REGULAR MEETING
FEBRUARY 20, 1990
A Regular Meeting of the City Council of the City of Cape
Canaveral, Florida was held on February 20, 1990, at the City
Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. The
meeting was called to order at 7: 30 P.M. by Mayor Pro Tem Ann
Thurm. Pledge of Allegiance was led by Mrs . Thurm.
The roll was called by the City Clerk. Officials present were
Mayor Pro Tem, Ann Thurm; Council Members Don Arabian, John
Porter and Rocky Randels. Also present were City Manager , Leo
Nicholas; City Attorney, Jim Theriac; and City Clerk, Jan
Leeser. Mayor Salamone was not in attendance.
Mr. Porter moved to approve the minutes of the Regular Meeting
of February 6, 1990. Mr. Randels seconded motion. Motion
carried unanimously.
NEW BUSINESS
1 . Ordinance No. 7-90 Amending Chapter 611 , Building Code, by
Adopting Latest Edition of the Standard Building Code and
Establishing Coastal Construction Building Code as Chapter
612 ( First Reading and Public Hearing)
AN ORDINANCE AMENDING CHAPTER 611 , BUILDING CODE, OF THE
CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, BY ADOPTING THE LATEST EDITION OF THE STAN-
DARD BUILDING CODE; ESTABLISHING THE COASTAL CONSTRUCTION
REGULATIONS AS AN INDEPENDENT CODE CHAPTER 612 ; REPEALING
ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH; PROVIDING AN
EFFECTIVE DATE.
Mrs. Thurm read the title of the Ordinance. Mr. Randels moved
to approve first reading. Mr. Porter seconded motion. Mr.
Arabian questioned the changes contained in the latest edition
of the Codes. Mr. Theriac advised that the changes were review-
ed and adopted by the Standard Building Code Congress and it was
his opinion their review was all that was required. Discussion
followed. Mr . Nicholas advised he would have the Building
Official in attendance at the next workshop meeting to discuss
the changes.
Vote on the motion was unanimous. Ordinance No. 7-90 was
approved on first reading.
2 . Ordinance No. 8-90 Amending Chapter 613, Standard Plumbing
Code, by Adopting Latest Edition of the Code (First Reading
and Public Hearing)
AN ORDINANCE AMENDING CHAPTER 613, STANDARD PLUMBING CODE,
OF THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, BY ADOPTING THE LATEST EDITION OF
THE STANDARD CODE; REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
Mrs. Thurm read the title of the Ordinance. Mr. Randels moved
to approve first reading. Mr. Porter seconded motion. Motion
carried unanimously.
3. Ordinance No. 9-90 Amending Chapter 614, Standard Mechan-
ical Code, by Adopting Latest Edition of the Code (First
Reading and Public Hearing )

THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, BY ADOPTING THE LATEST EDITION OF
THE STANDARD CODE; REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
Mrs. Thurm read the title of the Ordinance. Mr. Porter moved

carried unanimously.
5 . Ordinance No. 11-90 Amending Chapter 619, Standard Housing
Code, by Adopting Latest Edition of the Code (First Reading
and Public Hearing)
AN ORDINANCE AMENDING CHAPTER 619, STANDARD HOUSING CODE,
OF THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, BY ADOPTING THE LATEST EDITION OF
THE STANDARD CODE; REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
Mrs. Thurm read the title of the Ordinance. Mr. Arabian moved
to approve first reading. Mr. Porter seconded motion. Vote on
the motion was unanimous.
6. Ordinance No. 12-90 Amending Chapter 621 , Fire Prevention
Code, by Adopting Latest Edition of the Code (First Reading
and Public Hearing)
AN ORDINANCE AMENDING CHAPTER 621 , FIRE PREVENTION CODE, OF
THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL,
BREVARD COUNTY, FLORIDA, BY ADOPTING THE LATEST EDITION OF
THE STANDARD CODE; REPEALING ALL PORTIONS OF THE CODE IN
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.

motion was unanimous.
7. Ordinance No. 13-90 Amending Chapter 626, Life Safety Code,
by Adopting Latest Edition of the Code (First Reading and
Public Hearing)
AN ORDINANCE AMENDING CHAPTER 626, LIFE SAFETY CODE, OF THE
CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, BY ADOPTING THE LATEST EDITION OF THE STAN-
DARD CODE; REPEALING ALL PORTIONS OF THE CODE IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE.
Mrs. Thurm read the title of the Ordinance. Mr. Porter moved to
approve first reading. Mr. Randels seconded motion. Fire
Chief Dave Sargeant was questioned on the changes contained in
the latest edition of the Life Safety Code. He explained that
the changes were too voluminous for him to have any personal
knowledge of.

