The City Council of the City of Cape Canaveral met in Special
Fleeting at 190 Jackson Ave., the City Hall Annex.
Officials present were Mayor Richard R. Thum, Councilwoman -
Francis Jamieson, Councilmen - Wm. Ebern:ein, Jack Hurck, Eugene Jandreau,
City Manager - J. D. Bidgett,, City Attorney T. David Burns, City Clerk -
Donna J. Anderson, Sergeant -At -Arms - L. W. Nichols.
Item 1 Request for Razonin&
Mayor Thurm read the recormcendations of the Zoning Board denying
the request for rezoning and a letter from adjacent property owners objecting
to the request. Mr. Jandreau made a Motion that approvil of the 2nd and
Final Reading of an "ORDINANCE OF THE CITY OF CAPE CANAVERAL, FLORIDA,
AMENDING ORDINANCE NO. 81 -64 TO RF20NE A PARTICULAR PARCEL OF LAND FROM
R -4 CL ISSIF ICA':Ii;tJ TO C-1 CLASSIFICATION, CAUSING ZONING MAP TO CONFORM
TO THE AMENDIB:NT: PROVIDING AN EFFECTI/E DATE." be denied. Mr. Ehen+e in
seconded the Motion and it carried unanimously.
Item 2. Authorization for aContract frith the City Attorne in Re and to
Band Validation.
Mayor Thum read a Resolution "A JC.SOLUTION AUTHORIZING AGREEMENT
7JITI1 CITY ATTORNEY FOR VALIDATION OF SANICARY SERER REVENUE CERTIFICATES:
PROVIDING AN EFFECTI•!E DATS." On a Motion by Mrs. Jamieson, seconded by
Mr. Hurek and carried unanimously, the Resolution was adopted.
Item 3 Bulkhead Line
After discussion, Mrs- Jamieson made a Motion to establish a
Bulkhead Line off -shore from ,existing lands bordering on the Banana River
from the Southern to the Nortiern most territorial limits of the City of
Cape Canaveral, Florida and authorizing and directing the resident City
Engineer to locate the said bulkhead line including therein proposed roads
and drainage facilities and dedications for public purposes and to .meet
with the Planning and Zoning Board at their Regular Meeting of February

Regular Council Meeting in March 1965, Mr. Hurck seconded the Notion and
it carried with Mrs. Jamieson and Hr. Hurek voting in favor, Mr. Eberwein
and Mr. Jandreau opposing and Mayor Thum voting in favor, thereby breaking
the Lie.
There being no other business heforo the Council, the Meeting was
adjourned on a Motion by Mr. Jandreau, seconded by Mr. Ebenrean and carried _

REGULAR CCUNC iL NOTING
February 16, 1965
The City Council of the City. of Cape Canaveral, Florida, met in regular
session at the City Nall Annex, 190 Jackson Ave., Cape Canaveral, Florida.
Officials present wares Mayor Richard R. Thurm, Councilment Ws.
Eberwein, Jack Hurck, ELgene Jandreau, City Attorney - T. David Burnes City
Clark - Donna J. Anderson, Sergeant -At -Arms - L. W. Nichols.
The Minutes of the Regular Meeting of February 2, 1965, the Minutes of
the Special Meeting of February 5, 1965 and the Minutes of the Special Hosting
of February 9, 1965 were read by the Clark and with no additions or correction"
were approved as read.
Mr. Jandreau stated that he did not wish to approve the Treasury Report
until he had been given additional time for study.
NEW BUSINESS
Item 1. Zoning Ordinance Amendment -J

Item 1. was passed an the opinion of the City Attorney that a Zoning
Ordinance was not necessary pertaining to Item 2.�
Item 2. Rules of Procedure (Planning & Zoning Board).
The City Attorney read "AN ORDINANCE PRESCRIBING RULES OF PROCEDURE FOR
THE ZONING AND PLANNING BOARD OF THE CITY OF CAPE CANAVERAL FUMIOAt PROVIDING
AN EFFECTIVE DATE." Mr. Jandreau made a Motion to approve the first Reading
of the Ordinance. Mr. Hurck seconded the Motion and it passed unanimously.
Item 3. Waiver of Delinquency Penalty (Occupational Ordinance)
Mayor Thum read "A RESOLUTION WAIVING IELINQUENCY PENALTIES PRESCRIBED
IN ORDINANCE NO. 3-62 -A KNOWN AS THE OCCUPATIONAL LICENSE TAX ORDINANCE
ADOPTED ON AUGUST 26, 1964, UNDER CERTAIN CINCUMSTANCESB PROVIDING AN EFFECTIVE
DATE." On a Motion by Hr. Jandreau, seconded by Mr. Eberwein and passed
unanimously, the Resolution was adopted.
Item 4. Charter Amendments
Mayor Thurm read "A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY
TO PREPARE A SPECIAL ACT FOR SUBMISSION TO BREVARD COUNTY LEGISLATIVE DELEGATION
ANENDING CHAPTER 63 -1197, SPECIAL LAWS Or FLORIDA 1943, IN CERTAIN RESPECTSI
PROVIDING AN EFFECTIVE DATE." After discussion, Mr. Jandreau made a Notion
and it carried with Mr. Jandreau and Mr. Eberwein voting in favor of rejection
and Mr. Hurck opposed.
Mayor Thum then called a caucas and immediately thereafter the Meeting
was adjourned on a Notion by Mr. Hurck, seconded by Mr. Jandreau and carried
unanimously.

Vise Linda Dell of the ORLANDO SENTINEL asked that her objection to
the caucas be reflected in the Minutes.
