MOTION 1. Purpose, scope of Provisions:

SECTION 4. Storage of Junk Vehicles :
A junked vehicle may not be parked, stored or left in
the open unless it is necessary for the operation of a business
enterprise lawfully situated on private property. Any other junked
vehicle or vehicles must be relocated to a completely enclosed loca-
tion or otherwise removed from the property.
SECTION 5. Complaints, reports :
Any citizen or inhabitant of the City of Cape Canaveral
may make complaint to any officer of the existence of a junked vehicle.
Upon receipt of said complaint, the officer shall inspect the prop
erty complained of and file a written report with the City Administra-
tion. Said report shall be on a form provided by said City Administra-
tion and shall, at a minimum, include the following information:
property location, inspector, date, make, year,
type, color of vehicle, license number plate by
{ number, state and year; motor number, serial
number, number of wheels in place, percentage
of rust, and any other remarks regarding broken
glass, missing fenders, motor, transmission,
battery, radiator, headlights or bumpers;
said report shall also include a list of articles of value found with-
in the vehicle, Based upon said report, the City Administration shall
make a determination as to whether or not said vehicle is properly
classified as a junk vehicle.

of removing any junked vehicle or vehicles following the receipt of
a waiver by the property owner or his duly authorized representative
shall, in the event that the property owner or his duly authorized
representative can satisfactorily establish that the property owner
is not the owner of said junked vehicle, be at the City' s expense,
other provisions of this Ordinance notwithstanding.
SECTION 9. Rules and regulations to implement provisions :
The City Council of the City of Cape Canaveral, may enact
reasonable rules and regulations to implement and carry out the pro-
visions of this Ordinance.
SECTION 10. Provisions to be literally construed: •
The provisions of this Ordinance shall be literally con-
strued in order to effectively carry out the purposes of this Ordinance
in the interest of the public health, welfare and safety of the citizens
and residents of the City.
SECTION 11. Severability of provisions :' .
If any section, clause, sentence or provision of this Ordi-
nance, or the application of such section, clause, sentence or provision
of this Ordinance, or the application of such section, clause, sentence
or provision to any persons, bodies or circumstances shall be held to be
inoperative, invalid or unconstitutional, the invalidity of such section,
clause, sentence or provision shall not be held, deemed or taken to
affect. the validity or constitutionality of any of the remaining parts
of this Ordinance, or the application of any other provisions of this
Ordinance to persons, bodies or circumstances other than those as to
which it or any part thereof shall have been held inoperative, invalid
or unconstitutional.
SECTION 12. Effective date :
This Ordinance shall take effect immediately upon its arrival
by the Council of the City of Cape Canaveral, Florida.
