HomeMy WebLinkAboutOrdinance No.20-1966MI -CROFILMED � REPEALED 1 3.13.80 _aAb.NaY-73 ORDINANCE NO. ?("GL• AN ORDINANCE PROHIBITING THE USE OF SURFBOARDS WITHIN CERTAIN AREAS OF THE PUBLIC BEACHES; REPEALING ALL.ORDIN- ANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Cape Canaveral, Florida, sitting as a legislative and deliberative body, have found and determined that the use of surfboards in the surf and on and about the public beaches of the City of Cape Canaveral is dangerous and a hazard to the physical safety and welfare of the citizens of Cape Canaveral while swimming in the surf and walking on the said beaches; and, WHEREAS, the public health, safety and welfare require that the use of surfboards be restricted within the corporate limits of the City of Cape Canaveral; and, WHEREAS, under the general police powers of this state delegated to this city by general law and the special act creating this city, the city has power and authority to properly restrict the use of surfboards in the surf and on the beaches of the City of Cape Canaveral. NOW, THEREFORE, BE IT ORDAI14ED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, .FLORIDA, AS FOLLOWS: SECTION 1. It is hereby declared to be unlawful for any person to use or operate a surfboard upon any beach or in the surf or ocean adjacent to such beach, within the corporate limits of the City of Cape Canaveral, except in locations de- signated as follows: a. An area north of a projected line extended east into the Atlantic Ocean one thousand (1,000) feet from the north edge of Buchanan Avenue to and including a pro- jected line extending east into the Atlantic Ocean one thousand (1,000) feet from the north edge of Polk Avenue, being an area embracing approximately twelve hundred (1,200) lineal feet of shore line. e MICROFILMED 3.13.80 b. An area north of a projected line extended from the north edge of Adams Avenue east into the Atlantic Ocean one thousand (1,000) feet to a point approximately fifteen hundred (1,500) lineal feet north of such extention of Adams Avenue. c. An area north of a projected line extended from the north edge of Harbor Drive east into the Atlantic Ocean one thousand (1,000) feet to a point approximately fifteen hundred (1,500) lineal feet north of such extention of Harbor Drive. SECTION 2. Attached hereto and by this reference made a part hereof is a map depicting the permitted surfing areas as described in Section 1. SECTION 3. Any person found guilty of violating this ordinance in the municipal court, upon conviction, shall be punished by fine not exceeding one hundred dollars ($100) or by imprisonment not exceeding five (5) days or by both such fine and imprisonment in the discretion of the municipal judge.' SECTION 4. All ordinances or parts of ordinances in con- flict herewith be and the same are hereby repealed. SECTION 5. This ordinance shall take effect immediately .upon its adoption.
