HomeMy WebLinkAbout04-06-1965 Regular MeetingREGULAR COUNCIL MEETING April 6, 1965 The Regular Meeting or the City Council of the City of Cape Canaveral, Florida was held at 190 Jackson Ave., The City Hall Annex, The Meeting was called to Order by Mayor Thurm and the roll was called by the Clerk. Officials present were: Mayor Richard R. Thurm, Councilwomen - Francis Jamieson, Councilman - ids. Eberwein, Jack Hurck, Eugene Jandreau, City Attorney - T. David Burns, City Clerk - Dana J. Anderson, Sergeant -At -Arms - L. W. â– ichols. The Minutes of the Regular Meeting of March 16, 1965 and the recessed Meeting of March 17th, 1965, were approved with no additions or corrections. The Minutes of the Special Meeting of March 30th, 1965 were approved with the correction that the Meeting was held at the City Hall Annex rather than the City Hall. The Minutes of the Second Special Nesting of March 30th, 1965 and the Minutes of the Special Meeting of April 1, 1965 were approved as read. OLD BUSINESS Item 1, Ordinance Defining Arrest Authority (Second and Final Beading) Mayor Thurm gave second and Final Reading to "AN ORDINANCE DEFINING THE ARREST AUTHORITY. OF AN OFFICER AT THE SCENE OF AN ACCIDENT WITHIN THE CORPORATE LIMITS OF THE CITY OF CAPE CANAVERAL, FLORIDA." The Ordinance was adopted on a Motion by Mrs. Jamieson, seconded by Mr. Jandreau and carried with Mr. Hurck, Hre. Jamieson and Hr, Jandreau voting in favor and Mr. Eberxein opposing. Item 2, Ordinance Doe ring Certain Act" or Conduct Illegal (Second and Final Reading) Mayor Thurm gave second and final reading to "AN ORDINANCE DECLARING CERTAIN ACTS OR CONDUCT 1LIEGAL Ng ATINa TO BEER AND WINE, ANIMALS AND FOWL, DY14AHM AND EXPLOSIVES, ASSAULT AND BATTERY, ASSEMBLIES, BRIBERY, DESPOILING PROPERTY, DISORDERLY CONDUCT, DISTURBING RELIGIOUS WORSHIP, FIRE ALARMS, INDECENT BEHAVIOR, PETTT LARCENY, TAKING OR CONCEALING CF ANOTHERS PROPERTY, ASCESSORY, IIIEGAL NOISES, INJURY TO PUBLIC PROPERTY, RESISTING ARREST AND FALSE REPORTS, STATE MISDEMEANORS, TRESPASSING, VAGRANCY, WEAPONS AND POLICE REGISTRATIONS PROVIDING .PENALTY FOR VIOLATIONS, PROVIDING AN EFFECTIVE DATE." firs. Jamieson made a Motion to approve second and final reading. Mr. Hurck seconded the Motion and the Ordinance was adopted with Mr. Hurck, lbs. Jamieson, and Hr. Jandreau voting in favor and Mr. Mberwein Opposing. ITEM 3 Amendment to A.B.C. Ordinance (First Reading) On a Motion by Mr. Hunk, seconded by Mrs. Jamieson, the Item was tabled MGULAR COUNCIL - --TING, April 6, 1.965 Page 2 with Mr. Hurck, *a. Jamieson and Mr. Jandreau voting in favor and Mr. Eberwein opposing. Item 4. Election Ordinance (Second and Final Reading) Mayor Thum gave second and final reading to "AN ORDINANCE RELATING TO TIM ELECTIONS OF CITY OF CAPE CANAVERAL, FLORIDA, RELATING TO QUALIFICATIONS AND REGISTRATION OF ELECTORS, REGISTRATION OFFICERS AND PROCEDURESt CANDIDATES AND CONTESTING EIBCTIQNSt ELECTIONS, GENERAL, SPECIAL, BOND AND REFERRNDUN,t VOTINOt CONDUCTING AND CANVASSING RESULTS OF ELECTIONS AND ADOPTING A PERHANEW REGISTRATION SYSTKMt PROVIDING A PROCEDURE THEWFOR: DESIGNATING THE CITY CIERK AS SUPERVISOR OF REGISTRATION AND AS CUSTODIAN OF THE REGIS - TRATIDN BOOKS; PROVIDING FOR RELDVAL OF NAPES FROM REGISTRATION BOOKS; PRO- VIDING AN EFFECTIVE DATE; REPEALIM ORDINANCE 140. 4 -62." Mr. Jandreau made a Motion that second and final reading be approved. Mrs. Jamieson seconded the lotion. Hr..Hirck then made a Notion to Amend SECTION 4, LINE 4, on page 1 by inserting the words "and the City of Cape Canaveral" and on Page 10, SECTION 7, PARAGRAPH J, by striking the word "Town" and inserting inlieu there- of the word "City ", Page 17, PARAGRAPH F, strike the words "Supervisor of the Town" and insert in lieu thereof the words "the City Clark of the City of Cape Canaveral" , and by adding a new SECTION 20, "Each and every candidate f6r office in any election of the City of Cape Canaveral shall file his name and qualify on or before twenty -one (21) days prior to the holding of any election." Mr. Jandreau seconded the Motion to Amend. The Ordinance as Amended passed by the unanimous vote of the Council. NEW BUSINESS Item 1. Resolution - Service of Process by Mtnicioal Court. After Mayor Thum read "A RZSOL.UTICN REQUESTING A CFARTER AMENDMENT TO ENLARGE THE JURISDICTIONAL SERVICE CF PROCESS CF THE MUNICIPAL COURTI PRO- VIDING AN EFFECTIVE DAT39" Mr. Hurck made a lotion to Adopt. the Resolution. Nos. Jamieson seconded the lotion, The Resolution was Adopted by the unanimous vote of the Council. Item 2, Resolution Requesting Amendment to Shuford Hills Contract. Mr. Jandreau made a lotion instructing the City Attorney to contact the Attorneys for Shuford Hills with regard . to an amendment granting permission for recreational use, Mr. Hurck seconded the Motion and it carried unanimously. Item 3. Amendment to Abandon Auto Ordinance (First Reading) On a Motion by Mr. Hurck, seconded by Mr. Jandreau and carried unanimously, Item 3. was tabled. REGULAR COUNCIL MEETING, April 6, 1965 Page 3 Item A. Reaolution Designating_ the Building Inspector as Building Official, The City Attorney, Hr. T. David Burns read "A RESOLUTION DESIGMTING THE BUILDIM INSPECIC)R AS HJILDDC CFFICIALi PROVIDING AN EFFECTIVE DtTE." on a Notion by Mr. Jandreau, seconded by Nr. Hurck and carried unanimously, the Resolution wasadopted. _ Item 5. Review and Revision of the Budget. After discussion on revisions,, Mr. Hurck made a Notion to approve the Budget as revised. Mrs. Jamieson seconded the Motion. Upon further discussion of the Police Department answering service, Hr. Hurck made a Notion to Amend the Budget allowing $2,000.00 for Police Department. Mr. Jandreau seconded the lotion and the Budget . as revived and amended was approved with Mr. Hurck,.Nre. Jamieson and Mr. Jandreau voting in favor and Mr. Eberwein opposing. The Budget in attached hereto and .made a part of the Minutes. There being no other business before the Council, the Meeting was adjourned on a lotion by Mr. Hurck, seconded by Hr. Jandraeu and carried unan- imously. Approved this 20t /h day of April, 1965.