Vote on the motion was unanimous . Ordinance No. 13-90 was
approved on first reading.
8 . Resolution No. 90-4 Interlocal Agreement with Brevard
County for Transportation Impact Fees
A RESOLUTION AUTHORIZING THE CITY OF CAPE CANAVERAL TO
ENTER INTO AN INTERLOCAL AGREEMENT WITH THE BOARD OF COUNTY
COMMISSIONERS OF BREVARD COUNTY, FLORIDA, TO PARTICIPATE IN
THE BREVARD COUNTY TRANSPORTATION IMPACT FEE; PROVIDING AN
EFFECTIVE DATE.
(10 Mrs. Thurm read the title of the Resolution. Mr. Randels moved
for adoption. Mrs. Thurm seconded motion. Mr. Nicholas advised
that, according to Mr . Rich Enos of Brevard County, they were
striving to be cooperative regarding spending the impact fee
monies collected in the City, even so far as exploring the possi-
bility of using the monies on City arterial roads. Discussion
followed. Mr. Randels spoke in favor of the proposed
Resolution.
Vote on the motion was unanimous. Resolution No. 90-4 was
adopted.
9 . Resolution No. 90-8 Requesting New Transportation or
Utility Corridors Have Minimum Impact on the Environment
A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY,
FLORIDA, REQUESTING MINIMUM IMPACT ON THE ENVIRONMENT,
INFRASTRUCTURE AND EXISTING QUALITY OF LIFE IN THE ESTAB-
LISHMENT OF NEW TRANSPORTATION AND UTILITY CORRIDORS;
PROVIDING AN EFFECTIVE DATE.
Mrs. Thurm read the title of the Resolution. Mr. Randels moved
for adoption. Mr. Porter seconded motion. Discussion followed.
Mr. Porter moved to amend the fourth whereas by inserting the
words "in some cases" after the word authorities. Mr. Randels
seconded motion. Discussion followed. Mr. Porter spoke in
favor of the proposed amendment. Vote on the amendment was as
follows: In favor, Mr. Porter, Mr. Randels and Mrs. Thurm;
opposed, Mr. Arabian. Motion carried.
Vote on the main motion was unanimous. Resolution No. 90-8, as
amended, was adopted.
10. Resolution No. 90-9 Plat Approval, San Tomas Villas, Phase
IV, Lots 12, 13 & 14, Replat of Lots 15 & 16, Block 7, Avon-
by-the-Sea, Sec 23, Twp 24S, Rge 37E ( 126-128 Jefferson
Avenue) - Thomas Quinn
A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY,
FLORIDA, APPROVING THE PLAT OF "SAN TOMAS VILLAS" , PHASE
IV" ; AUTHORIZING THE MAYOR AND THE CITY CLERK TO CERTIFY
THE PLAT; PROVIDING AN EFFECTIVE DATE.
Mrs. Thurm read the title of the Resolution. Mr. Porter moved
for adoption. Mr . Arabian seconded motion. Motion carried unan-
imously.
11 . Resolution No. 90-10 Supporting the Adopting of the Bever-
age Container Deposit Legislation (Bottle Bill )
A RESOLUTION OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY,
FLORIDA, RE-ESTABLISHING AND RE-AFFIRMING THE STRONG SUP-
PORT OF THE CITY OF CAPE CANAVERAL, FLORIDA FOR THE
ADOPTION BY THE FLORIDA LEGISLATURE AT ITS NEXT SESSION OF
THE BEVERAGE CONTAINER DEPOSIT LEGISLATION, ALSO KNOWN AS
THE "BOTTLE BILL" ; PROVIDING AN EFFECTIVE DATE.

Mrs. Thurm read the title of the Resolution. Mr. Randels moved
for adoption. Mr. Arabian seconded motion. Mrs. Thurm and Mr.
Randels spoke in favor of the proposed Resolution. Discussion
followed.
Vote on the motion was unanimous. Resolution No. 90-10 was
adopted.
12. Motion Re: Request for Donation; Cocoa Beach High School
Project Graduation
Mr. Randels moved to donate $200.00 to the Cocoa Beach High
School Project Graduation. Mr. Porter seconded motion. Discus-
sion followed. Vote on the motion was unanimous.
DISCUSSION
Mr. Nicholas advised that in implementing the Concurrency Manage-
ment Regulations, no building permits would be issued until the
impact on the roads could be determined. He noted that the
City' s consulting engineers were contacting traffic engineering
firms for proposals on conducting traffic counts. This item
will be discussed at the March 1st Workshop Meeting.
Mr. Arabian reported on his tour of the Brevard County jail ; a
discussion he held with the State DOT on the level of service on
City roads; and, the seminar he recently attended on Beach
Preservation.
Mr. Porter reported on a meeting he recently held with Sgt.
McGee of the Sheriff ' s Department.
Mrs . Helen Filkins distributed a copy of a letter that was pre-
sented to the Canaveral Port Authority by the Cape Canaveral
Citizens Association.
There being no further business, the meeting was adjourned at
8 :50 P.M.
