Clerk, Jan Leeser.
1 . Ordinance No. 21-90 Amending Chapter 662, Concurrency
Management System, by Amending the Evaluation Criteria for
Transportation Facilities (First Reading and Public
Hearing )
AN ORDINANCE AMENDING CHAPTER 662, CONCURRENCY MANAGEMENT
SYSTEM, OF THE CODE OF ORDINANCES OF THE CITY OF CAPE
CANAVERAL, BY AMENDING THE EVALUATION CRITERIA FOR TRANSPOR-
TATION FACILITIES; PROVIDING SEVERABILITY; REPEALING ALL
PORTIONS OF THE CODE IN CONFLICT HEREWITH ; PROVIDING AN
EFFECTIVE DATE.
Mayor Salamone read the title of the Ordinance. Mr. Randels
moved to approve First Reading. Mr . Porter seconded motion.
Mrs. Leeser pointed out that the amendments in the proposed Ordi-
nance were those recommended by Mr. Jim Baker, of Transportation
Consulting Group. Mr . Baker and Mr. John Schoch, Planner, with
Briley, Wild & Associates, were in attendance and answered
Council ' s concerns on several aspects of the Ordinance.
Mrs. Thurm moved to utilize the annual average conditions for
determination of the traffic counts in paragraph (d) . Mr.
Randels seconded motion. Mr . Arabian voiced the opinion that
the peak seasonal conditions should be used. Discussion
followed on utilizing a mean between average annual and peak
seasonal. Vote on the motion was as follows: In favor, Mayor
Salamone and Mrs. Thurm; opposed, Mr. Arabian, Mr . Porter and
Mr. Randels. Motion failed.
Mr. Porter moved to utilize the mean of peak season and annual
average basis in paragraph (d) . Mr . Arabian seconded motion.
Mr. Randels voiced the opinion that this formula would be fair
to both the citizens and developers. Mr. Theriac advised that
this position would be defensible. Discussion followed. Vote
(: on the motion was as follows : In favor, Mr. Arabian, Mr. Porter
and Mr . Randels; opposed, Mayor Salamone and Mrs. Thurm. Motion
carried.
After a discussion on the suggested number and location of
traffic count stations to be utilized, Mr. Theriac recommended
amending sub-paragraph (e ) ( 2 ) to read, deleting the last
sentence:
"For developments that are anticipated to generate 6 to 50
new peak hour trips, a determination of excess capacity is
required at four City traffic count stations: two must be
off A1A and nearest the development; one must be at the
northern extreme of A1A and one must be at the southern
extreme of A1A. "

Mrs. Thurm so moved. Mr . Arabian seconded motion. Motion
carried unanimously.
Mr. Theriac recommended sub-paragraph (e ) ( 3) be amended to read,
deleting the last sentence:
" . . .at five city traffic count stations: three must be off
A1A and nearest the development ; one must be at the
northern extreme of A1A and one must be at the southern
extreme of A1A."
Mrs . Thurm so moved. Mr . Arabian seconded motion. Motion
carried unanimously.
Mr. Porter moved to amend sub-paragraph (e ) ( 5) to add the words
" . . .or a.m. peak hour, whichever is greater. . . " and to base the
analysis on the mean of peak season and annual average basis
numbers. Mr. Arabian seconded motion. Vote on the motion was
as follows: In favor, Mr. Arabian, Mr . Porter and Mr. Randels ;
opposed, Mayor Salamone and Mrs . Thurm. Motion carried.
Discussion was held on paragraph (f ) . No amendments were
proposed.
Mrs. Thurm moved to amend paragraph (a) by deleting the last
sentence. Mr. Porter seconded motion. Motion carried unani-
mously.
Mr. Porter moved to amend paragraph (b) by adding the words
" . . .or a.m. peak hour, whichever is greater. . . " . Mr. Randels
seconded motion. Motion carried unanimously.
Mayor Salamone requested the question be called on the main
motion. Vote on the motion was unanimous . Ordinance No. 21-90,
as amended, was approved on First Reading .
2. Resolution No. 90-22 Establishing Fees for Concurrency
Review Evaluation
A RESOLUTION ESTABLISHING FEES FOR CONCURRENCY REVIEW EVAL-
UATION IN THE CITY OF CAPE CANAVERAL, FLORIDA; PROVIDING AN
EFFECTIVE DATE.
Mayor Salamone read the title of the Resolution. Mrs. Thurm
moved for adoption. Mr. Randels seconded motion. Mr. Jim
Morgan, Building Official, gave a presentation on how the fees
were determined. Mrs. Thurm spoke in favor of the Resolution.
Discussion followed.
Vote on the motion was unanimous. Resolution No. 90-22 was
adopted.
3. Discussion/Motion Re: Policy Statement Defining Criteria
for Determining Wastewater Treatment Capacity
Mrs. Leeser explained that the Council needed to adopt a policy
statement on whether the daily or peak flow at the Wastewater
Treatment plant would be used for the purposes of concurrency
management. Mr. Bennett Boucher, Public Works Director, explain-
ed that the DER and EPA require the monthly average flow be
utilized. Mr. Boucher explained how these numbers were
calculated.
Mrs. Thurm moved to adopt the City' s current policy of using the
current daily flow. Mr. Porter seconded the motion. Discussion
followed. Mr. Arabian spoke against the motion. Vote on the

motion was as follows: In favor, Mr . Porter, Mr . Randels, Mayor
Salamone and Mrs. Thurm; opposed, Mr . Arabian. Motion carried.
There being no further business, the meeting was adjourned at
9: 20 P.M.
